CONTINIIED PUBLIC HEARING:
1. CONDITIONAL USE PERMIT - CASE NO. 114
Applicant: Louis and Alice Ross
COMMENTS•
The applicant is requesting a Conditional Use Permit to
develop a five (5) story, 100 unit motel, and one (1) story
restaurant at 11550 Long Beach Boulevard, in the C2-A (Medium
Commercial) and P-1 (Parking Overlay) zones. This item was
continued from the July 14, 1992 Planning Commission meeting
to allow the applicant to submit required environmental data
necessary in accordance with California Environmental Quality
Act (CEQA). Although the traffic study has been prepared and
submitted by Staff, no soils report has been submitted for
Staff review.
RECOMMENDED ACTION:
No action is recommended for this item since this project was
continued to the November 10, 1992 Planning Commission
meeting. .
NEW CASES•
2. CONDITIONAL USE PERMIT CASE NO. 80
Applicant: Ali Zakeri
BACKGROUND•
Pursuant to Planning Commission's directive, Staff is
bringing this item back for reconsideration since the
applicant has not been able to satisfy the conditions of
approval in a timely manner.
RECOMMENDED ACTION:
Staff request that the Planning Commission give Staff
direction relative to the disposition of this project.
3. ZONING ORDINANCE AMENDMENT CASE NO. 22
Applicant: City of Lynwood
COMMENTS:
Pursuant to City Council direction, staff is proposing to
amend Chapter 25, Section 25-16.15(c) of the Official Zoning
Code with respect to development standards for existing and
proposed automotive service and sales uses.

SUBJECT: Conditional Use Permit - Case No. 80
Applicant: Ali Zakeri
PROPOSAL:
On May 14, 1991, the Planning Commission approved CUP 79 & CUP 80
respectively for Mr. Ali R. Zakeri. Cup 79 was for a move-on of
' a single-family dwelling. Cup 80 was for a move-on of a single
story duplex. The Planning Commission requested to rehear this
case (CUP 80) in order to determine if Mr. Zakeri is in
compliance with the Conditions of Approval relative to Resolution
No. 2382.
CHRONOLOGY OF EVENTS
At the February 11, 1992 Planning Commission meeting, staff
briefed the Commission on the status of CUP 79 & CUP 80. The
applicant, Mr. Ali R. Zakeri, was present to explain the reason
for the delay in implementation of conditions of CUP 80. He
claimed that financial difficulties prevented him from acting
sooner. At the March 10, 1992 Planning Commission meeting, Staff
again briefed the Planning Commission with an update of CUP 80.
Mr. Ali R. Zakeri was not present at this meeting.
On the May 12, 1992 Planning Commission meeting, Mr. Zakari was
not able to give the Commission a tentative date for completion
of the project. At the June 9, 1992 Planning Commission meeting,
the Commission granted Mr. Ali Zakeri 60 days extension to i
initiate the project. Mr..Zakeri agreed to the extension by the I
Commission, claiming that he was delayed by the Public Works
Department checking the grading plans. The grading plan was �
revised approximately seven (7) times. �

The Public Works Departments records shows that Mr. Zakeri '
submitted grading plans for CUP 80 which were returned for �
revisions and corrections as follows:

Upon review of Public Works file on CUP 80, it was indicated that �
the grading plan was approved on September 28, 1992. Mr. Zakeri �
needs to submit landscaping and irrigation plan to the Planning �
Division for approval to comply with Condition No. 9 on ;
Resolution No. 2382. It should be noted that a builder typically �
submits landscape plans concurrently with grading plans to avoid ;
delays. i

Section 25-42 of the Lynwood Zoning Ordinance requires
that a Conditional Use Permit be obtained for any
residential development in the R-2 (Two-Family Residential)
zone.
2. Proper� Location:
The site is located on the north side of Fernwood Avenue
between Birch Street and Fir Street. (refer to the attached
location map).
3. Property Size•
- The site consists of an irregular shaped lot of
approximately 8,015 square feet in size.

The property is a vacant lot. The surrounding land uses are

The General Plan Designation for the subject property is

6. Project Characteristics:
The applicant proposes to move on a one story, 2,370 square
foot duplex, with an unattached four (4) car "garage. The
larger unit of the duplex consist of a living room, kitchen
dining area, laundry room, three (3) bedrooms, a bath and a
half bath. The smaller unit consist of a living room,
kitchen and dining area, two (2) bedrooms, and a full bath.
Approximately, twenty five percent (25%) of the lot area is
planned for landscaping.
7. Site Plan Review:
On April 24, 1991, the Site Plan Review Committee evaluated
the proposed development and recommended approval to the
Planning Commission, subject to specific conditions and
requirements.

' ISSUES AND ANALYSIS
c
1. Consistencv with General Plan
The proposed land use is consistent with the existing zoning
classification (R-2) and the General Plan designation two-
family residential. Therefore, granting Conditional Use
Permit No. 80, will not adversely affect the General Plan.
2. Site Suitabilitv
The subject property is adequate in size and shape to
accommodate the proposed development relative to the
proposed density; bulk of the structures; parking; walls,
fences; driveways, and other development features required
by the Zoning Ordinance. Furthermore, the subject property
is adequately served with the required public utilities and
offers adequate vehicular and pedestrian accessibility.
3. Compliance with Development Standards
The proposed development meets all the development standards
required by the Zoning ordinance regarding off-street
parking; front, and rear yard setbacks; lot coverage,
height, unit size; and density.
4. Comnatibility
The proposed project will be located in a neighborhood that
is substantially transitioned from single-family to multi-
family residences. Properties located to the north and west
are developed as sinqle family residential respectively, to
the east is vacant, and to the south is two-family
residential, and other properties in the vicinity are
� developed with single family. The proposed project is
consistent with the zoninq in the area and with the General
Plan designation.
5. Conditions of Approval
The applicant has received the Conditions of Approval for
CUP 80 in Resolution No. 2382. He has complied with
Condition No. 34. Mr. Zakeri is required to comply with the
remaining of the Conditions of Approval in Resolution No.
2382.
6. Benefits to Community
The proposed development will aid to esthetically upgrade
the neighborhood and will act as a catalyst to foster other
quality developments. Moreover, the development will add
favorably to the City's housing stock in furtherance of the
policies of the Aousing Element of the General Plan.
7. Environmental Assessment
The Community Development Department Staff has determined
that the project is categorically exempt pursuant to
Section 15061 b(3) of the State of California Environmental
Quality Act of 1989 as amended.
RECOMMENDATION:
Staff respectfully requests direction from the Planning
Commission on the disposition of this case.

