REGULAR MEETIiVG APRIL 2, 1940
The City Council of the City of Lynwood met in a regular ses-
sion, in the Council Chambers of the City Hall, 11331 Plaza Street, on
above date, at 7:30 P. M.
Mayor Lake in the chair .•
Councilman Nation was absent.
It was moved by Councilman Christensen and seconded by Council-
man Snyder that the minutes of the previous regular meeting of March 19,
1940 be approved as written. All members of the Council present voting
aye„ the Mayor declared the motion duly carried a•nd it was so ordered.
~NRITTEN COMMUNICATIONS:
A communication was received from City Engineer Bateman stating
that he has now received final approval of plans and specifications for
the improvement of Imperial Highway and authorization to proceed with the
work from the State Highway Department; also that sufficient funds have
acGUmulated in the Gas Tax Allocations to the City, therefore recommend-
ing that the City Council direct the City Clerk to advertise for bids for
supplies needed for said pro,~ect. Thereupon it was moved by Councilman
Meyer and seconded by Councilman Snyder that the City Clerk be instructed
to advertise for bids for the improvement of Imperial Highway. All mem-
bers of the City Council present voting aye, the Mayor declared the mo-
tion duly carried.
A communication was received from Herman Goldberg, making ap-
plication to move his pumps at his gasoline station so that they will be
within the ten foot set back for temporary purposes, stating that it would
improve the appearance of his station tremendously, stating that when,and
if the boulevard is widened, he would be willing to move the pumps back
or remove them entirely. After due consideration of the matter, the Coun-
cil determined that it is not within their power to authorize construc-
tion which would be in violation of theCity Ordinances, therefore the City
Clerk was directed to so advise Mr. Goldberg.
A communication was received from Chief of Police Miller sug-
gesting that a Secretary to the Civil Service Board be appointed as Mrs.
Corning, the former Secretary, is now not employed by the City of Lyn-
wood. There being no objection, the Mayor referred this matter to Coun-
cilman Snyder to check into and make his recommendation relative to the
matter.
A commuricatian was received from City Attorney Ruby reporting
on the matter of provisions of Ordinance No. 2,29 dealing with the matter
of Civil Service and vacancies that now exist on the Commission, recom-
mending that new members be appointed to replace the vacancies tY~t now
exist on the Commission. Thereupon it was moved by Councilman Christen-
sen and seconded by Councilman Meyer that A. L. Young be re-appointed
as a• member of the Civil Service `'~~mmission for a term of six years com-
mencing on December 31, 1937 and Ending December 31, 1943; also that W.
D. Chrisman be re-appointed as a member of the Civil Service Commission
.for a period of six years commencing on December 31, 1939 and •ending
December 31, 1945, said members to serve without compensation. All mem-
bers of the Counci_1 present voting aye, the Mayor declared the motion
duly carried and it was so ordered.
A communication was received from Chas. A. Ruby, City Attorney,
stating that in the case of C. A. Hudgins et al, Plaintiffs VS. City of
Lynwood, et al, Defendants, it was necessary to employ-certain witness-
es, setting forth amount due each, as follows:

Thereupon it was moved by Councilman Christensen and seconded
by Councilman Snyder that said fees be approved and that warrants be
drawn on the City Treas~lrer for said amounts.

A petition was received signed by Mrs. Ethyl Carlson, Mrs.
Edith Chapel, &1rs. B. J. Franklin, requesting the Council to widen Peach
Street by eliminating the parkway; also lower the crown of said Street,
between Fernwood Avenue and Lynwood Road in order to expedite the flow
of water thereon.

