HomeMy Public PortalAbout20011203REGULAR COUNCIL MEETING DECEMBER 3, 2001 1 CALL TO ORDER The Regular Council Meeting of December 3, 2001, was convened at 6:00 P.M. by Mayor Tom Rackers. Prayer was offered by Councilman Charles Jackson, followed by the Pledge of Allegiance. ROLL CALL The following Council Members were present for the roll call: Present: Angle, Blaney, Jackson, Landwehr, Olsen, Viessman, Vincent, Vogel, and Weber Absent: Nelson A quorum was declared present. Mayor Tom Rackers recognized and welcomed Boy Scout Troop 10 from Grace Church who were present at the meeting working on their Citizenship in the Community Award. Merit Badge Counselor Karen Winn was also present with the group. PRESENTATIONS BY STAFF, CONSULTANTS, AND INVITED GUESTS Councilman Roy Viessman made a report on his trip to San Diego, California, to attend the ceremonies forthe change of command forthe USS Jefferson City submarine. He displayed and presented items which he brought back with him as a memento of that occasion. Councilman Viessman stated that the crew of the USSJC very much appreciated the fact that a representative from the City of Jefferson attended their ceremonies. CONSENT AGENDA Mayor Tom Rackers left the Council Chambers at this time to avoid a conflict of interest with item (e) on the Consent Agenda. President Pro Tempore Charles Jackson assumed the Chair for this portion of the meeting. The following items were brought before the Council for their consideration: a. Council Meeting Minutes November 19, 2001 b. Council Special Workshop, November 20, 2001 c. Bid 1986 - Skid Steer Loader, Public Works d. (RENEWAL) Employee Assistance Program Contract with Capital Region REGULAR COUNCIL MEETING DECEMBER 3, 2001 2 Medical Center e. (RENEWAL) Authorizing Extension of Contract with Sprint for 9 -1 -1 Equipment f. (RENEWAL) Authorizing Lease with Childress Photography LLC A motion was made by Councilman Cliff Olsen for approval of the Consent Agenda as presented, seconded by Councilman Carol Blaney and approved unanimously. Mayor Tom Rackers returned to the Council Chambers to resume the Chair. MINUTES AND REPORTS RECEIVED AND FILED Mayor Tom Rackers announced that the following minutes and reports have been received and are on file in the City Clerk's Office for public inspection: a. Pedestrian - Bicycle Task Force, October 17, 20001 b. October, 2001 Finance Report Questions were asked of Finance Director Steve Schlueter regarding some of the revenue amounts which appeared on the Finance Report. Mr. Schlueter replied to those questions by explaining the sources of certain revenues, and the fact that some amounts are reappropriated at the close of the city's fiscal year (October 31) from one budget year into the next. ANNOUNCEMENTS BY THE MAYOR Mayor Tom Rackers presented a plaque to Phil Freeman and Duane Schreimann in appreciation for their efforts in the successful passage of the November 6 half -cent sales tax referendum issue. Mr. Freeman and Mr. Schreimann were present to accept the plaques. BILLS INTRODUCED Bill 2001 -132, sponsored by Councilman Landwehr, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING CHAPTER 16, ARTICLE II OF THE CODE OF THE CITY OF JEFFERSON BY REPEALING CERTAIN SECTIONS AND AMENDING OTHERS. Councilman Clyde Angle stated that he believes the commission should be retained, and that their powers should be broadened. REGULAR COUNCIL MEETING DECEMBER 3, 2001 3 Bill 2001 -133, sponsored by Councilman Vincent, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, DECLARING CERTAIN PROPERTY AS SURPLUS AND AUTHORIZING THE DISPOSAL OF SAID PROPERTY. Bill 2001 -134, sponsored by Councilman Landwehr, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING THE CODE OF THE CITY OF JEFFERSON, MISSOURI, TO PERMIT