HomeMy Public PortalAbout19990621REGULAR COUNCIL MEETING JUNE 21, 1999 CALL TO ORDER 1 The Regular Council Meeting of June 21, 1999, was convened at 7:30 P.M. by Mayor Tom Rackers. Prayer was offered by Councilman Steve Nelson, followed by the Pledge of Allegiance. ROLL CAL The following Council Members were present for the roll call: Present: Blaney, Jackson, Jaynes, Landwehr, Nelson, Nilges, Stella, Vincent, and Weber Absent: Vogel A quorum was declared present. PUBLIC HEARINGS Rezoning of 800 West High from RA -2 (Multiple Family Residential) to C -O (Office Commercial) — Planning and Code Enforcement Director Keith DeVault made a presentation outlining the background of the request for rezoning. Following Mr. DeVault's presentation, no one requested to speak in favor of, or opposition to, the request for rezoning. Mayor Tom Rackers declared the public hearing concluded. PRESENTATIONS FROM THE GALLERY A presentation was made by City Administrator Rich Mays and City Counselor Allen Garner regarding the status of the Hotel Governor project. A tour had been conducted by the developers of the project earlier in the day on June 21, and pictures of the progress were shown in a slide presentation. Tom Jones, Wastewater Division Director, made a presentation using overhead graphics to give an update of the status of the treatment plant. Mr. Jones indicated that the new components should be "online" within the next couple of weeks or so. Ms. Dottie Dallmeyer, 200 Chestnut, made a presentation in favor of Bill 99 -20, because she believes that a 30 -day notice to the Historic Preservation Commission does not allow them enough time to contact property owners. Ms. Toni Prawl, 210 Lafayette, was also present and also voiced her support for the bill. Mr. Joe Wilson, 2201 Oberman Place, made a presentation regarding animal ordinances. REGULAR COUNCIL MEETING JUNE 21, 1999 CONSENT AGENDA 2 The following items were presented for approval on the Consent Agenda: a. Minutes of June 7, 1999 City Council Meeting b. Authorizing Amendment to Tri -Star Communications Contract for Radio Receivers c. Acknowledgment of completion date for Hotel Governor Development Agreement A motion was made by Councilman Charles Jackson to approve the Consent Agenda as presented, seconded by Councilman Steve Nelson, and approved unanimously. MINUTES AND REPORTS RECEIVED & FILED Mayor Tom Rackers announced that the following reports have been received and are on file in the City Clerk's Office: a. Planning & Zoning Commission, May 13, 1999 b. May, 1999 Finance Report c. Board of Adjustment, May 11, 1999 d. Housing Authority Board of Commissioners, April 13, 1999 f. Solid Waste Committee, May 11, 1999 ANNOUNCEMENTS BY THE MAYOR There were no announcements by the Mayor at this time. MAYORAL APPOINTMENTS Mayor Tom Rackers asked Council Members to submit names to him for persons they think would be good candidates for appointments to boards and commissions. BILLS INTRODUCED REGULAR COUNCIL MEETING JUNE 21, 1999 3 Bill 99 -23, sponsored by Councilman Jaynes, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, CHANGING, AMENDING, AND MODIFYING THE ZONING MAP OF THE ZONING CODE OF THE CITY OF JEFFERSON, BY REZONING 800 WEST HIGH STREET FROM RA -2, MULTIPLE FAMILY RESIDENTIAL TO C -O, OFFICE COMMERCIAL. Bill 99 -24, sponsored by Councilman Jaynes, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, CHANGING, AMENDING, AND MODIFYING THE ZONING MAP OF THE ZONING CODE OF THE CITY OF JEFFERSON, BY REZONING LOT "A" OF MALL RIDGE SUBDIVISION SECTION 8 REPLAT, FROM RA -2, MULTIPLE FAMILY RESIDENTIAL TO PUD, PLANNED UNIT DEVELOPMENT. Bill 99 -25, sponsored by Councilman Nilges, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING THE CODE OF THE CITY OF JEFFERSON PERTAINING TO TATTOO ESTABLISHMENTS BY REPEALING THE PROHIBITION OF, AND PROVIDING FOR THE REGULATION OF, TATTOO ESTABLISHMENTS WITHIN THE CITY OF JEFFERSON. Councilman Larry Vincent requested that staff prepare an amendment to Bill 99 -25 stating that C -1 would be the only zone in which tattoo establishments would be permitted. Bill 99 -26, sponsored by