Applicant: Nativida Basua
COMMENTS
The applicant is requesting approval of a Conditional Use
Permit to sell beer and wine in an existing buildinq at 11106
Atlantic Avenue, in the C-3 (Heavy Commercial) zone.
RECOMMENDED ACTION
Staff respectfully request that after consideration the
Planning Commission deny CUP no. 106.
2. CONDZTZONAL USE PERMZT CASE NO. 104 �
Applicant: Jorge Barrera
COMMENTS•
The applicant is requesting a Conditional Use Permit to allow
and operate a Auto Tire Shop at 4346 Martin Luther King
Boulevard in the C-3 (Heavy Commercial) zone. On December
17, 1991 the City Council adopted a Moratorium prohibiting
new development of automobile related land uses. The
proposed land use is restricted by the Moratorium Ordinance;
however the applicant submitted the Conditional Use Permit
application on December 17, 1991 which was processed by staff
before the adoption of the Ordinance.
RECOMMENDED ACTION
Staff respectfully requests that after consideration the
Planning Commission drop this item from the agenda.
Applicant withdrew.
NEW PIIBLIC HEARINGS
3. CONDITZONAL USE PERMIT - CASE No. 110

COMMENTS
The applicant is requesting approval of a Conditional Use
Permit to transfer an off sale alcoholic beverages permit
- from existing market to a new 67,726 square foot market at
3831 E. Martin Luther King Jr. Boulevard in the C-2 (Light
Commercial) zone.

COMMENTS
Staff is considering an amendment to Chapter 25, Sections

COMMENTS

6. ACOUISITION OF JORGENSEN STEEL CORPORATION OFFICE. AT 10700
S. ALAMEDA STREET IN THE M(INDUSTRIAL) ZONE.
COMMENTS
Pursuant to Section 65402 of the Government Code, staff has
prepared the findings that the subject acquisition is in
conformance with the General Plan and that it will not have a
significant impact upon the environment pursuant to the
California Environmental Quality Act. Staff will present
this report to the City Council at the next scheduled City
Council Meeting to be held on March 17, 1992.

COMMENTS

The regular meeting of the Planning Commission of the City of
Lynwood was called to order by Chai'rperson Haynes on the
above captioned date at 7:35 p.m., in the Council Chambers of

Mr. Fenderson introduced Mr. Omoruyi, who made the
presentation.
Chairperson Haynes opened the Public Hearing.
Carlos Sanchez, 3405 Alicia Avenue, Lynwood, representing the
applicant, accepted the conditions for Mr. Balbuena. Mr.
Sanchez said the units will contribute to the betterment of
the neighborhood.
Commissioner Dixon asked about the square footage of each
unit and a short discussion followed, concerning the square
footage of both one and two-bedroom units.
There beinq no one else in the audience wishinq to speak in
favor of, or in opposition to the proposal, Chairperson
Haynes closed the Public Hearing.
Chairperson Haynes told Mr. Semaan that it is not fair for
� the Public Works Department to require a developer to pay for
two wheelchair ramps. He reminded staff that he has
objected, in the past, to the requirement for a wheelchair
ramp on the opposite side of the street as well as a
wheelchair ramp on the side of the development. He asked .
that one of them be dropped.
Mr. Fong rewrote Condition No. 35 to read: "Construct one
wheelchair ramp at the northwest corner of Elizabeth Avenue
and California Street.°
MOTION Commissioner Lee, SECONDED by Commissioner Muhsin,
to adopt Resolution No. 2417, "A RESOLUTION OF THE PLANNZNG
COMMISSION OF THE CITY OF LYNWOOD APPROVING CONDITIONAL USE
PERMIT NO. 98 FOR THE CONSTRUCTZON OF THREE (3) DWELLING
UNITS AT 3405 ELZZABETH AVENUE IN THE R-3 (MULTI-FAMILY,
RESIDENTIAL) ZONE, LYNWOOD, CALIFORNIA, 90262," subject to
the stated conditions and requirements, with the exception
that Condition No. 35 has been changed to read: "Construct
one wheelchair ramp at the northwest corner of Elizabeth
Avenue and California Street," and certifying that the
project is categorically exempt from the provisions of the
State CEQA Guidelines as amended by Section 15061 b(3).

2. Conditional Use Permit - Case No. 102
12317 Long Beach Boulevard (Arjel Levobits)
Applicant requests approval to develop and operate an
automobile tire shop in the C-3 (Heavy Commercial) zone.
This item was continued from the December 10, 1991, meeting.
On December 17, 1991, the City Council adopted a moratorium
prohibiting new development of automobile-related land uses,
, however, applicant submitted the CUP application on November
14, 1991, before passage of the ordinance.
Mr. Fenderson introduced Mr. Barfield, who read pertinent
information.

