HomeMy Public PortalAbout20020304REGULAR COUNCIL MEETING MARCH 4, 2002 CALL TO ORDER The Regular Council Meeting of March 4, 2002, was convened at 6:00 P.M. by Mayor Tom Rackers. Prayer was offered by Councilman Steve Nelson, followed by the Pledge of Allegiance. ROLL CALL The following Council Members were present for the roll call: Present: Angle, Blaney, Jackson, Landwehr, Nelson, Olsen, Viessman, Vincent, Vogel, and Weber Absent: None A quorum was declared present. Mayor Tom Rackers acknowledged that a group of Boy Scouts had entered the Council Chambers and asked that they stand and be recognized and tell what troop they were. Members of Troop 2 stood for recognition and stated they were working on their Citizenship in the Community merit badge. PRESENTATIONS FROM THE GALLERY The following presentations were made: Brad Harris & Capt. Ron Replogle, Missouri Department of Natural Resources presented a Special Certificate of Appreciation of Fire Chief Robert Rennick and Jefferson City Fire Department for his work in connection with enforcing laws about meth labs in Missouri. Chief Rennick accepted the award. Dave Kempker, Kempker Plumbing & Drain Service, 2912 Southwood Hills Road. Mr. Kempker stated that his reasons for opposition to Bill 2001 -186 were mainly because of safety. Robert Chiles, Chiles Electric, of 306 Haaf Drive, also stated his reasons for opposition to Bill 2001 -186. They felt the bill represented an inequity in requirements for qualifications to do work in Jefferson City. Ken Sandbothe, 5900 Shade Tree Lane, also spoke against passage of Bill 2001 -186. At his request, several members of the gallery who are licensed plumbers and electricians stood to indicate they also are in opposition to the bill. REGULAR COUNCIL MEETING MARCH 4, 2002 CONSENT AGENDA The following items were brought before the Council for their consideration: a. Council Meeting Minutes February 18, 2002 b. Authorizing Correction to Jefferson City Convention &Visitor's Bureau Budget A motion was made by Councilman Carol Blaney to approve the Consent Agenda as presented, seconded by Councilman Charles Jackson, and approved unanimously. BIDS OVER $25,000 Bid 1992 - Sport Utility Vehicle, Fire Department — A motion was made by Councilman Charles Jackson for approval, seconded by Councilman Carol Blaney and approved unanimously. Bid 1993 - One -Ton Flatbed Truck, Fire Department —A motion was made by Councilman Carol Blaney for approval, seconded by Councilman Charles Jackson and approved unanimously. Following a lengthy discussion, Bill 2001 -173 was defeated by the following roll -call vote: Aye: Vincent and Weber Nay: Angle, Blaney, Jackson, Landwehr, Nelson, Olsen, Viessman, and Vogel Bill 2001 -174, sponsored by Councilman Olsen, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING THE CODE OF THE CITY OF JEFFERSON, MISSOURI, BY REPEALING CHAPTER 12, (ELECTIONS), SECTION 36, (WARDS), AND ENACTING A NEW SECTION 36 IN LIEU THEREOF. Bill 2001 -174 was read third time by title, placed on final passage. Following a lengthy discussion, a motion was made by Councilman Carol Blaney to amend by substituting Option #11 instead of Option #2 which is in the original bill. The motion was seconded by Councilman Steve Nelson. After further discussion, Councilman Carol Blaney withdrew her motion and Councilman Steve Nelson withdrew his second. Councilman Larry Vincent then made a motion to substitute Option #12 for Option #2, the motion was seconded by Councilman Charles Jackson. Councilman Bob Weber then made a motion to call for the REGULAR COUNCIL MEETING MARCH 4, 2002 question, seconded by Councilman Larry Vincent and approved. Councilman Cliff Olsen requested that the record show that the Council discussed rolling back the fares to fifteen cents (15¢) when the original bill was passed. Councilman Olsen then requested that Bill 2001 -176 be withdrawn at this time. Councilman John Landwehr requested that Bill 2001 -169 be removed from the Informal REGULAR COUNCIL MEETING MARCH 4, 2002 Calendar and placed on final passage at this time. Bill 2001 -169 was then read third time by title and placed on final passage. Councilman Landwehr then moved that Substitute Bill 2001 -169 which was previously distributed to the Council in their March 1 Council Packets be accepted, the motion was seconded by Councilman Charles Jackson, and approved unanimously. Bill 2001 -169 was then passed, as substituted, by the following vote as Ordinance 13356: Aye: Angle, Blaney, Jackson, Landwehr, Nelson, Olsen, Viessman, Vincent, Vogel and Weber Nay: None RESOLUTIONS RS2001 -28 Annexation (Angle, Blaney, Jackson, Landwehr, Nelson, Olsen, Viessman, Vincent, Vogel, and Weber). A motion was made by Councilman Carol Blaney for adoption, seconded by Councilman Charles Jackson and approved unanimously. RS2001 -29 Discounted Memberships for City Employees at Capital Region Healthplex (Vincent). A motion was made by Councilman Carol Blaney for adoption, seconded by Councilman Charles Jackson and approved unanimously. NEW BUSINESS Councilman Cliff Olsen made comments regarding the issue of the eligibility of Fourth Ward Council Candidate Sharon Keating because of her residency in the ward. He asked City Clerk Phyllis Powell if Ms. Keating had come in and asked about her eligibility due to circumstances surrounding the purchase of a house located in the fourth ward. Ms. Powell answered that Ms. Keating had called and asked about the issue, but that she did not the answer, so she referred the question to City Counselor Allen Garner and asked fora legal opinion regarding the issue. Councilman Olsen then made further comments regarding other issues concerning City CounselorAllen Garner. Councilman Larry Vincent stated that, according to Roberts Rules of Order, he requested point of personal privilege, and made a motion for adjournment. The motion was seconded by Councilman Bob Weber. A voice vote was taken, but Councilman Cliff Olsen requested a roll -call vote on adjournment.
