HomeMy Public PortalAboutOrd 1695 - Rezoning - 08/12/2019ORDINANCE NO. 1695 AN ORDINANCE OF THE CITY OF CRESTVIEW, FLORIDA, PROVIDING FOR THE REZONING OF 6.5 ACRES, MORE OR LESS, OF REAL PROPERTY, LOCATED IN SECTION 28, TOWNSHIP 3 NORTH, RANGE 23 WEST, FROM THE OKALOOSA COUNTY MIXED -USE (MU) ZONING DISTRICT TO THE SINGLE OR MULTI -FAMILY DWELLING DISTRICT ZONING (R-2); PROVIDING FOR AUTHORITY; PROVIDING FOR THE UPDATING OF TIIE CRESTVIEW ZONING MAP; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF CRESTVIEW, FLORIDA AS FOLLOWS: SECTION 1. AUTHORITY. The authority for enactment of this ordinance is Section 166.041, Florida Statutes and Chapter 102, City Code. SECTION 2. PROPERTY REZONED. The following described 6.5 acres, more or less, of real property lying within the corporate limits of Crestview, Florida, with 6.5acres, more or less, being formerly zoned Okaloosa County Mixed -Use (MU) with the High Density Residential (IIDR) Future Land Use Map designation recently ratified by the Florida Department of Economic Opportunity, is hereby rezoned to the Single or Multi -Family Dwelling District Zoning (R-2) to wit: PIN # 28-3N-23-0000-0012-0010 A PARCEL OF LAND SITUATED IN SECTION 28, TOWNSHIP 3 NORTH, RANGE 23 WEST, OKALOOSA COUNTY, FLORIDA; BEING A PORTION OF THE NORTH HALF OF THE SOUTHWEST QUARTER OF THE NORTHWEST QUARTER THEREOF, AS DESCRIBED IN OFFICIAL RECORDS BOOK 2937, PAGE 478, OF THE PUBLIC RECORDS OF OKALOOSA COUNTY, FLORIDA; AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: BEGINNING AT TIIE NORTHWEST CORNER OF THE SOUTHWEST QUARTER OF THE NORTHWEST QUARTER PROCEDD S. 88°21'32" E. ALONG THE NORTH LINE OF AFORESAID NORTH HALF FOR A DISTANCE OF 575.00 FEET; THENCE DEPARTING SAID NORTH LINE PROCEED S. 01°58'18" W. FOR A DISTANCE OF 506.13 FEET; TIIENCE PROCEED N. 88°22'49" W. FOR A DISTANCE OF 577.09 FEET TO THE WEST LINE OF AFORESAID SECTION 28; TIIENCE PROCEED N. 02°12'29" E. ALONG SAID WEST LINE FOR A DISTANCE OF 506.36 FEET TO TIIE POINT OF BEGINNING. SECTION 3. MAP UPDATE. The Crestview Zoning Map, current edition, is hereby amended to reflect the above changes concurrent with passage of this ordinance. SECTION 4. SEVERABH,ITY. If any word, phrase, clause, paragraph, section or provision of this ordinance or the application thereof to any person or circumstance is held invalid or unconstitutional, such finding shall not affect the other provisions or applications of the ordinance which can be given effect without the invalid or unconstitutional provisions of this ordinance are declared severable. SECTION 5. EFFECTIVE DATE. The effective date of this Ordinance shall be the date Comprehensive Plan Amendment Cycle 19-0-1ESR adopted by Ordinance # 1691 becomes legally effective.