: Chairperson Haynes asked for the Fire Department report and
" was told they�had no comments. Chairperson Haynes then asked
Commissioner McMiller if he knew any standard fire department
requirements for tire shops. Commissioner McMiller was also
, concerned about the storage of combustibles and both agreed
that tires are combustibles.
Chairperson Haynes opened the Public Hearing.
Arjel Levobits, 841 N. Martell Avenue, Los Angeles, 90026,
rose to state he has owned the property for many years and
plans to lease it for use as a tire shop.
Then followed a discussion about the lack of Fire Department
requirements and the combustibility of stored worn tires.
Commissioner Lee asked what services will be performed and
Mr. Levobits said the only service performed will be the
installation of tires.
Commissioner Dixon stated that Lonq Beach Boulevard is an
important thoroughfare and such businesses should be
discouraged. Appearances of the businesses on Lonq Beach
Boulevard should be updated and inade to look inviting, rather
than discouraginq, to potential shoppers.
Mr. Levobits said he plans to improve the appearance of the
property while it is rented. It has been vacant for three
years and this usage is only temporary.
Both Chairperson Haynes and Commissioner Dixon agreed that
profit to the City from such shops is negligible.
Chairperson Haynes repeated his concerns about fire
requlations. He said a rubber fire is one of the hardest to
extinguish. He knew of one that smouldered for weeks.
Commissioner Haynes said the worn tires should be removed
every Saturday. Mr. Omoruyi said the Fire Department will
inspect the property. Both Chairperson Haynes and
Commissioner McMiller said the Fire Department should have
made some conditions.
Chairperson Haynea asked if anyone else wished to speak.
Charles Glenn, 3533 Carlin Avenue, Lynwood, rose to express
his knowledqe of Mr. Levobits as an absentee landlord who is
known for poor property management. He flatly didn't want
another tire shop in Lynwood since the Code Enforcement
- Department has a poor history of enforcing the City Code as
it relates to these businesses. Such businesses are already
using the public sidewalks to park vehicles and to store and
display merchandise for sale. He now calls the Code
Enforcement.officers weekly about those businesses in
operation and Lynwood doesn't need another one. Also, the
wording about trees and shrubs is vaque, he would like to
know exactly how many trees and how many shrubs. The
property adjacent to this property has never been maintained
properly. Since there is a two-story apartment building
(maybe thirty apartments) just on the other side of the wall,
he would like to see the tires stored in metal containers.
. He wants the installation of sprinklers required. Also, what
about the noise impact from the installation of tires.
People in the apartments won't be able to sleep if the shop
is allowed to stay open very late. He also agreed with
Commissioner Dixon that the appearance should be updated.
There being no one else in the audience wishing to speak in
favor of, or in opposition to the proposal, Chairperson

Haynes closed the Public Hearing.
Mr. Fong added Condition No. 15 to the Planning Division
Conditions and it will read: "All worn tires removed from
customers' automobiles and not intended for resale must be
removed from the premises before Saturday of each week." The
following conditions should be renumbered consecutively.
Commissioner pove asked the number of trees to be required
and was told that it would be perhaps four trees. However,
the applicant will be required to submit a landscape plan
" which must be reviewed and approved by Planning Department
personnel before the Certificate of Occupancy will be issued.
Commissioner Dixon said she would like Condition No. 7
changed to read: "Daily operating hours shall be from 7:�0
a.m. to 7:00 p.m."
" Chairperson Haynes does not want heavy-duty, diesel, ten
_ wheeler trucks on the property.
Commissioner Pryor commented that no occupancy can take place
until these conditions have met..
Commissioner Lee stated that Lynwood.already has quite a few
automotive businesses, over ten tire places alone, and Code
Enforcement isn't able to control those in existence.
Commissioner pove wants the existing buildings brought up to
Code before occupancy. ,
Commissionei' McMiller agreed with Commissioner Dixon that
Condition No. 7 should be changed to a twelve-hour day
weekdays and Saturdays. Commissioner Lee said the hours of
10:00 a.m. to 5:00 p.m. should be sufficient on Sunday.
Mr. Fong recorded Condition No. 7 to read: "Daily operating
hours shall be from 7:00 a.m. to 7:00 p:m. weekdays and
Saturday and from 10:00 a.m. to 5:00 p.m. on Sunday."
MOTION by Commissioner Lee to deny Conditional Use Permit No.
• 102. MOTION tabled for lack of a second.
Commissioner McMiller suggested adding another condition that
would require the upgrading of tha buildings to mini-mall
level. This was followed by a short discussion of how the
buildings could be upgraded.
Mr'. Fong added another condition, No. 38, which will read:
"Elevation drawings for the site must be upgraded and are
, subject to approval by the Planninq Commission at its next
regularly scheduled meeting.'�
MOTION by Coiamissioner Lee, SECONDED Dixon, to approve
Resolution No. 2415, "A RESOLUTION OF THE PLANNING CONII�SISSION
OF THE CITY OF LYNWOOD APPROVING CONDITIONAL USE PERMIT NO.
102 FOR THE DEVELOPMENT AND OPERATION OF AN AUTO TIRE SHOP .
WITH SALES IN THE C-3 (HEAVY COMMERCIAL) ZONE, AT 1237 LONG
BEACH BOULEVARD, LYNWOOD, CALZFORNIA," certifying that the
project is categorically exempt from the provisions of the
, State CEQA Guidelines as amended by Section 15061 b(3j and
subject to the stated conditions and requirements, with
Condition No. 15 added to the Planning Department Conditions
to read: "All worn tires removed from customers; automobiles
and not intended for resale must be removed from the premises
before Saturday of each week," and the following conditions
renumbered consecutively. Condition No. 7 was rewritten to
read: "Daily operating hours shall be from �:00 a.m. to 7:00
. p.m. weekdays and Saturday and from 10:00 a.m. to 5:00 p.m.
on Sunday, " and finally, Condition No,. 38 was added to read:

STAFF COMMENTS
Mr. Fenderson informed the Commissioners that staff will be
submitting the proposed updating of the zoning map and zoning
conditions to the Commissioners at their next meeting. The
Commissioners will have to be heavily involved and it is presumed .
that at least five sessions will be required.
PUBLZC ORAIS
Charles Glenn, 3513 Carlin Avenue, Lynwood, stated his concerns
about zoning ordinances. He would like it noted that Lynwood is
becoming a farming, rural community, with families living in
garages and raising chickens. Also, some residents seem to have
continual garage sales.
, COMMISSION ORAIS
Commissioner pove agreed with Mr. Glenn, but he noted that
enforcement takes manpower. We should go before City Council and
request high fines which will pay for more manpower.
Commissioner Lee congratulated Commissioner McMiller on his
reappointment. He agreed with Commissioner pove that more Code
Enforcement officers are needed.
Commissioner Pryor said there is also a problem getting citations
issued. Chairperson Haynes said the firs ticket is a warning,
the second ticket costs the violator money. It was agreed by
all that violations should cost more money.
Commissioner pove discussed the setback regulations of the City
of Los Angeles.
Commissioner McMiller expressed his concerns about the new trees
on the west side of Long Beach Boulevard that are not being
properly cared for. Also, residents are using their front yards
, to grow vegetables.
Commissioner Dixon discussed an upcominq community prime rib
dinner/dance. She would like to see much more Commissioner
involvement in the next Development Conference.
Commissioner Pryor asked about six median trees on A'tlantic
Avenue, south of Imperial and was told they were plowed down in a
hit-and-run accident.
Commissioner Lee asked about a median at Carlin and Bullis where
flowers were planted only a month or two ago and they are already
dead or dying. He liked the pretty yellow flowers that were
there before. He was told these flowers are dormant this time of
year. ,

Chairperson Haynes asked what staff is doing about the people at
the Hilton and was told that has been,turned over to the City
Prosecutor's office. He said they are panhandling, even
approaching women and children. One of them urinated on his car
tonight.
Commissioner Lee suggested staff ask Code Enforcement officers to
go out tomorrow.
Chairperson Haynes suggested staff should arrange a tour so that
the newer Commissioners could see all the chanqes that have been
made through the efforts of the Planning Commission. ,

MOTION was made by Commissioner Lee, SECONDED by Commissioner
Dixon, to adjourn to the regularly scheduled meeting of the
Planning Commission on February 11, 1992, and carried
unanimously. Meeting adjourned at 9:30 p.m.

necessitated by right shoulder injury.
MOTION by Commissioner Lee, SECONDED by Commissioner Muhsin,
to accept the minutes of'December 10, 1991, as submitted.

1. Conditional Use Permit - Case No. 101
11742 Second Avenue (Wilbur Owens)
Applicant requests approval to develop a duplex in the R-2
(Two-Family Residential) zone. This item was continued from �
the December 10, 1991, Planning Commissioner Meeting. �
Mr. Fenderson introduced Mr. Omoruyi, who made the �

Chairperson Haynes opened the Public Hearinq. ;
Wilbur Owens, 19308 Nestor Avenue, Carson, rose to question I
Condition No. 30, concerning FEMA requirements. Mr. Semaan �
said the FEMA map is now legal.. Chairperson Haynes said the I
� FEMA requirements are federal government requirements and the
City of Lynwood has no option. �
Mr. Owens then questioned Condition No. 32, requiring two
wheelchair ramps. Mr. Semaan replied that this was an error, �
there will be only one wheelchair ramp required, on the
northeast corner of Second Avenue and Josephine Street.
Mr. Owens then questioned Condition No. 36, requiring a `
marbelite street light. Chairperson Haynes stated this '
requirement is not negotiable. This requirement will ',
continue until all street lights in the City are marbelite. �

