A petition for approval of vacation of a public right-of-way was presented for public hearing on May 7, 1996 by Jack Marshall on behalf of McCall Gas Station, Inc., as owner of or with the consent of the owners of all parts of Block 1, McCa11's First Addition to the Townsite of McCall, fronting on the alley. 2. The necessary notice was given to the public and to other public agencies and entities. 3. The land in question is in Zone CB, as is all the surrounding property. The alley in question extends east-northeast from Third Street (Highway 55) to a dead end at the former railroad right-of-way. 4. The alleyway is not needed for transportation purposes; the petitioner proposes to re -plat the area to facilitate development of a Planned Unit Development. 5. The alley right-of-way goes up a very steep hill toward its northeasterly terminus, and has never been built beyond the part of it on the flat land toward the highway. The Commission concludes that: 6. The proposed vacation meets the purposes of IC 50-311 and the standards of MCC 3-21-310 (C) as a matter of law, provided a necessary condition of approval is met. 7. The proposed vacation is appropriate. 8. The approval of the vacation should be granted pursuant to MCC 3-21-310 (C), subject to the following condition of approval required by the Idaho or City Code, that the vacation be effective upon the fili of a suitable replat, and be subject to an easement for utilities in place. Mr. Martens seconded and the motion carried unanimously. Mr. Colton moved to suspend the rules requiring three readings and reading in full for the purpose of considering Ordinance No. 698 vacating a public right- of-way. Ms. Arp seconded. At a roll -call vote, Mr. Colton, Ms. Arp seconded and Mr. Martens voted "aye." Themotion carried. Mr. Burton read the Ordinance by title. Mr. Martens moved to adopt Ordinance No. 698. Upon receipt of a request for vacation, an application form will be provided the applicant by the Building Department or the Administrator of the Planning and Zoning Commission. 2. The application will include: (two copies of each) a) a legal description of the property to be vacated, b) a reason for the vacation, c) a written narrative statement. d) a sketch map showing the property and names and addresses of owners of adjoining property. e) a letter from, or signatures on a petition of each owner of adjoining property. f) a deposit in the amount of $100.00 in addition, publication of notices and hearings will be charged to the applicant. 3. Upon receipt of the application, the Secretary shall provide a receipt for the deposit and refer the application to the Administrator of the Planning and Zoning Commission. 4. The Administrator shall notify all utility companies involved, fire district, water district, sewer district, city (if vacation is within one mile of city limits) and any other interested party or governmental agency and request a reply within 15 days. 5. The Administrator shall inspect the vacation area on the ground. 6. The Administrator shall then place the application on the agenda of the next meeting of the Planning and Zoning Commission for their review. The applicant will be notified of this meeting and will be given the opportunity to present the proposal. 7. Within ten days after considering the application in a regular meeting, the Planning and Zoning Commission shall make a recommendation regarding the application to the McCall City Council and the applicant shall be notified of the action taken. 8. The City Council will consider the application at their next regular meeting along with the recommendation of the Planning and Zoning Commission and shall either: a) deny the application b) give public notice of the application as required by I.C. 50-1317 and hold a public hearing, after which the Board may either: 1) deny the application 2) approve the application 3) modify the application 9. MINUTES: The minutes of February 6, 1996 were approved as presented by a motion made by Allen, seconded by Yandell and unanimously carried. PUBLIC HEARING SCHEDULED FOR 7:30 P.M.: 1. Riverside Subdivision, Alley Vacation and Re -Plat: The Chairman opened the hearing at 8:00 p.m. There were no declarations made by the Commission members. Scott Acker, representing the City as the applicant, gave a presentation of the proposal, which is to relocate a 25 foot wide strip of property known as Simmons Street to the existing alley west in Block 1, Riverside Subdivision. Lots 1 through 19 would remain the same size, the fronting street would be on the west instead of the east of those lots. No one from the public wished to be heard. The Secretary read one letter submitted to the file which opposed the replat. After discussion, Allen moved to approve the alley vacation and replat of Riverside Subdivision, subject to the approval of the Fire Chief. Yandell seconded and the motion carried unanimously. McChrystal noted for the record that the Commission was unhappy with the replat because of the size of the road, however they felt it was an improvement over the existing plat. The hearing closed at 8:10 p.m. OLD BUSINESS: 1. Findings and Conclusion, Townley Appeal: The Attorney explained to the Commission that he wished for the Commission to review the document to verify the intent. After review, Yandell moved to approve the Findings of Fact and Conclusions of Law statement, and authorize the Chairman to sign it. Allen seconded and the motion carried unanimously. The Chairman signed the original. NEW BUSINESS: 1. Presentation of Progress, Downtown Planning Subcommittee. The Commission had asked that the Subcommittee update their progress thus far. Rick Fereday, Scott Findlay and Dave Peugh were in attendance to present the Downtown District Plan. Fereday gave a history of the Subcommittee's goals and explained how those had changed. He presented the District Plan map and described the proposed over -lay zones. The Commission expressed approval of the Subcommittee's work, however no action was necessary or taken. 2. Change to the Scenic Highway District, Pat Allen: Pat Allen explained that he wished to enclose his existing structure located at 301 Railroad Ave, commonly known as Pat's Glass. After a brief discussion, Yandell moved to find the change to the Scenic Highway district compatible with its surroundings. McChrystal seconded and the motion carried, with Allen abstaining. ADJOURNMENT: At 9:20, with no further business, Yandell moved to adjourn. Allen seconded and the motion carried.
