Comments The City Council directed the City Attorney to revamp the existing ordinance with respect to establishments selling alcoholic beverages in the City. Recommendation Staff respectfully request that, after consideration, the � Planning Commission adopt the atttached Resolution No. 2175: a. CONTINUED PUBLIC HEARZNGS 1. Conditional Use Permit No. 87106 Applicant is requesting a Conditional Use Permit to operate a business to repair and install automobile alarms, assemble push carts, and perform minor automobile repairs. It was established that Mr. Osorio would not do any welding at the site. Chairperson Kanka opened the Public Hearing and asked for comments from Mr. Osorio. Mr. Antonio Osorio, father of Eric Osorio, rose to represent his son. He gave his address as 625 S. Spring Street, Los Angeles. He stated that his son accepts all conditions. There being no one else wishing to speak for or against the proposal, Chairperson Kanka closed the Public Hearing. t•1r. Barnes stated that the conditions have not been'modified to allow assembly of push carts; that was not necessary because push cart assembly would be a permitted use. Mr. Barnes advised that the word "solely" in Condition No. 5 should be deleted and that condition amended to include push cart assembly. MOTION made by Commissioner Penalber, SECONDED by Commissioner Pryor, to amend Condition No. 5 to include, "and assemble push carts," and delete the word "soley." MOTION carried by the following vote: AYES: Commissioners Kanka, Penalber, Pryor, Willis NOES: None ABSENT: Commissioners Cole-Dennis, Dove ABSTAIN: None ' Commissioner Penalber reminded the Commission that he had requested that the hours of operation be limited, and that Mr. Osorio had agreed to said limitation. Mr. Barnes stated this could be done. Dorethea Tilford stated the City Code limits the hours of � operation from 7:00 a.m. to 9:00 p.m. Mr. Karefa-Johnson stated the hours of operation were covered under Condition No. 12. Mr. Osorio, from the audience, stated the hours could be limited from 8:00 a.m. to 7:00 p.m. without any hardship to him and his family. He reminded the Commission that he also wants to do minor automobile repairs. Chairperson Kanka asked if another amendment would be required to permit minor automobile repairs.and Mr. Barnes stated Condition No. 5 could be amended further to include minor electrical repairs. Commissioner Willis asked Mr. Osorio to define "electrical repairs." t�r. Osorio responded that he had written a letter, (Attachment A) which listed, under Item No. 1, minor auto repair as alternator, generator and electrical systems." Commissioner Willis then suggested that Condition No. 5 should be amended to delete "solely," and add, "minor electrical auto repairs, the assembly of push carts, and installation of electrical alarms." Tentative Parcel Map - Case No. 88002 11170 Long Beach Boulevard (McDonald Corp.) Applicant is requesting Tentative Parcel Map approval to consolidate seven and one-third (7-1/3) parcels into one, to build a restaurant. Chairperson Kanka opened the Public Hearing and Fred Encinas, Real Estate Officer for McDOnald Corporation, 10960 Ptilshire Blvd., Los Angeles, 90024-3786, rose to speak. He introduced their construction representative, Danny Cervantes, at the same address. Mr. Encinas questioned Condition No. 17 and James Devore insisted that the gutter and asphalt pavement be constructed. Mr. Encinas then questioned Condition No. 20 and Mr. Devore stated that this is required only if work is planned near those trees. � DISK M1:Minutes 3 I Condition No. 23,. relocating ficus and palm trees, caused a discussion between Mr. Encinas, Mr. Devore and Mr. Karefa- Johnson, with the City wanting trees saved, and McDonald Corporation wanting them removed. Mr. Layton Hull, owner of the McDonald's on Atlantic and Agnes Avenues, Lynwood, rose to say he will be the operator of the new McDonald's Restaurant and the restaurant on Atlantic just won an award. He suggested letting the landscape architect decide what to do about the trees. Mr. . Devore insisted that the trees should be removed and suggested that they .be relocated to Lindberg Park, if McDOnald's Corporation does not want them. Mr. Karefa- Johnson agreed with Mr. Devore. Russell Blackstone, 6464 Sunset Boulevard, Los Angeles, California, 90208, rose to discuss Condition No. 20 and James Devore reiterated that this condition would not have to be followed, unless McDonald Corporation performs work on the area of the trees. Condition No. 25 was questioned by Mr. Encinas, Mr. Devore - explained and it was then accepted by the applicant. It was decided that all of the conditions will stay as they are, and McDonald Corporation will work with staff to resolve them. Chairperson Kanka asked if anyone in the audience wanted to speak either for or against the proposal. There being no one, Chairperson Kanka closed the Public Hearing. MOTZON by Commissioner Pryor, SECONDED by Commissioner Penalber, to approve "A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LYNWOOD APPROVING TENTATIVE PARCEL MAP N0. 