HomeMy Public PortalAboutM 1940-08-20 - CCj ~ _ REGULAR IuIEETING AUGUST 20TH, 1940 The City Council of the City of Lynwood met in a regular session, in the Council Chamber of the City Hall, 11331 Plaza Street, on above date, at 7:30 P. M. Mayor Meyer in the chair. Councilmen Christensen, Zimmerman and P~geyer answered the roll call. Councilmen Lake and IV1cMeekin were absent.. It was moved by Councilman Christensen a.nd seconded by Council- man Zimmerman that the minutes of the previous regular meeting of August 6th, 1940 be approved as written. All members of the Council present voting aye, the Mayor declared the motion duly carried. Mr. E. h1. Hanlon was present and addressed the Council on the matter of a proposed 'oarber shop and beauty shop which his wife deGires to establish on Sanborn Ave., east of the alley off of Long Beach B1vd.,_ but upon inquiry with the Building Inspector regarding a building for such business at said location, they were advised that it would not be allo~a~led as it is a residential area, designated as R-1, requesting that the Council do whatever is necessary to permit the construction of such a building to house said businesses. At this time Councilman IVicMeekin arrived and took his seat a.t the Council Chamber. Pfr. Hanlon was advised by Mayor Meyer that the Council would take his request under advisement, and that in the meantime he should check titiiith the City Attorney to ascertain what the procedure is for chang- ing a zone. 'A~RITTEN COMP~UNI CATIONS A communication was received from U. S. Grant Hotel giving a schedule of rates for persons to stay at their hotel during the League convention to be held between Septem~,er 16th and 19th, incl. Mayor Meyer requested all Councilmen who desire to attend said convention to notify the City Clerk in order that reservations might be made at an early date. A communication wGs received from Rosella Peyton calling attention to the dangerous traffic condition at the corner of Long Beach Blvd. and Fernwood Ave. in Lyn~xrood, stating that it is almost impossible for pedestrians to cross, suggesting a "Stop and Gc " signal at said . point. There being no objection, the Ariayor referrred said matter to Councilman Zimmerman to take it up with Chief Miller to ascertain whether or not anything can be done to alleviate the situation. A communication was received from M. Jarvis, Secretary of the local W. C. T. U. to the effect that the 7:adies of the Lynwood V7omen's Christian Temperance Union voted to send ~~~ritten protest against allowing smoking in Council Chambers during public meeting. There being no ob- jection, said communication was ordered filed. A communication v~•as received from the Agricultural Commissioner of County of Los Angeles to the effect that the County have discontinued to appropriate moneys to be used for the purnnae of abating the puncture vine, suggesting that the Cities continue the fight aga~.nst said vine, and they will continue to fight same in County ur~dncarporated area. There being no ob~;ection, the P~-:ayor referred said communication to the atten- tion of Engineer Bateman with instructions to keep on the alert to cause "" such vines to be destroyed wherever found. A communication wa.s received from H. L. Byram, County Tax Collector making demand upon the City Council to provide funds to pay delinquent assessments under tre Improvement Bond Act of 1915, as required by statute, either by transfer of general funds to the interest and sink- ing funds of each of the districts, or the levying of additional taxes therefor, showing delinquency in the following Districts: Imperial #688, Lewis #720, and Refund A. & I. #7- 1185. There being no ob,;ection, said communication was ordered filed and no further action was taken. A communication pia s received from the League of California Cities with suggested form of Ordinance prohibiting trespassing and loiter- ing for the protection of industries vital to National Defenses attached. There being no objection said proposed and suggested Ordinance wa_s re- ferred to the City Attorney for study and report his findings to the City Council at their next regular meeting. The hour of 8 P. M. having arrived, said time being the hour fixed for receiving bids for the furnishing of electric energy necessary to illuminate the Street lamps in the City of Lynwood, as published in the Lynvaood Press. ti~~ X43 The City Clerk stated that one bid ha.d been filed by the Sou- thern California Edison Co. Thereupon it was moved by Councilman Christensen and seconded by Councilman McMeekin that said bid be publicly opened and declared. All members of the Council present voting aye, the Mayor declared the motion duly carried. Said bid was accompanied by a contract covering fiscal year 194C-41. There being no objection, said bid and contract was referred to the City Attorney for checking and report at the next regular meet- ing of the City Council. A communication was received from Fire Chief Lewis to the effect that he had the