At its March 26, 1998 meeting, the McCall City Council approved your application to
vacate a platted access easement, and to combine lots 1, 2 and 32 under the record
of survey procedure. The approval carried the following conditions:
(a) Primary access shall be located on Commerce Street. Deinhard Lane
access is limited to ingress only for eastbound traffic on Deinhard Lane.
The curb cut will be no greater than 14 feet wide, and skewed to
facilitate entry for eastbound traffic, and discourage westbound
Deinhard Lane traffic from using the entrance. The Deinhard Lane,
access point will be signed "Do Not Enter" for patrons leaving the site.
The Deinhard Lane access point will also be signedto prohibit westbound
traffic from turning left into the site.
(b) owner of the parcel dedicate the northerly 10' of lots 1 Et 2, for use as
Deinhard Lane right-of-way.
You may now proceed with a building permit application. Prior to the Building
Inspector issuing a building permit, I will need the following materials:
• A copy of the Record of Survey to be filed with the Valley County Recorders
office.
• A quitclaim deed dedicating 10' of right-of-way along Deinhard Lane, from
Lots 1 Et 2.

FINDINGS AND CONCLUSIONS IN SUPPORT OF APPROVAL OF
A VACATION OF A PLATTED ACCESS EASEMENT
VAC-98-1 - BROWN'S INDUSTRIES - LOT 2, PAYETTE LAKES COMMERCIAL CENTER
The Commission finds that:
1. A petition for approval of a vacation of a platted access easement, pursuant to
MCC 3-21-310, was presented for public hearing on March 3, 1998 by John
Holmquist, as representative of Brown's Industries, owners of:
An ingress a egress easement across the southerly most 30' of Lot 2 of Payette
Lakes Commercial Center, situate in the NW' of the SEA, Section 16, T.18N.,
R.3E., B.M., City of McCall, Valley County, Idaho.
2. The necessary notice was given to the public and to other public agencies and
entities.
3. The easement is located on the southerlymost portion of Lot 2, Payette Lakes
Commercial Center, and abuts Lots 1 Et 32 of the same subdivision.
4. An application to combine Lots 1, 2, and 32 of Payette Lakes Commercial Center,
through the Record of Survey procedure, was filed simultaneously. Therefore, the
access easement is not necessary to allow access from Lot 1 to Commerce St.
5. The access easement is not needed by public utilities to serve properties other
than the 3 lots under consideration. The owner of the property will need to allow
utilities access to the property, so as to serve the property itself.
6. Deinhard Lane is currently 70' wide in this location. Deinhard Lane is classified as
an "arterial" on the City Transportation Map, which requires an 80' right-of-way.
As a part of the record of survey application, the applicant will be required to
dedicate 10' along the northerly boundary of Lots 1 Et 2.
7. At the public hearing, the applicant's representative spoke in favor of the
application. No other persons spoke in regard to the application.
8. 5 letters were submitted prior to the public hearing, each of which came from an
area agency.
9. The vacation is appropriate, providing the following conditions are met:
(a) Primary access shall be located on Commerce Street. Deinhard Lane
access is limited to ingress only for eastbound traffic on Deinhard Lane.

(b) owner of the parcel dedicate the northerly 10' of lots 1 a 2, for use as
Deinhard Lane right-of-way.
The Commission Concludes that:
1. The proposed vacation is without harm to transportation or access needs, and will
result in a parcel that can be combined and developed.
2. At the public hearing, only the applicant's representative spoke regarding the
application. A second public hearing before the City Council is unlikely to
generate additional public comment. Therefore, a second public hearing is not
necessary.
3. The associated record of survey combining lots 1,2 and 32 satisfies the
requirement of MCC 3-21-310 (E) for the preparation and filing of a suitable
replat.
4. The proposed partial vacation is appropriate, with the following necessary
conditions:
(a) Primary access shall be located on Commerce Street. Deinhard Lane
access is limited to ingress only for eastbound traffic on Deinhard Lane.
The curb cut will be no greater than 14 feet wide, and skewed to
facilitate entry for eastbound traffic, and discourage westbound
Deinhard Lane traffic from using the entrance. The Deinhard Lane
access point will be signed "Do Not Enter" for patrons leaving the site.
The Deinhard Lane access point will also be signed to prohibit
westbound traffic from turning left into the site.
(b) owner of the parcel dedicate the northerly 10' of lots 1 a 2, for use as
Deinhard Lane right-of-way.
5. The Commission hereby recommends that the City Council vacate the platted
access easement, as described herein.

