PLANNING COMMISSION
CITY OF LYNWOOD, CALIFORNIA
THURSDAY, JUNE 15, 1989
OPENING CEREMONIES •
A. Call to order
Both the Chairperson and the Vice-Chairperson were absent, so
it was decided by informal vote of those Commissioners
present that Commissioner Pryor should act as Chairperson.
The regular meeting of the Planning Commission of the City of
Lynwood was delayed from Tuesday, June 13, 1989, because the
agenda was not posted until Monday, June 12, 1989. The
meeting was further delayed by a Personnel Board meeting held
in the Council Chambers until after 7:30 p.m. on Thursday,
June 15, 1989. The Planning Commission meeting was finally
called to order by Acting Chairperson Pryor on the above
captioned date at 7:54 p.m., in the Council Chambers of
Lynwood City Hall, 11330 Bullis Road, Lynwood, California
90262.
B. Pledae of Allegiance
Acting Chairperson Pryor led the Pledge of Allegiance.
C. Roll Call of Commissioners
Acting Chairperson Pryor requested the roll call, and
Planning Manager Fenderson complied.

Mr. Fenderson informed the Commissioners that Commissioner
Dove was committed to a prior meeting and requested an excused
absence and Commissioner Haynes had been doubtful that he
could attend.
MOTION by Commissioner Willis, SECONDED by Commissioner
Muhsin, to grant all absent Commissioners an excused absence.
MOTION carried unanimously.

Acting Chairperson Pryor asked for approval/disapproval of the
minutes of May 9, 1989.
MOTION by Commissioner Cole-Dennis, SECONDED by Commissioner
Willis, to approve the minutes of May 9, 1984. MOTION carried
by the following vote.

Mr. Fenderson introduced General Plan Interns working with the
City who attended the meeting.
CONTINUED PUBLIC HEARINGS:
1. Variance Case No. 2
10971 San Vicente Avenue (Ceneyda Reyes)
Applicant wishes to provide only three attached one-car
garages to serve three residential units rather than the
required six, plus remodeling existing front single
family home.
Staff has made many attempts to reach applicant's
consultant, with no response. Since this item has been
' continued previously, staff requests that it be removed
from the agenda.
Acting Chairperson Pryor opened the Public Hearing.
There being no one wishing to speak either in opposition
to or in favor of the proposal, he closed the Public
Hearing.

THE MUNICIPAL CODE WITH RESPECT TO PROPERTY MAINTENANCE",
finding the project exempt from the provisions of the
State CEQA Guidelines as amended by Section 15061 b(3) and
recommending that the City Council approve the findings in
Resolution 2263, waive the reading and introduce the
proposed ordinance, SECONDED by Commissioner Muhsin.

Applicant requests approval for the purpose of
consolidating four parcels into a single parcel.
Acting Chairperson Pryor opened the Public Hearing and
Olivia San Cero, 13736 Hote, La Puente, representing
applicant Vicente Preciado, rose to speak. With her was
her interpreter, Mohamed Abdul, 9692 Westwood,
Westminster, 92683. Mr. Abdul stated acceptance of all
conditions.
Mr. Barfield explained that the applicant is going to buy
and sell new/used cars and make only minor repairs
required to sell same. He stated there are no buildings
now, only empty lots.
' Mr. Barnes commented that the only question under the
Tentative Parcel Map is whether four parcels should be
combined.
Mr. Mas Explained that the four lots must be combined
because all four will be used for one business.

Applicant requests approval to operate a new/used
automobile sales and minor automobile repair service in
the C-3 zone.
Acting Chairperson Pryor opened the Public Hearing and
Olivia San Cero, 13736 Hote, La Puente, representing
applicant Vicente Preciado, rose to speak. With her was
her interpreter, Mohamed Abdul, 9692 Westwood,
Westminster, 92683.
Commissioner Cole-Dennis asked if only minor repairs would
be done, and Mr. Abdul replied affirmatively. Mr.
Barfield commented that nothing major would be permitted.
Commissioner Willis asked what percentage of new and used
cars would be sold. Mr. Barfield stated that question had
not been discussed, but the applicant does have a
dealership and cannot sell new cars without it.
Mr. Abdul stated that all conditions were acceptable and
Mr. Fenderson stated that staff will follow the progress
work.
Commissioner Muhsin asked when the applicant plans to
finish the project. Mr. Barfield replied that the
application will be null and void if no action is taken
within 120 days. Mr. Mas further explained that the
applicant has 120 days to pull the required permits. All
permits have expiration dates and if nothing is done, and
the permits are not renewed, the City can force removal of
partially built buildings.
There being no one else wishing to speak, Acting

Acting Chairperson Pryor opened the Public Hearing and W.
Chang Hone, a registered Civil Engineer representing the
applicant, 135 Waterview Street, Playa del Rey, rose to
state the appliant's acceptance of all conditions.
Mr. Mas stated that there is presently a building on the
southern two parcels and the applicant plans to
rearrange said building and add more buildings. This
hearing is just to clear the record for something that
was started four years ago and the consolidation of the
four parcels into one was missed at that time.
There being no one else wishing to speak, Acting
Chairperson Pryor closed the Public Hearing.