Councilmen Blaney, Landwehr & Vincent, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, REPEALING CHAPTER 5 (ANIMALS), OF THE CODE OF THE CITY OF JEFFERSON, MISSOURI, AND ENACTING A NEW CHAPTER 5 IN LIEU THEREOF. Several Council Members indicated that they object to the limit of numbers of dogs and cats within the bill. Councilman Larry Vincent stated that without a limit, the city could not solve the problems which it has been dealing with for the past several years. Bill 99 -27, sponsored by Councilman Nilges, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING AN AGREEMENT WITH THE MISSOURI DEPARTMENT OF PUBLIC SAFETY FOR A NARCOTICS CONTROL ASSISTANCE PROGRAM GRANT AND AUTHORIZING SUPPLEMENTAL APPROPRIATION OF FUNDS, AMENDING THE 1998 -99 ANNUAL BUDGET WITH IN THE GENERAL FUND. REGULAR COUNCIL MEETING JUNE 21, 1999 4 BILLS PENDING Bill 99 -15, sponsored by Councilman Blaney, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A GRANT AGREEMENT WITH THE MISSOURI DEPARTMENT OF TRANSPORTATION FOR THE PURCHASE OF A REPLACEMENT COMPUTER FOR THE TRANSIT DIVISION. Bill 99 -19 was read third time by title and placed on final passage. Councilman Rick Nilges made a motion to amend by deleting one duplicated item on the auction list as indicated on the information distributed to the Council prior to the meeting. Motion to amend was seconded by Councilman Charles Jackson, and approved unanimously. Bill 99 -19 was then passed, as amended, by the following vote as Ordinance 12940: Aye: Blaney, Jackson, Jaynes, Landwehr, Nelson, Nilges, Stella, Vincent, and Weber Nay: None Bill 99 -20, sponsored by Councilman Blaney, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING CHAPTER 8 OF THE CODE OF THE CITY OF JEFFERSON, MISSOURI, PERTAINING TO BUILDING AND NEIGHBORHOOD PRESERVATION AND CONSERVATION AND FURTHER REGULATING THE DEMOLITION OF BUILDINGS TO PROVIDE AN OPPORTUNITY FOR PRESERVATION. Bill 99 -20 was read third time by title and placed on final passage. Councilman John Landwehr moved to amend Bill 99 -20 by changing the 90 -day limits to 60 days. Motion to amend was seconded by Councilman Rick Nilges, and approved with Councilman Carol Blaney voting "Nay." Bill 99 -20 was then passed, as amended, by the following vote as Ordinance 12943: Aye: Blaney, Jackson, Jaynes, Landwehr, Nelson, Nilges, Stella, Vincent, and REGULAR COUNCIL MEETING JUNE 21, 1999 6 Weber Nay: None Bill 99 -21, sponsored by Councilman Jackson, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH GEORGE BUTLER & ASSOCIATES FOR REDESIGN OF THE DIX / SOUTHWEST CONNECTOR. Bill 99 -21 was read third time by title and placed on final passage. Councilman Charles Jackson explained the need for the redesign to move this project into the next phase, and stated that after this phase, if it is determined that it is not needed, the Council can stop the project at that point. Bill 99 -21 passed by the following vote as Ordinance 12942: Aye: Blaney, Jackson, Jaynes, Landwehr, Nelson, Nilges, Stella, Vincent, and Weber Nay: None Bill 99 -22, sponsored by Councilman Nilges, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH THOMAS INDUSTRIAL COATINGS FOR PAINTING OF WEATHER WARNING SIRENS, AND AUTHORIZING SUPPLEMENTAL APPROPRIATION OF FUNDS, AMENDING THE 1998 -99 ANNUAL BUDGET WITHIN THE GENERAL FUND. Bill 99 -22 was read third time by title, placed on final passage and passed by the following vote as Ordinance 12943: Aye: Blaney, Jackson, Jaynes, Landwehr, Nelson, Nilges, Stella, Vincent, and Weber Nay: None NEW BUSINESS Councilman Carl Jaynes announced that an ad hoc storm water committee meeting will be held June 29, 1999 at 6:30 PM. UNFINISHED BUSIN ESS There was no unfinished business to come before the Council at this time. REGULAR COUNCIL MEETING JUNE 21, 1999 COUNCIL LIAISON REPORTS 7 Councilman Charles Jackson announced the Public Works Committee meeting for June 24 at 6:30 PM. ADJOURN MENT There being no further business to come before the Council at this time, Councilman Larry Vincent made a motion to adjourn, motion was seconded by Councilman Charles Jackson approved unanimously at 9:40 P.M.