MINUTES:
Showers moved to approve the minutes of March 3, 1998, seconded by Davenport.
Davenport inquired as to enforcement of sidewalk maintenance. After discussion, the
motion carried on an unanimous vote.

Commission reviewed comments from the Transportation Advisory Committee (TAC)
meeting of March 17, 1998. Showers moved to amend the Findings 9. (a) and
Conclusion 3. (a) to allow eastbound traffic on Deinhard an ingress only, as per the
recommendation of the TAC. Potter seconded and the motion carried on a 3-1 vote,
with Davenport dissenting.
SR-98-1 Pat's Glass Et Door - Install Awning/Sign - 301 Railroad Avenue
Showers moved to approve the Findings a Conclusions, as presented. Davenport
seconded and the motion carried unanimously.

'Commission reviewed a site plan and landscape plan, previously required as a
condition of approval for construction in the scenic route overlay district.
Locke presented the staff report, and gave a brief history of the application. Gerald
Cope, applicant, presented a revised site plan addressing the site of the addition.
Commission discussed need for defined access and sidewalks along the extent of the
NAPA site. The Commission asserted the need for the site plan to address both the
addition, and the existing building. Cope expressed concern over parking and site
access for large trucks, if the existing site is designed to provide a defined access
point.
Commission and Locke developed alternatives that would maintain parking and access
to the site. Commission requested that Mr. Cope redesign the site plan to address
the existing building and site.
Davenport moved to table the matter pending submission of a revised site plan
addressing the entire site as a single unit. Showers seconded and the motion carried
unanimously.
NEW BUSINESS
PUBLIC HEARING:
SUB-98-1 - Lakeport Plaza Subdivision - Preliminary Plat Application
Chair introduced the application and opened the public hearing at 7:55 p.m.
Locke summarized the application and presented the staff report. Joel Droulard,
representing the applicant, presented the developers proposal, and noted comments
made by the Transportation Advisory Committee. Commission discussed lot size,
maintaining Smith Court as a private street and bike paths. Potter inquired as to the
overall vision of the project, with particular reference to appearance. Ballard Smith,
developer, indicated that design of the structures would be in a similar vein as the
Market Square development.
Guy Turner, representing the applicant, discussed the CCEtRs with the Commission.
Davenport noted typographical errors. Davenport inquired as to how the CCEtRs
would work in conjunction with McCall City Code. Locke indicated that some
restrictions in the CCEtRs would be superseded by City Code.
Chair asked if anyone from the public wished to comment on the application. Donna
Darling, Manager of the Super 8 Motel, 303 S. 3rd St., spoke requesting information on
the proposed subdivision. Locke displayed the plat and responded to questions of

potential uses, indicating the property is Zoned GC. Turner responded to questions of
actual proposed uses, potential buyers, and construction schedules.
Chair closed the public hearing at 8:20 p.m.
After brief discussion, Davenport moved to approve the preliminary plat of SUB-98-1,
as presented. Showers seconded, adding the following conditions to the original
motion:
(a) Provision of a bike path along Highway 55
(b) Smith Court is to remain a private street
Brief discussion as to sidewalks ensued, with Droulard indicating that the
development team was considering two alternatives: a sidewalk along the edge of the
r/w with a grassy swale separating it from the road; and, a wider asphalt surface,
striped for pedestrians.

SR-98-4 - Kristy's Cafe - 406 W. Lake St. Sign
Davenport moved to approve the sign with the following condition:
• The freestanding pole sign be removed
Potter seconded and the motion carried unanimously.
Bike Path Master Plan
As requested by City Council, the Commission reviewed the McCall Bike Path Master
Plan. Davenport, as a member of the Parks 8t Recreation Advisory Committee (PRAC),
made himself available for questions. Davenport noted 2 omissions/clarifications for
the Plan:
• Objective I, Strategy 1c., should refer to the "Airport Park" as the location for an
information kiosk.
• Map should identify a proposed bikeway along the Deinhard Ln. extension, and
Boydstun St. north to Highway 55.

Showers inquired as to whether the Bike Path Master Plan addresses bicycles only, or
if other non -motorized uses are included.
After discussion, Davenport moved to recommend approval of the Bike Path Master
Plan, with the following comments:
• Objective I, Strategy lc., should refer to the "Airport Park" as the location for an
information kiosk.
• Map should identify a proposed bikeway along the Deinhard Ln. extension, and
Boydstun St. north to Highway 55.
Potter seconded and the motion carried unanimously.
OTHER
Showers noted that the TAC will be working on a sidewalk provision of the city code.