RESOLUTION N0. 2382
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF LYNWOOD APPROVING CONDITIONAL USE
PERMIT NO. 80 FOR THE CONSTRUCTION OF A
SINGLE STORY DUPLEX AT 3621 FERNWOOD AVENUE
ZN THE R-2 (TWO-FAMILY RESIDENTIAL) ZONE,
LYNWOOD, CALIFORNZA.
WHEREAS, the Lynwood Planning Commission, pursuant to law,
conducted a public hearing on the subject application; and
WHEREAS, the Planning Commission, considered all pertinent
testimony offered at the public hearing; and
WHEREAS, the Community Development Director has determined
that the proposal is exempt from the provisions of the State CEQA
Guidelines Section 15061 b(3), as amended; and
WHEREAS, a Conditional Use Permit is required for.
development in the R-2 (Two-Family Residential) 2one.
Section 1. The Planning Commission hereby finds and
determines as follows:
A. The site of the proposed use is adequate in size and
shape to accommodate the structures, parking, walls,
landscaping, driveways and other development features
required by the Official Zoning Ordinance.
B. The structures, as proposed, subject to conditions,
will not have a negative effect on the values of
surrounding .properties or interfere with or endanger
the public, health, safety, or welfare.
C. The site will be developed pursuant to the current
zoninq regulations and site plan submitted and approved
by the Site Plan Review Committee.
D. ThQ granting of the Conditional Use Permit will not
adversely affect the General Plan.
_ E. The proposed development will add favorably to the I '
housing stock and will provide additional affordable �
priced housing in concert with the policies of the !
Housing Element of the General Plan. i
F. The proposed development will aid in aesthetically I
upgrading the area and will act as a catalyst in �
fostering other quality developments. i
Section 2. The Planning Commission of the City of Lynwood, �
based upon the aforementioned findings and determinations, hereby '
approves Conditional Use Permit, Case No. 80, provided the !
following conditions are observed and complied with at all times. �

COMMi1NITY DEVELOPMENT DEPARTMENT
1. The proposed development shall comply with all applicable
regulations of the Lynwood Municipal Code, the Uniform
Building Code and the Fire Code.
2. Any proposed subsequent modification of the subject site or
structures thereon, shall be first reported to the Community
Development Department, Planning Division, for review of
said Conditional Use Permit.
3. The applicant shall meet the requirements of all other City
Departments.
4. The applicant and/or his representative shall sign a
Statement of Acceptance stating that he/she has read,
understands, and agrees to all conditions of this resolution
prior to issuance of any building permits.
PLANNING DIVISION CONDITIONS
5. The applicant shall contact the U.S. Post Office (Lynwood "
main office) to establish the location of mail boxes serving
the proposed development.
6. This Conditional Use Permit shall lapse and become void one
hundred and twenty (120) days after the use permitted has
been abandoned or has ceased to be actively exercised.
7. Construction shall commence within (6) months from date
of issuance of building permits.
8. Landscaped areas are to be a minimum of twenty-five (25$)
percent of the lot area.
9 Landscaping and irrigation shall be installed in accordance
with a detailed plan to be submitted and approved by the
Planning Division prior to issuance of any building permits. I
The minimum plant material shall be trees and shrubs I
combined with ground cover.as follows: One (1) five (5) I
gallon shrub for each 100 square feet of landscaped area; �
and two (2) fifteen gallon trees for each 500 square feet of
. landscaped areas. �

10. The required front, rear, and side yards shall be landscaped
and shall consist predominately of plant materials except i
for necessary walks, drives and fences. �
I
11. A minimum of four (4) enclosed parking spaces shall be �
_ provided. �
12. A six (6') foot high block all shall be installed along the j
perimeter of the property, except within the twenty (20') '
foot front yard setback. In this frontage, if built, the ;
wall shall not exceed a height of four (4') feet measured '
from top of curb. �

13. No side yard shall be less than five (5') feet.
14. Final building elevations, including materials of
construction, shall be submitted to and approved by the
Building Official and the Planning Division prior to
issuance of any building permits.
15. Before any building permits shall be issued, the developer
shall pay $1.58 per square foot for residential buildings to
the Lynwood Unified School District, pursuant to Government
Code Section 53080.
16. All driveway and parking areas shall be paved.
17. Acoustical construction materials shall be used throughout
the units to mitigate freeway noise to the standards and
satisfaction of the Building and Safety Division.
18. The roof shall be constructed with a non-reflective material
including shingles, woodshake, and other similar roofing
material that is not reflective, glossy, or polished and/or
rolled formed type metal roofing.
19. Residential structures shall have an exterior siding of�
brick, stucco, wood, metal, concrete, or other similar
material other than the reflective glossy, polished and/or
rolled-formed type metal siding.
20. All front yard setbacks must be measured from inside the
property lines.
, 21. Prior to obtaining a buildinq permit, the design of the
exterior elevation of the building must be approved by the
Director of Community Development or his/her designee.
22. All building elevations shall be architecturally treated in
a consistent manner, including the incorporation within the �
side and rear buildinq elevations of same or all of the
design elements used for the primary (front) facades.
23. That the applicant submit elevation drawings to the Planning �
Division showing the exterior building design; including the i
specification of colors, and materials. I
24. All security fences, grills, etc. shall be architecturally I
, compatible with the design of the subject and adjacent
building. In addition, no security fences, grills, etc.
shall be installed without the prior written approval of the I
Director of Community Development.

