HomeMy Public PortalAbout20020218REGULAR COUNCIL MEETING FEBRUARY 18, 2002 1 CALL TO ORDER The Regular Council Meeting of February 18, 2002, was convened at 6:00 P.M. by Mayor Tom Rackers. Prayer was offered by Councilman Edith Vogel, followed by the Pledge of Allegiance. ROLL CALL The following Council Members were present for the roll call: Present: Angle, Blaney, Jackson, Landwehr, Nelson, Olsen, Vincent, and Vogel Absent: Viessman and Weber A quorum was declared present. PRESENTATIONS FROM THE GALLERY There were no presentations made at this time. CONSENT AGENDA The following items were brought before the Council for their consideration: a. Council Meeting Minutes February 4, 2002 A motion was made by Councilman Carol Blaney to approve the Consent Agenda as presented, seconded by Councilman Larry Vincent, and approved unanimously. BILLS INTRODUCED Bill 2001 -173, sponsored by Councilman Landwehr, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, CHANGING, AMENDING, AND MODIFYING THE ZONING MAP OF THE ZONING CODE OF THE CITY OF JEFFERSON, BY REZONING 21.04 ACRES LOCATED IN THE 2400 BLOCK OF COUNTRY CLUB DRIVE, LOCATED IN SECTIONS 2 AND 11, TOWNSHIP 44 NORTH, RANGE 12 WEST, COLE COUNTY, MISSOURI FROM RS -1 SINGLE FAMILY RESIDENTIAL TO PUD PLANNED UNIT DEVELOPMENT. City Counselor Allen Garner explained to the Council, at their request, that since a protest has been filed in this matter, if the signatures meet all legal requirements, it will take a two - thirds super majority of the Council to pass this ordinance. If the signatures do not meet legal requirements, it will take the same number of votes to pass as any other ordinance (six), with the mayor voting to break a five -five tie vote. Bill 2001 -174, sponsored by Councilman Olsen, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING THE CODE OF THE CITY OF JEFFERSON, MISSOURI, BY REPEALING CHAPTER 12, (ELECTIONS), SECTION 36, (WARDS), AND ENACTING A NEW SECTION 36 IN LIEU THEREOF. Bill 2001 -172 was read third time by title, placed on final passage and passed by the following vote as Ordinance 13349: Aye: Angle, Blaney, Jackson, Landwehr, Nelson, Olsen, Vincent, and Vogel Nay: None INFORMAL CALENDAR Bill 2001 -166, sponsored by Councilman Jackson, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN EMPLOYMENT CONTRACT EXTENSION WITH RICHARD MAYS FOR THE POSITION OF CITY ADMINISTRATOR OF THE CITY OF JEFFERSON. Councilman Charles Jackson requested that Bill 2001 -166 be removed from the Informal Calendar and placed on third reading and final passage. Bill 2001 -166 was read third time by title and placed on final passage. Councilman Charles Jackson stated that since the contract has been in the possession of the contract for some time, he believes the effective date should be retroactive to the appropriate date in February. Bill 2001 -166 was then passed by the following vote as Ordinance 13350: Aye: Angle, Blaney, Jackson, Landwehr, Nelson, Olsen, Vincent, and Vogel Nay: None Bill 2001 -169, sponsored by Councilman Landwehr, entitled: AN ORDINANCE AMENDING SECTION 22 -33 OF THE CODE OF THE CITY OF JEFFERSON, MISSOURI, PERTAINING TO WRECKED VEHICLES. Councilman John Landwehr requested that Bill 2001 -169 be placed on the Informal Calendar at this time to allow time for amendments to the bill so that business owners and residents will both be satisfied with the ordinance. Councilman John Landwehr requested that Bill 2001 -169 remain on the Informal Calendar REGULAR COUNCIL MEETING FEBRUARY 18, 2002 5 at this time. He stated that progress is being made toward addressing the issues of all parties concerned before its final passage at the first meeting in March. NEW BUSINESS Councilman Clyde Angle made comments regarding city's current contract with the Cole County Collector, and made a motion that the City continue to carry out its existing contract with the County exactly as it has since 1983, and that the City give immediate written notice to the County of our desire to renegotiate the contract when the 120 -day notice provision comes up, or prior to that time. The motion was seconded by Councilman Cliff Olsen. Following discussion regarding pending staff reports on this issue, Councilman Angle withdrew his motion and Councilman Cliff Olsen withdrew his second until those reports can be received and reviewed by the Council. Councilman John Landwehr announced that the final draft