Chair introduced the application for a vacation of a platted access easement and a
record of survey to combine 3 parcels into 1. Potter inquired as to dedication of R/W
and whether Deinhard Ln. would be a straight line, 80' wide. Locke indicated that
city standard arterial is 80' wide, and that as each application came forward, the City
would request a dedication sufficient to achieve an 80' R/W.
Chair opened the public hearing at 7:15 p.m., and solicited input from the applicant's
representative, John Holmquist. Holmquist stated that he was unaware of the
Transportation Advisory Committee's recommendations of denying access to Deinhard
Lane. Holmquist was aware of a request for a 5' dedication along Deinhard Lane, but
would need to check with owner regarding dedication of an additional 5'.

Discussion shifted to sidewalks and their necessity in this location. Allen voiced
concerns that though the Commission may be able to require sidewalks in this
instance, they will be unable to require them of neighboring properties. Allen also
noted that sidewalks may interfere with drainage. Showers asserted that if they do
not begin requiring -sidewalks, the City will never have them. After lengthy discussion
among Commission, consensus emerged to not require sidewalks, but for the
applicant to dedicate 10' of R/W which would then be available for a future sidewalk.
This area should be available for pedestrians.
Allen moved to approve VAC-98-1 with accompanying ROS, with the following
conditions:
1. Access be limited to Commerce Street only
2. Applicant dedicate the Northerly 10' of lots 1 Et 2 to the city for use as Deinhard
Ln. R/W.

CALL TO ORDER and MINUTES
The Chair called the meeting to order at 7:05 p.m. and declared a quorum
present. Corrections were made and Smith moved to approve the minutes of
the February 11, 1998, as amended. Shower seconded. The motion carried,
with one abstain.
II. NEW BUSINESS
VAC-98-1, Payette Lakes Commercial Center, Lots 1,2 and 32
The group discussed the development and other imminent development,
namely the Post Office relocation. The group was concerned about the high
volume of traffic expected at the Marketplace driveways and increasing
traffic on Commerce over time. Smith moved to recommend denial of
access to Deinhard Lane, installation of sidewalks on Commerce and
Deinhard, request a right-of-way dedication to obtain arterial width on
Deinhard and to recommend approval of the easement vacation. Whiteman
seconded.
In a general discussion, Campbell advocated sidewalks on both sides of
Commerce and none on Deinhard. Much discussion centered around equity
and fairness when requiring sidewalk on one side of the street and not the
other. Smith's motion carried 3 to 1.
Preliminary Plat of Lakefork Plaza Subdivision
Staff recommended tabling the item, as she hadn't been able to contact the
developer. Campbell moved to do so, Whiteman seconded and the motion
was unanimously approved.
Fund raising
Showers indicated that the Committee should make the effort to set up a tax-
exempt account to accept charitable donations for the Deinhard-Boydston
Connector. He felt that grass roots' support was necessary. Whiteman and
Campbell agreed and recommended that staff investigate.

The potential plan is for Showers to make a presentation to City Council with
the whole Committee present. Smith commented that Committee members
could also make presentations to civic)realtor and homeowners' groups. After
further discussion, the Committee decided to discuss the item at the next
meeting, when Arp could be present.
Cul-de-sacs
Smith commented that cul-de'-sacs should be prohibited. Showers advocates
cul-de-sacs only as an interim solution. Showers further believed that the
developer would need to dedicate right-of-way to eventually complete the
through street. The group acknowledged that there would be unusual
circumstances where cul-de-sacs may be acceptable. Whiteman moved to
recommend to Planning and Zoning that cul-de-sacs be prohibited by
ordinance except when acting as an interim solution and when
accompanied by a right-of-way dedication to provide for an eventual
through street. Smith seconded. The motion carried with 3 ayes and 1
abstain.
The Committee then discussed hammerheads. Fields commented the Public
Works opposes hammerheads as a maintenance problem. Discussion
centered on identifying situations where hammerheads would be necessary.
Smith moved to recommend prohibition of hammerheads. Whiteman
seconded and the motion carried with 3 ayes and 1 abstain.
Staff commented that the Code requires private streets to be built to the
same standards as public streets. The Committee acknowledged that and
chose not to amend their previous recommendations.
Smith requested the Public Works and the City Engineer look at existing roads
that have been plowed with a wing and address the question of how much
right-of-way the City really needs.
III. OTHER
The Committee requested review of the proposed sidewalk ordinance and
requested that the Public Works Director attend the meeting.
IV. ADJOURNMENT
Showers moved to adjourn at approximately 9:15 pm. Campbell seconded
and the motion was unanimously approved.