25. Air conditioner.s, heating, cooling ventilation equipment, i
swimming pool pumps and heaters and all other mechanical
devices shall be located within the rear yard or street side
yard of corner lot. Such equipment shall be screened from ;
surrounding properties and streets and so operated that they �
do not disturb the peace, quiet and comfort of neighboring i
residents, in accordance with the City's Noise Ordinance.

' 26. The existing property shall be cleaned and maintained in
sanitary condition pending construction and shall be
maintained in a neat and orderly manner at all times.
Failure to comply may result in revocation of the
Conditional Use Permit.
27. If applicable, the facade of the existing structure shall be
improved to the satisfaction of staff with an additional
material to window level which relates to the facade of the
new construction. Staff's determination is reviewable if
necessary by the Planning Commission.
28. A cover sheet of approved conditions must be attached to
plans prior to submission to the Building and Safety
Division.
29. Entity will maintain a pro-active approach to the,
elimination of graffiti from the structures, fences and an
accessory building, on a daily basis.
30. For the purpose of providing heating for any dwelling
proposed, only an energy efficient forced air furnace shall
be used, and that the use of any wall furnace shall be
expressely prohibited.
PUBLZC WORKS ENGINEERING DEPARTMENT
31. Provide documentation that lots dividing the property were
legally separated to the satisfaction of the Department of
Public Works. After reviewing the documents, the Department
of Public Works may require the submission and recordation
of a parcel map or lot merger.
,32. Submit a copy of property deed or recent title report to the
Department of Public Works.
33. Dedicate a ten (10) foot wide strip of property along
Fernwood Avenue.
' 34. Submit a grading plan prepared and signed by a registered i
Civil Engineer. Property is located within 100 year flood �
zone per FEMA Flood Insurance Aoundary Work Map of March 26, ;
1991. The owner(s) has the option to build the pad !
elevation one foot above the flood level zone per Flood
. Boundary Map or sign a Hold Harmless letter with the City of
Lynwood. �
35. Reconstruct new curb and gutter along Fernwood Avenue. �
36. Reconstruct damaged sidewalk along Fernwood Avenue. I

37. Close existing drive approach and construct proposed drive �
approach(es) Per City standards along Fernwood Avenue.

38. Construct one (1) wheelchair ramp(s) at the northeast corner �
of Fir Street and Fernwood Avenue.

39. Connect to public sewer. Each building shall be connected �
separately. Construct laterals as necessary. ;

r 40. Install two (2) - 24" box street trees per City of Lynwood
standards along Fernwood Avenue.
Species to be determined by the Department of Public Works.
A permit to install the trees is required by the Engineering
Division. Exact locations of the tree(s) will be determined
at the time the permit is issued.
41. Reqrade parkway and landscape with grass.
42. Provide and install one (1) marbelite street pole with
light fixture, underground services and conduits on Fernwood
Avenue.
43. Underground all utilities.

; Staff is proposing to amend Chapter 25, Section 25-16.15(c) of
the Official Zoning Code with respect to development standards
for.,existing and proposed automotive service and sales uses.
BACKGROUND• �
This item was brought to the Planning Commission: as an
information item at the September 8, 1992 meeting in order to
begin discussion on new development standards proposed by staff.
These standards are designed to eliminate external problems
associated with auto service and sales uses as previously
identified and encourage new businesses of a higher quality. A
slide film pYesentation was presented to the Commission that
showed how existing auto service businesses were subject to new
development standards and can be retrofitted with features such
as screen-walls, landscape, to help reduce the visual blight
generated by these types of uses.
ISSUES AND ANALYSIS:
Due to a proliferation of auto service uses along the main
° thoroughfares of the City and visual blight deteriorated
commercial facilities and other nuisance-related problems
associated with automotive repair, sales, and equipment
" installation, the City is proposed new zoning code provision to
accomplish the following:
1) Establish new zoning code provisions to require appropriate
mitigation of blighted conditions associated with existing
businesses.
2) Incorporate new design and development standards to
- regulated automotive uses.
ENVIRONMENTAL ASSESSMENT:
The Community Development Department has determined that pursuant
to Section 15073 of State CEQA Guidelines the project could not
have a significant effect on the environment. Therefore, a
Negative Declaration has been prepared and is bn file in the
Community Development Department and the Office of the City
Clerk.
RECOMMENDATION•
Staff respectfully request, that after consideration, the
, - Planning Commission adopt the attached Resolution No. 2451.
A. Finding that Zoning Ordinance Amendment Case No. 22 is
exempt from the provisions of the State CEQA Guidelines, as
amended.

that this Amendment does warrant a negative declaration and is

and
Section 1. The Planning Commission hereby finds and
determines as follows:
A. The proposed amendment.will be consistent with the
objectives and the development policies of the City of Lynwood.