There was a discussion about the problems encountered in
complying with the requirements of FEMA, considering the I
heights of the freeway, the height of block wall fences and
many other problems that will be caused by the height of new .
buildings next to present buildings built before FEMA
requirements. Chairperson Haynes suggested to Mr. Fenderson ;
that applicants should be told "up front" of the allowances ;
that must be made for FEMA requirements in flood zone areas.
This way, oriqinal plans can be made to accommodate FEMA �
requirements.
Commissioner Pryor asked Mr. Fong to check for any legal ways '
to make FEMA requirements easier for developers.
There being no one in the audience wishing to speak in favor �
of, or in opposition to the proposal, Chairperson Haynes
closed the Public Hearing.

Applicant request approval to operate an automotive

17, 1991, the City Council adopted a moratorium prohibiting
such usage , however, the applicant submitted his application �
on December 16, 1991, one day before the adoption of the �
ordinance. I

Mr. Fenderson introduced Mr. Omoruy'i, who read pertinent I
information.
Mr. Fenderson corrected Condition No. 8, stating the �
applicant has a screen running across the back of his �
property, somewhat like a carport. Also, staff has issued
Mr. Ortiz a temporary business license. �
Chairperson Haynes questioned Condition No. 42, asking that '
the need for this condition be checked, since no one will be
living on the premises. He also asked about Fire Department (
Conditions Nos. 2 and 3. Condition No.'2 was changed to i
read: "No auto spray painting shall be conducted, " and '
Condition No. 3 was corrected to read: '�No drop cord in '
place of fixed wiring and faulty or hazardous wiring.�� !

Commissioner Lee asked exactly what work is performed at an �
automobile electrical shop. Mr.Fenderson said the applicant
will work only on the electrical system of automobile. ,
Mr. Fenderson said no tires will be stored and removed �

Chairperson Haynes opened the Public Hearing. (
Applicant Jose Ortiz, 12631 Long Beach Boulevard, rose to �
explain that his business is testing only, of the electronic
fuel injection system. He does not repair, just diagnostic �
testing. They do not roar the automobile engine, but it does �
have to run.

There was a short discussion about operating hours. Mr. �
Ortiz said his Sunday hours are from 8:00 a.m. to 7:00 p.m. �
Also, the shed is now under construction. It looks like a �
carport but will be enclosed. He has guard dogs and the �
property is totally fenced in.

Commissioner McMiller asked about Condition No. 18, which ,
includes "woodshake" as an acceptable choice for roofing �
material. Mr. Fenderson said this wording will be eliminated
in the future. Chairperson Haynes expressed his total '
opposition to any use of woodshake for roofing.
Regarding Condition No. 28, Chairperson Aaynes discussed a �
� new paint that can be washed clean from any graffiti that may �
be inflicted on it. While it is costly, Chairperson Haynes
thinks it is an excellent investment.

Chairperson Haynes opened the Public Hearing. Herbert
Flores, 1800 W. Beverly Boulevard, Montebello, representing
the applicant, rose to question Condition No. 34, requirinq a
wheelchair ramp. Mr. Flores said the wheelchair ramp is
already there. Mr. Semaan said if it is already there, this
condition will be eliminated.
Concerning Conditions No. 32, Mr. Flores said the second unit
will be raised 4' To match the existing building.
Concerning Condition No. 12, requiring a 6' block wall fence
encompassing the property , Mr. Flores said there is an
existing block wall fence in the back and on the north side.
Chain link fencinq is on the south and in the front, and he
would like to keep it. Chairperson Haynes said the planning
Commission always requires cement block fencing when there is
more than one unit. '

because the conditions of the CUP's have not been fulfilled. Both
CUP's were granted on the conditions that they would be owner- �
occupied and one is already up for sale. Applicant Ali Zakeri, j
who was present, said this is because of their economic �
situation. He said he still lives at 11639 S. Ramona Avenue,
Hawthorne, as he did when he applied for the CUP. Mr. Fong said �
the Commission could reschedule the hearing to consider !
revocation of the CUPs. It was explained to Mr. Zakeri that since �
they have not fulfilled the conditions of the CUPs, the CUPs may
be revoked. Chairperson Aaynes said that he voted approval I
because the property would be owner-occupied, and asked that this �
item be rescheduled for the next regularly scheduled meeting of �
the Planning Commission on March 10,'1992. �

Division Work Program because he wants all Commissioners in
attendance for the presentation.
Mr. Fenderson discussed auto shop elevations and both Chairperson
Haynes and Commissioner Lee asked�for new elevations.
PUBLIC ORALS
Joe Vecchio, 1142 Atlantic Avenue, Lynwood (1375 Dormus Road,
Pasadena, CA, 91105); Gus Moretta, 1600 Carlson Lane, Redondo
Beach; Jose Gacson and his son, 412 Mayflower Boulevard, #221,
Long Beach,90814, all of whom are Atlantic Avenue coin laundry
owners, came to the podium to say they want a moratorium placed
on coin laundry businesses on Atlantic Avenue. They discussed
several new coin laundries in the immediate vicinity of theirs.
Approximately six or seven coin laundries are located in a four
block area on Atlantic Avenue, and one of the new owners charges
only fifty cents per wash, whereas they all charge seventy-five
cents per wash.
Commissioners Dixon, Lee and McMil'ler agreed that staff should
investigate the situation. Chairperson Haynes said a
proliferation of coin laundries could cause a raise in water I
rates and asked staff for a survey of existing laundries, to be ,
presented to the Commission at the next meeting.
COMMZSSION ORALS '
Commissioner McMiller discussed three kinds of graffiti: ganq i
graffiti, business graffiti and political graffiti. He defined !
gang graff.iti as the scribblings.we all recognize. He defined ,
business graffiti as over-zealous businesses with too much �
signage. He defined political graffiti as election signs left up
after elections are over. xe wants all three kinds eliminated. �
Mr. Fenderson said revision of the sign ordinance will cover �
this, but this sort of thing is constantly reoccurring. The CIty i
simply does not have enough manpower to cope with it. �
Commissioner McMiller said the City of Cerritos requires that all I
houses be painted earth tones and this s his preference. He
particularly objects to a green house and swing sets in front
yards. He would like to see free paint (in earth tones) given to '
property owners who agree to repaint their homes within a
specified time. ;
Chairperson Haynes commented that we're talking about private
property. ;
Commissioner Pryor discussed the pretty pictures of cars, etc., ,
painted on the outside of an auto accessory business now in
operation on Atlantic Avenue off Beechwood, possibly named Ace ,
Hardware and Supplies.

THE CITY OF LYNWOOD APPROVZNG CONDITIONAL
USE PERMIT NO. 110 FOR THE TRANSFER OF
OFF-SALE ALCOHOLIC BEVERAGES PERMIT FROM
EXISTING TO PROPOSED FRONTIER FOOD
WAREHOUSE (MARKET) AT 3831 E. MARTIN
LUTHER KING JR. BOULEVARD IN THE C-2
• (LIGHT COMMERCIAL) ZONE, LYNWOOD,
CALIFORNIA 90262
WHEREAS, the Commission, pursuant to law, conducted a public
hearing on the subject application; and
WHEREAS, the Planning Commission, considered all pertinent
testimony offered at the public hearing; and
WHEREAS, the Community Development Director has determined
that the proposal will not have a negative effect on the
environment, and has therefore declared a Negative Declaration
for the project; and
WHEREAS, a Conditional Use Permit is required for
development of a new commercial use in area designated as '
Commercial under the General Plan and in a C-2 (Liqht Commercial)
zone.
Section 1. The Planning Commission hereby finds and �
determines as follows:

A. The Conditional Use Permit is for the transfer of I
existing off-sale alcohol beverages permit to the �
proposed market. �

1. The applicant and /or his represntative shall comply with
all conditions on resolution 2400 for CUP 90 approving the
construction of a new 67,726 square foot market (Frontier
Food Warehouse)
2. Off-sale liquor establishments shall not sell or store motor
fuels on the same premises as alcoholic beverages, except
upon conditions of the following:
,. (A) No beer or wine shall be displayed within (5) feet of
, the cash register or the front door unless it is in the
" permanently affixed cooler as of January 1, 1987.
, (B) No advertisement of alcoholic beverages shall be
displayed at market windows or buildings.
(C) No self-illuminated advertising for beer or wine shall
be located on buildings or windows.
. (D) Employees on duty between the hours of 10:00 p.m. and
2:00 a.m. shall be at least 21 years of age to sell beer
and wine.
Section 3. A copy of Resolution 2424 shall be delivered