Mr. Mas stated the City wants the property cleaned of

The applicant, Richard Stute, 7811 Fairchild Avenue,
Canoga Park 91306, rose to state the problems he has
encountered in his attempts to have the property cleaned
and assured Mr. Mas that the property would be cleaned on
Saturday by a crew from the San Fernando Valley. He
stated the debris originates next door to his property.

STAFF COMMENTS:
Mr. Barfield discussed 85 "B" boxes and their impact on the
' General Plan.
' Mr. Fenderson gave the Commission an update on the General Plan.
He also stated a Code Enforcement officer will make a
presentation at the Planning Commission's July 11, 1989, meeting.
Mr. Mas discussed the General Plan and stated approval for same
will come before the Planning Commission later.
� Mr. B-Pessima stated staff is now working on a satisfactory
method of publication of the building permit standards as
� requested by Commissioner Cole-Dennis, and this will be presented
I to the Planning Co�nission at their July 11, 1989 meeting.
� � Mr. Mas stated that requests for staff support made by
� Commissioners will always be granted. He stated that staff is
` unconditionally at the service of the Commissioners, who may have

the Planning Commission to the City Council by Mrs: Bible. The
City Council overturned the Planning Commission's rejection and
granted the Variance, enabling Mrs. Bible to keep her overheight
fence around her property, which is fronted by a bus stop. Acting
Chairperson Pryor asked if Mrs. Bible didn't have to get a
building or some other kind of permit and Mr. Mas replied that
her particular type of fence (wrought iron) didn't reguire any
permits. Commissioner Willis stated his objections to the
newspaper coverage. Commissioner Cole-Dennis stated she was glad
Mrs. Bible was given permission to keep her fence, however, she
hadn't seen the newspaper article, only heard of it. Mr. Mas
promised to bring the article to the next meeting.
COMMISSION ORALS:
Commissioner Willis stated the northwest corner of olanda and
Atlantic is covered with debris. Mr. Mas stated the owners are
pulling building permits.
Commissioner Cole-Dennis welcomed the students to the meeting and
thanked Mr. B-Pessima for his help in her attempts to get
building permit information to the public.
Commissioner Muhsin stated as long as the City has alleyways,
they should be cleaned. Mr. Semaan stated the City is trying to
vacate alleys and therefore is not cleaning or repairing same.
Acting Chairperson kryor stated as long as the alleys are still
in existence, the City should maintain them. Mr. Semaan replied
that any particular alley will be swept if someone recommends it.
Acting Chairperson Pryor stated that the alley behind his
property was repaired and given a new curb. Mr. Mas stated that
particular alley can't be vacated by the City because it provides
necessary access.

Applicant: Joseph Chang
Proposal•
The applicant is requesting approval of a Conditional Use Permit
in order to build a two-story, five unit residential building at
11265 Louise Avenue in the R-3 (Multi-Family Residential) zone.
Facts•
The proposal is to build a two-story, five unit, complex with two
car garages for each unit, and approximately 38� landscaping and
open space.
During the public hearing on May 9, the Planning Commission
recommended the case be continued to the regularly scheduled
meeting of the June 13, in order to allow the applicant to
redesign his project, reduce the number of bedrooms per unit, and
provide additional open space.
on May 30, 1989, the applicant requested that his proposal be
continued to the regularly scheduled meeting of the Planning
Commission on July 11, 1989, in order to allow him additional
time to complete the revised plans.
On June 23, 1989, the applicant requested that his application be
cancelled (see attached).
This item was continued from the Planning Commission's regularly
scheduled meeting of June 15, 1989.
Recommendation
Since the applicant has requested that his application be
cancelled, staff respectfully request that after consideration,
the Planning Commission remove this item from the Agenda.

PROPOSAL
The applicant is requesting approval of a Conditional Use Permit
to develop one two-story duplex and one two-story dwelling unit
at 11311 Louise Avenue, in the R-3 (Multi-Family Residential)
zone.
FACTS:
1. Source of Authority
Section 25-4.2 of the Lynwood Zoning Ordinance requires that
a Conditional Use Permit be obtained in order to build or
relocate dwelling units in the R-3 zone.
2. Property Location
The subject property is a rectangular lot that is located
along Louise Avenue between Martin Luther King Jr. Blvd. and
Sanborn Avenue (see attached Location Map).
3. Property Size
The property is measured at forty five (45') feet wide and
two hundred and sixty four (264') deep with an area of
approximatley eleven thousand eight hundred and eighty
(11,880) square feet.
4. Existing Land Use
The property is presently developed with a single family
house. The surrounding land uses comprise of high density
residential developments and are as follows:
North - Multi-Family Residential
South - Multi-Family Residential
East - Multi-Family Residential
West .- Multi-Family Residential
5. Land Use Description
The General Plan designation for the subject property is
Multi-Family and the zoning classification is R-3 with the
following surrounding land uses.

