HomeMy Public PortalAbout20000501REGULAR COUNCIL MEETING MAY 1, 2000 CALL TO ORDER The Regular Council Meeting of May 1, 2000, was convened at 6:00 P.M. by Mayor Tom Rackers. Prayer was offered by Rev. Steve Wilson, First Foursquare Church, followed by the Pledge of Allegiance. ROLL CAL The following Council Members were present for the roll call: Present: Angle, Blaney, Jackson, Landwehr, Nelson, Olsen, Stella, Vincent, Vogel and Weber Absent: None A quorum was declared present. ELECTION OF PLANNING & ZONING REPRESENTATIVE / ALTERNATE There were no nominations for Planning & Zoning Representative and Alternate at this time. Mayor Tom Rackers announced the election would be postponed. CONSENT AGENDA a. Minutes of April 17, 2000 (OLD) Council Meeting b. Minutes of April 17, 2000 (NEW) Council Meeting A motion was made by Councilman Carol Blaney for approval of the Consent Agenda as presented, motion was seconded by Councilman Charles Jackson, and approved unanimously MINUTES AND REPORTS RECEIVED AND FILED Mayor Tom Rackers announced that the following minutes and reports of City boards and commissions have been received, and are on file for review, by the City Clerk's Office: a. Firefighter's Retirement System, Jan. 20, 2000 b. Planning & Zoning Commission, Mar. 9, 2000 c. Financial Report for March 2000 REGULAR COUNCIL MEETING MAY 1, 2000 AT &T Cable Services Annual Report - FY1999 e. Historic Preservation Commission, Mar. 14, 2000 ANNOUNCEMENTS BY THE MAYOR Mayor Tom Rackers announced that May 1 through 7, 2000, has been declared National Public Servants' Week, and commended the City staff for their dedication and hard work to make Jefferson City a better place to live, work, and raise its families. BILLS INTRODUCED Bill 2000 -6, sponsored by Councilman Vincent, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, DECLARING CERTAIN PROPERTY AS SURPLUS AND AUTHORIZING THE DISPOSAL OF SAID PROPERTY. Bill 2000 -7, sponsored by Councilman Landwehr, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING THE PERSONNEL POLICY MANUAL OF THE CITY OF JEFFERSON BY THE ADDITION OF A NEW SECTION 14- 13, SPECIAL CIRCUMSTANCES LEAVE, NON WORK- RELATED. Councilman John Landwehr requested that the rules be suspended and Bill 2000 -7 be placed on final passage. There were no objections to the request for suspension of the rules. Councilman Clyde Angle made a motion to amend Bill 2000 -7 as follows: 1. Addition of a new Section B(5)(e) as follows: Any period employee engages in any occupation or employment for wage or profit other than with the City. Amendment to Section B(6)(e) as follows: cmploycc's normal city carnings; or the date employee engages in any occupation or employment for wage or profit other than with the City; or Amendment to Section B(5)(d) as follows: For any period of absence due to intentionally self - inflicted injuries; a war, declared or undeclared, or any act of war; the employee's active participation in a riot, rebellion or insurrection; or the employee's committing or attempting to commit an assault, felony, serious misdemeanor, or other REGULAR COUNCIL MEETING MAY 1, 2000 illegal act. Motion to amend was seconded by Councilman Cliff Olsen. Councilman Bob Weber moved to amend the motion to amend by adding language to Section B(5)(d) including such activities as "parachuting, race car driving, bungeejumping, rodeos, motorcycle riding, and other such activities." Motion was seconded by Councilman Charles Jackson. Following a discussion, several Council Members stated that, while they agreed with Councilman Weber's intention, they felt that a specific, detailed list of all activities be written so no questions would arise as to one activity over another. The motion to amend the amendment was defeated by the following roll -call vote: Aye: Angle, Jackson, Olsen, Vogel, and Weber Nay: Blaney, Landwehr, Nelson, Stella, and Vincent The original motion to amend was then approved unanimously. Bill 2000 -7 was read second and third times by title, placed on final passage and passed, as amended, by the following vote as Ordinance 13053: Aye: Angle, Blaney, Jackson, Landwehr, Nelson, Olsen, Stella, Vincent, Vogel and Weber Nay: None Bill 2000 -8, sponsored by Councilman Landwehr, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO ENTER INTO A SUPPLEMENTAL AGREEMENT WITH THE MISSOURI DEPARTMENT OF TRANSPORTATION FOR PEDESTRIAN /BICYCLE FACILITIES. BILLS PENDING Bill 2000 -1, sponsored by Councilman Landwehr, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, ACCEPTING AND APPROVING THE PLAT OF COVINGTON GARDENS SUBDIVISION, SECTION THREE, A SUBDIVISION OF THE CITY OF JEFFERSON. Bill 2000 -1 was read third time by title, placed on final passage and passed by the following vote as Ordinance 13054: Aye: Angle, Blaney, Jackson, Landwehr, Nelson, Olsen, Stella, Vincent, Vogel and Weber REGULAR COUNCIL MEETING MAY 1, 2000 Nay: None Bill 2000 -2, sponsored by Councilman Blaney, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING SECTION 19 -401, (STREETS AND HIGHWAYS), SCHEDULE (J), (PARKING PROHIBITED), SUBPARAGRAPH (A), OF THE CODE OF THE CITY OF JEFFERSON, BY THE ADDITION OF A PORTION OF SWIFTS HIGHWAY. Councilman Leonard Stella made a motion to accept substitute Bill 2000 -4 which was included in the Council Packets. Motion was seconded by Councilman Steve Nelson and approved unanimously. Bill 2000 -4 was read third time by title, placed on final passage and passed, as substituted, by the following vote as Ordinance 13057: Aye: Angle, Blaney, Jackson, Landwehr, Nelson, Olsen, Stella, Vincent, Vogel and Weber REGULAR COUNCIL MEETING MAY 1, 2000 Nay: None Bill 2000 -5, sponsored by Councilman Blaney, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AMENDMENT NO. 1 TO THE SECTION 5311 OPERATING GRANT AGREEMENT WITH THE MISSOURI HIGHWAY & TRANSPORTATION DEPARTMENT FOR PUBLIC TRANSPORTATION PROJECT. Bill 2000 -5 was read third time by title, placed on final passage and passed by the following vote as Ordinance 13058: Aye: Angle, Blaney, Jackson, Landwehr, Nelson, Olsen, Stella, Vincent, Vogel and Weber Nay: None RESOLUTIONS RS2000 -02 — Joining Mid - Missouri Regional Planning Commission (Nelson). Following a discussion in which several Council Members voiced their approval of joining the Mid - Missouri Regional Planning Commission, a motion was made by Councilman Steve Nelson for adoption of RS2000 -02. Motion was seconded by Councilman Charles Jackson and approved unanimously. NEW BUSINESS No new business was brought before the Council at this time. UNFINISHED BUSINESS Councilman Charles Jackson requested information from the Public Works Department pertaining to quarry quantities, the methodology of determining who should be party to contracts with the city, and any information which would indicate that there was at the time of bidding a joint venture between the city and the county. Councilman Jackson requested that City Administrator Rich Mays ensure that a representative from the Public Works Department is at all Council meetings in the future. Councilman Leonard Stella asked for any updated information the status of the AT &T Cable franchise agreement. City Counselor Allen Garner stated that the city is currently in the REGULAR COUNCIL MEETING MAY 1, 2000 process of setting up a group of meetings on the issue, and trying to get a final version of the agreement for the Cable Quality Commission to start working with in June. Charles Lansford, Interim Director of Planning & Code Enforcement, made announcements pertinent to the citywide annual spring cleanup. Mayor Tom Rackers reminded citizens that Census 2000 workers would be making door -to- door calls in the next few weeks and encouraged citizen cooperation and courtesy. COUNCIL LIAISON REPORTS There were no Council Liaison reports made at this time. GO INTO EXECUTIVE SESSION A motion was made by Councilman Charles Jackson that the Council go into Executive Session at this time to discuss matters pertaining to real estate, litigation and personnel. Motion was seconded by Councilman Larry Vincent, and approved unanimously at 7:45 P.M. by the following roll -call vote: Aye: Angle, Blaney, Jackson, Landwehr, Nelson, Olsen, Stella, Vincent, Vogel and Weber Nay: None