Mrs. Dolly Stelzer addressed the Council on said matter ob-
jecting to such widening at this time favoring rather that the City wait
until it can be ascertained ~hatrelief the completion of Compton Creek
Unit No. 1 will give to Peach Street residents, calling attention to the
power lines that would of necessity have to be moved.
After due consideration of the matter, the n~layor referred the
matter to Engineer Batemanc~ to check into the feasibility of such a
project and the estimated cost thereof ._
A request for refund of weed assessment was received from Anna
K. Bauersfeld alleging that a company cleaned the Lot described as Lot
81, Tract 2551 and therefore it was not cleaned by the City. There being
no objection, said matter was referred to City Engineer Bateman for c~ek-
ing and recommendation.
A communication was received from the California Municipal
Utilities Association calling attention to the benefits of the City in
becoming a member of their Association, and the goad that they are ac-
complishing on behalf of Cities who owm their own Utilities, giving
schedule of membership due. There being no objection, the Nlayor ordered
the communication filed and no further action was taken on the matter.
Resolutions were received from the American Legion, Post No. 85,
Exchange Club and Central Gardens Woman's Club requesting that the Coun-
cil help finance the dental clinic project. There being no objection,
the Mayor ordered the Resolution filed requesting t1~.at the City Clerk cnm-
municat3with each organization notifying them that there is no money
available in the budget for 1939-40 for such prupose, however, that they
will consider the matter further in preparing the 1940-41 budget.
A comrunication was received from the Lynwood Press, objecting
to the granting of a license to a nersgn who is to conduct a second-
hand store next to their business establishment in which they plan to
use the rear for living quarters, suggesting that it would constitute a
public nuisance and that living quarters in such ,a building under the
conditions that exist there is a violation of the public health la•~v.
After due consideration of the matter, it was determined tha'~
no application has yet been•received for a used furniture establishment
at said location and. that before same was granted the ordinance required
that applicant make his request to the City Council at which time proper
steps can be taken to guard against any bad conditions that might be
created by the granting of such a permit.
Report of the City Court was received for the month of March;
also health reports for weeks ending IUlarch 23 and 30 , 1y40. There be-
ing no objection, said reports were ordered.filed.
ORAL COMNUNIGATIONS:
Mr. H. B. Evans addressed the Council seeking information rela-
tive to what has been done about eliminating the dairy that exists on
Tweedy-Abbott Road, just north ~f Tract 8312, stating; that conditions are
very bad there on account of the accumulation of flies caused by such
dairy, requesting that something be done to have the nuisance abated.
Mayor Lake stated that an opinion is on file regarding the mat-
ter by the CityAttorney, suggesting and. directing that the City Clerk
read same.
There~aron the City Clerk read said opinion which stated that
anything• which is injuriqus to health or offensive to the senses or an
obstruction to the free use of property so as to interfere with the com-
fortable enjoyment of life or property by ~~n entire community or neigh-
borhood, is a public nuisance; also setting forth other sections of the
Code of Civil Procedure ar~d of the Civil Code pertaining- to the matter.

setting forth the procedure for the City to follo~=rs. The City Attorney
stating that the Council should. first £Tive the petitioners and the
dairy notice of a hearin~• to be held beforethe Counci_1 to: deterrnine
the fact of ~rahether or not the dairy constitutes a public nuisance; also
that a Notice be published for one week in the newspaper of-said hear-
ing, and if it is found that the dairy constitutes a public nuisance,
the Council shall then set a.reasona.ble tune for its abatement, if not
removed, the City Attorney can then proceed to have same abated by Court
action. Thereupon it wac rioved by Councilman P~~ieyer and seconded by Coun-
cilman Christensen that the City Clerk be instructed to publish a Notice
of Hearing in connection with said- matter and notifying-the Peititioners
and the owners of the dairy to be present at a hearing to be held before

it was so ordered.

A communication was received from Frank Eichaltz, Secretary
of 'technocracy, Inc. o#' Lynwood, requesting the use of the City Hall
some eveing between April 21st tq April 7th. Thereupon it was moved
by Councilman Snyder and seconded by Councilman Christensen that per-
mission be granted to said or~•anization to use the Council Chamber .on
April 23rd, 1940. A11 members of the Council present voting ay,e t_he,

It was moved by Councilman Snyder and seconded by Councilman
Meyer that said Ordinance No. 317 b~ adopted as read the second time,

A Grant Deed was received dated September 25, 1931, signed by

It was moved by Councilman RlTeyer and seconded by Council-
man Christensen that the City Attorney be instructed to amend the Or-
dinance relating to bond of City Officials -to provide for a bond of
x,30,000.00 for City Treasurer. All members of the Counci~ present
voting a~=e, the Mayor declared the motion duly carried and it was
so ordered.
The matter of request for construction of a garage and
sleeping room by C.F H. Bohnhardt at 3197 Lynwood Road to be used
temporarily as a worf~ shop, was brought up for considerations of the
City Council.
It was moved by Councilman Snyder and. seconded by Council-
man PvTe,yer that permit be granted to Mr. Bohnhardt to consturct said
Building., said b~zi1_ding to be an addition of not to e~.ceed 50~fn of his
present building which he is using as a work shop wherein he manufac-
tures a small article as required by the Zoning Ordin~;nce. All members
of the City Council present voting aye, the r,~ayor declared the motion
duly carried and it wa.s so ordered.
Councilman Meyer submitted a written report regarding the
Spring Conference of Mayors and Councilmen of the League of California
Cities which he attended between March 28th and 29th, 1940. The City
Clerk was directed to prepare one copy .for each councilman for study.
