REGULAR PlIEETING IvIARCH 18TH 1941 The City Council of the City of Lynwood met in a regular sess- ion, in the Council Chamber of the City Hall, 11331 Plaza Street, on a- bove date, a t 7 : 30 P. ~~i. ~,Iayor P~Ieyer in _the chair. Councilmen Christensen, Lake, Zimmerman and Ivleyer answered the roll call. Councilman P~:cP:Ieekin was absent.. It was moved by Councilman Christensen and seconded by Council- man Lake that the minutes of the previous regular meeting of March 4th, 1941 be approved aG written. All members of the Council present voting aye, the P~Tayor declared the motion duly carried and it was so ordered. WRITTEN CON~irIUNICATIONS: ' A communication was received from the Railroad Commission of the State of California announcing a reduction of X1,500,000.00 of South- ern California Edison Co., Ltd. There being no objection, said communi- cation was ordered filed. A communication was received from Elias D. t~'hite, 4284 h~Torton Road protesting against the residence of another family of Latin extrac- tion on Morton Road, at 480 P~~Iorton Road, requesting that the Council do something about taking care of the situation. At this time Councilman R~~cMeekin arrived and took his seat at the Council table. The-City Attorney ruled that it is up to the property owner s to enforce racial restriction and not the City, therefore, the City Clerk was instructed to communicate with Ivir. T~'hite informing him of the property ourner's rights in the matter; also that the Building Inspector be instruc- ted to caution builders and realtors not to sell or rent to persons other that the Caucasian race as it leads to trouble for the property owners as well as the City. A communication was received from Chas. J. PJliller, Chief of Police, requesting that his action be sustained in suspending officer for a period of five days beginning T~Ia.rch 15th, 1941, urithout pay, on account of violation by Paliee Officer W. R. Legg of Section 18 of Ordinance No. 2.2.9 by absenting hir;self from duty for three hours u~ithout permission. Thereupon it wa.s moved by Councilman Christensen and seconded by Council- man Zimmerman that suchcetion by Chief of Folice IJliller 3~e ratified. Roll Call: Ayes: Councilmen Christensen, Lake, Zimmerman, Iv?eMeekin and Meyer. Noes: None. . A communication was received from Robt. E. Emerson, Business Agent of Animal Oddities, requesting permission to show in Lynwood from ?arch 24th to Pu"arch 27, inclusive on Long Beach Blvd. a.t Flower, Sanborn or Lynwood Streets. After due consideration of the matter, it was moved by Councilman Christensen a.nd seconded by Councilman McMeekin that per- mission be denied. Roll Call: Ayes: Councilmen Christensen, Lake, Zimmerman, Mc1t~Teekin and I~,~eyer. - Noes: None. . A communication was received from the L. A. County Division of the League of California Cities announcing their next meeting at Topsy's Cafe, 2600 Firestone Blvd. on ?,~a.rch 4th, 1941, at 6:45 P.M., when the principal speaker will be Richard Graves, Executive Secretary of the State League; also John J. O'Toole of San Francisco. All who plan on attending were requested to so notify the City Clerk in order that reservations might be made. A communication was received from Richfield Oil Corporation sub- mitting Contract to furnish gasoline up to December 31st, 1941. There be~ng no objection, said matter was turned over to the City Engineer to check into; also to check present contract to ascertain provisions as to termination thereof. A communication was received frorri the Board of Supervisors of Los Angeles County with attached minute order of their Honorable Body of Priarch 4th, 1941 ~~?herein they authorize the use of three methods described therein in arriving at valuations of tax-deeded properties, proposed to be sold to Ftlunicipalities. There being no objection said communic:;~tion was ordered filed. A communication was received from Arden Farms Co. to the effect that there have been some Cities utho have been requested by milk dealers ~'~ to adopt a.n ordinance which would call for day delivery of milk, so in or- der to get an idea. of the will of t~~e consumer` the=~ have sent out an un- biased letter, together v~lith a_ postcard ~°equestin~ them to mail same into the City Council of Lynwood to indicate their defiire. The City Clerk stated that a number of cards have come in, a large majority of them desiring be- fore breakfast delivery of milk. There being no objection, said communi- cation was ordered filed. A Eommunication w,Tas received from E. ?~U. Lewis, Chief of the Fire Department, to the effect that the upstairs quarters of the Fire Depart- ment are verg;badly in need of paint, and if the Council see fit to bu~*:' the material, their personnel will paint same, stating that the cost of paint would be approximately $50.00; also stating that the eligible list for the Fire Department expired some time ae~o, therefore another examina- tion should be held. After due consideration of the matter, it was decided not to a- uthorize painting as requesas the amount set up in the budget for repair to building i~ already depletec:~, :•.o~=never, it was moved by Councilman Zim- merman and seconded by Councilman ^!eP~~eekin that the Civil Service Board be requested to call for an examination for ar. eligible list for the Fire Department at the same time that an examination is held for Folice Officers. All. members of the Council present voting aye, the Piayor declar=d the mo- tion duly carried and it was so ordered. An application for emrloyment was received from Arthur Lee Cole; also health report. The hour of 8 P.P~;. havin~• arrived, said time being the hour fix- ed for hearing protests or objections to changing Zone R1 to Zone C3 as affecting Lot 576, Tract 2551, ubon the Final Rer.