The City Council of the City o-f Lynwood met in a regular session, Council Chamber of the City Hall, 11331 Plaza Street, on above date, P. M. Mayor Meyer in the chair. Councilmen Christensen, Zimmerman and Ike-yer answered the roll Councilman Lake and McLleekin were absent. It was moved by Councilman Christensen and seconded by Council- man Zimmerman that the minutes of the previous regular meeting of Octo- ber 1st, 1940, be approved as written. All members of the Council present voting aye, the Mayor declared the motion duly carried and it was so or- dered. WRITTEN COMMUNICATIONS: A communication was received from Tailored Homes Building Co. to the effect that some time ago they appeared before the City Council requesting that Silver Maple Trees be purchased for the parkways in their subdivision known as Tract No. 11862: loceted on Bullis Road and Platt, stating that nothing has been done, again renewing their appli- cation. After due consideration of the matter, the Council instructed the City Clerk to communicate with them to the effect that the City is contemplating commencing a tree propagation pro,~ect in con,~unetlon with the Works Progress Administration office, at which time trees will be planted for use in parkways, when-the Council will consider his request further. A communication was received from the Peace Officers Associa- tion, announcing their next meeting at the Casa Manana Cafe on Tuesday night, October 29, 1940 in the City of Culver City. There being no ob~ec- tion said communication was ordered filed. A communication was received from the City Attorney giving a report on two cases now pending in Court, a flood case occasiened by the September 24, 1939 flood at or near Third Avenue and the P. E. tracks, stating that it comes up for hearing and pleading on October 17th, at which time he contemplates to have the case dismissed as fare as the City is concerned. Also reporting that the case against the City Treasurer relative to payment of moneys to certain bondholders in A. & I. District No. 23, came up for hearing at which time he appeared by demurrer and re- quested that the Flaintiff be required to serve ali bondholders invb~ved, which demurrer was sustained, so it no doubt will come up later when it is possible to have service on all bondholders. There being no objection, said report was ordered filed. A communication was received from the City Attorney relative to liability on the part of the City in licensing a travel agency, stating that there is none, however, that the applicant should be made to show that he has secured permission Prom the Railway Commission to oper- ate. Thereupon it was moved by Councilman Christensen and seconded by Councilman Zimmerman that permission be granted to Jack Zwahlen to oper- ate a travel agency on Long Beach Boulevard and that the hieense Collec- tor be authorized to issue license therefor upon proof from said appli- cant that he has secured consent from the Railroad Commission of the State of California to operate. All members of the Council present vot- ing aye, the Mayor declared the motion duly carried. A Grant Deed was received, executE~. by Lottie D. Wilson, A. R. Wilson, Ora P. Wilson, Henry Wilson and Violet May Wilson, wherein they deed the northerly 26.5 feet of Lots 76,77 and 78, and a strip of land 40 feet in width lying westerly Prom and ad,~acent to the easterly line of Tract No. 92, of Lots 78 and 79, all in Tract No. 92, to the CITY OF LYNWOOD~ Thereupon it was moved by Councilman Christensen and seconded by Councilman Zimmerman that said deed dated October 5, 1940 be accepted and that the City Clerk be directed to cause same to be recorded in the office of the County Recorder of Loa Angeles County. A communication was received from the Board of Supervisors of Loa Angeles County with copy of Resolution adopted by their Honorable Body wherein they authorize an appropriation of X7,598.43 for the improve- ment of certain Streets as specified in the City's Resolution to t~m~.of recent date. There being no objection, said communication was ordered filed. 165 Health reports for week ending October 5th and September 28th, 1940 were received and ordered filed. UNFINISHED BUSINESS: A~communication was received from City Attorney Ruby reporting on the matter of application for business license by John Fontans,.,stat- ing that upon investigation he finds it the practice of other ~nris~.iction to ascertain that property damage a#~d public liability insurance is carr- ied in the amounts oP X5,000.00 property damage and 5-10,000 publie~ liability, and if such insurance is carried he sees no reason why license should not be issued to applicant. Thereupon it was moved by Council- man Christensen and seconded by Councilman Zimmerman that permission be granted to John Fontana to operate a taxi service in the City of Lynwood, and that the License Collector be authorized to 'transfer dame Prom the former holder of said license.. Roll Call: Ayes: Councilmen Christensen, Zimmerman and Meyer. Noes: None. Absent: Councilmen Lake and McMeekin. A communication was received from City Attorney Ruby relative to new insurance policy covering public liability insurance and pro- perty damage on City motorized equipment, to the effect that there should be an endorsement on same specifying that wherever the words City of Lynwood appears in the policy it will be constructed to mean City of Lynwood and/or its Mayor and common Council, individually and/or collectively, and/or any public .entity within the City. Thereupon it was moved by Councilman Christensen and seconded by Councilman Zimmer- man that. the City Clerk be instructed to secure an endorsement for said policy covering said matter as recommended by the City Attorney. All members .of the Council voting aye, the Mayor declared the motion duly carried and it was go ordered. ORDINANCE N0. 