Dear Jeff,
I have reviewed the entire file on the street vacation and zone
change approved last August by the City. There were conditions
of approval contained in the Findings of Fact and Conclusions of
Law on each of these matters. I have attached a copy of these
documents.
As I read them the following are required before these actions
are final and are essential to complete prior to issuance of an
occupancy permit.
A.DEVELOPMENT AGREEMENT: This form is complete and on my desk.
The attachments however are not complete as follows:
1. We need a legal description for the entire project. We
have legals for the zone change area which does not include the
laundramat or bowling alley. The legal should include these
properties.
2. We have received the Engineer's certification of the
bond. We note that a 6' bikepath is expected. An 8' width will
be required. The development agreement will need initials for
this change.
3. The site plan as it addresses the city property shows the
berm and bike path along Deinhard. We discussed this on the
phone with you and Larry and I trust you understand the
corrections we wish to have made.
When these 3 items are complete, the Development Agreement
can be forwarded to the Council for approval.
B. ADDITIONAL RIGHT OF WAY FOR BIKEPATH:
We need the deed from you for the additional 5' of
right-of-way along Deinhard.
C. WATER AND SEWER EASEMENTS: We need as built drawings and 20'
easements for city operation and maintenance of the lines within
the project.
D. AGREEMENTS;
I need to have copies of written agreements with Smiths and
Downers and I believe, from Bill Bayse for access and snow
storage rights which were promised to them as a part of the
approval.
E. "LEASE": We need to. negotiate the terms of the lease and
present this to the City Council for approval.
F. WATER LINE INSTALLATION, UNDER RIGHT TURN LANE, DEINHARD
LANE:
This line is a part of the water bond minimum project. See
attached letter and sketch for details. There are several ways
to handle this, the easiest of which may be for your contractors
to install and to bill the city for this cost. We would need unit
prices prior to agreeing to pay these costs. It is unlikely the
city will have a contractor on board before you are ready to
pave. This will need some further discussion.
All of the above documents, except perhaps C and F above, must be
in my office before I can present the Development Agreement to
the Council. You may need to schedule an appearance on April_28
before the Council to secure relief from withholding an occupancy
permit, if these cannot be accomplished.

This letter is to advise you that on July 28, 1993, the McCall
City Council with a quorum present and voting in regular session,
considered your application for a zone change on certain property
and your request to vacate Eismann Street.
Those matters were both approved and the Council approved both

FINDINGS AND CONCLUSIONS IN SUPPORT
OF RECOMMENDATION OF APPROVAL OF
CONDITIONAL VACATION OF STREET
The Commission finds that:
1. A petition for approval of the vacation of a street was presented for public hearing
on July 20, 1993, by White -Leasure Development Company with respect to
Eisman Street.
2. The necessary notice was given.
3. Eisman Street, as platted, extends from Floyde Street to Deinhard Lane. Where it
lies along the boundaries between the Payette Lakes Care Center and Simplot
property, it bends to the west and then back to the south, and has not been built. It
has been built only for a short distance south from Floyde Street, essentially as
part of the driveway of the Payette Lakes Care Center, which driveway extends
due south from Floyde Street to the Care Center building. The portion of the right
of way that has been paved is thus a peculiar shape at the south end, where the
right of way bends west, but the road goes straight.
4. The street as platted abuts to its east, listed from north to south, the property of the
Simplot interests, the property of the Care Center, and Simplot property affected
by White -Leasure development proposals. The street as platted abuts to its west,
listed from north to south, the property of the Dr. and Mrs. Lester Downer, the
property of the Simplot interests„ and the Simplot property affected by White -
Leasure development proposals.
5. The road today physically provides access to the Care Center, access to the rear of
Dr. and Mrs. Downer's property, and right of way for water lines and possibly
other utilities.
6. The road has certain characteristics which make it unattractive from the point of
view of considering its being opened throughout for traffic. First, the right-of-
way is very steep where it descends a bluff line between the Care Center elevation
and the White -Leasure development area. Second, its southern terminus is too
close to Highway 55 for safe traffic flow. Finally, its unbuilt portion lies between
or on property of the applicants, and they do not want the road to exist. The road
could, if built, provide access to and from the area of proposed development.
7. The proposed street vacation is without harm to transportation needs provided
certain concerns are addressed, namely adequate traffic flow onto and off of the
area of the proposed development, and protection of access and utility rights, as
required by statute.
The Commission concludes that:

8. There are necessary conditions of approval, including some from a prior action
with respect to a rezoning:
a. Execution of a Development Agreement in form and substance
satisfactory to the Administrator and the Attorney, and approved by the
City Council, as expressing the conditions of this and prior approvals.

b. Access to the parcel from Highway 55 shall be across adjacent, purchased
property of the same owners, well north of the Deinhard intersection;
c. That a free right turn lane should be provided to Highway 55 prior to
construction of phase two of the development;
d. Five feet additional right of way shall be dedicated for Deinhard Land
across the whole frontage of the ownership;
e. A bike path shall be provided more or less parallel to Deinhard Lane and
connecting east and west at locations approved by -the City, across the
whole frontage of the property;.
f. An agreement must be reached in writing between the persons receiving
reconveyance of the right of way and the following owners to assure their
continued use and access:
(1) Duane and Alberta Smith respecting snow storage in the former
right of way of Eisman Street east of and for the benefit of the
Smith property;
(2) Dr. and Mrs. Downer and for the benefit of their property
providing access to the rear of their property;
(3) The appropriate Simplot interest and for the benefit of their
property presently to the west of Eisman Street;
(4) The City of McCa11 respecting water lines including fire hydrant
supply; and
(5) Idaho Power Company and GTE respecting any utility lines in the
Eisman Street right of way.
Vacation should be down the centerline at points south of the north
property line of the Payette Lakes Care Center property; and to the benefit
of the Care Center north of that point, to provide continued access to the
dominant user.
h. All survey, document preparation, and recording costs are to be borne by
the applicants.

