I~Iayor Meyer in the chair. Councilmen Christensen,- Zimmerman, TulcPv~eekin and Meyer answered the•roll call. . Councilman Lake was absent. It wa.s moved by Councilman Christensen and seconded by Council- man.McNleekin that the minutes of the previous regular meeting of February 18th, 1941 be approved as written. All members of the Council present. voting aye, the P~~ayor declared the motion duly carried and it was so or- dered. _ WRITTEN COP~~~'JIUNI CATIONS ; • A communication was received from the Planning Congress call- ing-attention to their next meeting to be held in the City of Pomona on March 8th. There being no ob,jeetion, said communication was ordered filed. A communication was received from Pars. D. J. Holmes, .3241 Flovrer Street to the effect that the sidewalk along Von's market is often ob- structed by smelly garbage cans, crates-of vegetables and so forth, stat- ing that she does not believe that they should be permitted to unload vegetables and meats on that side. of their building as Flower Street is a narrow street anyway. There being no objection, said matter was referr- ed to the Police Department to investigate and order such corrections as are necessary, to also contact Iairs. Holmes regarding the disposition of said matter. A communication was received from Alfred Jones, County Engineer, to the effect that they have investigated the drainage condition at the intersection of Fernwood Avenue and Peach Street on the north side of the Pacific Electric Railway, stating that the existing culvert under the Pacific Electric Railway is offering very little obstruction to the flow of the water as there is no appreciable difference in the elevation of the flow on the north and sou tr. sides of -the track other that that which is due to the natura_1 gradient of the channel, st-ting that the only lo- gical solution to the problem requires the interception of the storm wa- ter in the upper re-.ches of the water shed by the installation of an un- derg~round drainage system. Thereupon RESOLUTION N0. 1287, entitled: "A RESOLUTION C}F THE CITY COUNCIL CF THE CI`T'Y OF LYNtix~'OCU PETITIONING THE HONORABLE BOARD OF SUPERVISORS OF LOS ANGELES COUNTY TO TAKE II~TvIEDIATE ACTION IN APPROFRIAT- ING SUFFICIENT FUNDS TO INTAKE PRELII~iINARY SURVEYS FOR CONSTRUCTION CF EAST COIaIPTON CREEK N0. 2 PROJECT", was read. It was moved by Councilman MclViee- kin and seccnded by Councilman Zimmerman that said Resolution No. 1,87 be adopted. Roll Call: Ayes: Councilmen C;7rietensen, Zimmerman, IUIcMeekin and Meyer. Noes: None. Absent: Councilman Lake. A communication was received from IvTa.ster Lubricants Company, 962-972 East Fourth Street, Los Angeles, to the effect that they are the owners of approximately 8 acres embracing the Compton-Lynwood Peet Bog, making application to purchase bonds issued ir. refunding A. & I. District No. 8 againet a portion of Lot 27, Mod,jeska Acres which the City is the owner of, stating that they desire possession of the property in order that they may fence same together with the rest of their property. There being no ob,j ection, tree Iviayor appointed Councilman McN7eekin and Attorney T.~~offitt a committee to check into the matter and report at the next meet- ing of the City Council. The hour of 8 P.M. having arrived, said time being the hour fix- ed for hearing protests or objection in connection with changing Zone R1 to 7~ne C3 as affecting Lot 576,,Tract 2551, upon the tentative report of 1Ghe City Council in connection with said matter filed at the meeting of the":Citty Council at their meeting held on February 18th, 1941. The Clerk stated that affidavits of Hosting Notices and of pub- lication and mailing vaere on file in his office. Thereupon the PJlayor inquir.