HomeMy Public PortalAboutM 1940-02-06 - CC~~ REGULAR MEETING FEBRUARY 6, 1940 The City Council of the City of Lynwood met in a regular ses- sion in the Council Chamber of the City Hall, 11331 Plaza Street, on above date, at 7:30 P.M. Mayor Lake in the chair. Councilmen Christensen, Meyer, Snyder and Lake answered the roll call. Councilman Nation was absent. It .was moved by Councilman Christensen and seconded by Council- man Meyer that the minutes of the previous regular meeting of January 16, 1940 be approved as written. All members~of the Council present voting aye, the Mayor declared the motion duly carried and it was so ordered. WRITTEN COMMUNICATIONS: A communication was received from C. C, Koehler & Co. calling attention to a nuisance adJoining the tract of land an which he is build- ing located on Washington Street and Pine Avenues, between Tweedy-Abbott and Pendelton in Tract 10269, in the form of a cow-yard. Mr. Koehler also stated that he has lost several sales on account of this and the Loan Company from whom he is obtaining loans will not loan within 250 feet of the cow-yard, stating that he proposes to improve 36 Late with- in a year, requesting the Council to ascertain what can be done about the matter. Mr. L. A. Harter, owner and operator of the above referred to dairy, stated that he has been looking for a new location for his cows, however, that he wishes to continue the sale of milk on Imperial Highway where he is now located. Mr. Harter stated that he wishes to cooperate in the matter, however, that he would like to have some more time to look around to obtain a suitable location in County unincorporated area. After due consideration of the matter, it was duly moved by Councilman Snyder and seconded by Councilman Meyer that Mr. Harter be given until June 1, 1940 to move the cows out of Lynwood, however, that thereafter he be permitted to sell milk from the location where he resides on Imperial Highway. All members of the Council present voting aye, the Mayor declared the motion duly carried and it was so ordered. A communication was received from The Craft Shows, making appli- cation to exhibit in the City of Lynwood for a period of six days April 9th to 14th, inclusive, using the same location as in previous years near Long Beach and Tweedy Boulevards,, they to comply with all laws and ordin- ances pertaining to tented attractions. After due consideration of the matter, it was moved by Councilman Christensen and seconded by Councilman Meyer that permission be granted the Craft Show to hold a carnival here and that they be required to pay X100.00 in addition to the regular license Pees for such privilege, and that said amount and all but X100.00 of the license fee charged be placed in a special fund to be used for the purpose of decorating the streets during the holiday season. Weaver, 10109 Pinehurst Avenue, South Gate, stating that they have an organization known as the new anti-aircraft of the southeast now under way, and a suitable place for a reeuiting office in Lynwood is needed, requesting permission ~to use the City Hall lobby ,for such purpose, together with the use of a small table and two chairs on Tuesday, between the hour of 3:30 and 5:00 P. M. andSaturdays 12:00 noon to 5.:00 P.M.; also Thursday 3x30 to 5:00 P. M. beginning Saturday February 10th. After due consideration of the matter, it was duly moved by Councilman Meyer and seconded by Councilman Christensen that permission be granted on the dates as requested. All members of the Council present voting aye, the Mayor declared the motion duly carried and it was so orderd A communication was received from R. A. Moffitt, City Treasurer to the effect that he has opportunity to purchase bonds of A. & I. Dist- riot 17 of the par value of ~2~524.82 for ~1,262,4I, which is at a pries of 50¢ flat, stating that there is sufficient money in the interest and sinking fund to pay approximately one-half of the required amount and there are other funds availablein the Special Assessment and Tax Relief Fund to make up the difference, requesting authorization to mike such purchase. ~h Thereupon it was moved by Councilman Christensen and seconded by Councilman Meyer that the City Treasurer be authorized to purchase said bonds of A. & I. District 17 for the price as stated above. Roll Call: Ayes: Councilmen Christensen, Meyer, Snyder and Lake Noes: None Absent:Councilman Nation. Report of the City Court was received also health reports for