AUTOMOTIVE REPAIR, AUTOMOTIVE EQUIPMENT
INSTALLATION AND AUTO SALES USE AND
DEVELOPMENT STANDARDS.
The City Council of the City of Lynwood' DOES HEREBY ORDAIN
AS fol2ows:
Section l. Chapter 25 of the Lynwood Municipal Code is
hereby amended for the purpose of this section to prevent
harmful effects and to promote the public convenience and
welfare, conserve the value of property and encourage the most
appropriate use by requiring review and/or control as set forth
, herein.
Section 25-16(c) To read as follows:
To this extent, the following minimum development standards
would be imposed under a Condition Use Permit to all vehicle
repair and equipment installation facilities:
1. Pavina
The site shall be entirely paved with no less than a two
inch thickness of blacktop or equally serviceable hard
_ surface pavement. existing uses that are currently not
paved shall conform with this requirement within three
• years from the adoption of this Title.
2. Structures
Entrances to individual service bays shall not face public
rights-of-way or abutting residential parcels.
� 3. Repair Activities
All repair activities and operations shall be conducted
` entirely within an enclosed buildinq. Outdoor hoists are
prohibited.
4. Enclosure
� Repair facilities performing body and fender work or _
similar noise-generating activities shall be conducted in
fully-enclosed structures with walls of concrete block or
` similar materials providing sound attenuation. All
painting shall occur within an approved fully enclosed
booth.
5. Litter
The premises shall be kept in a neat and orderly condition
at all times and all improvements shall be maintained in a
condition of reasonable repair and appearance. Used or
, discarded automotive parts or equipment or permanently
disabled, junked or wrecked vehicles may not be stored
outside the main buildinq or shall be stored in an area
completely.screened from view by a solid block decorative
wall.
�. 6. Storaae
_ Exterior parking area shall be used for employee and
customer parking only,and not for the repair or finishing
work or long term (over one week) storage of vehicles.

A solid masonry wall shall be erected and attractively
maintained along all property lines.

8. Hazardous Materials Manaqement
,.
A. Commercial and industrial concerns which receive,
utilize, store, transport, or dispose of hazardous
waste and restricted use pesticides in quantities
exceeding 500 lbs. at anyone time, shall have access
to sewer and freeways, and shall keep such materials
at least 2,000 feet from the nearest area planned for
residential use.
B. Commercial and industrial vehicle concerns which
propose to locate within the City of Lynwood shall
provide the Fire Department with a list of all
hazardous materials to be used at the site, a
description of where and how each is stored, and how
each react in a fire.
C. Placards or other appropriate signage indicating
hazardous materials or wastes are being stored shall
be placed on all buildings which have hazardous
materials or wastes stored.
D. The discharge of hazardous wastes into the air, land,
or into water resources within City boundaries is -
prohibited.
E. Commercial and industrial concerns which create,
utilize, store or treat hazardous materials or waste,
shall prepare a hazardous materials and waste
management plan which provides for the use of the best
available technology within the production process.
The plan shall be subject to approval by the Fire
Department, and review by the Police Department and
shall outline source reduction, treatment, handling,
transportation, disposal, emergency response and
employee training methods.
F. Uses which create, utilize, store, or treat hazardous
waste, shall implement the best available technology
for on-site pretreatment and reduction of hazardous
wastes, whenever feasible.
9. Air Oualitv
A. All mechanical ventilating equipment shall be directed
to top story exhaust vents which face away from
adjacent residential properties.
B. Required exhaust systems shall be equipped with
appropriate and reasonably available control
technology to minimize or eliminate noxious pollutants
which would otherwise be emitted.
10. Landscape
Five percent (5�) of the total site area shall be improved
with landscape and landscaped areas shall have an
irrigation system installed subject to the review and
approval of the Director of Community Development.
STORAGE OR VEHICLES
No vehicles to be displayed, sold, rented, or repaired shall be
parked or stored on any street or alley.
The conditional Use Permit may adjust, or add to, any of the .
standards set fourth in this section when it is found that the
I public health, safety or general welfare is served thereby.

AUTO SALES DEVELAPMENT STANDARDS
c
Auto sales uses exhibit many of the same problems discussed
under auto repair uses especially used auto sales business that
repair and refurbish used vehicles. In addition to those
problems, however, these uses generate other issues involving
signs and special sales events devices.
REPAIR ACTIVITIES
All repair and equipment installation activities shall conform
to the development standards referenced as No. 1 through 9
Repair Activities of this report.
ABATEMENT OF EXISTING TEMPORARY ADVERTISED DEVICES
All existing temporary advertising devices including but not
limited to banners, balloons, flags, pennants, valance, or
advertising display constructed of cloth, canvas, light fabric,
cardboard, wallboard, plywood or other light material, as well
as any mechanical, audible, or animated statuary device, shall
be abated within a period of one hundred eighty (180) days from
the effective date of this section.
DEVELOPMENT OF AUTOMOBILE AND TRAILER SALES LOTS
� No person shall use any lot or parcel of land for the purpose of
conducting or maintaining thereon an open-air type facility for
the display and sale of new or used vehicles without complying
with the following minimum regulations:
(1) The sale of new or used vehicles, and shall be
subject to a Conditional Use Permit.
(2) The complete plans, showing the location and design
of all buildings, structures, signs, lights, fences,
bumpers or barricades and the proposed development
thereof, including landscaping, shall first be
submitted to, and be approved by, the site Plan
review Board, prior•to any consideration by Planning
Commission.
(3) The entire area of such lot or parcel shall be
surfaced, thereafter maintained in good condition
with not less that a two-inch thickness of blacktop
or other equally serviceable hard surface pavement,
and prior to the laying of such surfacing, the
entire area shall be effectively treated with a weed
destroyer.
(4) The property shall be attractively maintained in a
neat and orderly condition, and the business
' conducted thereon shall be operated in a manner so
as not to be detrimental to others residing or
working in the vicinity.
(5) Adequate devices or structures shall be installed
and maintained so as to protect any boundary line
fence, wall or building from damage and to prevent
any part of a vehicle from extending across any
public or private property lines and that all such
installations and the maintenance thereof shall be
in conformance with standards and specifications
approved by the Community Development Department.
(6) Open areas shall be used solely for the display of
� new and used vehicles, and shall not be used for the
display of vehicles acquired for dismantling
purposes or vehicles classified as total loss
salvage vehicles.
(7) A solid masonry wall shall be erected and
attractively maintained along all property lines.