pleasure of attending the 47th Annual Conference of the Pacific Coast Association of Fire Chiefs at Tacoma,"shington, requesting that he be reimbursed a part of his expense in the amount of X45.00. After due consideration of the matter, it wa.s moved by Council- man Mc~,Te.ekin and seconded by Councilman Zimmerman that said expense. be allowed Fire Chief Lewis and that a warrant be drawn on the City Trea- surer for said amount of X45.00, and that in the future all employees or department heads desiring to attend any convention that they dis- cuss the matter of expense money with the City Council prior to their attendance. It was moved by Councilman McMeekin and seconded by Council- man Christensen that the City allow no expense money to attend con- ventions when taken as part of the employee's regular vaction time. All members of the Council present voting aye, the A~ayor declared the .motion duly carried. A communication was received from City Attorney Ruby advising that M. Bringhurst has sued the City. in Superior Court for an alternative writ of. mandate requiring the City Tre=surer to pay certain moneys in ~: the sinking fund of A. & Z. District No. 23, stating that he has already made an appearance in Court to have the action postponed in order not to let it go by default, requesting .that the Council instruct him to represent the City in said action, if phis is their desire. Absent: Councilman Lake: An application for license. to operate a store of used furni- ture and transfer at 11034 Atlantic Ave., was received from Robert Dearie and Lincoln McCadden, enclosing X6.00 the license fee therefor. There- upon it was moved by Councilman McMeekin and seconded by Councilman .Zimmerman that permit be granted and that the License Collector be auth- orized to issue license therefor. All. members of the Council .present voting aye, the P.~iayor delared the motion duly carried and it wa_s so ..ordered. An application for license t.o operate a used .car lot at the .corner of Beechwood Ave. and Long Beech Blvd., wa.s received from Samuel J. Chapman and Raymond Loup, .enclosing X6.00 the license fee therefor. .Thereupon it was moved by Councilman MclU,eekin and seconded by Councilman .Christensen .that ?~er:rit be granted and that the License Collector be .authorized to issue a license therefor.. Silberg, making applica- tion for per:nis.sion to use a portion o.f the Southern Pacific right of .way, located on the westerly boundary of the City for the purpose of .sorting and incinerating combustible rubbish originating at General .Motors Plant, stating that he will be .g~.ad to comply with all existing .laws and ordinances governing an opera.t3~on of this type. Thereupon it was moved by Councilman tJicMeekin and seconded by Councilman Christensen .that permit be granted to Mr. Silberg .as requested, subject to the nui- sance Ordinance if it should develope into a nuisance at a later date; also that the City assumes no responsib3;lity of damage to the Southern Pacific property.. Absent: Councilman Lake.. 1.44 The health report for week endin~• August 10th, 1940; also appli- cation for employment was received from Arthur H. Spencer. There being no objection, said report and application were ordered filed. NEW BUSINESS: RESCLUTION N0. 1253, entitled: "IN THE MATTER OF THE PROPOSED IL~iPROVENIENT OF LOUISE STREET, FIRST AVENUE, LINDEN STREET, ELP~I STREET, F~'RNWOOD AVENUE, PINE STREF`T, LOCUST STREET, SANBORN AVENUE, SHIRLEY AVE- NEPE AND CERTAIN ALLEYS, INCLUDING ALL INTERSECTIONS OF STREETS AND ALLEYS, BY CONSTRUCTING PUBLIC SEF~~ERS. RESOLUTION PROPOSING TO INSTITUTE IP~~iPROVE= iV[ENT PROCEEDINGS AND DIRECTING H3EPARATION OF REPORT", was read. Thereupon it was moved by Councilman P~Ic1Uleekin and seconded by Councilman Zimmerman that said resolution No. 1253 be adopted. Thereupon a Report was received from City Engineer Bateman, set- ting forth the total cost of the project in the sum of X28,914.29 to be borne bar the property in the district; also setting forth the assessed value of the property in the district, as well as the true value thereof, and such other information as is required by Section 6 of the "Special Assessment Investigation, Limitation and iL~7a,jority Protest Act of 1931" . An Ordinance, entitled: "AN ORDINANCE OF THE INCORPORATED CITY OF LYNWOOD, CALIFORNIA, FIXING THE RATES OF TAXES AND LEVYING TAXES FOR THE FISCAL YEAR BEGINNING JULY 1, 1940 AND ENDING JUNE 30TH, 1941", was introduced and read the first time. It was moved by Councilman Christen- sen and seconded by Councilman Zimmerman that said Ordinance be accepted as read the first time, and pass to the second reading. Absent: Councilma n Lake.. 145 It was moved by Councilman Christensen and seconded by Council- man Zimmerman that Mayor Meyer be instructed to confer with Chief of Police b~Iiller and request that the Police Department cooperate with the License Collector in the matter of checking up on Trucks and others -who do business in the City of Lynwood without a license.
