City of McCall, Planning and Zoning Commission Minutes of August 1, 1995. a. Hilton Street Vacation. Mr. Burton gave a report. After discussion, Mr. Eckhardt moved to adopt the Findings and Conclusions of the Commission and to approve the vacation. Ms. Arp seconded and the motion carried unanimously. b. Annexations. After discussion, council agreed to take the recommended annexation of the remainder of Sections 5, 6 and 8 and the Shady Beach, Pilgrim's Cove and Brightwater neighborhoods under advisement. Old Business 20. Ordinance No. 681 Respecting Hawker's and Peddlers. Mr. Burton gave a report noting that sales of services and rentals could be included in the ordinance. After discussion which included approval of the concept of putting services and rentals into the ordinance, Mr. Colton moved to suspend the rules requiring reading of the ordinance in full. Mr. Martens seconded. At a roll call vote Messrs. Colton, Martens, Eckhardt, and Ms. Arp voted "aye." Mr. Burton read the ordinance by title, adding rentals and services. The mayor ordered that the ordinance and proposed Resolution No. 15-95 respecting fees be continued to the next agenda. New Business 21. Request for Adjustment of Utility Account - Tom Welsh. Mr. Henderson gave a report. After discussion Mr. Eckhardt moved to deny the request. Mr. Martens seconded and the motion carried unanimously. 22. Request for Adjustment of Utility Account - Stanley Anderson. Mr. Henderson gave a report. After discussion Mr. Eckhardt moved to deny the request. State Insurance Fund Annual Policy Information Summary Page 3 CITY OF McCALL PLANNING AND ZONING COMMISSION FINDINGS AND CONCLUSIONS IN SUPPORT OF APPROVAL OF VACATION OF PUBLIC RIGHT OF WAY The Commission finds that: 1. A petition for approval of vacation of a public right-of-way was presented for public hearing on August 1, 1995 by Rob and Lindy Hilton, as owners of Lots 1 through 10, and 13 through 24, Block 12 Townsite of Lardo also known as 201 West Lake Street, specifically for the vacation of the alleyway within Block 12, Lardo Townsite. The hearing was continued from July 18, 1995 to August 1, 1995 by the Commission members present in accord with MCC 3- 32-020(A). 2. The necessary notice was given to the public and to other public agencies and entities. 3. The land in question is in Zone B and in part also in Zone SL, as it is bounded on the East by the North Fork of the Payette River. 4. The alleyway is not needed for transportation purposes; the petitioner proposes to re -plat the area into three lots, there is as noted no property at the far end of the alley, and the alley has never been built. 5. There is adjacent property, namely Lots 11 and 12 of Block 12, which did not join in this petition. Those lots front on Parkdale Street (not built), and Lot 12 also fronts on Rowland Street, such that the alley is not the only access to them. One- half the alleyway between Lots 11 and 12 on the North, and Lots 13 and 14 on the South, should be vacated to each ownership. The entire alleyway east of those lots should be vacated to petitioner. The Commission concludes that: 6. The proposed vacation meets the purposes of IC 50-311 and the standards of MCC 3-21-310 (C) as a matter of law. 7. The proposed vacation is appropriate. Lardo Townsite The request is to vacate an East-West alleyway within Block 12 of Lardo Townsite. This property is located North of Pinedale Street, East of Rowland Street, South of Parkdale Street, and West of the River. It is South of the Rowland Brothers plant. The land is in the process of being resurveyed into three larger lots. The zoning is High (Multifamily) Residential Zone B. Three larger lots would lend themselves better to a well -designed project, than would the myriad tiny lots that exist. There is no guarantee of a well -designed project, of course, but it would become possible. There is no apparent transportation need for this alley, now or in the forseeable future. We recommend approval. Rogers Family Trust, Rezoning Application from Zone A to Zone B, acreage in McCa11's First Addition The request is to rezone presently undeveloped property at the southeast corner of McCall's First Addition. It is west of Davis, North of Wooley, at the South end is east of Lenora and Louisa Streets, and at the north end is east of the alleyway in the block east of Louisa Street. This property has not been developed, and the reasons why it has not been developed relate to lack of infrastructure which is now being improved in the general area. This proposal is before you on a remand from the City Council, which in the days before the adoption of Ordinance 615 had asked you to insist that the developer produce detailed maps of tree cover and wetlands, with the eye to fashioning development conditions, one might speculate. Of course, tree cutting is limited by Ordinance 615, and addressing of wet properties (drainage, protection of water quality) are also addressed by 615. The existance of these protections may make such detailed and