3.31, entitled: "AN ORDINANCE OF THE INCORPORATED. CITY OF LYNWOOD, CALIFORNIA, PROHIBITING DBZBING OR PROPELLING OR USING UPON THE STREETS AND PUBLIC THOROUGHFARES OF SAID CITY, ANY MOTOR VEHICLE ~NHICH SHALL NOT HAVE FENDERS OVER THE FRONT ~VFiEELS OF SAID VEHICLE AND SUCH OTHER FENDERS AND PROTECTION OVER THE OTHER VGHEELS 0~ SUCH VEHICLE AS EQUIPPED BY FACTORY AND FIXING THE PENALTY FOR THE VIOLATION THEREOF," was read for the second time. Thereupon it was moved by Councilman Chris- tensen and seconded by Councilman Zimmerman that said Ordinance be adopt- ed as read the second time, finally pass and be published as required by law. NEY~ BUSINESS: It was moved by Councilman Zimmerman and seconded by Council- man Christensen that the City Council appropriate X15.00 Prom the Pro- motion account of the City to help defray expen8es in connection with the Haloween parade to be held on October 31, 1940. Roll Call: . . Ayes: Councilmen Zimmerman, Christensen and Meyer. Noes: None. Absent: Councilmen Lake and McMeekin. The hour of 8 P. M. having arrived, said time being the hour fixed for any and all persons having any objections to the proposed work, or improvement, the ,extent of the district to be assessed, or the grades to which the work .is proposed to be done, in connection with the installation of sewers as specified more fully in Resolution of Intention No. 1260. Mayor Meyer inquired of the audience whether or not there was anyone present who wished to protest either orally or in writing regarding said matter. There waa no response. Thereupon the Mayor asked the City Clerk whether any written protests or objections had been filed. The City Clerk stated that two had been filed. Whereupon he read one signed by Mrs. Clara M. Lee, 381 Ken- oak Dr., Fomona, California, as owner of Lot 7, Block 9, and Lot 16, B1ock,I1, in Tract No. 9288, ob,~ecting to any more assessments being levied. He also read one from Geo. A. Thereupon RESOLUTION N0. 1268, entitled: "RESOLUTION AGREEING TO PURCHASE BONDS IN THE MATTER OF THE PROPOSED IMPROVEMENT OF LOUISE STREET, FIRST AVENUE, LINDEN STREET, ELM STREET, FERNWOOD AVENUE, PINE STREET, LOCUST STREET, SANBORN AVENUE, SHIRLEY AVENUE AND CERTAIN ALLEYS, INCLUDING ALL INTERSECTIONS OF STREETS AND ALLEYS, BY CONSTRUCTING PUBLIC SEWERS," was read. Absent: Goud~ilmen Lake and McMeekin. The hour of 8 o'clock P. M.Y~aving arrived, said time being the hour fixed for a hearing-upon the tentative report of changing Zone R-1 to Zone C-3, on the north side of Imperial Highway, between Lewis Road and Otis Street, as published in the Lynwood Press and posted in the dis- trict and mailed to interested property owners, as required by law. The Mayor inquired of the audience whether or not there was any one present who wished to protest to the changing of said Zone. Mr. Leander addressed the Council requesting information as to the type of buildings that would be constructed in the new zone. Mayor Meyer stated on behalf of the Council that it would be commercial build- ings, which he understands would be of the frame stucco type. Mr. Shepperson was present and submitted a sketch of the type of building which he is proposing to build in said zone. "'" Thereupon the Mayor asked the City Clerk whether or not any written objection of protest had been filed. The City Clerk stated that none had. been filed. Thereupon a Final Report of the City Council of the City of Lyn- -' wood regarding the proposed change of Zone as specified above, was read, Fixing Novem?~br 6th, 1940, as the time for a hearing in connection with said matter, at the hour of 8 P. The City Clerk submitted statement showing condition of budget for first three months of the fiscal year; or at the close of business September 30, 1940. There being no objection same was or- dared filed. The Chief of Police was instructed to check up on traffic conditions at the intersection of Platt and California Streets since the opefling of California Street south of Platt, to ascertain 1f any- thing can be done about reducing speeding at said intersection. It was moved by Councilman Christensen and seconded by Coun~il- man Zimmerman that Water Superintendent Bateman be instructed to check up on the water plants to determine whether or not anything Gan be done to prevent access to water tanks and other City Equipment, in order to preclude any sabotage activities by un~American individuals. All mem- bers of the Council present voting aye, the Mayor declared the motion duly carried. City Attorney Ruby addreasec~ the Council on the matter bf suit filed by the City against the Southern California Edison Co., Ltd. stat- ing that he has secured a copy oP the complaint, stating that he can arrange for a conference with. the defendant at' the pleasure~_ of the Counc- cil, however, he believes that the Council should have some one~epresent the Gity in this case in Court inasmuch as the services of Attorney Hess has been suspended with, augg~esting that he would do so if t~-=is their desire. Thereupon RESOLUTION N0. 1269, entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE INCORPORATED CITY OF LYNWOOD, CALIFORNIA, IN RESPECT TO THE CITY ATTORNEY REPRESENTING THE SAID CITY IN LITAGATION," in action entitled, City of Lynwood vs. .Southern California Edison Co., Ltd., was read.
