JOINT PLANNING AND ZONING COMMISSION
MINUTES -
September 14, 1993

CALL TO ORDER AND ROLL CALL:
The Chairman called the meeting to order at 7:35 p.m. The
secretary called the roll. Bill Erlebach was absent due to
illness. The Chairman declared a quorum present.
MINUTES:
The minutes of August 24, 1993 were approved as presented.
The Chairman introduced a new business item on the agenda which
was also pertinent to the Daly public hearing. The agenda was
rearranged to save time.
NEW BUSINESS
1. DAVIES, Lot Width/Length Ratio in Development Standards:
The Chairman read a prepared memorandum (attached).
Mr. Davies gave a presentation showing the proposed plat plan.
The Administrator stated the issue is the exemption from the
Subdivision Regulations adopted by the City.
After discussion, Johnson moved to declare the north portion of
Lot 2, Payette Lakes Cottage Sites, containing 17,250 square feet
a buildable lot, exempt from Valley County Subdivision
Regulations 130-29 (C), with the condition that the common
driveway be dedicated and the easement recorded.
Boydstun seconded and on a roll call vote the motion carried
unanimously.
2. DALEY, Preliminary Subdivision:
This item was originally scheduled for public hearing. In light
of the information obtained from the previous item, the
Commission determined that a public hearing was not necessary,
Valley County Subdivision Regulations 130-29 (C).
-Secretary Davidson read letter from State- Department of Lands.
Scott Acker from Toothman-Orton Engineeringalong with the
applicant, gave a presentation and fielded questions by the
Commission.
After discussion, Johnson moved to declare the division of Lot
151, Payette Lake Cottage Sites allowable and both lots
created as buildable lots with the following conditions:
1. Both lots are to use the common 20 foot easement for
driveways
2. The only access to the lake from 151B is through 151A and
3. No building permit shall be issued until the old building,
which is on the property line of 151 and 152, is removed.
Knipe seconded and on a roll call vote the motion carried
unanimously.
PUBLIC HEARINGS SCHEDULED FOR 7:30 P.M.:
1. PONDEROSA STATE PARK, SPECIAL USE PERMIT APPLICATION: *****
The Chairman introduced the application. The application is for
a special use permit to construct improvements to the North
Beach Park, namely toilet facilities, parking and handicap
accessibility. There were no declarations made by any of the
Commission members.
The Administrator presented oral notes concerning the lack of
sewer extension to the North Beach Area, and the improvements of
waste water management, and water quality if the application is
approved. He recommended that the application is appropriate and
a flood plain permit and 404 wetlands permit should be required.
Richard Taplan, Assistant Manager of Ponderosa State Park gave a
brief presentation and fielded questions from the Commission. No
one else wished to be heard and the hearing was closed to public
comment.
McCall City Code 3A-9-3 (H) Public and Semi-public Use was
quoted as the appropriate special use.
After further discussion, Boydstun moved to recommend approval of
the special use permit as presented. Johnson seconded and on a
roll call vote the motion carried unanimously.
The findings of the Commission are that:
1. The impact on the community and down stream is positive not
negative.
2. The water quality will be improved in the lake.
3. The fire access will be improved.
The Commission concludes that:
1. The use conforms to a special use, outlined in MCC 3A-9-3-(H)
Johnson moved to recommend that no second hearing be required,
noting no objections to the application. Knipe seconded and the
motion carried unanimously.
The hearing was closed at 9:36 p.m.
NEW BUSINESS CONTINUED:
1. SHEPHARD, preliminary plat:
Steven Shephard and Jo Zimmer gave a presentation. The concept
is to create 3 lots from an 8 1/2 acre parcel.
Shephard produced letters from Payette Lakes Water and Sewer
District and the McCall Rural Fire Department denoting compliance
to their respective standards.
Mr. Shephard was instructed to file a formal application for
plat.
2. ZONE CLASSIFICATION, Airport Planning Area:
After discussion, staff was instructed to deal with the unmarked
area of the zone map as zone E, Agriculture until the proposed
zoning ordinance is adopted.
OTHER BUSINESS:
Report on Tate Variance from Valley County Prosecutor:
Attached to the minutes is the memo from the Prosecuting
Attorney's office. After discussion the Commission instructed
staff to write the Tates a letter inviting them to re -apply for a
variance or remove the encroaching porch. The Commission also
noted that if the variance is denied, they may have to remove the
porch anyway.
ADJOURNMENT:
With no further business, the meeting adjourned at 10:35 p.m.

NOTICE OF PUBLIC HEARING
The City of McCall Area of City Impact Planning and Zoning
Commission will hold a public hearing on October 12, 1993 at 7:30
p.m. (or as soon thereafter as the matter may in its turn be
heard) at the McCall City Hall 216 Park Street, McCall, Idaho.
The hearing is for the purpose of receiving testimony from