6. Project Characteristics
' In addition to the existing single family house, the
applicant proposes to build three two-beilroom uaits
comprising of a one two-story duplex and one two-story
dwelling unit. In all three two-car garages and two open
parking spaces will be grovided. For each of the units the
living room, dining area, kitchen and one half bath will be
located on the first floor while two bedrooms and two full
baths will be provided on the second floor . Approximately

ANALYSIS AND CONCLUSION
1. Consistencv with General Plan
The property is consistent with the existing zoning
classification (R-3) and the General Plan designation (Multi-
Family). Therefore, granting Conditional Use Permit No. 13
will not adversely affect the Lynwood General Plan.
2. Site Suitability
The property is adequate in size and shape to accommodate the
proposed development relative to density, bulk of the
structures, parking, walls, fences, landscaping, driveways
and other development features required by the Zoning
Ordinance.
The property is adeguately served with the required public
utilities and offers adequate vehicular and pedestrian
accessiblity.
3. Compatibility
The proposed development is surrounded by high density
residential developments. Therefore, the project will be
compatible with developments in the area.
4. Compliance with Development Standards
The proposal meets all of the development standards required
by the Zoning Ordinance with respect to parking; front,
side, and rear-yard setbacks; distance between structures;
lot coverage; open space and landscaping; building height;
unit si2e and density.

The improvements as proposed, subject to the conditions
i recommended by the Site Plan Review Committee, would neither have
a negative effect nor would it interfere with the values of the

6. Benefits to Community
The proposed development will aid to aesthetically upgrade the
neighborhood and act as a catalyst in fostering other quality
developments. Furthermore, it will add favorably to the City's
housing stock and provide additional affordably-priced housing in
furtherance of the policies of the Housing Element of the General
Plan.
7. Environmental Assessment
According,to State CEQA Guidelines, the project is Categorically
Exempt. The Exemption has been prepared and is on file in the
Community Development Department and the Office of the City
Clerk.

RESOLUTION NO. 2277
A RESOLUTION OF THE PLANNING COMMISSION OF TAE
CITY OF LYNWOOD APPROVING CONDITIONAL USE
PERMIT (CUP) N0.13 TO CONSTRUCT ONE TWO-STORY
DUPLEX AND ONE TWO-STORY DWELLING UNIT IN R-3
MULTI-FAMILY RESIDENTIAL) AT 11311 LOUISE
AVENUE, LYNWOOD, CALIFORNIA, 90262.
WHEREAS, the Lynwood Planning Commission, pursuant to law,
conducted a public hearing on subject application for a Conditional
Use Permit; and
WHEREAS, the Planning Commission carefully considered all
pertinent testimony offered at the public hearing; and
WHEREAS, the Community Development Director has determined that
the proposal is exempt from the provisions of the State CEQA
Guidelines Section 15061 b(3), as Amended; and
WHEREAS, the site is located in the R-3 (Multi-Family
Residential) zone, subject to the granting of a Conditional Use
Permit.
Section 1. The Planning Commission hereby finds and determines
as follows:
A. The site of the proposed use is adequate in size and shape
to accommodate the structures, parking, walls, landscaping,
driveways and other development features required by the
Zoning Ordinance.
B. The granting of the proposed Conditional Use Permit will
not adversely affect the Lynwood General Plan.
C. The structures as proposed, or modified, subject to
conditions, will not have a negative effect on the values
of surrounding properties or interfere with or endanger the
public health, safety or welfare.
D. The site will be developed pursuant to the current zoning
regulations and site plan submitted, reviewed and approved
by the Site Plan Review Committee.
E. The proposed development will add favorably to the housing
stock and will provide additional affordably priced housing
in concert with the policies of the Housing Element of the
General Plan.
� F. The proposed development will aid in aesthetically
I upgrading the area and will act as a catalyst in fostering
� other quality developments.

, Section 2. The Planning Commission of the City of Lynwood,
� based upon the aforementioned findings and determinations, hereby
� approves Conditional Use Permit, Case No. CUP 13, provided the
� following conditions are observed and complied with at all times.