(8) No advertising sign, structure or device, whether
E temporary or permanent in character, shall be
erected or maintained upon the premises without the
design thereof and the proposed location having
first been submitted to the Community Development
Department for approval. Temporary advertising
devices shall include, but not be limited to:
banners, balloons, flags, pennants, valance, or
advertising display constructed of cloth, canvas,
light fabric, cardboard, wallboard, plywood, or
other light material, as well as any mechanical,
audible or animated statuary device. Temporary
advertising may be permitted only during an approved
special events sale which shall be limited to a
maximum of eight days per calendar year. No single
sale may exceed two consecutive days. All temporary
advertising devices shall be approved by the
Director of Community Development prior to their
installation.
ABATEMENT OF NONCONFORMZNG USES
Wherever a vehicle sales lot exists upon any property within the
City at the time of adoption of this section, such use shall be
abated or shall meet all provisions of this section within one
hundred and eight (108) days after the date of adoption of this
orclinance.
Section 2. Severabilitv. If any section, subsection
subdivision, sentence, clause, phrase or portion of this
ordinance or the application thereof to any person or place, is
for any reason held to be invalid or unconstitutional by the
3ecision of any court or competent jurisdiction, such decision
shall not affect the validity of the remaining portions, of this
ordinance or its application to other person or places. The
City Council hereby declares that it would have adopted this
ordinance, and each section thereof, irrespective of the fact
that any one or more section, subsection, sentence, or place, be
declared invalid or unconstitutional.
Section 3. The City Clerk is hereby ordered and directed
to certify to the passage of this ordinance and to cause the
same to be published once in the Lynwood Press, a newspaper of
general circulation printed, published, and circulated in the
City of Lynwood.

At the September S, 1992 Planning Commission meeting,

Paramount's commercial development looks so good.
Discussions with Paramount Community Development Staff reveal
that the City's commercial development is a result of a �
combination of policy documents, high standards proposed by staff
as conditions of approval and high standards maintained by the

Usually, the staff will get a commercial project and disagree
with the applicant over various issues relating to design,
amenities or interpretation of how the C.B.G. Architectural
Guidelines apply to the project. Staff will then request
revisions as conditions of approval and allow the Design Review
' Board (DRB), which are the same members of the Planning
Commission, to resolve the issues. The DRB typically rules in
favor of Staff's recommended revision or ask for even higher
quality development standards than those suggested by Staff.

Aoolicant: Ali Zakeri
PROPOSAL:
On May 14, 1991, the Planning Commission approved CUP 79 & CUP 80
respectively for Mr. Ali R. Zakeri. Cup 79 was for a move-on of
a single-family dwelling. Cup 80 was for a move-on of a single
story duplex. The Planning Commission requested to rehear this
case (CUP 80) in order to determine if Mr. Zakeri is in
compliance with the Conditions of Approval relative to Resolution
No. 2382.
CHRONOIAGY OF EVENTS
At the February 11, 1992 Planning Commission meeting, staff
briefed the Commission on the status of CiJP 79 & CUP 80. The
applicant, Mr. Ali R. Zakeri, was present to explain the reason
for the delay in implementation of conditions of CUP 80. He
claimed that financial difficulties prevented him from acting
sooner. At the March 10, 1992 Planning Commission meeting, Staff
again briefed the Planning Commission with an update of CUP 80.
Mr. Ali R. Zakeri was not present at this meeting.
. On the May 12, 1992 Planning Commission meeting, Mr. Zakari was '�
not able to give the Commission a tentative date for completion
of the project. At the June 9, 1992 Planning Commission meeting, !
the Commission granted Mr. Ali Zakeri 60 days extension to i
initiate the project. Mr. Zakeri agreed to the extension by the ,
`Commission, claiminq that he was delayed by the Public Works
Department checking the grading plans. The grading plan was
revised approximately seven (7) times.

The Public Worka Departments records shows that Mr. Zakeri i
submitted grading plans for CUP 80 which were returned for I
revisions and corrections as follows: i

Upon review of Public Works file on CUP 80, it was indicated that i
the grading plan was approved on September 28, 1992. Mr. Zakeri �

submits landscape plans concurrently with grading plans to avoid

ISSUES AND ANALYSIS
1. Consistencv with General Plan
The proposed land use is consistent with the existing zoning
classification (R-2) and the General Plan designation two-
family residential. Therefore, granting Conditional Use
Permit No. 80, will not adversely affect the General Plan.
2. Site Suitabilitv
The subject property is adequate in size and shape to
accommodate the proposed development relative to the
proposed density; bulk of the structures; parking; walls,
fences; driveways, and other development features required
by the 2oning Ordinance. Furthermore, the subject property
is adequately served with the required public utilities and
offers adequate vehicular and pedestrian accessibility.
3. Comoliance with Development Standards
The proposed development meets all the development standards
required by the Zoning Ordinance regarding off-street
parking; front, and rear yard setbacks; lot coverage,
height, unit size; and density.
4. Comvatibility
The proposed project will be located in a neighborhood that i
is substantially transitioned from single-family to multi-
family residences. Properties located to the north and west
are developed as single family residential respectively, to I
the east is vacant, and to the south is two-family
residential, and other properties in the vicinity are ,
developed with single family. The proposed project is I
consistent with the zoning in the area and with the General !