19519 TO COMBINE LOTS 171, 172, 173, 174, 175, 176, 178 AND PART OF 170, TRACT N0. 2551 M.B. 24-78-80 IN THE OFFICE OF THE LOS ANGELES COUNTY RECORDER, COMMONLY KNOWN AS 11170 LONG BEACH BOULEVARD, LYNWOOD, CALIFORNIA," and to find that said Parcel Map will not have a significant effect on the environment and certify the Negative Declaration as adequate. Zoning Ordinance Amendment - Case No. 88006 (Density Bonus) Ms. Tilford presented the staff report, indicating as follows: The proposed amendment is to modify existinq density bonus/incentives to allow density bonuses of only twenty-five (25�) percent above basic density in multiple-family residential zones. The proposed amendment would repeal the density bonus for large lot developments, and restate and modify those provisions for a density bonus relating to affordable housing for low and moderate income households, including senior citizens. DISK P91:Minutes 4 The proposed amendment would decrease the density bonus in the Lynwood Municipal Code for low and moderate income households from thirty (308) percent to twenty-five (25$) as required by State law. Chairperson Kanka opened the PubTic Hearing and asked if anyone wished to speak for or against the proposed Zoning Ordinance Amendment. There being no one, Chairperson Kanka closed the Public Hearing. Commissioners Pryor and Penalber asked staff for a more complete explanation and Dorethea Tilford complied. . Basically, the City of Lynwood is coming into conformance with state requirements, the Deputy General Counsel replied. Mr. Barnes explained that the present 308 would be eliminated, only 25� would be available for multiple-unit builders. MOTION by Commissioner Penalber, SECONDED by Commissioner Pryor, to find that the proposed amendment is exempt from the provisions of the State CE4A Guidelines, as amended, and recommended that the City Council approve RESOLUTION N0. 2171, "A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LYNWOOD RECOMMENDING CITY COUNCIL ADOPTION OF AN AMENDMENT TO CHAPTER 25, THE OFFICIAL ZONING ORDINANCE OF THE LYNWOOD MUNICIPAL CODE, WZTH RESPECT TO DENSITY BONUSES IN THE MULTIPLE FAMILY RESIDENTIAL ZONES." MOTION carried by the following vote: AYES: Commissioners Kanka, Penalber, Pryor, Willis NOES: None ABSENT: Commissioners Cole-Dennis, Dove ABSTAIN: None NEW PUBLIC HEARZNGS 4. Tentative Parcel Map - Case No. 88007 12017 Atlantic Avenue (Leonel and Maria Vasquez) Applicant requests Tentative Parcel Map approval to consolidate two (2) parcels into one to build a commercial structure at 12017 South Atlantic Avenue in the CB-1 zone. Chairperson Kanka opened the Public Hearing and found the applicant was not present. Doug Barnes stated that, legally, the applicant doesn't have to be present but he recommended that a negative response should be presumed of any questions the Commission would have asked. There being no one wishing to speak for or against the proposal, Chairperson Kanka closed the Public Hearing. Zoning Ordinance Amendment - Case No. 88008 Helistops Mr. Carter reported that staff prepared this zoning ordinance amendment to establish regulations to allow helistops in the C2, C2A, C3, H-M-D and CF zones of Lynwood. Both the Lynwood Regional Justice Center and St. Francis Medical Center wish to establish helistops in connection with planned construction of new facilities. No refueling, repairs, or maintenance of the helistops will be permitted onsite. Chairperson Kanka opened the Public Hearing. There being no one wishing to speak either for or against the proposed • regulations concerning helistops, she closed the Public Hearing. P1r. Karefa-JOhnson stated that the proposed regulations are not for any specific case and that staff is preparing general rUles so as to be prepared when specific cases come before the City. At this time, the City has no ordinance to regulate helistops. He further stated that SCAG, Caltrans, the League of California Cities and governmental offices in Sacramento were contacted for input. Staff also witnessed a helistop demonstration in Orange County. MOTION by Commissioner Pryor, SECONDED by Commissioner Penalber, to find that the proposed amendment is exempt from the provisions of the State CEQA Guidelines and adopt RESOLUTION N0. 2174, "A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LYNWOOD RECOMMENDING CITY COUNCIL ADOPTION OF AN AMENDMENT TO SECTION 25 OF THE LYNWOOD MUNICIPAL CODE RELATIVE TO THE PLACEMENT AND CONSTRUCTION OF HELISTOPS WZTHIN THE CITY." MOTZON carried by the following vote: AYES: Commissioners Kanka, Penalber, Pryor, Willis NOES: None ABSENT: Commissioners Cole-Dennis, Dove ABSTAIN: None 6. Conditional Use Permit - Case No. 88012 3532 Los Flroes Blvd. (Herbert Thomas) Mr. Carter presented the staff report� indicating as follows: The applicant is requesting a Conditional Use Permit to build four apartments at the subject address in the R-3 (MUltiple- Family) zone. Because the street is of substandard width, with parking presently permitted on one side only, the applicant must provide extra parking space.
