The City Council of the City of Lynwood met at a regular ses- sion, in the Council Chamber of the City Hall, 11331 Plaza Street, on above date, at 7:30 P. M. Mayor McMeekin in the chair. Councilmen Meyer, Willard and McMeekin answered the roll call. Councilmen Christensen and Lake were absent. It was moved by Councilman Meyer and seconded byCouncilman Willard that the minutes of the previous regular meeting of~ August 4, 1942 be approved as written.- A11 members of the Council present voting aye, the Mayor declared the motion duly carried and it was so ordered. WRITTEN COMMUNICATIONS: A communication was received from the Los Angeles County Divi- sion of League of California Cities inviting the Council to 'attend their next meeting to be held at the Hermosa Beach Bil tmore on August 2?, 1942, at 6 P. M., speaker to be Jude Peirson Ha11. There being no ob~eetion, said communication was ordered filed with the suggestion that anyone who wishes to attend to so notify the City .Clerk in order that reservations may be made. A communication was received from Eva Smith, Camping Chairman of Lynwood G~.rl Scouts Council thanking for use of Constitution Park for their first day camp. There being no objection, said communication was ordered filed. At this time Councilman Lake arrived and took his seat at the Council table. A communication was received from The Regional Planning Com- mission of Los Angeles County requesting that when subdivisions are ap- proved by Cities, that they first consult the Highway map of Master Plan of .Highways for L. A. County to assure that the Streets are laid out to provide. for. right of way for approved County highways heretofore approved by Cities. It was moved by Councilman Meyer and seconded by Councilman W111ard that in the future all subdivision maps be first approved by the City Engineer who is to consult the Master Plan of the County to ascer- tain that it complies with approved highways. All members of the Council present voting aye, the Mayor declared. the motion duly carried. A communication was received from Mrs. Ivan Rubeshaw, 2?27~' E. 108th Street requesting that the City do something to provide sewer faci- lities for her use as she. has two buildings on her property and there- fore is in dire need of sewer facilities. There being no ob,~ection said matter was referred to City Engineer Bateman to investigation. A communication was received from Mills Alloys, Inc. thanking the Council and Fire Chief for action taken in connection with clearing the fire hazard which existed north of their plant and south of the P. E. right of ws~y, however, now appealing far like action south of their plant as it is very much of a fire hazard too. A communication was also. received from the Lorraif~e Corporation likewise requesting that the City take action which will eliminate the fire hazard that exists south of their factory on account of old lumber being stored thereat. There being no objection, Mayor McMeekin referred this matter tt~ re Chief Lewis for action to see that something is done which will eau a said fire menace to be abated. A communication was received from Jesse O~Laverty requesting that he be permitted to take up his tax deeded Lot No. 1251, Tract 3335 on an installment basis .of X10.00 per month. After due consideration, it was moved by Councilman Lake and seconded by Councilman Meyer that the City Clerk be authorized to notify the appliaat~b that he may buy the tax deed at the same pries as offered t© the City by the County, however, that the bonds will still be against the parcel. All members of the Council present.voting aye, the Mayor declared the motion duly carried. The hour of 8 P. M. having arrived, said time being the hour fixed for hearing any objections or protests in connection with the construction of a proposed sewer. system in the southeast and .northeast portion of the City of Lynwood, as required by the "Special Assessment Tnveatigation Limitation and Majority Protest Act of 1931," as amended. The City Clerk stated that notices of said hearing had bean mailed to. all property owners in the district notifying them of the proposed assessment as estimated by the City Engineer, and that an affi- davit of~ such mailing is on Pile in his office. Thereupon the City Clerk read the report of the City Engineer in connection with said proposed improvement ss filed on Juiy 14, 1942. The Mayor inquired of the City Clerk whether or not ~,3y writ- ten objections or protests had been filed. The City Clerk stated that one had been filed by Mr. G. R. Magnuson, protesting against th® ~~ cost of Mr. and Street; Harold Street. e uncil protesting to the the proposed improvement as affecting their respective lot: Messrs. R. L. W. Gardner, 10861 Alexander The following addressed the Council in favor of proceeding with the proposed work: Messrs. C. W. Arnett, 10821 Jackson Street; Mr. Scheidt, 10931 Alexander Street; Mrs. Bixby, 4309 Imperial Highway; R.. Algard, 12122 S. Gertrude>'Street; L. B. Haworth, 10982 Elm Street, ; M. A. Ber- Hard, 10934 Alexander Street; M. G. Mays, 12035 Cornish Street; I. Beach, 10913 Cornish Street; R. L. Latch, 12029 Muriel Street, and Leonard Hunt, 10952 Elm Street. After due consideration of all the matters presented to the Council, it was finally decided that if any protes.tants submit a peti- tion signed by a majority of the property owners on any given street that the City Council will consider excluding the Street from the pro- ceedings, provided it does not otherwise jeopardize the