WHEREAS, the Lynwoo3 Planning Commission, pursuant to law,
conducted a public hearing on the subject application; and
- WHEREAS, the Planning Commission, considered all pertinent
- testimony offered at the public hearing; and
WHEREAS, the Community Development Director has determined
. that the proposal is exempt from the provisions of the State CEQA
, Guidelines Section 15061 b(3), as amended; and
WHEREAS, a Conditional Use Permit is required for.

A. The site of the proposed use is adequate in size and
shape to accommodate the structures, parking, walls,
landscapinq, driveways and other development features

will not have a neqative effact on the values of
surrounding properties or interfere with or endanger
the public, health, safety, or welfare.
C. Tha site will be developed pursuant to the.current
°• zoninq regulations and site plan submitted and approved
by the Sita Plan Review Committee.
D. The qrantinq of the Conditional Use Permit will not
adversely affect the General Plan.
. E. The proposed development will add favorably to the
housinq stock and will provide additional affordable
priced housinq in concert with the policies of the
Housing Element of the General Plan. i
F. The proposed development will aid in aesthetically I
upgrading the area and will act as a.catalyst in �
fosterinq other quality developments. I
Section 2. The Planning Commission of the City of Lynwood, i
based upon the aforementioned findings and determinations, hereby I
approves Conditional Use Permit, Case No. 80, provided the i

COMMLINITY DEVEIAPMENT DEPARTMENT
; 1. The proposed development shall comply with all applicable
regulations of the Lynwood Municipal Code, the Uniform
Buildinq Code and the Fire Code.
2. Any proposed subsequent modification of the subject site or.
structures thereon, shall be first reported to the Community
Development Department, Planning Division, for review of
said Conditional Use Permit.
3. The applicant shall meet the requirements of all other City
Departments.
4. The applicant and/oz his representative shall siqn a
Statement of Acceptance stating that he/she has read,
understands, and agrees to all conditions of this resolution
. prior to issuance of any building permits.
P__LANNING DIVISION CONDITIONS
5. The applicant shall contact the U.S. Post Office (Lynwood '
main office) to establish the location of mail boxes serving
the proposed development.
b. This Conditional Use Permit shall lapse and become void one
hundred and twenty (120) days after the use permitted has
been abandoned or has ceased to be actively exercised.
7. Construction shall commence within (6) months from date
of issuance of buildinq permits.
S. Landscaped areas are to be a minimum of twenty-five (25$)
percent of the lot area.
9. Landscaping and irrigation shall be inetalled in accordance
with a detailed plan to be submitted and approved by the
Planninq Division prior to issuance of any bui3ding permits.
The minimum plant material shall be trees and shrubs
combined with ground cover as follows: one (1) five (5) •
gallon shrub for each 100 square feet of landscaped area; `
and two (2j fifteen qallon trees for each 500 square feet of
" . landscaped areas.
l0. The required front, rear, and side yards shall be landscaped
and shall consist predominately of plant materials except
. for necessary walks, drives and fences.
, 11. A minimum of four (4) enclosed parkinq spaces shall be

12. A six (6') foot high block all shall be installed along the
, perimeter of the property, except within the twenty (20')
foot front yard setback. In this frontage, if built, the

13. No side yard shall be less than five (5') feet. .
14. Final buildinq elevations, including materials of
construction, shall be submitted to and approved by the
Building Official and the Planninq Division prior to
issuance of any building permits.
15. Before any building permits shall be issued, the developer
. shall pay $1.58 per square foot for residential buildings to
the Lynwood•Unified School District, pursuant to Government
Code Section 53080.
16. All driveway and parking areas shall ba paved.
17. Acoustical construction materials shall be used throuqhout
the nnits to mitiqate freeway noise to the standards and
satisfaction of the Building and Safety Division.
18. The roof shall be constructed with a nori-reflective material
including shinqles, woodshake, and other similar roofing
material that is not reflective, qlossy, or polished and/or
rolled formed type metal roofing.
19. Residential structures shall have an exterior siding of'
brick, stucco, wood, metal, concrete, or other similar
material other than the reflective glossy, polished and/or
rolled-formed type metal sidinq.
20. All front yard setbacka must be measured from inside. the
property lines.
. 21. Prior to obtaining a building permit, the design of the
exterior elevation of the building must be approved by the
Director of Community Development or his/her desiqnee.
' 22. All buildinq elevations shall be architecturally treated in
a consistent manner, including the incorporation within the
side and rear buildinq elevations of same or all of the
desiqn elementa used Por the primary (front) facades.
" 23. That the applicant submit elevation drawinqs to the Planning

do not disturb the peace, quiet and comfort of neighboring
residents, in accordance with the City's Noise Ordinance.