Dear Planning and Zoning Commission:
We are requesting a Lot Merge and a Vacation of a Platted Easement located
between Lots 1,2 & 32 of the Payette Lakes Commercial Center. The easement
was originally designed as an ingress/egress access easement. Currently we
are under contract with Les Schwab Tire Center to purchase the three Tots and
build one building.
This transaction is scheduled to close March 15, 1998. In order for us to achieve
this deadline, we are submitting applications for a Lot Merge and a Vacation of a
Platted Easement for the Planning and Zoning Meeting scheduled February 17th
and the City Council Meeting on February 25th. In an effort to make this a one
time lot merge, we would like for the Planning and Zoning Committee to hold off
on recording the Lot Merge and Vacation of an Easement until after closing date
March 15, 1998.

Dear Andy:
Payette Lakes Water and Sewer District has been notified of the request to vacate the
platted easement located on Lots 1 & 2 of Payette Lakes Commercial Center.
The stated access easement also has an installed sewer service connection installed which
is intended to serve Lot 1 from the Commerce St. gravity sewer main. The service line
runs through all of the 94' width of Lot 2 to provide sewer service to Lot 1.
It is my understanding through a conversation with.you that theintentof the developers is
to situate one — large building on all three lots. This would require that the building be
constructed over the sewer service line, presently intended to serve Lot 1. I also
understand that there are sewer service lines, which would provide several options for
service that are already in place for Lots 2 & 32. It would be possible to use any of the
existing service lines.
The Payette Lakes Water and Sewer District will take no exception to the vacation of the
platted easement provided that:
1) There is to be one structure placed on all three lots (#1,2, & 32).
2) That the sewer service line which will be located under the building, that is now
intended to serve Lot 1, is properly abandoned in the area where it will be under
the new structure.

easements on Lots 1,2 & 32 in Payette Lakes Commercial Subdivision, The request was
made. by Meredith Smith of Collier international.,
Idaho Power Co. would be agreeable to the vacation of the 10 ft. easements centered on
the interior lot linos of Lots 1 & 2, Lots 1 & 32 tired Lots 2 & 32. The 10 ft. front and roar
easements should remain.

In Payette Lakes Commercial Center.
Dear Commission Members;
Thanks for the opportunity to comment on the above referenced application. Valley
County owns property near the subject tract. The Juvenile Detention Center site is not adjacent
but is located approximately 330 feet easterly. I did not review the application with the Board of
County Commissioners but will respond with the comment that the request, if granted, will have
no impact on the county property.
I recommend that access to Lot 1 continue to be limited to Commerce Way as was
intended by provision of the easement. The order to vacate will likely be accomplished by an
ordinance or similar document effected by the City Council. That document should be recorded
in the county records.

Dear Mr. Locke:
We received a copy of the Notice of Public Hearing for the vacation of an access
easement application submitted by Judd DeBoer. The property is located in the Payette
Lakes Commercial Center. Idaho Transportation Departments presents the following
recommendations.
A Transportation Impact Study (TIS) may be require at the discretion of the Idaho
Transportation: Department's (ITD).Traffic-Engineer ifthe=proposed developments meets
criteria presented in ITD's Requirements for TransportationImpact Study, April 1995. A
TIS is not required if the development generates less than 25 new peak hour trips on a
state highway and the total added volume will be Tess than 250 vehicles per day. A "full"
TIS is required whenever a proposed development will generate 100 or more new peak
hour trips; or when the total volume expected to be added to the state highway system
by the development equals or exceeds 1000 vehicles per day. A "minor" TIS is required
for developments that will generate between 25 and 99 new peak hour trips or will add
from 250 to 999 vehicles per day. For further_ information on the TIS, contact the District _
Permit Officer, Mr. Nick Brizzi at 334-8341..
Other recommendations concerning proposed development that is within sight distance
of the state roadway system include:
1) Setbacks—ITD strongly recommends structures not be any closer than 150
feet to the state right-of-way in areas with full control of access. In all other
areas, a separation of 100 feet should be maintained. These setbacks are
intended to mitigatethe impact between facilities.