proceedings, and provided it will not interfere with main trunk lines to_serve other parts of the project. The City Council stated that these petitions, if any, must be presented Monday morning in order that they may be reviewed by the City Engineer to determine whether or not they. are signed by a majority of the property owners residing on the Street affected. The Mayor made it clear on behalf of the City Council that if a ma.,jority protest petition is filed covering all of the area affected by the pro- posed improvement then the proceedings will be stopped. Thereupon it was. moved by Councilman Meyer and seconded by Council wan Willard that the hearing be continued to August 24, 1942, at 7:45 P. M. All member s. of the Council present voting aye, the Mayor declared the motion duly carried and it was so ordered. A communication was received from H. L. Byram, Tax Collector, Los Angeles County, making demand upon the City Council to make a levy to service Refunding A. & I. No. 7 delinquency existing for f iseal year 1941-42 in the amount of X3,214.78, or pay said amount from the General Fund. Inasmuch as this delinquency has been taken care of by the City 1n the liquidation of tax deeded Lots and through General Fund advance, no further action was taken by the City Council and the com- munication was ordered filed. A communication was received from W. B. McKesson, Public Em- ployees War Savings Committee for Southern California, suggesting that a Resolution or Ordinance be adopted which will provide for a payroll deduction by the City on behalf of City employees for purchase of war saving bonds and stamps. There being no objection, the Mayor ref erred this matter to City Engineer Bateman, Chief of Police, Fire Chief, City Treasurer and City Clerk to investigate and recommend a procedure to take care of the matter. An application for permit to operate a palmistry at 11430 L. B. Blvd. was received Prom George Adams,. 932 E. 25th St., L. A. attach- ing~'lieense fee for first quarterly license. It was moved by Council- man Lake and seconded by Councilman Meyer that permit be denied. All members of the Council present voting aye, the Mayor declared the mo- tion duly carried and it was so ordered. A eommu nieation was received from. Chas... A. Ruby, City Attorney, advising that he had successfully prosecuted the case in connection with removal of the obstruction on Alameda Street of the Owl Cafe through Superior Court; also submitting a bill in the sum of X25.00 as addition- al Attorney fees in connection with said work. The following persons addressed th Co ~J NEW BUSINESS: A quitclaim deed covering Lots 1, 2, 60, 61, 62, 63 and 121, License Surveyor's Map was eubmitted,•wherein the Building and Loan Commissioner of the State of Calif orn•ia, through its Officer Harley Hise, conveys its interest in said i,ots to •the City of Lynwood, said deed be- ing dated July 17, 1942. An Ordinance, entitled: "An Ordinance. of the Incorporated City of Lynwood, California, establishing Tax District No. 1 and No. 2 of said City, fixing the rates of taxes, and levying texas for the fiscal year beginning July 1, 1942 and ending June 30, 1943," was introduced and read for the first time. It was moved by Councilman Lake and seconded by Councilman Meyer that said Ordinance be accepted as read the first tide and pass to the second reading. An Offer was received from Carmelo Gattuso to purchase Lot X25 Tract 3172 for the sum of X500.00, he to qui~~ title himself, otherwise the Lot to be sold free and clear to the prospective purchaseP. An Offer to purchase Lot 293, `t'ract 2651 for the sum of X550.00 was•received Prom Chas. A. Ruby, the City to quiet title thereon, and the lot to be clear of all taxes, assessments and bonds of record. An Offer was received from Florence P. Willard to purchase Lots 35 and 36, Block 17, Mod~eska Park for the sum of $300.00, on which the City holds tax title and fee title to, said Lot to be cleared off all taxes, assessment and bonds of record. A communication was received from~Alma 3. Burk offering to pur- chase Lot 30, Block 2, Mod~jeska Park for the sum of X100.00, free clear of all taxes, bonds and assessments of record, and on which the City now holds tax title and fee title. A report and communication was received from the appraisal com- mittee who appraised certain Lots to be offered for sale and other Lots on which offers are filed, making the fi~llowing recommendations to the City Council: 1. That the offer of Carmelo Gattuso to purchase Lot 925, Tra-ct 3172 be accepted as per his bid. 2. That the offer of Chas. A. Ruby to purchase Lot 293, Tract 2551 be accepted as per his bid. 3. That, the offer of Florence P. Willard be accepted to pur- chase Lots 35 and 36, Block 17, Mod,eska Park for the sum of X300.00, as per her bid. 4. That the offer of Alma S. Burk to purchase Lot 30, Block 2, Mod~jeska Park for100.00 be rejected, however, that the Lot be offered for sale to her for X135.00 free and clear. The appraisers also submitted appraisals on certain other lots listed in the communication dated August 18, 1942. Thereupon it was moved by Councilman Meyer and seconded by Countilman Lake that the recommendations of the Appraisal Committee per- taining to the sale of these properties as listed above be accepted and that the sale be consummated;~that the Tax Deed be secured from the Coun- ty of L. A. and papers drafted for completion of the transactions, and the City Clerk be directed to notify Mrs. Burk about the action in connec- tion with her offer.
