It was moved by Councilman Christensen and sec~;nded by Coun- cilman PJleyer that the minutes of the previous adjourned regular meeting of September 29, 1942 be approved as written. All members of the City Council voting aye, the Mayor declared the motion duly carried and it g7as so ordered. 1x1RIT"IEN Cc~TvIIv'UI~ICATION: A communication was received from Lynwood School District ex- pressing their appreciation for the fine spirit of cooperation of the City Council in making the playground project a -success in sharing in the expense thereof. There being; no objection said communication was ~ ordered filed. ' ~ A communication was received from Donald G. Carver to the effect that beginning on October 1, 1942 he ~~rill be in active duty in the U. S. Guard for the duration of the war, therefore according to the wishes of the City Council he is advising of his service in the armed forces. It was moved by Councilman Ivieyer and seconded by Council- man Christensen that Police Officer Carver be granted a leave of absence from the Department as provided by Ordinance r1o. 376. All members of the Council voting aye, the Mayor declared the motion duly carried. A communication way received from City Engineer A.J. Bateman recommending for the consideration of the City Council certain increases in salaries of employees. After due consideration thereof, it was moved by Councilman 'Willard and seconded by Councilman Lake that the recommen- lotions of Engineer Bateman be accepted and that the salaries of Fire Chief Lewis be increased from X207.90 to "2'5.00 per month; the salary of Engineer Engineer Earl Gallaher fro m X179.02 to X190.58 per month; the salary of Fireman E. Yolton from X140.00 to X160.00 per month; the sal- ary of Paul Brodhagen from 152.26 to X157.50 per month. City Engineer stated that these increases were provided in ,the ~ud~°e t. A communication wa.s received from P~Iayme Cooper making appli- cation for a license to operate a used car lot at 10749 L. B. Blvd. It v~Tas moved. by Counc~lm~n ti'r'illard and seconded by Councilman Christen- sen that permission be granted, however, with the understanding that there shall be no wrecking of ears thereat, and no buildin~~ constructed without the approval of the Building Inspector. All members of the Co'mcil voting aye, the PJiayor declared the motion duly carried and it was so ordered. A communication was received from Ivi. Tellefson expressing his appreciaticn for the opportunity of installing ~ system of keeping ordinance records. There bu ng no objection, said communication was ordered filed. A communication was received from City Attorney Rub~.r to the effect that the flood cases brought against the City of Lynwood., County of Los Angeles and Pacific Electric Railway in_the year 1938 have fin- ally been dismissed and so far as the City is concerned, finally dis- posed of, submitting a bill for attorney fees in tt~e sum of 25.00. It was rioved by Councilman Ivieyer and seconded. by Councilman Willard that the demand for Attorney fees be paid. Roll Call: Ayes: 'Councilmen C'^ristensen, Lake, Meyer, tMillard and Mc- Meekin. Noes: None. a~nrriunication was received from City Attorney Ruby report- ing on the~~rouF~ht by the Government of the United States vs. the City of Lynwood, et al, recommending that no appearance be made in Court in defense of said action as the cost of such appearance would be in ex- cess of the amount that would ~`~crue to the City if the case uTas de- cided in favor of the Defend~_nts, also stating that the County no doubt will appear _n defense of the matter. It was moved by Councilman Lake and seconded by Councilman Meyer that the City of Lynwrood make no ap- pearance in Court in connection with said matter. Iuiaxv!rell, dated Septemti-er 22, 1942, whereby she deeds to the City of Lynwocd a portion of Lot `? of the subdivision of the J. J. Eullis 7 11/100 acre lot, needed in the opening of S~ntP Fe Avenue, eras submitted. It was moved b;• Council- man Meyer and seconded b.T Councilman Lake that said deed be accepted and that the City Clerk be directed to cause laid instrument to be re- cor~ed in the office of tree Recorder of Los P.ngeles County, California. M. having arrived, said time being the h^ur fixed for a hearing, in connection with changing the zoning or Zone"Rl to Zone M2 as affecting Bl asks 2, 4, 6, 8,10,12 and 14 of Tract 5418, as per notices posted along the affected district and per notice published in the Lynwood Prdss. The &iayor