=~d of the City Clerk whether or not any written protests or objections had been filed. The:° Clerk stated that none ha.d been filed. X05 Thereupon Final report of the City Council of the City of Lyn- wood, California, in relation to said proposed change of Zone from R1 to Zone C3, was read, fixing March 18th, 1941, at 8 P.M. as the time for hearing on said Final Report. It wasmaved by Councilman Christensen and seconded by Councilman Mcll~eekin that said report be adopted. Roll Call: Ayes: Councilmen Christensen, Mcluieekin,Zimmermar~ and Meyer. Noes: None. Absent: Councilman Lake. A communication was received from Attorney Rascae R. Hess, dat- ed•February 28t1~, 1941, requesting the Council to rescind their former action of discharging him from employment in the prosecution of actions brought in the franchise compensation matters against the Southern Calif- ornia Edison Company and the Southern California Gas Company, as the County of Los Angeles, through their representative Mr. Prichard are bringing like action, and that as a matter of fact they used much the same language of his com;glaint in there suit against the Southern California Gas Company and the Southern Counties Gas Company as he did. There i~simg no ob,~ection, said matter was referred to the City Attorney for checking and report. A communication was received from the City Treasurer requesting permission to purchase a new Sundstrand Adding Maching for a total consi- deration of X237.93, Tess and allowance of X30.00 for the old Burrough machine now in use in his Department, stating that the present machine is 28 years old and is no longer accurate and gives trouble to the Depart- ment. . Thereupon it was moved by Councilman ~ricMeekin and seconded by Councilman Christensen that the City Treasurer be authorized to purchase said adding machine. Roll Call: Ayes: Councilmen Christensen, 1VicMeekin, Zimmerman and Meyer. Noes: None. Absent :• Councilman Lake. A communication was received from City Treasurer Wilkinson to the effect that he has had a communication from J. ~4. Lowery, County Aud- itor, requesting the division of A. & I. District .7 bonds covering Lots 29 and 30, Block 17, Mod,~eska Park, and Lot I, Tract 2794. Th~eFeupon RESOLUTION N0. 1288, entitled: "A RESOLUTION OF THE CITY COUNGLL OF THE CITY OF LYNWOOD, CALIFORNIA, FINDING THAT CERTAIN LOTS HAVE BEEN SUBDIVIDED, AND ORDERING THE STREET SUPERINTENDENT OF THE CITY OF LYNtiV00D TO FILE WITH THE CLERK OF SAID CITY COUiJCIL, AND AMENDED ASSESSMENT, SEGREGATING AND APPORTIONING THE UNPAID INSTALLMENTS OF THE ORIGINAL ASSESS~JIENTS IN ACCORDANCE ;rJITH THE BENEFITS TO THE SUBDIVIDED PORTIONS OF THE LOTS SUBDIVIDED", was read. It was moved by Councilman Christensen and seconded by Councilman Zimmerman that said Resolution No. 1288 be adopted. Roll Call: Ayes: Councilmen Christensen,. McMeekin, Zimmerman and Meyer. Noes: None. Absent: Councilman Lake. A communication was received from City Treasurer Wilkinson stating that there are now outstanding bonds of A. & I. District No. 16 in. the principal amount of X58,552.43 together with unpaid interest cou- pons~~in the amount of X23,677.90; that. several years ago the City and County•purchased all of said bonds at a great discount and the County now owns bands in the amount of ~45,I00.00 and the City own X13,452.43, stating that the City has invested X4,2,00.00, stating that the bonds have been kept alive in order to make possible a more advantageous refunding of District 18, however, the bondholders are aware of the Qwne.x~ship of said bonds and are assuming that at the proper time the City will order the cancellation of said issue without cost to the pr€rperty owners, so he recommended that the bonds be cancelled in order to make it possible to secure loans in District No. 16 for building purposes, stating further that the County is willing to cancel their. bonds if the City will do so. Thereupon it was moved by Councilman TvicMeekin and seconded by Councilman Christensen that the City of L;,rnwood cancel Acquisition and Improvement District No. 16 bonds now awned by the City, a.n~l that the County of Los Angeles be requested to deliver the bonds that they hold against said district for cancellation by the City Treasurer. Roll Call: Ayes: Councilmen Christensen, Zimmerman, McMeekin and itiieyer. Noes: None. Absent: Councilman Lake. A communication was received from Jas. P. Reynolds giving a 2 ~~ resume of his bonds held of Series "AA" of the 1915 Improvement Bond Act, stating that the total amount due, including interest is X6,321.26, re- questing the Council. to consider the matter of payment thereof