of the proposed Zoning Ordinance has been distributed, and that the next step is to hold a public hearing and then final approval by the Council. After discussion, the Council scheduled a public hearing to be held on Thursday, March 14, 2002, at 5:30 PM in the upper level conference room. Councilman Cliff Olsen encouraged the city to continue looking into the matter of the CVB Board in the recent allegations of self - dealing by a former Board Member. Councilman Olsen made a motion that the City's Finance Department audit all of the CVB transactions for the year 2000 up to April 2000, when the new CVB Board was set up. Councilman John Landwehr seconded the motion. Following a lengthy discussion, Councilman Olsen stated he would table the motion to allow Council time to receive more information on the matter. UNFINISH ED BUSIN ESS Councilman Clyde Angle requested a progress report on the South Country Club Drive project. City Administrator Rich Mays asked that either Marty Brose or Pat Sullivan to prepare a written summary prepared to distribute at the February 21 Public Works & Planning Committee meeting. Councilman Clyde Angle asked that it also be sent to the residents in the affected area as well. Councilman Cliff Olsen made comments regarding lack of street lighting on Truman Road, and stated the city needs to look at getting it lit. Marty Brose stated that location is different since it is not residential and would be expensive because power would have to be run to the area first. He stated he will look into the matter and get back to the Council with his findings. Councilman Charles Jackson made comments regarding the E. McCarty Street improvements, specifically in connection with the area through the bluffs. Marty Brose stated that there are three different alternatives to bring before the Council at the February 21 Public Works & Planning Committee meeting. REGULAR COUNCIL MEETING FEBRUARY 18, 2002 6 Councilman Clyde Angle asked the status of appointments to the Mayor's Advisory Commission on Human Rights. Mayor Tom Rackers stated he has been talking to some people about serving on it, but it is not yet finalized. Councilman John Landwehr made comments about a sign issue which has been brought to his attention by a citizen, and asked Mr. Sullivan to get with him so he can give him the information. Councilman Clyde Angle wants to have another work session to address several subjects which he asked to be addressed in previous meetings. He asked the City Clerk to find that list of topics. Councilman Clyde Angle made comments regarding the consultant's figures on the downtown sidewalk project and wanted to know when Council would get to discuss the cost sharing property owners would have in that project. City Administrator Rich Mays stated he would get information which Councilman Angle requested to the Council by the February 21 Public Works & Planning Committee meeting as to when that information will be available. Councilman Clyde Angle made comments regarding the F.O.P. issues brought up at the last Council Meeting. He wanted to know if the Council would respond to the Police Personnel Board letter dated July 21, 2001. He also asked that the City Administrator pass on the letter which the Council received from Mike Wagers dated October 12, 2001, to the Police Personnel Board for their consideration. He stated that three other items should be delivered by the City to the Police Personnel Board: wage benefit manning survey dated January 3, 2002; Missouri Municipal League wage and salary survey of August 22, 2000; and the February 4, 2002 memo given to the Council dealing with the issues related to the Police Department. Councilman Clyde Angle asked about outstanding warrant list in the City. He believes the City is not effectively working the warrant list. COUNCIL LIAISON REPORTS Councilman Carol Blaney announced that a Pedestrian - Bicycle Task Force meeting will be held Wednesday, February 20 at 7:00 PM at City Hall. Councilman Charles Jackson announced a Public Works and Planning Committee meeting will be held Thursday, February 21 at 6:30 PM at City Hall. GO INTO CLOSED SESSION Mayor Tom Rackers announced that pursuant to Sec. 610.021 of the Revised Statutes of Missouri, the Chair would entertain a motion for the Council to go into Closed Session to discuss the following two topics: REGULAR COUNCIL MEETING FEBRUARY 18, 2002 7 a.