announced that this was the place and time for hear- ing any protests or objections relative to maid matter, inquiring of the City Clerk vrhether or not any written protests had been filed. Thereupon the City Clerk presented and read t1A~o petitions that had been filed in his office, protesting the changing of the zone in said Tract on the grounds that this tract was originally set up as a residential district; that a change of zone would decrease the value of their properties; that the proposed new zone would only encourage small factory sites with small financial investments; that it would be unfair to existing home owners who reside there, and certain other arguments against said zone change as set forth fully in said petitions. Said petitions ~~aere signed by Carry Lavoie and 48 others and one peti- t-ion by James C. Cruikshank and. 22 others. ~'he Mayor inquired of the audience whether or not there was any one present v~r'r_o dished to protest in connection with said matter. Therupon Attorney R. P. Moffitt addressed the Council on be- half of Gregory P. Pano.~:ulos the petitioner, stating among other t^ings that his Client has resided at 2701 110th Street since 1~~~; th~.t ir. 1934 he went into the truckingbusiness, and su}ti~sequently pr~rc'.^.ased the two lots next to his residence for the parking of his".trucks; that he now has 9 trucks, stating that Mr. Panopulos has tu~rc lots on Alameda. Street that are suitable for storing his trucks on, but at the present time he is unable to build any building to ~~:;use them on account of the tivar condition; Mr. Moffitt also stating that recently a warrant ~¢as is- sued for his arrest and Per. Gregory Panopulos addressed the Counc~_1 appealir.~- to tre Cot:rcil t}:at they make an exception to the zoning so that it ~~~ill be possible for him to stay where he is until after the tR1ar, stating that he will promise to move within 6" days after tl-e war, also giving a history of his trucking business. Thereupon it was moved by Councilman 1~'illard a,nd seconded by Councilman P~Jleyer that the matter be ~;cstp,anedd until the next meeting of the City Council. All members of the Council with the exception of Councilman Lake voting aye, the Mayor declared the :.~oticn d:ly carried. 43 Councilman Lake addressed the Council stating the reason why he ~FJOUld not vote in favor of the motion, v~ias because that he believes that the Council are in a position to act now rather than to delay the matter. After due consideration of the matter, it was moved by Coun- cilman Willard and seconded by Councilman Christensen that the motion to postpone the matter be rescinded. All members of the Council present voting aye, the Mayor declared the motion carried. t"y7~ereupon it wU.s moved by Councilman ~"illard and seconded by Councilman Christensen that the City Attorney be instructed to draft necessary papers for consideration of the Council at their next meeting calling for a, variance to the Zone as affecting Mr. Panopulos property, setting forth among other things a time limit of one ;Tear for no further explansion, etc. Roll Gall: Ayes: Councilmen Lake, Christensen, Willard and lUieyer. Noes: Councilman iJIcF~Ieekin. A communication was received from Chas. W. s'Veber calling at- tention to the noise that is made after dances on Saturday nights at the Masonic Temple which disturbe his tenants many of whom are defense workers and need their ,rest; also regarding the parking of cars against his courts and when they start their motors it fills their romm with exhaust gases to the extent that they have to .getup and leave the room, or possibly become gassed. After due consideration of the matter, the matter of noise and discipline on the Streets and sidewalks was referred to the Folice Department; also the City -Clerk was instructed to write to the Masonic order requesting them to cooperate ao correct the situation. Report of City Court, was received, as well as applications for employment from Wm. W. Murphy and Luther B. Myers. There being no objection said report and applications were ordered filed. UNFINISHED BUSINESS: A communication was received from City Attorney Roby reporting on the letter from Roscoe R. Hess which ~r.7as referred to him, to the ef- fect that he believes that the case pending against the Utility Companies in regard to franc'~ise fee matters be kept_ pending anc? be n~~dismissed, unless the County of~Los Angeles who have also broug'~t suit .gives us notice and request so to do.