26. The existinq property shall be cleaned and maintained in
sanitary condition pendinq construction and shall be

Failure to comply may result in revocation of the

27. If applicable, the facade of the existing structure shall be
improved to the satisfaction of staff with an additional
material to window level which relates to the facade of the
new construction. Staff's determination is reviewable if
necessary by the Planninq Commission.
28. A cover sheet of approved conditions must be attached to
plans prior to submission to the Building and Safety
Division.
29. Entity will maintain a pro-active approach to the
elimination of graffiti from the structures, fences and an �
accessory building, on a daily basis. I
30. For the purpose of providinq heating for any dwelling
proposed, only an enerqy efficient forced air furnace shall
be used, and that the use of any wall furnace shall be

PROPOSAL:
Staff is proposing to amend Chapter 25, Section 25-16.15(c) of
the Official Zoning Code with respect to development standards
for existing and proposed automotive service and sales uses.
BACKGROUND•
This item was brought to the Planning Commission as an I
information item at the September 8, 1992. meeting in order to
begin discussion on new development standards proposed by staff. �
These standards are designed to eliminate external problems I
" associated with auto service and sales uses as previously I
identified and encourage new businesses of a higher quality. A �
slide f�ilm presentation was presented to the Commission that �
showed how existing auto service businesses were subject to new �
development standards and can be retrofitted with features such �
as screen walls, landscape, to help reduce the visual blight i
generated by these types of uses. i
ISSUES AND ANALYSIS: �
Due to a proliferation of auto service uses along the main �
thoroughfares of the City and visual blight deteriorated
commercial facilities and other nuisance-related problems '
associated with automotive repair, sales, and equipment . j
installation, the City is proposed new zoning code provision to
accomplish the following: �
1) Establish new zoning code provisions to require appropriate �
mitigation of blighted conditions associated with existing !
businesses. ,
2) Incorporate new design and development standards to �
regulated automotive uses.
ENVIRONMENTAL ASSESSMENT:
i
The Community Development Department has determined that pursuant
to Section 15073 of State CEQA Guidelines the project could not
have a significant effect on the environment. Therefore, a '
Negative Declaration has been prepared and is on file in the I
Community Development Department and,the office of the City �
Clerk. i
RECOMMENDATION: �,
Staff respectfully request, that after consideration, the i
Planning Commission adopt the attached Resolution No. 2451. '

8. Hazardous Materials Management
' A. Commercial and industrial concerns which receive,
utilize, store, transport, or dispose of hazardous
waste and restricted use pesticides in quantities
. exceeding 500 lbs. at anyone time, shall have access
to sewer and freeways, and shall keep such materials,.
at least 2,000 feet from the nearest area planned for
residential use.
' B. Commercial and industrial vehicle concerns which
propose to locate within the City of Lynwood shall
provide the Fire Department with a list of all
hazardous materials to be used at the site, a
description of where and how each is stored, and how
each react in a fire.
C. Placards or other appropriate signage indicating
hazardous materials or wastes are being stored shall
be placed on all buildings which have hazardous
materials or wastes stored.
D. The discharge of hazardous wastes into the air, land,
or into water resources within City boundaries is
prohibited.
E. Commercial and industrial concerns which create,
utilize, store or treat hazardous materials or waste,
shall prepare a hazardous materials and waste
management plan which provides for the use of the best
available technology within the production process:
The plan shall be subject to approval by the Fire
Department, and review by the Police Department and
shall outline source reduction, treatment, handling,
transportation, disposal, emergency response and
employee training methods.
F. Uses which create, utilize, store, or treat hazardous
waste, shall implement the best available technology
for on-site pretreatment and reduction of hazardous
wastes, whenever feasible.
9. Air Ouality
A. All mechanical ventilating equipment shall be directed
to top story exhaust vents which face away from
adjacent residential properties.
B. Required exhaust systems shall be equipped with�
appropriate and reasonably available control
technology to minimize or eliminate noxious pollutants
which would otherwise be emitted.
10. LandscaAe
Five percent (5�) of the total site area shall be improved
with landscape and landscaped areas shall have an
irrigation system installed subject to the review and
approval of the Director of Community Development.
STORAGE OR VEHICLES
No vehicles to be displayed, sold, rented, or repaired shall be
parked or stored on any street or alley.
The conditional Use Permit may adjust, or add to, any of the
standards set fourth in this section when it is found that the
public health, safety or general welfare is served thereby.

AUTOMOTIVE REPAIR, AUTOMOTIVE EQUIPMENT
INSTALLATION AND AUTO SALES USE AND
DEVELOPMENT STANDARDS.
,, The City Council of the City of Lynwood DOES HEREBY ORDAIN
' ` AS follows:
Section 1. Chapter 25 of the Lynwood Municipal Code is
hereby amended for the purpose of this section to prevent
harmful effects and to promote the public .convenience and
welfare, conserve the value of property and encourage the most
appropriate use by requiring review and/or control as set forth
herein.
Section 25-16(c) To read as follows:
To this extent, the following minimum development standards
would be imposed under a Condition Use Permit to all vehicle
repair and equipment installation facilities:
1. avin
- The site shall be entirely paved with no less than a two
_ inch thickness of blacktop or equally serviceable hard
surface pavement. existing uses that are currently not
paved shall conform with this requirement within three
years from the adoption of this Title.
2. Structures
Entrances to irrdividual service bays shall not face public
rights-of-way or abutting residential parcels.
3. Reoair Activities
All repair activities and operations shall be conducted
entirely within an enclosed building. outdoor hoists are
prohibited.
4. Erlclosure
Repair facilities performing body and fender work or
similar noise-generating activities shall be conducted in
fully-enclosed structures with walls of concrete block` or
similar materials providing sound attenuation. All
painting shall occur within an approved fully enclosed
booth.
� 5. Litter
The premises shall-be kept in a neat and orderly condition
at all times and all improvements shall be maintained in a
condition of reasonable repair and appearance. Used or
discarded automotive parts or equipment or permanently
disabled, junked or wrecked vehicles may not be stored
outside the main building or shall be stored in an area
, completely screened from view by a solid block decorative
wall.