three weeks; there being no ob,jeetion, said reports were ordered filed. UNFINISHED BUSINESS: A communication was received from Engineer Bateman recomme~gling that Stephen H. Sims be refunded X2.25 weed charge on the South 60 feet of Lot 4, Block 9, 't'ract 9337. Thereupon it was moved by Councilman Snyder and seconded by Councilman Meyer that said refund be granted and allowed after it is determined that the taxes for 1939-40 have been paid in full. Roll Ca11: Ayes: Councilmen Christensen, Meyer, Snyder and Lake Noes: None Absent:C©uncilman Nation An opinion was received from City Attorney Ruby in connection with the claim of Cora E. Reynolds as to whether or not the City can legally pay interest on a 19th Bond belonging to her, reporting that it is his opinion that it can be done under certain conditions, therefore submitting a proposed Resolution in connection therewith, setting forth the basis for such advance from the General Fund for such purpose. Thereupon RESOLUTION CIO. 1219, entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD, CALIFORNIA, DETERMINING STREET IMPROVEMENTS WITHIN WHAT IS KNOWN AS GOLDEN AVENUE~IMPROVEMENT DISTRICT AND OTHER STREET IMPROVEMENT DISTRICTS WITHIN SAID CITY OF LYNWOOD, CALIFORNIA, TO BE OF MORE THAN_LOCAL BENEFIT: THAT THE ASSESSMENTS HERE- TOFORE LEVIED AGAINST THE PROPERTY IN SAID IN[PROVE141ENT DISTRICT ARE UN- JUST AND IN EXCESS OF THE BENEFITS DERIVED FROP,~ SUCH IMPROVEIutENTS, AND THAT PUBLIC luiONIES BE APPROPRIATED TO PAY DELINQUENT INTEREST ON BOND NG. 1g IN SERIES AA, ISSUED AGAINST SAID DISTRICT", was read. It was moved by Councilman Snyder and seconded by Councilman Christensen that said Resolution No. 1219 be adopted. Roll Call: Ayes: Councilmen Christensen, Meyer, Snyder and Lake Noes: None Absent : Counci~.rrian Nation. Considerable discussion was had regarding the marble table matter as to whether or not to submit the measure to the people for a vote, however, no action was taken in connection therewith. Discussion was also had in connection with the advisability of submitting the fire- cracker and .fireworks proposalto the voters, however, no action was taken other than the City Attorney was to study the_ new state law in connection therewith the Councilman Christensen. NEW BUSINESS: A communication was received from Engineer Bateman attaching a lea-se from the P. ~. Railway Co., covering an easement acrioss the right of way for water lines purposes, recommending the approval, however, subject to check of the rental charge of X5.00 covering a period oP 5 years. Thereupon it was moved by Councilman Christensen and seconded by Councilman Snyder that said Easement be accepted and that the Mayor be authorized to exenute same for and on behalf of the City of Lynwood, and that the City Clerk check up on the rental charge to ascertain wheth- er or not same is a proper charge. Ayes: Councilmen Christensen, Meyer, Snyder and Lake Noes: None Absent: Councilman Nation It was moved by Councilman Snyder and seconded by Councilman Meyer thAt the City Clerk be authorized to secure polling places for the City General Municipal Election to be held on April 9, 1940; also that he be instructed to advertise for electionofficers, and that there shall be established six polling places for the conducting of said election. All members of the Council present voting aye, the Mayor declared the motion duly carried and it was so ordered. A Map of Tract No. 12180, which is bounded on the west by Lindbergh street, on the south by Cedar Avenue and on the East and North by Tract No. 2992, was submitted, same having been prepared by Engineer Bateman, showing streets for the proposed subdivision, Lot numbers, etc. /I Thereupon it was moved by Councilman Christensen and seconded by Coun- cilman Snyder that said subdivision Map as stated be approved by the City Council of the City of Lynwood and that the Streets as establish- ed therein be accepted. Roll Call: Ayes: Councilmen Christensen, IVieyer, Snyder and Lake Noes: None Absent:Councilman Nation A communication was received from the Colletti Transfer Sys- tem Inc., to the effect that they erroneously paid a license fee for transportation truck, requesting that they be refunded the fee o~f X12.00 ina.smueh as they are no longer doing business within the City of Lynwood. Thereupon it was moved by Councilman Meyer and seconded by Councilman Christensen that said Company be refunded $12.00 the amount of the business license fee.