The Staff is proposing to amend Chapter 25, the Official 2oning
, Ordinance, with reference to the re-establishment of residential
legal nonconforming uses.
Backaround•
With the adoption of the Lynwood General Plan, and the extensive
downzoning associated with the amendment, many Lynwood
residential properties have become legal nonconforming. As a
result many residents who want to refinance their homes are
having problems with the banking industry.
° Issues and Analysis:
, The intent of the ordinance amendment is to allow residential
properties, which have become legal nonconforming as a result of
, the Lynwood General Plan update to rebuild. Because property
owners are having problems refinancing their homes, (due to legal
nonconforminq status) an ordinance amendment to allow
reconstruction is in order. The amendment would assure banks
that if properties were destroyed by fire or any other natural
. disaster, the property owner would have the right to rebuild.
The second part of the ordinance amendment deals with residential
properties which were legal nonconforming, prior to the General
Plan update. This section also deals with a property owners
ability to rebuild in case of a natural disaster. If such a
disaster were to occur, and the property were damaged more than
fifty percent, the property owner would have the right to rebuild
as long as construction started within a year of the disaster.
Environmental Assessment
Pursuant to Section 15073 of the State CEQA Guidelines, as
amended, a Negative Declaration has been prepared. It has been
determined that at the project could not have a siqnificant
effect on the environment based upon the completion of the
Znitial Study and Environmental Checklist, which has found that
there are no significant impacts resulting from the project.
RECOMMENDATION•'
Staff respectfu�ly requests that after consideration, the
Planning Commission adopt the attached Resolution Na. 2426:
1. Recommend that the City Council certify the Negative
Declaration as adequate.
2. Recommending City Council adoption of Zoning Ordinance
Amendment No. 20.

AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF LYNWOOD AMENDMENT TO CHAPTER 25 OF
THE MUNICIPAL CODE WITH RESPECT TO THE RE-
ESTABLISFiMENT OF RESIDENTIAL LEGAL NON-
CONFORMING USES.
The City Council of the City of Lynwood DOES HEREBY ORDAIN
AS follows:
Section 1. Chapter 25 of the Lynwood Municipal Code is
hereby amended to the re-establishment of residential legal non-
conforming uses.
Section 25-15 To read as follows:
Re-establishment of a Nonconforming use in the Event of a
Disaster or Adoption of the August 1990 General Plan Amendment.
Any residential structure which became legal nonconforming as a
result of the adoption of the Auqust 1990 Lynwood General Plan
Update may rebuild to its previous use, subject to a Conditional
' Use Permit, and compliance with City development standards, or:
Zf the structure or structures in which a nonconforming use is
located are destroyed by fire, explosion, other casualty or
natural disaster, the nonconforming use may be re-established so
long as the structure in which it is housed is reconstructed to
the standards for such a use as set forth in this title, and so
long as the reconstruction occurs within one year of the date of
the disaster. Destruction for this purpose is defined as damage
to an extent of more than fifty (50) percent of the replacement
' cost at the time of destruction.
Section 2. Severabilitv. If any section, subsection
subdivision; sentence, clause, phrase or portion of this
ordinance or the application thereof to any person or place, is
for any reason held to be invalid or unconstitutional by the
decision of any court or competent jurisdiction, such decision
shall not affect the validity of the remaining portions, of this
ordinance or its application to other person or places. The City
Council hereby declares that it would have adopted this
ordinance, and each section thereof, irrespective of the fact
that any one or more section, subsection, sentence, or place, be
declared invalid or unconstitutional.
Section 3. The City Clerk is hereby ordered and directed to
certify to the passage of this ordinance and to cause the same to
be published once in the Lynwood Press, a newspaper of_ qeneral
circulation pririted, published, and circulated in the City of
Lynwood.
First read at a regular meeting of the City Council of said

The Staff is proposing to amend Chapter 25 of the Official Zoning I
Ordinance with respect to motel/hotel development standards city- i
wide. The Proposed hotel/motel development standards are intended
to establish new guidelines relative to hotel/motel size, �
landscaping, parking, lot depth and lot size. j
Backaround•
, The Mayor has expressed concern relative to the concentration of �
motel uses along the City's thogoughfares, as well as the need to
develop new design regulations, and has directed staff to develop ;
a moratorium ordinance and the subject Zoning Amendment. On �
February 18, 1992, the City Council .adopted an urgency ordinance I
restricting development of new motels in the City of Lynwood. The
initial moratorium was initiated for a period of (45) forty-five
days with an option to extend for an additional ten months, fifteen i
days.
Issues and Analysis: �
The City contains (38) thirty-eight motel uses concentrated along
Atlantic Avenue and Long Beach Boulevard. (See Attachment). The ,
current motel requirements for motel/hotel uses do not provide the �
necessary measures to ensure quality development for such uses.
, Staff has prepared new requlations pertaining to parking, i
landscaped setback, minimum lot depth, minimum lot size and a '
minimum number of units, as more fully described in the attached �
Ordinance.
Environmental Assessment: �

THE CITY COUNCIL OF THE CITY OF LYNWOOD, CALIFORNIA, DOES
ORDAIN AS FOLLOWS:
SECTION 1: Section 25-9.1(c) of the Lynwood Municipal
Code is hereby amended to read as follows:
c. Motels and hotels, provided a conditional use permit .
has been obtained and that the followinq standards hava been met:
1. No cooking facilfties shall be permitted in any
rooms, other than the manager's.
2. Tha following development etandards must be I

comprising the westerly portion of the city block bounded by �
Alameda Street on the west, Martin Luther King Jr. Boulevard �
on the north; 108th Street on the south; and Santa Fe Avenue !