as same have besldelinquent far a long time. After due consideration of the matter it was moved by Councilman TvTcIuTeekin and seconded by Councilman Christensen that the City Treasurer be-authorized to offer Mr. Reynolds settlement of said bonds on the basis of 50¢ on the dollar of the principal amount due u=i,th cancellation of all interest due. Roll Call: Ayes: Councilmen Christensen, Zimmerman, NicIvleekin and Nieyer. Noes: T1one. Absent: Councilman Lake. A petition was received signed by J. 0. Law and 31 other proper- ty ov~Tners residing near 3132 Los Flores Boulevard, petitioning the City Council to take steps to eliminate the practice of the tenant living at 3132 Los Flores Boulevard, in keeping and raising chickens in commercial "~± quantities at. said address, giving certain reasons for their request. Pti~:r. Clark, representing the County Health Department addressed the Council on said matter stating that they have been working on the mat- ter for along time, and that he has been assured by the occupant of said premises that he is going to move Within two weeks to Artesia, in fact, that he is already tearing, down some of his equipment to be moved to his new location, however, suggesting to the Council that something be done to amend the zoning ordinance or Nuisance Ordinance to .eliminate such conditions in the future. The Mayor stated on behalf of the Council that they would -take the matter under advisement. A petition was received signed by 0. Var. Lunn and 28 others, re- questing that weavers be installed under the Improvement Bond Act of 1911, together with the W. P. A. project on Otis Street and T~~IcNerney Street, between Tweedy-Abbott Road and Imperial Highway. - A Petition was also received signed by Fred S. Orgill and 19 others requesting that the Council initiate proceedings to install a sani- tary sewer system under, the Improvement Bond Act of 1911, together with a W. P. A. project on TJiallison Street,. and Otis Street, between Tweedy- Abbott Road and Imperial Highway; also thht curbs be constructed on the east side of rJ7allison Street, between Alma Street and Tweedy-Abbott Road. There being no objection, said Petitions were referred to the City Engineer for checking and report. A communication was received from Engineer Bateman to the ef- fect that the rapidly increasing number of water accounts ras made neces- sary the purchase of a ne~x~ bookkeeping machine to replace the presentmach-rne which was purchased primarily .for the preparation of Mattoon Apt Refunding Bonds, recommending that a Burroughs Machine be purchased at a cost of between X1,000.00 and1,100.00 stating that sufficient funds are set up in the present budget to take care of any payments falling due during the present fiscal year. There being no objection, said matter was referred to Councilman McNteekin to check into. A communication was received from Engineer Bateman submitting claim of Mr. Clark in the amount of X16.65 for alleged damage to his car when.it fell into .a six foot hole thereby damaging the front of his car,. requesting the council to reimburse him for said costs, Engineer Bateman stating that the City has no construction work whatsoever under way on Fracar Avenue where the accident occured, stating that perhaps P~r1r. Clark refers to a broken server connection which caused the pavement to settle over the break. If this is the location, this hole has been barricaded and lanterned ever since the condition of the street v~Tas called to their attention. There being no objection, the Mayor referred said matter to Councilman Christensen to check into and report at the next meeting his findings. Report of activities of the City Court for month of February was received; also health reports. There being no objection, said reports were ordered. filed. ORAL CONTTuNNI CATIONS Pair. Aug. Herbold addressed the Council. on drainage problems as they exist at Peach Street and Fernwood Avenue; also Mrs. Hillman, Niessrs Bennett and Magnus addressed the Council on said matter. T~~r. Bogue addressed the Council on the matter stating that the only permanent solution will be for Compton Creek Tdos. 1 and 2 to be com- pleted and until such