M. In the absence of Mayor McMeekin the meeting was called to order by the City Clerk and upon roll call it showed the following present: Councilmen Christensen, W'llard and Meyer. Councilmen Lake and McMeekin were absent. It was moved by Councilman Christensen and seconded by Council- man Willard that Councilman Meyer be appointed to act as temporary Chair- man and Mayor protein. A11~members of the City Council present voting aye, the Mayor declared the motion duly carried and it was so ordered. A Grant Deed was submitted, wherein the City of Lynwood proposes to convey their interest in Lot 1393, Tract 3389 to Harvard B. Anderson and Phyllis Anderson. • Thereupon RESOLU`T'ION N0. 1472, entitled: "RESOLUTIOT~i SELLING CERTAIN REAL ES`T'ATE AND AU`T'HORIZING TH~~' EX~:CU`T'ION OF A DEED UPON PAYI~IEN`1' OF THE CONSIDERA`T'ION NA~rIED THEREIN, ", was read. It was moved by Council- TM~an Christensen and seconded by Councilman Willard that said Resolution No. 1472 be adopted. Ro11 Ca11: Ayes: Councilmen Christensen, Willard and Meyer. Noes: None. Absent: Councilmen Lake, and McMeekin. A Grant Deed was submitted, wherein the City of Lynwood proposes to convey their interest in and to Lot 925,`Tract 3172 to Carmelo Gatuso and Carmela Gattuso. Thereupon RESOLUTION N0. 1473, entitled: "RESOLUTION SELLING CER`T'AIN REAL ESTATE ArvD AUTHORIZING THE EXECli~T`ICN OF A DEED UPON PAYMENT OF THE GONSIDERATICN NAP~IED 'T'hEREIN," was read. It was moved by Council- man ~Nilla.rd and seconded by Councilman Meyer that said Resolution No. 1473 be ador•~ted. Roll Call: Ayes: Councilmen Christensen, ti'Villard and lUieyer. Noes: None. Absent: Councilmen Lake and McMeekin. A communication was received from J. Cavanaugh appealing to the Council to have the pavement in front of 11629 Long Beach Blvd. fixed as the concrete has "Buckled", and when heavy trucks cross the ridge it causes a tremor. There being no objection, said communication was ordered turned over to the City Engineer for his attention. A communication was received from Mrs. Readmar Siekel, 11213 Peach Street, offering to purchase tax title to Lots 2 and 3, Block I7, Mod,jeska mark for a total consideration of X200.00. The City Clerk stated that th.e appraisal Committee hens approved this offer and recommends that the sale be made. Thereupon it was moved by Councilman Christensen and seconded by Councilman Dillard that the offer be accepted and that said Lots be sold to Readmar Siekel for a total consideration of 200.00, free and clear of all assessments, taxes and bonds of record. Roll Call: Ayes: councilmen Christensen, Willard and Meyer. Noes: None. Absent: Councilmen Lake and McMeekin. The City Clerk stated that Mr. H. A. Behnke who is Trustee of funds in Refunding A. & I, Districts 6,9 and IO set up in. Escrow is contemplating on ,joining the navy and if he does it would be advisable for the City to appoint another Trustee in order that funds, if any, may be disbursed with- out delay when they accumulate, however, that. Mr. Behnke desires that an audit be made of the accounts so that he would be cleared before he submits his resign$tion, therefore, the City Clerk suggested that the Council ap- point a competent auditor to do such~:ork. Thereupon it was moved by ~ouncilmPn Christensen and seconded by Councilman Willard that W. R. Wright be emp3;vyed to make such audit. doll Call: Ayes Councilmen Christensen, Willard and Meyer. At this time Councilman Lake arrived and took his seat at the Council table. ~~ ORDINANCE NO. 376, entitled: "AN ORDINANCE OF TriE CITY OF` LYN_ V~OOD, CALIFONNIA, GItAN`l`ING Lr'AVE OF ABSENCE FOR SERVICE ?"N `This AR?br'D FOR_ CES OF THE UNI'T'ED ST'A'TES TO r~JiPLCY'r;ES AND AFPOIN~l'ED OFFICERS OF SAID CITY AND F TXING PROCEDURE FOR NO`~ICE 'THEREOF," was read for the second time. It was moved by Councilman Christensen~~ nd seconded by Councilman Willard that said Ordinance be adopted as read the second time, finally pass and be published as reruired by law. Roll Cal_1: Ayes: councilmen Lake, Christensen, ',Willard a.nd Meyer. Noes: None: Absent: Councilman McMeekin. A communication was received from A. L. Young, on behalf of J 0. Law submitting offer of X500.00 for the ~3urchase ~of Lot 226, Tract 2551 free anc~ clear of'all taxes, assessments and bonds of record. The City Clerk stated that t'r_is bid was in -'ine with appraisal as made by the Ap- praisal Committee some time ago. Thereupon it was moved