SIDEWALK VENDORS. Bill 2001 -135, sponsored by Councilmen Jackson and Landwehr, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH MECO ENGINEERING COMPANY FOR PROFESSIONAL DESIGN SERVICES FOR THE EAST HIGH STREET IMPROVEMENT PROJECT, DAWSON STREET STORM WATER PROJECT, AND THE WILCOXON / LINCOLN STREET STORM WATER PROJECT. Councilman John Landwehr stated that Councilman Jackson had pointed out to him some changes which need to be made to correct the contract. He stated that those changes would be made before the next Council Meeting, and that a substitute bill will be sent to the Council at the December 17 meeting. Bill 2001 -136, sponsored by Councilmen Jackson and Landwehr, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH ENGINEERING SURVEYS AND SERVICES FOR PREPARATION OF DESIGN PLANS AND SPECIFICATIONS FOR THE EAST MCCARTY STREET IMPROVEMENT PROJECT. Councilman John Landwehr requested that when the City receives the proposals from contractors on the projects for both Bills 2001 -135 and 2001 -136, that the City Council be given a chance to look at them early enough that they will have ample time to ask questions and digest what will be presented to them for consideration of contracts. Bill 2001 -137, sponsored by Councilman Vincent, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING AN AGREEMENT WITH THE MISSOURI DEPARTMENT OF PUBLIC SAFETY, MISSOURI DIVISION OF HIGHWAY SAFETY FOR A DRIVING WHILE INTOXICATED ENFORCEMENT GRANT AND AMENDING THE 2001 -2002 ANNUAL BUDGET WITHIN THE GENERAL FUND. Councilman Clyde Angle asked Interim Police Chief Jim Johnsen to find out how many alcohol - related accidents have occurred in the city over the past year. He stated he also believes that taverns and bars should contribute to the Sober Chauffeur program. REGULAR COUNCIL MEETING DECEMBER 3, 2001 4 Bill 2001 -138, sponsored by Councilmen Vincent, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING AN AMENDED AGREEMENT WITH THE MISSOURI DEPARTMENT OF PUBLIC SAFETY FOR A NARCOTICS CONTROL ASSISTANCE ( "MUSTANG ") PROGRAM GRANT AND AUTHORIZING SUPPLEMENTAL APPROPRIATION OF FUNDS, AMENDING THE 2001- 2002 ANNUAL BUDGET WITHIN THE GENERAL FUND. Bill 2001 -139, sponsored by Councilmen Landwehr and Jackson, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI PROVIDING FOR THE VOLUNTARY ANNEXATION OF REAL PROPERTY LOCATED IN THE ALGOA AREA CONTIGUOUS TO AND LYING EAST OF THE PRESENT CITY LIMITS AND WEST OF THE MOREAU RIVER INTO THE CITY OF JEFFERSON, MISSOURI, LOCATED IN THE COUNTY OF COLE, STATE OF MISSOURI, AND REPEALING SECTION 1 -17 OF THE CODE OF THE CITY OF JEFFERSON, MISSOURI, DEFINING THE EXISTING CITY BOUNDARY AND ENACTING A NEW SECTION PERTAINING TO THE SAME SUBJECT. Councilman John Landwehr thanked City Staff for their hard work and diligence in working on this voluntary annexation. He explained that there are very many fine details which accompany such a project, and that Staff has done an outstanding job. BILLS PENDING Bill 2001 -129, sponsored by Councilman Jackson, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN INTERGOVERNMENTAL AGREEMENT WITH COLE COUNTY FOR SEWER LINE EXTENSION FOR WREN ENTERPRISES. Bill 2001 -129 was read third time by title, placed on final passage and passed by the following vote as Ordinance 13307: Aye: Angle, Blaney, Jackson, Olsen, Viessman, Vincent, Vogel and Weber Nay: None Abstain: Landwehr Bill 2001 -130, sponsored by Councilman Blaney, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING SECTION 19 -401, (STREETS AND HIGHWAYS), SCHEDULE (J), (PARKING PROHIBITED), REGULAR COUNCIL MEETING DECEMBER 3, 2001 5 SUBPARAGRAPH (A), OF THE CODE OF THE CITY OF JEFFERSON, BY THE ADDITION OF TWO PORTIONS OF WEST MAIN STREET AND A PORTION OF BROOKS STREET. Bill 2001 -131 was read third