The subject property is basically rectanqular in shape. It !
has 250 feet of frontage along Alameda Street; 703 feet along I
Martin Luther King Boulevard; 559 feet along 108th street. �
The area has been calculated to be approximately 139,728
square feet, Or 3.21 acres.

The subject site is flat, with two story, masonry and steel, �

this acquisition and has been filed in the community

The applicant is requesting a Conditional Use Permit to establish
an on sale beer and wine permit for an existing restaurant at
3840 E. Martin Luther King Jr. Boulevard in the C-2 (Light
Commercial) zone.

that a Conditional Use Permit be obtained in order to
operate any business selling alcoholic beverages for on-site

7. Proiect Characteristics:
°� The applicar� proposes to operate a full service restaurant
(see exhibit 1) selling alcoholic beverages. The restaurant
' will offer alcoholic beverages only with food. The
operating hours of the restaurant will be from 8:00 am to
_ 10:00 pm, daily. The existinq building will be altered with
tenant improvements and an exterior upgrading. the subject
site has a total of 16o parking spaces with five (5�)
percent landscaping.

At its regular meeting on February 4, 1992, the City Council
reviewed and approved the applicant's request for beer and
wine sales as a part of the proposed restaurant operation
and forwarded the item to the Planning Commission with a
• recommendation for approval of the requisite Conditional Use
•. Permit Application.

ANALYSZS AND CONCLUSION: •
1. Cohsistencv with General Plan
The proposed land use is consistent with the existing zoning
classification of C-2 (Light Commercial) and the General
Plan designation of Commercial, therefore, grantin.g
Conditional Use Permit No. 111, will not adversely affect
the General Plan.
2. Site Suitabilitv
The property is adequate in size and shape to accommodate
the proposed development relative to structures, parking,
. walls, fences, landscaping, driveways and other development
° features required by the Zoning Ordinance.`
Martin Luther King Jr. Boulevard is a major arterial and is
' well suited to carry the quantity of traffic the proposed
development would generate.
3. Comoatibilitv
The proposed development is surrounded by a mixture of
� commercial developments, public facilities, and residentials
uses therefore, the project will be compatible with the
surrounding land,uses.
� 4. Compliance with Develocment Standards
, The proposal does meet the development standards required,by .
the Zoning ordinance with respect to setbacks; lot coverage; '
building heights; and parking. However, it is not in '
accordance with distance requirements as established by the
City's Liquor Ordinance (1306) Section 25-16.40 On-Sale �
Liquor Establishment. But, the proposal carry out a number I
of City Concept Goals and Land Use Goals of the General 'i
Plan. They are as follows: i

' The proposal will assist in upgrading the commercial use of
the property and support the Commercial designation of the
General Plan.
7. Environmental Assessment
' The Community Development Department has determined that the
project could not have a significant effect on the
. , environment. Therefore, a Notice of Exemption has been
prepared and is on file in the.Community Development
Department office and in the office of the City Clerk.
RECOMMENDATION
Staff respectfully requests that after consideration the Planning
Commission adopt the attached Resolution No. 2428.
, 1. Certifying that the project is categorically exempt,
from the provisions of the State CEQA Guidelines as
amended by Section 15061 b(3).

RESOLUTION NO. 2428
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF LYNWOOD APPROVING A CONDITIONAL
USE PERMIT TO OPERATE A RESTAURANT WITH
ALCOHOLIC BEVERAGES (BEER AND WINEj IN THE
' C-2 (LIGHT COMMERCIAL) ZONE, 384-0 MARTIN
• LUTHER KING JR. BOULEVARD, LYNWOOD,
CALIFORNIA.
WHEREAS, the Planninq Commission of the City o£ Lynwood,
pursuant to law, held a public hearing on subject application; and
WHEREAS, the Commission has carefully considered all pertinent
testimony offered at the public hearing; and '
WHEREAS, the Community Development Director has determined that
the proposal is exempt from the provisions of the State CEQA
Guidelines, Section 15061 b(3) as amended; and
WHEREAS, the project is consistent with the General Plan in
that the subject site is designated "Commercial" on the General Plan
Map; and -
` WHEREAS, the restaurant is located in the C-2 (Light
Commercial) zone and may sell alcohoTic (beer and wine) beverages,
subject to the granting of a Conditional Use Permit.
The Planning Commission of the City of Lynwood does hereby
resolve as follows:
section l. The Planning Commission of the City of Lynwood
finds and concludes as follows:
A. That the granting of the proposed Conditional Use Permit '
will not adversely affect the General Plan.
B. That the proposed looation of the Conditional Use is in �
accord with the objectives of the Zoning Ordinance and the I
purpose of the zone in which the site is located. I
C. That the-proposed location of the Conditional Use and the
conditions under which it would be operated or maintained, �
wi11 not be detrimental to the public health, safety, or
welfare, or materially injurious to properties or
improvements in the vicinity; �
D. That the proposed Conditional Use Permit will comply with i
each of the applicable provisions of the Zoning Ordinance
as stated in the conditions below. �

, GENERAL -
1. The proposed development shall comply with all applicable
regulations of the Lynwood Municipal code, the Uniform Building
. • Code and the Uniform Fire Code.
2. Any proposed subsequent modification of the subject site or
-' structures thereon, shall be first reported to the Community
Development Department, Planning Division, for review.
3. The applicant, or his representative, shall sign a Statement of
Acceptance stating'that he/she has read, understands, and
agrees to the conditions stated herein before any building
permits are issued.
REDEVEIAPMENT AGENCY
4. Access.to restroom facilities should be provided.
5. Loading/unloading parking area for the restaurant must be ,.
addressed.
6. A signage plan must be submitted for Redevelopment Division
approval, prior to installation. _
7. Only beer and wine shall be sold, unless another alcoholic
beverage license is approved by the Planning Coaamission:
8. This application shall�be subject to a yearly review by the
Redevelopment Agency.
' 9. The proponent shall not post or maintain any signage visible
from the public right-of-way advertising brands of alcoholic
beverages offered for sale on the premises.
l0. Alcoholic beverages shall not be offered for off-site
consumption.
� PLANNING DIVISION
11. This permit shall become void one hundred twenty (120) days,
unless extended, after the use permitted has been abandoned or
has ceased to be.actively exercise
� 12. Rehabilitation of the structure shall commence within three (3)
months from date of issuance of building permits.
13. The applicant shall contact the U.S. Post Office (Lynwood main
, office) to establish the location of mail boxes serving the
proposed development.
14. Where vehicles are to be parked immediately adjacent to a
, public or private street or alley, a decorative masonry wa11 a
maximum of thirty-six inches in heiqht measured from the
finished surface of the parking area, and/or bermed; shrub and
groundcover lot from street view shall be provided. If a wall
is.provided, there must be minimum landscaping to screen wall.

15. Prior to the installation or construction of any fence' or
masonry wall within any zone, the property owner shall obtain a
permit.

16. All fences or masonry walls shall be required to maintain

18. Each off-street parking space shall not.be less than twenty
(20) feet in length and nine (9) feet in width, exclusive of ,
, access driveways or aisles, except as noted below:
a. Any standard parking space that is immediately adjacent to
a wall, structural column, light standards, or similar
obstruction on one or both of its longer sides or in an
enclosed space shall be at least ten (10') feet in width
and twenty (20') feet in length.
b. Two parking spaces designed for the handicapped shall be
provided. These spaces may be provided as follows:
a. . Dimensions. The minimum dimensions of each
automobile parking stall for the handicapped shall be
not less than fourteen (14) feet in width by eighteen
(18) feet in length. Said stalls shall be lined to
provide a nine (9) foot parking area and a five (5)
foot loadinq and unloading area or;
. b. Two (2) spaces may be provided within a twenty-three
'(23) foot wide area, lined to provide a nine (9) foot
parking area on each side of a five (5) foot loading
and unloading area. The minimum length of each
parking space shall be eighteen (18) feet.
c. Location. All parking spaces for the handicapped
shall be located adjacent to the main entrance of the
facility for which the spaces are provided. The .
, parkinq spaces shall be positioned so that the
handicapped persons shall not be required to walk or
, � wheel behind parked vehicles.
19. The parking lot.plan for the subject site shall have a
• circular-flow arrangement without dead-end aisles when
„-- ' possible.
' 20. The applicant shall submit elevation drawings to the Planning
Division showing the exterior buildinq design; including the
specification of colors, and materials, must obtain approval by
the Community Development Director or his/her designee.
. 21. All security fences, grills, etc. shall be architecturally
compatible with the design of the subject and adjacent
buildings: In acldition, no security fences, grills, etc. shall
be installed without the prior.written approval of the
" Director of Community Development and required, building
permits.
° 22. Air conditioners, heatinq, cooling ventilation equipment,
heaters and all other mechanical devices shall be screened from
' surrounding properties and streets and so operated that they do
not disturb the peace, quiet and comfort of neighboring
residents, in accordance with the City's Noise Ordinance. All
'• means of access to the referenced equipment shall be designed
' and installed so as to prevent access to unauthorized persons
and shall be approved by the Building and Safety Division.
