VACATION OF PUBLIC RIGHT-OF-WAY
For value received, CITY OF McCALL, Grantor, an Idaho municipal corporation,
grants, bargains, sells, and conveys to the owner of the following described Lots, of
McCall, Valley County, Idaho, Grantee, the following described real property:
That portion of the alleyway between Lots 1 through 10, inclusive, and Lots
15 through 24, inclusive, within Block 12, Townsite of Lardo
located in Valley County, Idaho;
Subject to easements, reservations and exceptions of record, assessments and taxes not yet
accrued. Grantor warrants only that Grantor has neither created nor suffered any
encumbrance whatsoever against the subject property.

19. City of McCall, Planning and Zoning Commission Minutes of August 1, 1995.
a. Hilton Street Vacation. Mr. Burton gave a report. After discussion, Mr. Eckhardt
moved to adopt the Findings and Conclusions of the Commission and to approve the vacation.
Ms. Arp seconded and the motion carried unanimously.
b. Annexations. After discussion, council agreed to take the recommended annexation of
the remainder of Sections 5, 6 and 8 and the Shady Beach, Pilgrim's Cove and Brightwater
neighborhoods under advisement.
Old Business
20. Ordinance No. 681 Respecting Hawker's and Peddlers. Mr. Burton gave a report noting that
sales of services and rentals could be included in the ordinance. After discussion which included
approval of the concept of putting services and rentals into the ordinance, Mr. Colton moved to
suspend the rules requiring reading of the ordinance in full. Mr. Martens seconded. At a roll
call vote Messrs. Colton, Martens, Eckhardt, and Ms. Arp voted "aye." Mr. Burton read the
ordinance by title, adding rentals and services. The mayor ordered that the ordinance and
proposed Resolution No. 15-95 respecting fees be continued to the next agenda.
New Business
21. Request for Adjustment of Utility Account - Tom Welsh. Mr. Henderson gave a report. After
discussion Mr. Eckhardt moved to deny the request. Mr. Martens seconded and the motion
carried unanimously.
22. Request for Adjustment of Utility Account - Stanley Anderson. Mr. Henderson gave a report.
After discussion Mr. Eckhardt moved to deny the request. Ms. Arp seconded and the motion
carried unanimously.
23. The council acknowledged a claim for damage from Henry M. Purcell.

PLANNING AND ZONING COMMISSION
FINDINGS AND CONCLUSIONS IN SUPPORT OF
APPROVAL OF VACATION OF PUBLIC RIGHT OF WAY
The Commission finds that:
1. A petition for approval of vacation of a public right-of-way was presented for
public hearing on August 1, 1995 by Rob and Lindy Hilton, as owners of
Lots 1 through 10, and 13 through 24, Block 12
Townsite of Lardo
also known as 201 West Lake Street, specifically for the vacation of the alleyway
within Block 12, Lardo Townsite. The hearing was continued from July 18, 1995
to August 1, 1995 by the Commission members present in accord with MCC 3-
32-020(A).
2. The necessary notice was given to the public and to other public agencies and
entities.
3. The land in question is in Zone B and in part also in Zone SL, as it is bounded on
the East by the North Fork of the Payette River.
4. The alleyway is not needed for transportation purposes; the petitioner proposes to
re -plat the area into three lots, there is as noted no property at the far end of the
alley, and the alley has never been built.
5. There is adjacent property, namely Lots 11 and 12 of Block 12, which did not
join in this petition. Those lots front on Parkdale Street (not built), and Lot 12 also
fronts on Rowland Street, such that the alley is not the only access to them. One-
half the alleyway between Lots 11 and 12 on the North, and Lots 13 and 14 on the
South, should be vacated to each ownership. The entire alleyway east of those lots
should be vacated to petitioner.
The Commission concludes that:
6. The proposed vacation meets the purposes of IC 50-311 and the standards of
MCC 3-21-310 (C) as a matter of law.
7. The proposed vacation is appropriate.