time by title, placed on final passage and passed by the following vote as Ordinance 13309: Aye: Angle, Blaney, Jackson, Landwehr, Olsen, Viessman, Vincent, Vogel and Weber Nay: None INFORMAL CALENDAR Bill 2001 -108, sponsored by Councilman Blaney, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AGREEMENTS WITH MISSOURI TRANSIT LINES, INC. FOR INTER -CITY BUT ROUTE AND LEASE OF BUS TERMINAL FACILITY. Councilman Carol Blaney requested that Bill 2001 -108 be removed from the Informal Calendar and placed on final passage at this time. Bill 2001 -108 was read third time by title, placed on final passage and passed by the following vote as Ordinance 13310: Aye: Angle, Blaney, Jackson, Landwehr, Olsen, Viessman, Vincent, Vogel and Weber Nay: None NEW BUSINESS Councilman Charles Jackson asked that Staff look into the area of Washington Park as a possible location for Habitat for Humanity projects. REGULAR COUNCIL MEETING DECEMBER 3, 2001 6 Councilman Charles Jackson suggested that the High Street and McCarty Street project proposals have a little more structure to them so that the Council can understand them more easily. He also asked if the stability of the rock cuts in the E. McCarty Street bluff area would be included in the RFP. Jack Kramer, Engineering Division Director, stated that stabilizing those cuts would be a part of the project. Councilman Clyde Angle asked if another work session could be held to discuss (1) a convention center, (2) review the concepts of zero -based budgeting, and (3) downtown sidewalks. Councilman Edith Vogel stated that the downtown sidewalk issue has been reviewed at length by a committee of city staff, downtown business owners, banks, and consultants, and she felt that further work sessions on this issue would not be beneficial. Councilman Larry Vincent and Councilman John Landwehr suggested that the other items could be discussed at a Public Works meeting. Councilman Landwehr also suggested a Finance Committee meeting to discuss the funding of sidewalks. Councilman Clyde Angle stated that he is a downtown business owner and he had not yet seen any figures about what his share might be in this project. He asked Councilman Charles Jackson to add these items to the Public Works meeting agenda. Mayor Tom Rackers stated that perhaps he and City Administrator Rich Mays could sit down with Councilman Angle to answer his questions about the issue of funding the downtown sidewalks in lieu of a formal meeting. UNFINISHED BUSINESS Councilman Bob Weber suggested scheduling a meeting for sometime right after the first of the year to discuss the issue of redistricting. Mayor Tom Rackers asked City Administrator Rich Mays to make a note and contact Council Members regarding that. Councilman Clyde Angle made comments regarding the attendance of Council Members at Closed Sessions. A lengthy discussion ensued regarding this issue. COUNCIL LIAISON REPORTS There were no Council Liaison reports made at this time. APPROVAL OF CLOSED SESSION MINUTES Closed Session Minutes, November 19, 2001 —A motion was made by Councilman Larry Vincent for approval as presented, seconded by Councilman Charles Jackson, and approved unanimously. GO INTO CLOSED SESSION REGULAR COUNCIL MEETING DECEMBER 3, 2001 7 Mayor Tom Rackers announced that pursuant to Sec. 610.021 of the Revised Statutes of Missouri, the Chair would entertain a motion for the Council to go into Closed Session to discuss one the following: a. Legal Actions [Sec. 610.021.(1)] b. Real Estate [Sec. 610.021.(2)] A motion was made by Councilman Charles Jackson to go into Closed Session, seconded by Councilman Carol Blaney, and approved by the following roll -call vote at 7:05 PM: Aye: Angle, Blaney, Jackson, Landwehr, Olsen, Viessman, Vincent, Vogel, and Weber Nay: None
