The minutes of February 12 , 1990 were approved as presented.
Public Hearing: Vacation Request of Jack Phippen
The meeting was called to order by Chairman Eddins at 7 : 30
p.m. The purpose of this evening's meeting was to hold a
public hearing regarding the request of Jack Phippen to
vacate a cul-de-sac that is a portion of Valley Rim Road in
Valley View Subdivision #2 . This cul-de-sac intrudes onto
his lot; the vacation of the cul-de-sac would add to the
usable space on his lot.
It was stated for the record that the Impact Planning and
Zoning Notice of Hearing publishing fees in the amount of
$51.88 had not been paid.
Chairman Eddins asked the Commission to make any declarations
they may have; there were none. Ms. Eddins went on to read
the Staff Report.
Chairman Eddins stated that there were no proponents or
opponents in attendance.
The floor was then given to Mr. Les Ankenman, Valley County
Engineer from Cascade, Idaho.
Mr. Ankenman presented maps indicating the locations of the
utilities on the property and the cul-de-sac Mr . Phippen
wants vacated.
The hearing was closed to public comment.

Mr . Johnson made a motion to recommend approval of the
cul-de-sac vacation as presented.
Mr. Anderson seconded the motion and on a roll call vote, the
motion passed unanimously.
The hearing was adjourned at 8:00 p.m.
Valley County Street Map Project:
Mr. Les Ankenman, Valley County Engineer, proceeded to make a
presentation to the Commission on the Valley County Street
Map Project. Mr. Ankenman went through his set of maps with
the Commission and explained how the system works and
instructed the Commission on how Valley County had dealt with
the various inconsistencies found.
Books of the completed project will be distributed when the
project is complete.
Adjournment:
At 10: 30 p.m. , Mr. Boydstun moved to adjourn. Mr. Anderson
seconded and the motion carried unanimously.

for a Vacation ) Conclusions of Law
The matter of an application by Jack R. Phippen of 4103 S.W.
328th St. , Federal Way, Washington 98023 for a Vacation
having been presented to the McCall Area of Impact Planning
and Zoning Commission , (hereinafter referred to as the
Commission ) makes the following Findings of Fact and
Conclusions of Law.
FINDINGS OF FACT
Jack R. Phippen (hereinafter referred to as the applicant)
submitted an application to the Commission on January
18, 1990 for approval of vacation of the cul-de-sac located
at the southerly end of Valley Rim Road in Valley View
Subdivision No. 2 located Southwest of McCall, Idaho and more
particularly described as follows:
(See attached copy of Exhibit 14)
The application was pursuant to Section 3A-13-1 of the
Village Code of McCall entitled, "Subdivision Regulations" .
This application was for approval as set out in the Ordinance
titled Subdivision Regulations for Valley County, Idaho ,
Section 510. Procedure for Approval of Vacations of Plats,
portions thereof, public rights-of-way or easements.
Public Notice of Hearing was given on February 8 , 1990 .
Notice was published in the Central Idaho Star News and was
posted on the property, in the McCall Post Office, at McCall
City Hall and in the County Courthouse.
The Commission then held a public meeting on February 26 ,
1990 at 7:30 p.m. in the McCall City Hall, Council Chambers.
At the public hearing on this Request for Vacation, the
Commission was presented information by the applicant,
elicited comments from the community, received the staff
recommendations and accepted questions from those in
attendance.
The applicant presented that he is the owner of Lot 96 ,
Valley View Subdivision No . 3 . He owns all the property
adjacent to the cul-de-sac . He wishes to utilize the