expensive mapping unnecessary. The original proposal met with some opposition from the owners of existing homes, primarily to the south, who spoke of wildlife uses of the land, of wetlands, of urban forest, and other environmental concerns, and who expressed anxiety about the prospective character of the people who would live in the higher density development. They wished to see a continuation of the housing pattern they have established for themselves. A development of this density should not be permitted without adequate road access. Davis Avenue in the vicinity needs additional right-of-way (it is presently built somewhat west of its existing right-of-way, Wooley needs additional right-of-way to be page 1 printed July 18, 1995 216 East Park Street • P.O. Box 1065 • McCall, Idaho 83638 • (208) 634-7142 • FAX (208) 634-3038 extended to the west to get traffic from this development off of Davis and off of the Louisa -Lenora type streets to the north and west. Also, a sewer line is built it what would be a logical place for a Fir Street right-of-way, but the builders erroneously assumed that Fir extended east of Dawson, which it does not. An easement for this sewer line, which could serve this development, needs to be acquired. Some or all of these matters could be dealt with through platting, but should not be left to depend on that process which might occur soon, or not soon enough. Approval is recommended on the basis that near -in property with superior access and utilities, and presenting some development difficulties in terms of topography and wetlands, presents an ideal opportunity for the very imaginative grouping of structures and leaving of open space that single family lots discourage. Approval should be conditioned, however, upon Developer being bound to execute a grant of right-of-way for Pine - Wooley, and for Davis, as shown in the file and in current drawings by Kerr Surveying, from the northern edge to the property along Davis to Wooley, and from Davis to Lenora, without which access there would be inadequate transportation services for the ultimate occupants of this land, and an undue burden on other neighborhood streets. Approval should also be conditioned upon grant of an easement for the sewer line. As zoning actions cannot without consent of the applicant be subject to conditions to be carried out later (by use of an agreed development agreement), the recommendation must be to approve if rights -of -way are granted, and to deny if they are not. Rogers Family Trust,Vacation Application Lenora Street. Dawson Street, Fir Street, within part of McCa11's First Addition The request is to vacate streets which have never been built, which upon dedication of the Wooley-Pine Connector lands will be superfluous. Roads within the proposed housing development will be generated out of the planning for that development, and will be obliged to meet Fire Department access standards. The Staff recommends approval of the request, with the understanding that the request would be absurd but for the proposed grant of right-of-way for Wooley as shown in the file and in current drawings by Kerr Surveying, from the northern edge to the property along Davis to Wooley, and from Davis to Lenora. In other words, the City needs the current Lenora Street - Dawson Street route, unless it has been made unnecessary by the Pine - Wooley Route. There is a Court decision that we cannot condition a vacation upon action by the property owner, as one either needs or does not need a road, I. e. one cannot sell a right- of-way. This is a rule which may not apply to this situation, as it arose in the context of a broken promise to build a hotel. The sought promise here is to provide an alternate, better route. The safe thing to say is again that these streets are unnecessary if the other right-of-way has been granted, but are necessary until that time. These situations present a chicken -egg situation to be sure, but people of good will can work these things out. page 2 printed July 18, 1995 City of McCall. MINUTES: The minutes of June 20, July 10 and 26, 1995 were approved as presented on a motion made by Mr. Allen, seconded by Ms. Yandell and unanimously carried. PUBLIC HEARINGS SCHEDULED FOR 7:30 P.M.: 1. Right-of-way Vacation, Rob Hilton: The Chairman opened the public hearing at 7:50 p.m. There were no declarations made by any of the Commission members. The application was to approve the vacation of the alley separating the lots in Block 12, Lardo Subdivision. Rob Hilton gave a brief presentation, explaining that he would like to combine and reconfigure the 22 lots into 3 lots, without the alley separation. All new lots would have street right-of-way frontage. It was noted that Jeff Russell owned two of the lots in Block 12, and that he was in favor of the alley vacation. No one from the public wished to be heard and there were no letters in the file either in favor nor in opposition of the application. The hearing was closed to comment. After discussion, Allen moved to recommend