The City Council of the City of Lyne~ood met in an adjourned regular session, in the Council Chamber of the City Hall, 11331 Plaza Street, on above date, at 7:30 P. P,h. TJla,yor Lake in the chair. Councilmen Nation, Christensen, r4eyer, Snyder and Lake answer- ed the roll call. It was moved by Councilman "Beyer and seconded by Councilman Christensen that the minutes of the previous regular meeting of August 15th, 1939 be approved as written. All members of the Council voting aye, the T4'Ic,.~~ or declared the motion duly carried and it :eras so ordered. Councilman Nation addressed the Council to the effect that City Judge Hemmen~ray is on his vacation, suggesting that the City Attor- ney be appointed to fill the position until his return. Theref ore, it ~x~as moved by Councilman Nation and seconded by Councilman Snyder that City Attorney Ruby be appointed as City Judge to preside during the absence of Judge Hemmenway, without compensation therefor, excepting that received as City Attorney. Roll Call: Ayes: Councilmen Nation, Christensen, Tv2eyer, Snyder and Lake. Noes: None It vaas moved by Councilman Snyder and_ seconded by Councilman P1[eyer that T~Zrs. Corning be employed temporarily to take care of Court Clerk duties and Matron service during the vacation of Mrs. VUanamaker, at salary of X50.00 for the two weeks' period. WRITTEN COTJiTtNNICATIONS: A communication was received from the Southern California Con- ference of Seventh-d_ay Adventists thanking- for the co-operation of the officials of the City of Lynwood in connection with their building pro- ~ect and school, presenting a Resolution which v~ras unanimously adopted by the delegates present at their last meeting Sunday August 13th, thank- in~ the City for their courtesy to them. There being ne ob,jection, said communication was ordered filed. A communication was received from the Lyn«?ood Assessment Relief Cor~ooration commending the City Council for their co-operation in per- mitting Chas. C. Reed and Robert A. T:.Ioffitt to help the Board of Direc- tors to handle the r~7attoon Bonds kno~jm as A. & I. Dist . No. 19, and ,thanking P.2r . T,4of f it t and P.~r . Reed for the excellent work performed . A communication was also received from T~tiss Camilla I. Kendall expressing appreciation for the honest and successful efforts in liq- udating the bonded indebtedness knov~rn as A. & T. Dints. i~1o. 4 and 7. There being no objection, said communications were ordered filed. A communication was received from Diehl and Edwards, by W. R. Wright making application to d_o the audit for the fiscal year 1939-40 for sum of X800.00, payable X200.00 quarterly, the first three quarterly audit reports to be in condensed form, and the fourth and final quarter to be reported in detail as reretofore. Thereupon it tin:as moved by Councilman Snyder and seconded by Councilman Tvat'_on that the City of Lynwood engage Diehl and Edwards, C. P. A.'s, to do the City auditing for the fiscal year 1939-40, for the sum of ~~800.00 per year. Roll Call: Ayes: Councilmen ~iation, Christensen, T~Ze~-er, Snyder and Lake. Noes: None. A communication was received in the form of petition objecting to the noise that emanates from the roller skating rink on Minnesota Aven- ue on account of a loud speaker that is too loud, making it difficult for residents in the immediate vicinity to sleep and study. mayor Lake ordered the communication filed, stating that he will check into the matter and_ see if the matter can be properly adjusted. Demands were received from H. L. Byram, County Tax Collector to provide funds for the payment of all delinquent assessment for a.ll proiects in the City under the Improvement Band Act of 1915, giving list of districts and delinquency of each, said communications bein~~ dated August ?, 1939. There being no objection, said communications °~:ere ordered filed and no further action was taken in connection therewith. 33 A communication was received from the Municipal Fiscal Offi- cers of Southern California, urging the Councilmen to place the opp~r- tunity for the Fisc~.l Officers to attend the League of California Municipalities' Annual Convention in Oakland between September 18th to 21st, inclusive.. After due consideration of the matter, it was agreed to provide expense money for Councilman h:~eyer, City Treasurer and the City Clerk to attend, they to keep an account of costs and present bill. At this time r~.4a~,ror Lake requested the City Clerk to adminis- ter the Oath of Office to Chas. A. Ruby, temporary Judge, which the City Glerk did, whereupon.he was inducted into office. A communication was received from the Housing Authority of the County of Los Angeles announcing a groundbreaking ceremoney for its first low-cost housing project on Saturday, August 26th, at 2. P. M. There being no objection, said communication was .ordered filed. A communication was received signed by Mrs. Chas. Brownell under date of August 23, 1939 to the effect that they paid assessment No. 7 on the East 59.31 feet of Lot 139, Tract 2551 twice, therfore making application for refundfin the amount of X37.78. Thereupon it was moved by Councilman ~"~?eyes and seconded by Councilman Christensen that refund be made as