HomeMy Public PortalAbout20010416 OLD COUNCILREGULAR COUNCIL MEETING APRIL 16, 2001 (OLD COUNCIL) 1 CALL TO ORDER The Regular Council Meeting of April 16, 2001, was convened at 6:00 P.M. by Mayor Tom Rackers. Prayer was offered by Councilman Edith Vogel, followed by the Pledge of Allegiance. ROLL CAL The following Council Members were present for the roll call: Present: Angle, Blaney, Jackson, Landwehr, Olsen, Stella, Vincent, Vogel, and Weber Absent: Nelson A quorum was declared present. PRESENTATIONS FROM THE GALLERY Mayor Tom Rackers presented a plaque containing a Key to the City to outgoing Councilman Leonard Stella and conveyed his appreciation on behalf of City officials and staff for the outstanding contribution Councilman Stella has made to the City during his tenure as Councilman. Mr. Stella accepted the award and made comments directed toward the Mayor, fellow Council Members and staff thanking them for their cooperation and help. CONSENT AGENDA The following items were presented to the Council for their approval by consent: a. Minutes of April 2 , 2001 City Council Meeting A motion was made by Councilman Carol Blaney for approval of the Consent Agenda, motion was seconded by Councilman Charles Jackson, and approved unanimously with Councilman Cliff Olsen being absent during the vote. ANNOUNCEMENTS BY THE MAYOR There were no announcements by the Mayor at this time. REGULAR COUNCIL MEETING APRIL 16, 2001 (OLD COUNCIL) 2 BILLS PENDING Bill 2000 -139, sponsored by Councilmen Vincent and Blaney, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE NECESSARY DOCUMENTS TO ENTER INTO THE FEDERAL AVIATION ADMINISTRATION TOWER CONTRACT PROGRAM. Bill 2000 -139 was read third time by title, placed on final passage and passed by the following vote as Ordinance 13180: Aye: Angle, Blaney, Jackson, Landwehr, Olsen, Stella, Vincent, Vogel and Weber Nay: None Bill 2000 -140, sponsored by Councilman Vincent, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH MODERN INTERIORS, INC., FOR CEILING TILE AT THE JEFFERSON CITY POLICE DEPARTMENT. Bill 2000 -140 was read third time by title, placed on final passage and passed by the following vote as Ordinance 13181: Aye: Angle, Blaney, Jackson, Landwehr, Olsen, Stella, Vincent, Vogel and Weber Nay: None Bill 2000 -141, sponsored by Councilman Vincent, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH THE JEFFERSON CITY CONVENTION AND VISITORS BUREAU, INC. Bill 2000 -141 was read third time by title and placed on final passage. Councilman Larry Vincent made a motion to amend paragraphs (6) and (10) of the contract as follows: 6. Submission of Budget. The Contractor shall submit to Council for its approval a line item budget for the upcoming contract period. Following approval by the City, adjustments within the total amount approved may be made of a minor nature with the approval of the Contractor's Board, provided that if adjustments in major categories, i.e., Administration, Operations and Programs, exceeds ten percent (10 %) or $10,000.00 it shall not be made prior to receiving the approval of the City Administrator who shall inform thc Mayor and City Council of the changc in thc budgct. If actual revenue exceeds or is anticipated to exceed the total approved budget, the Contractor may request a supplemental appropriation or budget the excess during the following fiscal year. REGULAR COUNCIL MEETING APRIL 16, 2001 (OLD COUNCIL) 3 19. Termination. It is understood and agreed that either party may terminate this contract by giving to the other party thirty (30) days notice in writing of said termination. thirty (30) days in advance of any expected termination date. Upon termination of this Agreement, unless the same be renewed, the Contractor shall deliver to the City all funds received by the Contractor from the City and representing sums collected by the City from the hotel and motel transient guest tax then remaining in the possession of the Contractor after the Contractor's payment of all allowable expenses. A lengthy discussion was held, after which a motion was made by Councilman Bob Weber to call for the question. Motion was seconded by Councilman Larry Vincent and approved. The original motion to amend was then approved. Bill 2000 -141 was then passed, as amended, by the following vote as Ordinance 13182: Aye: Blaney, Jackson, Landwehr, Stella, Vincent, Vogel and Weber Nay: Angle, and Olsen Bill 2000 -127, sponsored by Councilman Jackson, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH AMEREN UE FOR THE CONVEYANCE OF REAL PROPERTY WITH CONDITIONS. Councilman Charles Jackson requested that Bill 2000 -127 be removed from the Informal Calendar and placed on final passage and read third time by title at this time. Councilman Jackson then made a motion to amend Bill 2000 -127, contract language, as distributed to the City Council by City Counselor Allen Garner in the Council Packets. The motion to amend was seconded by Councilman Larry Vincent and approved unanimously. Bill 2000- 127 was then passed, as amended, by the following roll -call vote as Ord. 13183: Aye: Angle, Blaney, Jackson, Landwehr, Olsen, Stella, Vincent, Vogel and Weber Nay: None Bill 2000 -134, sponsored by Councilman Landwehr, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, CHANGING, AMENDING, AND MODIFYING THE ZONING MAP OF THE ZONING CODE OF THE CITY OF JEFFERSON, BY REZONING THE END PORTIONS OF 1425 SUNSET LAKE ROAD FROM RS -2, SINGLE FAMILY RESIDENTIAL TO RA -1, MULTIPLE FAMILY RESIDENTIAL. REGULAR COUNCIL MEETING APRIL 16, 2001 (OLD COUNCIL) 4 Councilman John Landwehr requested that Bill 2000 -134 be withdrawn at this time. Bill 2000 -138, sponsored by Councilman Angle, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING CHAPTER 26 (POLICE) OF THE CODE OF THE CITY OF JEFFERSON BY ENACTING A NEW ARTICLE V PERTAINING TO RACIAL PROFILING. Councilman Clyde Angle requested that Bill 2000 -138 be removed from the Informal Calendar at this time. bill 2000 -138 was read third time by title and placed on final passage. Councilman Clyde Angle made a motion to accept Substitute Bill 2000 -138, cosponsored by Councilman John Landwehr, which was distributed to the Council in their Council Packets. Motion to accept the substitute was seconded by Councilman Carol Blaney and approved unanimously. Substitute Bill 2000 -138 was then passed by the following roll -call vote as Ord. 13184: Aye: Angle, Blaney, Jackson, Landwehr, Olsen, Stella, Vincent, Vogel and Weber Nay: None UNFINISH ED BUSINESS Councilman Charles Jackson made comments regarding the City Annex building's project, and made a motion that City Staff be allowed to move forward with Phase I I of that project at this time. Motion was seconded by Councilman Cliff Olsen, and approved unanimously. ADJOURN SINE DIE A motion was made by Councilman Larry Vincent to adjourn sine die at this time to allow the swearing -in of elected officials and seating of the newly elected Council members.