cul-de-sac area for building and personal purposes in
accordance with all building codes.
The staff report was prepared by Leslie L. Ankenmann, P.E.
Nine property owners within a 300' radius of the applicant's
property were notified of the application for a Vacation.
The utilities and various public agencies pertinent to the
application were also notified.
There were no opponents present and no letters have been
received in opposition.
Other facts presented at the Public Hearing are:
1 . Lot 96 is currently a bare lot . It surrounds a
cul-de-sac platted in Valley View Sub. No. 2 . When
improvements are constructed on Lot 96 , they will
be required to meet local setback requirements. The
cul-de-sac provides the only access to the lot; the
front yard setback would be enforced from the
perimeter of the cul-de-sac .- The location of
future improvements would be drastically
restricted. Vacating the cul-de-sac would result
in 70 feet of frontage on Valley Rim Road for lot
96 while greatly reducing the affect setbacks will
have on the location of future improvements. More
efficient use of the lot will result.
2 . The plats for Valley View Sub. No . 2 and No . 3
provide for a public road connecting Valley Rim
Road with Ridge Road. There is no apparent need
for the cul-de-sac now that circulation of traffic
is assured. Future growth in the neighborhood will
not be adversely affected by the proposed action.
The cul-de-sac is not needed to provide access to
any property. It is not needed to provide existing
or .future utility service to properties in the
neighborhood.
3 . Staff has searched for negative aspects- of the
proposition, but has found none.
The Commission incorporates by reference the accumulated
record in this application which includes the tape recording
of the meeting-

CONCLUSIONS OF LAW
The Commission met to consider the disposition for the
Application for Vacation of the cul-de-sac located at
the southerly end of Valley Rim Road in Valley View
Sub. No. 2 on February 26, 1990. The actions and findings of
the Commission , which are the Conclusions of Law , are
governed by 3A-13-1 of the Village Code for McCall, Idaho.
The Commission reviewed the record of this application and
voted to recommend approval of the Vacation for the following
reasons:
1 . Proper application and fees were received .
2. Proper notice was given the public, adjoiners, and
agencies.
3 . Notice was posted on the property and in public
buildings.
4. Numerous agencies responded. No objections were
heard.
5 . The only property owner that responded had no
objection.
6. The petitioner owns all of the property, fronting
along the cul-de-sac.
7. The cul-de-sac is not needed for future development
of the neighborhood.
8. The cul-de-sac is not needed for utilities.
9. The cul-de-sac is not needed by any public agency.
A motion was made, seconded and carried unanimously
10. The cul-de-sac is not needed to serve the interests
of adjacent property owners.
11. The cul-de-sac has not been maintained at public
expense and has not been used by the public as a
street, driveway, or thoroughfare.
A motion was made , seconded and carried unanimously to
recommend approval for vacation of the cul-de-sac.

Based on these Facts and Findings , granting approval of
the Vacation of the cul-de-sac as proposed by the applicant
would comply with the Ordinance 391 of the McCall Village
Code and the standards expressed in Idaho Code 67-6501 et
seq. , titled "Local Planning Act" .
Therefore, the application for a Vacation should be and the
same is hereby recommended for approval for the reasons
stated above.

APPLICANTS STATEMENT: Applicant is the owner of lot 96, Valley
View Subdivision No. 3 . Applicant owns all the property adjacent
to the cul-de-sac. Applicant wishes to utilize the cul-de-sac
area for building and personal purposes in accordance with all
building codes.
STAFF ANALYSIS: The roads in the Impact Area are administered and
maintained by the County. Zoning and building matters are admin-
istered by the Impact Area P&Z and the City. This proposal involves
both jurisdictions . The Impact Area P&Z should consider those mat-
ters detailed in Section 510 . 3 of the Subdivision Regulations;
"The Commission shall review the proposed vacation with regard
to future development of the neighborhood. The Commission shall
also take into consideration the interests of adjacent property
owners, of utilities, and of various public agencies where pertinent
to the application. "
The decision of the Commission will be a recommendation of the
Board of County Commissioners who will consider the matter at their
March 12 meeting.