` Exterior parking area shall be used for employee and
customer parking only,and not for the repair or finishing
work or long term (over one week) storage of vehicles.
7. Screenina
A solid masonry wall shall be erected and attractively
maintained along all property lines.

AUTO SALES DEVELOPMENT STANDARDS
Auto sales uses exhibit many of the same problems discussed
under auto repair uses especially used auto sales business that
repair and refurbish used vehicles. In addition to those
. problems, however, these uses generate other issues involving
signs and special sales events devices.
REPAIR ACTIVITIES
All repair and equipment installation activities shall conform
to the development standards referenced as No. 1 through 9
_ Repair Activities of this report.
ABATEMENT OF EXISTZNG TEMPORARY ADVERTISED DEVICES
All existing temporary advertising devices including but not
� limited to banners, balloons, flags, pennants, valance, or
advertising display constructed of cloth, canvas, light fabric,
cardboard,- wallboard, plywood or other light material, as well.
as any mechanical, audible, or animated statuary device, shall
be abated within a period of one hundred eighty (180) days from
the effective date of this section.
' DEVELOPMENT OF AUTOMOBILE AND TRAILER SALES LOTS
No person shall use any lot or parcel of land for the purpose of
conducting or maintaining thereon an open-air type facility for
- the display and sale of new or used vehicles without complying
with the following minimum regulations:
(1) The sale of new or used vehicles, and shall be
subject to a Conditional Use Permit.
(2) The complete plans, showing the location and design
of all buildings, structures, signs, lights, fences,
bumpers or barricades and the proposed development
thereof, including landscaping, shall first be
,. _ submitted to, and be approved by, the site Plan
review Board, prior to any consideration by Planning
' ' Commission.
(3) The entire area of such lot or parcel shall be
' surfaced, thereafter maintained im good condition
with not less that a two-inch thickness of blacktop
or other equally serviceable hard surfaae pavement,
and prior to the laying of such susfacing, the
entire area shall be effectively treated with a weed
_ destroyer. '
(4) The property shall be attractively maintained in a
neat and orderly condition, and the business
conducted thereon shall be operated in a manner so
' as not to be detrimental to others residing or
working in the vicinity.
(.5) , Adequate devices or structures shall be installed
� and maintained so as to protect any boundary line
fence, wall or building from damage and to prevent�
any part of a vehicle from extending across any
public or private property lines and that all such
installations and the maintenance thereof shall be
in conformance with standards and specifications
approved by the Community Development Department. ,
- (6) Open areas shall be used solely for the display of
new and used vehicles, and shall not be used for the
display of vehicles acquired for dismantling
purposes or vehicles classified as total loss
salvage vehicles.

(8) No advertising sign, structure or device, whether
temporary or permanent in character, shall be
erected or maintained upoa the premises without the

special events sale which shall be limited to a
maximum of eight days per calendar gear. No single
, sale may exceed two consecutive days. All temporary .
advertising'devices shall be approved by the
Director of Community Development prior to their
installation.
ABATEMENT OF NONCONFORMING USES
Wherever a vehicle sales lot exists upon any property within the
City at the time of adoption of this section, such use shall be
abated or shall meet all provisions of this section within one
hundred and eight (108) days after the date of adoption of this
ordinance.
Section 2. Severabilitv. If any section, subsection
subdivision, sentence, clause, phrase or portion of this
• ordinance or the application thereof to any person or place, is
for any reason held to be invalid or unconstitutional by the
decision of any court or competent jurisdiction, such decision
shall not affect the validity of the remaining portions,, of this
- ordinance or its application to other person or places. The
City Council hereby declares that it would have adopted this
ordinance,.and each section thereof, irrespective of the fact '
that any one or more section, subsection, sentence, or place, be
declared invalid or unconstitutional.
: Section 3. The City Clerk is hereby ordered and directed
to certify to the passage of this ordinance and to cause the
same to be published once in the Lynwood Press, a newspaper of
: general circulation printed, published, and circulated in the
City of Lynwood.

SUHJECT: DEVELOPMENT STANDARDS IN CITY OF PARAMOUNT
BACKGROUND:
' At the September 8, 1992 Planning Commission meeting,
Commissioner Haynes requested that the staff find out why
Paramount's commercial,development looks so good.
Discussions with Paramount Community Development Staff reveal
that the City's commercial development is a result of a
combination of policy documents, high standards proposed by staff
as conditions of approval and high standards maintained by the
Planning Commission.
The Central Business District (C.B.G.) Architectural Guidelines
adopted by the City in 1983 provides graphical guidelines for the
following components of commercial development design:
- Site Access: Vehicular and,Pedestrian
- Parking design alternatives
- Landscape for parking lots
- Setback scenarios
- Site planning
- Site Amenities: Courtyard,� seating areas, landmark

- Pocket Parks '
- Screening for parking and loading areas, and mechanical
areas

- Street furniture '
- Paving materials
- Color palettes
- Exterior materials
' - Building forms, proportion, scale

With regard to'multi-residential development, Paramount''s
ordinance requires that all projects are subject to the
• Development Review.Board process. Additionally, all projects
, proposed in R-M (Residential-Multi-Family) Zones must integrate
_ treatments and features into the project such as covered patios,
security systems, spas, and tot lots (refer to page 10 of
Ordinance 759).,
Usually, the staff will get a commercial project and disagree
with the applicant over various issues relating to design,
amenities or interpretation of how the C.B.G. Architectural
Guidelines apply to the project. Staff will then request
revisions as conditions of approval and allow the Design Review
Board (DRB),, which are the same members of the Planninq
' Commission, to resolve.the issues. The DRB typically rules in
favor of Staff's recommended revision or ask for even higher
quality development standards than .those suggested by Staff.