requested and that the City Treasurer be authorized to pay same from the Bond Redemption Fund. Roll Call: Ayes: Councilman Nation, Christensen, Meyer, Sndyer and Lake. Noes: None. A communication was received from L. H. Stewart reporting on the application for reduction of lighting rate covering street lights to tr_e effect that no decision has been. reached by the Rail- road Commission of the State of California, however, that they might expect a decision in the case within the next few weeks. There being no objection, said communication was ardered.filed. A communication was received from the Pacific Coast Associa- tion.of Fire Chief's announcing their 46th Annual Conference & School on September 18th and 19th. After due consideration of the matter, it was duly moved by Councilman Snyder and. seconded by Councilman PJleyer that the Fire Chief be allowed expense money to attend said con- vention, the amount not to exceed the amount allotted last year. Noes: None The City Clerk presented his annual statement of receipts and disbursements and fund balance for fiscal year beginrii~ July 1, 1938-and ending June 30, 1939, as shown on the Records of the City of Lynwood, all as required by law. It was moved by Councilman Pdeyer and seconded by Councilman Nation that same be accepted and filed. All' members of the Council votin.M aye, the I~'fa.yor declared the motion duly carried and it was so ordered. An application was received from Charles Shrader for employ- ment, also health report. There being no ob~eetion, the Mayor order- ed same filed. City Treasurer Reed addressed the Council to the effect that Mr. Murphy who holds 1915 bonds in District "Q" which are held in Trust for the benefit of a hospital, has offered to waive all interest which is back 4 years, if the principal in the amount of X3,000.00 is paid at par. Mr. Reed stating that Mr. P~~urphy has been very cooperative in surrendering his personal bonds with a substantial discount as high as 50~, therefore he would recommend that these bonds be purchased as they are trust funds, payment to be made from the Special Assessment Tax and Relief Fund in which fund there is money available. Thereupon it was moved by Councilman Snyder and seconded by Councilman Meyer that the City Treasurer be authorized to purchase said bonds from Thomas C. P~iurphy for ~~ ,000.00 to .be paid from said funds. Roll Call: Ayes: Councilmen Nation, Christensen Pvteyer, Snyder and Lake. Noes: None. City Treasurer Reed requested th Council to ratify his actions in connection with the expenditure of funds from the Special Assessment and Tax Relief Fund. After due consideration of the matter, it was duly moved by Councilman Nation and seconded by Councilman I"~eyer that the disburse- ments of funds, transfer of funds, redemption of bonds and purchase of bonds by the City Treasurer from the Special Assessment Tax and Relief Fund be ratified by the City Council of .the City of Lynwood. Roll Call: Ayes: Councilmen Nation, Christensen Meyer, Snyder ~.nd Lake Floes : None. ORAL COMT~IUNICATIONS: Mr. G. E. olbrook addressed the Council regarding stray doffs and whether or not anything has been done to eliminate same. Pdayor Lake sta.t~i. that the Council have instructed the City Attorney to draft a suitable ordinance to take care of the situation. Mr. Holbrook also spoke about the nuisances that existed in his district and stated that while some improvements have been made, however, more are needed. n,4ayor Lake stated that he would. look into the matter further. UNFINISHED BUSINESS: communication was received from D. W. Golfelt, Area Criief of the Health Department of Los Angeles County, stating tr~,t trey had reinspected the Palomar District, stating- that they now find the sani- tary.eondition corrected. There being no obeection, said communication was ordered filed. The matter of the proposed purchase of Lot 492, Tract 2551 for the purpose of opening California Street was discussed. P~gr. Moffitt stating that T4rrs. Tatom, the owner thereof, has offered same for X400. After due considerat`on of the matter, same was postponed until the City Engineer returns to ascertain treat a definite deal is made in connection with the other lot needed. An opinion was received from City Attorney with regard to the proposed purchase of afire engine, to the effect that he finds no provision that requires the advertisement for bids for t'r_e purchase of Fire and Police equipment, hovaever, that Section 865 of the P:2uni- cipal Corporation Act provides that the City Gouncil shall not incur any indebtedness or liability in any manner which exceeds in any year the income and revenue provided for such year, without the assent of two-girds of the qualified electors. There being no objection, said communication was ordered filed. An Agreement was received from the Southern California Edison Conpany in connection with furnishing electric energy for the purpose of illuminating the Street lighting sSTstem in the City of Lynv~rood. Noes: None. . Grant of Easement coverir~ the Westerly 5 feet of Lot 380, Tract 2551, signed by Nicholas K. Va.siliou and i:2ary Vasiliou, was re- ceived, said easement being dated August 29, 1939. Thereupon it was moved