provide access to any property. It is not needed to provide exist-
ing or future utility service to properties in the neighborhood.
Staff has searched for negative aspects of the proposition but
has found nonce.
Public notice of the P&Z and Board meetings has been given in
the Star News. A notice was also posted on the property, in the
McCall post office, at McCall City Hall, and in the County Courthouse.
Property owners within 300 feet of lot 96 were notified by letter.
The petitioner is the owner of 100 percent of the frontage along
the cul-de-sac. This drastically limits the interests of any other
party. Vacated property is generally allocated. uniformly to all
adjoiners. This cul-de-sac, if vacated., should be allocated to the
petitioner.
AGENCY RESPONSES: a) Valley County. Road Supervisor: Valley Rim
Road, Ridge Road, and the coiinecting road are maintained on a year
round basis, including snow removal, by the County Road Department.
They have not maintained the cul-de-sac during the winter and would
rather not a.pent the time and expense it would take. The Road
Supervisor sees no value to the public road system and recommends
the cul-de-sac be vacated.
b) Valley County Assessor: Robert Downend states the proposed
vacation will have no affect on the Assessor' s office. For assess-
ment purposes it would be to their advantage.
c) Valley County Sheriff: Lewis Pratt sees no problem in granting
the request so long as Valley Rim Road is connected with Ridge Road.
d) McCall Rural Fire Department: Dale Points concurs with the
Sheriffs comments.
e) City of McCall: Larry Chalfant concurs with the County Road
Supervisor. Eliminating the cul-de-sac from public maintenance
would be in agreement with city policy.
f) Idaho Power: Dennis Barber states that Idaho Power has no ob-
jection to vacating the cul-de-sac. There are no existing facilities
that would be affected. Dennis provided a map showing the location
of a service box on the property. The box is for serving future im-
provements on lot 96 .
g) Contel: E.J. Hewitt reports that Contel has no facilities in the
cul-de-sac and does not need the cul-de-sac to serve the neighborhood.
PROPERTY OWNER RESPONSES : Chet McGinnis called the County office to
state that he could not attend the hearings but has no objection to
granting the request to vacate the cul-de-sac.
No other property owners have contacted the county office.

Your. petition to vacate the cul-de-sac at the southerly tip
of Valley Rim Road will be considered by the McCall, Idaho Area
of City Impact Planning & Zoning Commission at 7 : 30 P. M. on
February 26, 1990 at McCall City Hall. You or an authorized
agent must attend the hearing.
You are required to pay an additional $25 . 00 fee to the City
of McCall, P. 0. Box 1065, McCall, Idaho 83638 for their expenses
related to the P&Z hearing. You will also be required to pay the
cost for publication of the notice of hearing one time in the
local paper. You will be notified of that amount after the notice
has appeared in the paper.
The P&Z decision will be a recommendation to the Board of
County Commissioners. They will hold a public hearing on March 12,
1990 in the Commissioners meeting room of the County Courthouse,
Cascade, Idaho, at 2 : 00 P.M. .
We have received comments back from each agency contacted.
None of the agencies and neither utility company objected to the
proposal. We are just now sending notices to each property owner

The proposal is to vacate the cul-de-sac located at the

Since the Valleyview Subdivision is outside of the city limits,
and many years away from city services, I have no problem with the
vacation of the cul-de-sac. The city is against cul-de-sacs
anyway because of the dead end and snow removal problems. The fewer
of these cul-de-sacs, the better. Hopefully this is the county
policy also.

Valley County has recieved an application to vacate a portion
of Valley Rim Road in Valley View Subdivision No. 3. Since Valley
County has jurisdiction of the roads in the Impact Area, I believe
it would be appropriate for the Board of County Commissioners to- con-
sider the vacation. A Planning and Zoning Commission is required
to review the proposed vacation with regard to future development
of the neighborhood and to consider the interests of adjacent
property owners, of utilities, and of various public agencies. I
propose that the Impact Area Planning and Zoning Commission do that
review at a public hearing and make recommendations to the Board
of County Commissioners . I understand that actions of the Impact
Area P&Z are reviewed by the McCall Council.
If you agree with this procedure please set a date for public
hearing. I will circulate the application to the utility companies,
to the public agencies, and property owners within 300 feet.
If there is a fee for your commissions action please let me
know and I will contact the applicant.