time very little can be done. to alleviate th.e situ- ation, sug~~estirig that a Committee be appointed to contact the 8oazd of Supervisors and to work out some grogram of cooperation with other Cities 207 affected in a united effort to receive action necessary from the County to remedy the situation. ~ ~ •• Thereupon PJiayor r~ieyer appointed .T~iessrs H. Bogue, August Her- bold, H. W. Mosher, "V. H. Shinde and C. E. Bennett to work on said com- mitt~e. Mr..Zeiner addressed the Council on the bad water condition on Iutallison Street south of Tweedy-Abbott Road, stating that Alma Street causes a.ridge which prevents the .water from running off to the south;. requesting that the City do something to correct the situation; also that they are anxious to have sewers and Curbs constructed as petitioned for by property owners. Mr. Zeiner was requested to .see Engineer Bate- man-regarding his case. Mr. Magnus addressed the Council about the need for widening Flower Street by removing the curb and putting them flush with the side- walk thereby.eliminating the parkway, as said street is used by truckmen in delivering commodities to Von's market making it very difficult to pass an said street.. . Mr. J. 0. Law addressed the Council about their petition request- ing.that the chickens be eliminated at 3132 Los Flores Blvd., to the ef- fect that he is.glad to hear from the Health Inspectgr that the occupant is going to move, however, that there should be some ordinance to prevent like occurence in future instances. UNFINISHED BUSINESS: A communication was received from Engineer Bateman recommedding that the weed refund be made to RRrs. Annie Nelson as affecting Lot 80, Tract ?794 in the amount of X2.85. Thereupon it was°;.moved by Councilman Christensen that refund be made in said amount when it is determined that the.applicant has paid her 3940-41 taxes in full, which motion was duly seconded by Councilman Zimmerman, and upon roll call showed the following result: Ayes: Councilmen Christensen, Zimmerman, McMeekin and Meyer., Noes: None. Absent: Councilman Lake. . The Committee appointed to check into the matter of request by Bob~Williams to have established a 4-~ foot setback as affecting Lot 341, Tract 2551, from NlulfordAvenue, reported that they can. see no objection thereto. Thereupon it was moved Y~y Councilman T~1cMeekin and seconded by Councilman Zimmerman that the City Attorney be instructed to draft an ordinance fixing such set back as requested. All members of the Council present voting aye, the g~ayor declared the motion duly carried and it was so ordered. HORSES, Tv7ULES, BURROS, DOIdKEYS, GOATS AND BOVINE ANIMALS AND PROVIDING FOR THE CLEANING OF BUILDINGS, YARDS AND CORRALS, AND REQUIRING THE RE- T~,OVAL AND DISPOSITION OF THE IVTANURE FROM SUCH ANIMALS", was read by ce~p- tion for the second time. It was moved by Councilman Christensen and seconded by Councilman Zimmerman that the further reading of said Ordin- ance be waived. It was moved by Councilman Zimmerman and seconded by Councilman IvlcI~ieekin that the City Attorney be instructed to draft a notice calling for an examination far-:an eligible list for the Police Department, the time to be on the date determined by the Civil Service Board and the Chief of Police. All members of the Council present voting aye, the P~Iayor de- clared the motion duly carried and it was so ordered. Councilman Zimmerman addressed tr.~e Council on the matter of cour- tesy on the part of Police Officers in dealing with the public, suggesting thetthe utmost care be taken by the Department in not antagonizing those who may have violated the lave any more than possible. Co~•ncilman Zimmerman also spoke about the advisability of call- ing in civilian rlelp in order to curb petty thefts throughout the City. Councilman Zim,;.erman also spoke about the need of florescent ~: lights in the '1t'ater Department. Councilman P•.~cl4ieekin was ac~pointed to look into the matter v~:nen he checked up on the matter of need for a book- keeping machine by said department. It was moved by Councilman Christensen a.nd seconded by Council- man Zimmerman that the meeting adjourn to I~~Iarch 18th, 1941, at 7:3C P.M.