approval of the vacation as presented. Yandell seconded and the motion carried unanimously. OTHER BUSINESS: Annexations: ******** The Commission discussed the possibility of annexing certain areas of the Impact Area into the City limits. After discussion McChrystal moved to recommend to the City Council that the Council consider annexation of the remainder of Sections 8, 5, -and 6, as well as the Shady Beach, Pilgrim's Cove and Brightwater neighborhoods. Allen seconded and the motion carried unanimously. The Commission also discussed auto sales and signs in the Scenic Highway District. ADJOURNMENT: At 8:25 p.m., with no further business, Allen moved to adjourn. Yandell seconded and the motion carried. THE CITY OF McCALL TRANSPORTATION ADVISORY COMMITTEE MINUTES March 27, 1995 Chairman Kirk called the meeting to order at 7:00 p.m. in the American Legion Hall of City Hall. William Kirk, Jodelle Barber, Tom Kerr, and Richard Cowdrey answered the roll call. Gary Shimun was present to represent staff. Hal Sager was also present. Minutes of the previous meeting: Kerr motioned and Barber supported to approve the minutes of the January 25, 1995 meeting. The motion carried. Member Dan Krahn arrived at 7:15 p.m. Chairman Kirk directed that the Timberlost VUFairway Ridge development be brought to the top of the agenda. Hal Sager presented the development to the Committee. After considerable discussion, Krahn moved to recommend to City Council that a Local Improvement District be formed and that Clements Street from Reedy Lane to Wooley Street, and that Spruce Street from Clements Street to Ponderosa Street be fully developed to City standards, including water and sewer lines. Cowdrey supported the motion. Krahn, Cowdrey, Barber and Kirk supported the motion. Kerr abstained from the motion. The motion carried. During the discussion it was noted by Hal Sager that the developer of Fairway Ridge would support the formation of a Local Improvement District to accomplish the tasks outlined in the above motion. Staff Reports: Shimun reported on the status of traffic lights for the intersections of Mission and Lake, and Deinhard and Third. Kerr and Shimun reported on the progress of land acquisition for the Deinhard-Boydstun Connector. Old Business: Shimun explained to the Committee City Council's direction to review the proposed bike path route through the City, and to use only those routes that do not need right of way acquisition. After reviewing the map, it was determined that areas in question were for discussion only, and that the recommended route was on present rights of way. Shimun was directed to get with Kerr to obtain a new map that outlined the recommended route through town. The status of the funds to construct the Deinhard-Boydstun Connector bridge was discussed. Box 1436 McCall, Id. 83638 208-634-7394 April 27, 1995 TO: Planning and Zoning, City Of McCall In the interest of reducing density we are asking Planning and Zoning to allow us to change the property lines of Block 12 in the Lardo subdivision, by combining 22 small lots to make 3 large lots, as shown on the enclosed map. This can be accomplished if the city would vacate the 20 foot road easement that runs thru the middle of block 12. Please consider this request which would be in the city's interest as well as the subdivision's. We thank you, ob & Lindy Hilton A lengthy discussion of the East Side Bypass right of way through Joe Scott's property took place. The Transportation Committee is concerned that the City is already a full year behind in this process. Shimun pointed out that the actual construction of that leg is contingent upon the sale of a certain number of lots by Spring Mountain Ranch, and that sales were no where near that trigger point at this time. Shimun was directed to contact Joe Scott's representatives to determine where all parties were at in these negotiations. It was suggested that Candy Anderson be asked to approach Joe Scott regarding the importance of the by-pass for completion of the bike path project. Information: Chairman Kirk noted that, a County meeting on the West Mountain Road Transportation Plan was scheduled for 7:00 p.m. on April 12, 1995 in the Senior Center. Since the Deinhard-Boydstun Connector would ultimately connect to this route, Chairman Kirk thought members would be interested. Lardo Townsite The request is to vacate an East-West alleyway within Block 12 of Lardo Townsite. This property is located North of Pinedale Street, East of Rowland Street, South of Parkdale Street, and West of the River. It is South of the Rowland Brothers plant. The land is in the process of being resurveyed into three larger lots. The zoning is High (Multifamily) Residential Zone B. Three larger lots would lend themselves better to a well -designed project, than would the myriad tiny lots that exist. There is no guarantee of a well -designed project, of course, but it would become possible. There is no apparent transportation need for this alley, now or in the forseeable future.