by Councilman Christensen and seconded ""'1 by Councilman Willard that said offer be accepted, subject to 1942-43 taxes. The hour of 8 P.P~. having arrived, said time being the hour fixed for hearing any protests or ob,jectians in connection with the pro- posed work or improvement, the extent of the district to be assessed, or the grades to which the ~rork is proposed to be done, as described fully in Resolution of Intention No. 1458 heretofore adopted. The City Clerk stated that Affidavits of publication of said Resolution of Intention,, Affidavit of Posting and Affidavit of Mailing setting forth the time and place of sai~? hearing were on file in his of- fice. The Mayor pro tem announced that this was the time and place for a hearing in connection v!~ith said matter, inquiring of the City Clerk whether or not any written objections or protests ha d. been filed. T~nereupon the City Clerk read a protest from Mrs.. Marie Wyranch, as oVaner of Lot 60, Tract 6312, as she does deem it advisable at this time to go ahead with the improvement. Also a written protest from a Margaret Wright, as owner of Lot 103, Tract 6312, protesting because of the high cost and shortage of labor and materials. Also a written protest from Sequoia Investment Corporation, by Chas. H. Scott, S~'cretary, protesting as owners of lots 9, 10, 11, 12, 13 14, 15,16, 17, 25, 26, 37, 38, 39, 40, 41, 42, 43, 44, 45, 53, 64, 65, 68, 71, 85, 93, 92, portions of Lots 95, 96, 97, 98, 99, 118, 119, 12~, 121, 122, all of Lots 123, 124, 12;-, 126,128, 145, 146, 147, 148, 149, 150, 151, 152, 153, 1;,6, 162, 172, 174, 175, 176, all in Tract 6312, on the grounds that the total cost of the project is excessive due to abnormal war condi- tions; that it would be more in keeping to allow the present supply of labor and materials to be used on war efforts; that the project would be a worth w~aile one after the war; that there is no assurance that the sub- stitute materials vrould be satisfactory; and that only improperly construc- ted cesspools have caused trouble. A Petition was received signed by Mrs. Wm. J. Grayson and other property owners requesting that Cornish Avenue be excluded fram~the present sewer project, which is signed l~~y 46.70 of -the property owners fronting ti~:ereon according to the City Engineer, but including the protest as filed by Chas. H. Scott would be in excess of 50~. A Petition was received signed by Mrs. L. R. Sch3otterbech and 1C other property ~rwners o~^~r~ing property on Colyer Avenue, between Imper- ial High`vay and. Pendleton Avenue petitioning the Council to institute pro- ceedings for the construction of sanitary sev,Ters along said Street, which according to the City Engineer i~ signed by 50.340 of the assessable frontage in favor of sewers. Mr. A. L. Young, owner of property at 10919 San Vincente Avenue addressed the Council requesting tra.t San Vincente Avenue be included in the pro,jeet, int-rod.ucin~~• the other two resident propoerty owners on the Street, submitting their need for se~n7er f=cilities as the cesspools are c'1.~?. ,and full to capacity. Engineer Bateman explained why said Street was not included in the present project, because there are so many tax deeded Lots along said Street on which the proposed assessments would not be saleable on account of excess indebtedness eauwed by other refunding bonds and taxes which have accumulated, however, that the Street may be able to be included if the Council sees fit and if the City is wi11_ing to purchase the non-saleable bonds thereon. 3~ Mr. Speer, 10419 McNerney Avenue, addressed the Council de- siring information as to the cost of the sewer, which was answered by the City Engineer as nearly a.s it can be ascertained at the present time. Mr. Speer stated that the cost has been misrepresented, and that he is very much in favor of the project on the cost basis as explained by the Engineer, as his cesspools have given him much trouble. After-due consideration of all protests and petition heard in writing and orally, it was duly moved by Councilman Lake and seeond.ed by Councilman Willard that the hearing be concluded and that the Peti:~ions for inclusion and exclusion into and from the district be considered by the Engineer when the Resolution are drawn up for adoption of the Council at their meeting to be held on September 15, 1942. All members of the Council present voting aye, the Mayor pro tem declared the motion duly carried.