by Councilman Snyder and seconded by Councilman Iv7eyer that said easement be accepted and that the City Clerk be directed to cause same to be recorded in t'r_e County Recorder's office of Lot Angeles County, All members of the Council voting aye, the I~~Zayor declared the motion duly carried. AGREEP:ZENT ~~'aiving Violation of Restrictions as affecting Lot 380, Tract 2551, whereby the City of Lynwcod agrees to a violation of the condition as to the purchase, sale and keeping for sale, of intox- icating liquors thereon. A epmmunication was received from City Treasurer Reed, reading ,,,~ as follows "For the past nine years it has been my privilege to serve the people of Lynwood as their City Treasurer. My original employment was predic~.ted upon a sincere desire to effect a solution to the ~ecial Assessment problem which confronted the City. Now the time has come when the problem nears solution and I feel that the reconstruction work which has been started can be completed by those who are now iden- tified with the City. Therefore, I desire to accept an appointment which has been offered me with the State of California. This new employ- ment will provide me with an opportunity to enlarge my public service and at the same time hold a better promise for personal advancement. "It is with a feeling of sincere regret that I sever my offi- cial relationship with your Honorable Body and leave the many friends whom it has been my privilege to be closely associated with in the .City Hall. "In harmony with the thoughts abo~Te expressed., I do hereby resign as City Treasurer of the City of Lynwood. . Respectfully, Ghas. C. Reed City Treasurer". Thereupon it was moved by Councilman Nation and seconded by Councilman Meyer that said. resignation be accepted with regrets. Roll Call: Ayes: Councilmen Nation, Christensen, Meyer, Snyder and Lake. Mayor Lake expressed his appreciation for the splendid cooper- ation that they had always received from the City Treasurer and for the • service that he has rendered far the benefit of the City of Lynwood, commenting that City Treasurer Reed has made a name for himself and for the City as a leading City Treasurer of the State on account of the leadership that he has given to the Fiscal Officers of the State League of Municipalities and for his leadership in other organizations as well. Councilman Nation also expressed his appreciation to Mr. Reed for the services that he has rendered in helping to liquidate the Mattoon Aet debt, stating that the advice that he has given to the Coun- cil in such matters was invaluable. Councilman Snyder also expressed his sentiments regarding the services rendered by Mr. Reed to the effect that he always had the ut- most confidence in the administration of City affairs on account of '' such fine leadership as was displayed by Mr. Reed and other officers as well. Mr. Snyder stated that Mr. Reed has always given his hearty support to the City Council and_ they appreciate it very much. Mr. W. R. Wright, Auditor, also addressed the Council to the ' effect that in auditing R1Ir. Reed's books he had never found any trans- a.etions th at looked even questionable, but that his record has always been clear. PJir. Reed reiterated his appreciation to the City Council for the splendid co-operation that he has received from them as well as the confidence that they have in him, stating that the relationship that has existed has been a most pleasant one. It was moved by Councilman Snyder and seconded by Councilman Christensen that the salary of P,~r. P.~Zoffitt as Special Counsel in the sum of 200.00 per month be discontinued. Roll Call: Ayes: Councilmen Nation, Christensen, T~geyer, Snyder and Lake. Noes: None. Thereupon it was moved by Councilman Nation and seconded by Councilman Snyder that iJfr. Robert A. r~aoffitt be appointed City Treasurer of the City of Lynwood at a salary of X200.00 per month, subject to a bond as required by law. Roll Call: Ayes: Councilmen Nation, Christensen, IvZeyer, Snyder and Lake. Noes: None. Thereupon a bc:~r~d in the principal sum of $15,000 covering I~Ir. Moffitt as City Treasurer was received. There being no objection, the Mayor referred said_ bond to the City Attorney for checking. Thereupon it was .~aoved by Councilman Christensen and seconded By Councilman Jleyer that the salary of Alice Converse be increased from X100.00 per month to X120.00 p?r month. Specifications and proposed contract for the purchase of a new fire engine for the Fire I~artment, was received from the Seagrave Corroration calling for a total consideration of X9,609.85, in payments as stated therein, said price based on F. 0. B. Columbus, Ohio. Thereupon it ~Fras moved by Councilman Snyder and seconded by Councilman Christensen that said_ proposal be accepted and that the City purchase a. new Fire Truck for a total consideration of X9609.85 in Payments as specified in the proposed contract, a.nd that the I~'Iayor be authorized to execute said contract for a.nd on behalf of the City of Lynwood. It was moved by Councilman Snyder and seconded by Councilman Meyer that the City purchase 1000 feet of 21f fire hose at 64~ per foot, and 200 feet of l~" hose at 44~G, including rocker lug attachments.