COMMUNITY DEVELOPMENT DEPARTMENT CONDITIONS
1. The applicant shall meet the requirements of all other City
Departments.
2. The applicant or his representative, shall sign a Statement
of Acceptance within fifteen (15) days from the date of
approval of this Resolution by the Planning Commission.
Signing this statement implies that applicant or his
representative has read, understands and agrees to the
conditions of this Resolution.
3. All City of Lynwood Municipal Code and Zoning Ordinance
requirements shall be met.
4. The total development will consist of two (2) two-story
buildings each to comprise of two bedroom duplex and a two
dwelling unit with parking and other amenities
5. A minimum of three (3) two-car garages shall be provided
along with two open parking spaces.
6. A minimum of twenty-five percent (25�) of the lot shall be
landscaped and provided with an automatic irrigation system.
7. Street numbers for the new buildings shall be plainly
visible, shall be a minimum of four inches (4") in height
and contrasting in color to the background.
8. All construction shall be performed by a licensed contractor.
9. A landscape plan shall be submitted and approved prior to
the issuance of building permits.
10. No principal building on the site shall exceed a height of
thirty-five (35') feet.
11. Construction shall be completed within six (6) months from
date of issuance of building permits.
12. The
Conditional Use Permit shall become null and void if
compliance under the foregoing conditions does not commence
within ninety (90) days from the date on which the
Conditional Use Permit was granted.
13. A masonry wall six feet (6') in height shall be constructed
along the perimeter of the property, except within the
twenty foot (20') front yard setback, which shall not exceed
four feet (4') in height. Construction of a fence in the
front yard set-back is optional (not required).
14. Being that the property is located close to a freeway,
� accoustical construction materials shall be used throughout
the units to mitigate freeway noise to the standards and
'I satisfaction of the Building and Safety Division.

� 15. Final building elevations, including materials of
� construction, shall be submitted to and approved by the
i Building Official prior to issuance of any building permits.

} 16. Before any building permits are issued, the
�' applicant/developer shall pay $1.53 per square foot for
-P=.;,�.ent�?1 huii�ings to the Lynwood Unified School
District, pursuant to Government Code Section 53080.
�� PUBLIC WORKS/ENGINEERING CONDITIONS
17. Submit a copy of property deed or recent title report to the
Department of Public Works.
18. Submit a grading plan prepared and signed by a registered
Civil Engineer. Property is located within the 100 year
flood zone area. Pad elevations shall be 1 foot above flood
level zone per flood boundary map. Also conform to all
applicable codes per Section 12 1/2 of Lynwood Municipal
Code. Building above flood level will require substantial
amount of fill, therefore, suggest alternative methods of
design to minimize amount of livable space at ground level.
29. Construct 24" wide qutter and asphalt pavement along
property frontage on Louise Avenue.
20. Reconstruct damaged and substandard drive approach (es), per
City standards.
21. Construct two (2) wheelchair ramp (s) at northwest corner of
Louise/Sanborn and southwest corner of Louise/Sanborn.
22. Proposed driveway shall be realigned so that the top 'X' is
located one foot inside the property line.
• 23. Connect to public sewer. Each building shall be connected
separately to the main sewer line. It may be advantageous
to construct an 8 inch sewer main line into the property.
Contact the Engineering Division for more details.
24. Provide and install one marbelite street pole with light
fixture, underground services and conduits.
25. Underground all utilities.
26. Underground existing utilities if any modifications are
proposed for the electrical service panel.
27. A permit from the Engineering Division is required for all
off-site improvements.
28. All required water meters, meter service changes and/or fire
protection lines shall be installed by the developer. The
work shall be performed by a licensed contractor hired by
the developer. The contractor must obtain a permit from the
Public Works/Engineering Division prior to performing any
work.
29. Because the property is in the "old" and "new" flood zone,
the development has to meet the old flood zone requirements.
30. Property owner(s) has the option of ineeting the new flood
I zone requirements or sign the "Hold Harmless" Agreement with
the City of Lynwood, and build the pad one foot above the
I 100 year flood level.

31. If security bars are placed on bedroom windows, at least one
window for each bedroom shall have quick release mechanisms
that do not require a key or any special knowledge.

PROPOSAL:
The applicant is requesting approval of a Conditianal Use Permit
�to develop two, two story residential buildings at 11168 Louise
Avenue, in the R-3 (Multi-Family Residenti.sl) zone.
FACTS:
The applicant is proposing to develop two, two (2) story detached
residential dwelling units with attached two car garages. Each
dwelling unit will consist of two bedrooms, living and dining
areas, kitchen, two baths, and private open space.
Staff, upon recommendation of the Site Plan Review Committee,
recommends approval of the proposal provided that the plans be
revised to address the issues of useable open space and
landscaping, and relocation of the laundry facility.
On June 27, 1989, the applicant requested a continuation of this
item to allow for revision of his plans.
RECOMMENDATION:
Staff respectfully request that, after consideration, the I
Planning Commission continue Conditional Use Permit, Case No. 15
(CUP 15) to its reqularly scheduled meeting on August 8, 1989. I