~ort as filed at the re~~u- lar meeting of the Council held on T~:arch 4th, 1941. The P~~-1a.yor inquired of the .audience whetter or not there was any one present v~=ho wished to protest to t:~e chan~tng of said zone. There was no response. Thereupon the Pia.yor inquired of the City Clerk vahether or not any written objections had been filed. The Clerk stated that none ha_d been filed; the City Clerk also st~-ting that Affidavits of Fublication, Posting and_ TJ~ailing v~~ere on file in his office showing that same had been complied with as required by la.w. ~4hereupon an Ordinance, entitled: "An Ordinance of the Incorpor- ated City of L~,rnvaood, California, charging Lot 576 of Tract 2551 as per map recorded in Book 24 at Pa~•es 7B, r9 a.nd 80 of ~l-"aps in the office of the County Recorder of Los Angeles Count~r, California, and. located in the City of Lynwood, California, from Zone R1 into Zone C3, and amending the Zoning i.~"ap of said City to show said lands ir. Zone C3 instead of Zone Al", =a~as introduced and read. ir, full for the first reading. Thereupon it eras moved by Councilman Lake and seconded by Councilman Christensen that same be accepted a.s read the first time ands pass to the second reading. It vaas moved by Councilman i~~~c~~.eekin. and seconded by Coun- cilman Zimmerman that same be accented as read the first time a.nd pass to the second reading. Roll Call: . Councilman Py?cwieekin reported for the Committee consisting of NIr. r~ioffitt a.nd himself retarding the application of T,.asters Lubricant Co. to purchase refunding bonds of A. & I. District No. B as levied on certain portions of Lot 27, I.iodjeska Acres, reporting that he does not 7~Arish to re- commend that same be sold a.t this time as the City can use same for dump- ing purposes. Thereupon it vaas moved by Councilman P~~~clt~.eekin and seconded by Counci~_man Zimmerman thr.t the City Council do not accept the offer of Tiias- ter Lubricant Comicany to buy the refunding bonds as af~'ecting Lot ~7, T~;iod- jeska. A communication alas received from City Engineer Bateman report- ing on the petition filed in connection lvith request for se~~~ers on I+ralli- son, Otis and I11cNerney Streets, between Imperial a.nd Tweedy-Abbott Road, to the effect that same is signed by 610 of the subdivided property v~hich will be subject to the a.sressment, suggesting that if the Council wishes him to proceed with a `N. P. A. project on this and other territory in said District they so instruct him. Thereupon it was moved by Councilman Lake and seconded by Coun- cilman PJ~cNleekin that the City Engineer be instructed to prepare plans and specifications for a Works Progress Administration project, together with a 1911 Bond issue, to construct sewers in. the district north of Imperial, bet~~een Rtallison Avenue and Atlantic Avenue, together with any other sub- division not at present severed., - . . PUBLIC INTEREST, CONVENIENCE AND NECESSITY REQUIRE THE CANCELLATION OF CERTAIPI 1915 ACT ASSESSP~iEIdTS AND ORDERING THE CANCELLATION THEREOF", was read. A communication was also received from Special. Counsel R, A.. IVioffitt to the effect that this includes all the rest of the Lots in the southwest district of the City on which tags deeds have been sold. . It was moved by Councilman Lake and seconded by Co~;ncilman McT~eekin that the contract entered into with Mid-Cities Credit Bureau to help° collect dead water accounts, dated January 5, 1937, be can- celled. All members of the Council voting aye, the Mayor declared the motion duly carried and it wa_s so ordered. Councilman McMeekin stated that he had checked up Qn the need -for a bookkeeping machine for the water department, a.nd finds that it will increase the efficiency of the office, therefore making a motion that the City purchase a Burrough Bookkeeping machine for use in the wa- ter department as per recommendation of the ~~~ater Superintendent. Roll Call: Ayes: Councilmen Christensen, Lake, Zimmerman, PdicMeekin and I~leyer. Noes: None. No lights were ordered for the 'Fdater Depa-rtment because it was determined that the item set up in the budget for repairs to City Hall is depleted. It was moved by Co~?ncilman Zimmerman and seconded by Councilman Christensen that the Department now purchasing water in bottles be instruc- ted to discontinue such purchase and that Lynwood water be used. All members excepting Councilman Lake voting aye, the Mayor declared the mo- Lion duly carried. Councilman Zimmerman addressed the Council on the matter of tele- phone service in tie Police Department, and the Fire Department. Council- man-Zimmerman was appointed a. committee of one to investigate the matter. Tvir.