FINDINGS AND CONCLUSIONS IN SUPPORT
OF APPROVAL OF A ZONING MAP AMENDMENT
The Commission finds:
1. A petition for approval of a Zoning Map Amendment was presented on July 7,
1993 by White -Leasure Development. The application respected a metes and
bounds description of approximately 20 acres of land in turn approximating the
S 1/2 SW 1/4 NE 1/4 of Section 16, T. 18 N., R. 3 E., B. M., located generally
west of and adjacent to the Department of Lands/STTPA project, north of
Deinhard Lane, east of the commercial strip on Highway 55, and south of the
Payette Lakes Care Center and the Housing Southwest senior housing
development off Floyde Street, more particularly described on Exhibit A.
2. The request was for reclassification from Zone A to Zone D, General
Commercial.
3. The lands to the east, south, and west of the subject tract have commercial or
industrial zoning. The Commission has already recommended that the subject
property be reclassified into the General Commercial Zone as part of the areawide
rezoning proposed as part of the new proposed zoning ordinance process. The
land owners to the north generally support the application as evidenced by theirs
letters and petitions.
4. There was no opposition. The applicant did not object to a development
agreement being required addressing certain concerns.
The Commission concludes:
5. The proposed reclassification of the property does not require an amendment to
the Comprehensive Plan.
6. The Commission recommends approval to the Council, subject, however, to the
execution of a development agreement addressing:
a. A buffer area of not less than 50 feet in width along the northerly
boundary of the tract maintained in natural vegetation, but for a possible
water line alignment and footpath.
b. Highway 55 access as to safety and effectiveness.
c. Water supply and easements.
d. Use of natural materials on the exterior of buildings.
e. A bike path functionally parallel to the Deinhard alignment.

Reference: Marketplace Shopping Center-SH 55 & Deinhard Lane Preliminary
Channelization Plan
Dear Mr. Keating
The referenced Channelization Plan affects the alignment of the proposed 8" waterline along
Deinhard Lane that is included in the Water Master Plan and Minimum Project. The attached
copy of the Channelization Plan shows the proposed alignment of said waterline in red. I
recommend that the waterline be installed prior to any road improvements.
The design of the waterline is 80% complete and is planned to be part of the Water System
Improvement Project, scheduled to start late summer of 1994 and continue through 1995. It is
possible to construct the waterline earlier under a separate contract or make it a requirement of
the roadway work. Regardless of how the projects are initiated, I further recommend to execute
them concurrently to realize a waterline installation savings of approximately $6,000.00.

RE: Street Vacation request
I. ISSUES:
The request before you is the vacation of Eismann St. between
Floyd and Deinhard Lane.
II. DISCUSSION:
A street right-of-way exists for Eismann Street however no
street has ever been constructed on the property. It is unlikely
that the city would build this street and if constructed the cost
to conquer the geography would be excessive.
III. RECOMMENDATION:
There are no standards for determining the merits of a
vacation. The basis for that is your judgement and discretion.
If you elect to recommend to the Council the vacation of the
right of way, the following should be conditions of that action:
1. That access to the assembled parcel be as presented in
the Development plan to Highway 55;
2. That a free right turn lane be constructed prior to
commencement of Phase II of the project, at developer cost on the
northeast side of Deinhard Lane;
3. That an additional 5' of right of way be dedicated along
the Deinhard frontage;
4. That a bicycle path along the Deinhard Lane frontage be
constructed at developer cost to a standard approved by the city..
5. That an agreement with Duane Smith, A-1 Storage be
executed and a copy filed with the city and recorded to provide
snow storage as required by Mr. Smith and any future owner;
6. That the vacation be down the centerline, except for the
Floyd Street area, where the right -of way shall be dedicated to
the Nursing home for access.
7. That all surveying, recording and other costs be borne by
the applicant.

Dear Sue:
As a representative of the land owner this letter shall serve as our formal request to vacate
Eisman Street. We propose for your consideration the following reasons for vacation.
A. Taking into consideration the present and future development in the vicinity of
Highway 55 and Deinhard Road it appears that the current location of Eisman
Street is inappropriate to service the future needs of this area.
B. We believe that a future street at this location would provide a very negative
impact on the residential area to the rear of our property and present and future
residential properties on Floyde Street, regardless of the proposed uses being
developed on our landlords property.
C. There appears to be major topographical obstacles to overcome if the road were
to be constructed in the future in its current location.

Dear Sue:
It is our understanding that in the event the City of McCall does allow the vacation of Eisman
Street that a portion of the property will revert to the J. R. Simplot Company. Further it is
our understanding that at the time of vacation and transfer that the property will automatically
be given the same zoning designation as the property it is enjoined with as long as the square
footage of the vacated property is substantially less than the square footage of the dominant
parcel.
Sue, I would appreciate it very much if you would confirm this for me.

Typically when a street is vacated a center line is followed and
each half is transferred to the respective adjacent property
owner. Additionally, the zone assigned is the same as that
property to which it is attached.
