M. ' Mayor Willard in the chair. Councilman Lake, Wiggins and Willard answered.the roll call. Councilmen Christensen and Meyer were absent. It was moved by Councilman Lake and seconded by Councilman Wiggins that the minutes of the previous regular meeting oY November 2, 1943, be approved as written. All members of the City Council present voting aye, the Mayor declared the motion duly carried and it was so ordered. WRITTEN COMMUNI CATIONS: A communication was received from Walter N. McNaughton making application for a•license to operate a used car sales Iot next to his service station located at 10530 Lang Beach Blvd.-, stating that there will be no wrecking of oars thereat, submitting ~?. 54 covering license fee. Thereupon 'it was moved by Councilman Lake and seconded by Council- man Wiggins that permission be granted and that the License Collector be-authorized to issue license therefor. All members of the City Council voting aye, the Mayor declared the motion duly carried. A Tax Deed, dated 8ctober 3©, 1943, and signed by H. L. Byram, Tax Collector of Los Angeles County, whereby they coney their interest in certain paroele of land that are a part of Oscar Tower Allot, in Tract No. 1 of Partition of a portion of the Home tract of Antonio Maria Lugo and Maria Garman Lugo, being a portion of Ro San Antonio, to the City of Lynwood, was submitted. A Tax Deed, dated October 30, 1943, and signed by H. L. Byram, •Tax Collector of Los Angeles County, whereby they convey their interest in certain parcels of land in Tracts 6473, 6474, 6575, ?572, 7816, 8716, 9235, 9862, and 10503, to the City of Lynwood, was Submitted. A Tax Deed, dated October 30, 1943, and signed by H. L. Byrum, Tax Collector of Los Angeles County, whereby they convey their interest in certain lots in Tracts 2551, 2794, 31?2, 3351, 3389, 4936, 5259, and 5418, to the city of Lynwood, was submitted. A Tax Deed, dated October 30, 1943, and signed by H. L. Byrum, Tax Collector of .Los Angeles County, whereby they convey their interest in certain lots in Tract No. 921 to the City of Lynwood, was submitted. A Tax Deed, dated October 30, 1943, and signed by H. L. Byrum, .Tax Collector of Los Angeles County, whereby they convey their interest in certain lots located in Mod~eska Park, as per Book 9, pages 142 and ~.1~3 of Maps, Records .oY Los Angeles County, to the City of Lynwood, was submitted. A Tax Deed, dated October 30, 1943, and signed by H. L. Byrum, Tax Collector of Los Angeles County, whereby they convey their interest in Lot 176, Tract 6554 to the City of Lynwood, was submitted. Thereupon it was moved by Councilman Lake and $econded by Councilman Wiggins that said Ttx deeds described above, be and the .same are hereby accepted, and that the City Clerk of the City of Lynwood be directed to~cause said instruments to be recorded in the Office of the Recorder of Los Angeles County. Roll Call: Ayes: Councilmen Lake, Wiggins and Willard. Noes= None. Absent; Councilman Christensen and Meyer. An offer was received from A. L. Young, on behalf of William J. Whitaker, to purchase Lots 2I and 22, Block 6, ~Iod,~eska Park for a total consideration of X300.00 free and clear of all indebtedness, and City to furnish a merchantable title thereto. Said offer being within the appraisal and no one present desiring to raise said offer, it was moved by' Councilman Wiggins and Seconded by Councilman Lake that it b® accepted, and that the Special Counsel be instructed to proceed with clearing the title thereon. Clouse offering to purchase Lots 29, 34 31, 32 and 33, Block 3, Mod~eska Park for a total consld- eration of ~850.C~0, free and clear of all indebtedness, and the City to clear title. Said offer being within the appraisal thereof, and no one present desiring .to raise the bid, it was moved by Councilman Lake and seconded by Councilman Wiggins that the offer be accepted, and that the Special Counsel be instructed to proceed with clearing the title ___ _ _ ~~~3 thereon. District No. 18 assessment district, facing Long Beach Boulevard .and Norton Avenue, east of Barlow Avenue, for the sum of $1, 650.00, free and clear of all indebtedness, and City to clear title thereon, was received from Walter Larkin. This offer being with- in the appraisal thereof, and no one present desiring to raise the bid, it was moved by Councilman Wiggins and seconded by Councilman Lake that said offer be accepted, and that the Special Counsel be.in$trueted to proceed with clearing the title thereon. Absent: Councilmen Christensen and Meyer. ~ An offer to purchase Lots 25, 26 and 27, Block 3, Tract 0474 .for the sum of X500.00, Pree and clear of all indebtedness and City to furnish a clear title thereto, was received from Mrs. Clelia Elg. This offer being withie the appraisal thereof, and no one present desiring to raise ,the bid, it was moved by Councilman Wiggins and seconded by Councilman Lake that the offer be accepted, and that the Special Courieel be instructed to proceed with quiet title action thereon. This offer being within the appraisal thereof, .and no one present wishing to raise the bid, it was moves by Councilman Lake and seconded by Councilman Wiggins that the offer be accepted, and that the Special Counsel be instructed to proceed with action to clear title. . . An offer to purchase Lot 94?, Tract 3172 for the sum of X600.00 free and clear of all taxes, assessments and bonds, and City to clear title thereon, was received from H. G. Fullerton. Said offer being. less than the value thereof,. and no one present desiring ,to increase the bid, .it was moved by Councilman Wiggins and seconded by Councilman Lake that the offer be re~eeted. All members of the City Council-present. voting aye, the Mayor declared the motion duly carried. A commu nieation was received from the The Development Engineer,. Inc. by Arthur C. Wright, requesting that his option to purchase certain tax deeded lots be extended for 90 days, stating that he has scoured priorities to build on 30 sites, but has not yet secured F. H.A.Committments thereon; also requesting a 90 days optiQne on other tax deeded lots as listed in his letter of November 10, 1943. After careful consideration of the matter, it was moved by Councilman Wiggins and seconded by CouncilmanLake that the option be granted as requested with prices as fixed by the Appraisal Committee; also with the understanding that -e, iP the applicant does not secure priorities for all Lots he shall be required to build on so~-e of the Lots in Tract 921. Report of Activities of the Fire Department for the months oP September and October were received. There .being no objection, said reports were ordered filed. ORAL COMMiJNICATIONS: Mr. Robert Elgard addres8ed the Council., expressing the opinion of himself .and Messrs. Tunney and Flint, in the Broadacre territory regarding the proposal of closing Magnolia Ave. through the Junior High School property, stating that they would be in favor thereof if it was preserved for drainage purposes and for sewex line now in the right-of-way, and if Bradfield Street can be opened through to Carlin Ave. so that it would help the drainage situation. After due consid- eration of the matter, the Mayor instructed the City Attorney to check into the possibility of the school Board acquiring the right-of-way for Bradfield Street when they condemn the land needed for school purposes that they are in the. process of doing at this time, and if this is ~~: impossible, to ascertain the_ procedure for the City to do so; also to secure a drawing from Street Superintendent Blain regarding the~best_ method of opening the street. Mrs. Mayme Powell addressed the Council regarding her claim for injuries caused in a fall in the City Hall building, to the effect that she believes that she should be compensated as requested in her letter considered by the Council on November 2, giving a detailed explanation of her fall, alleging that the City should maintain a rubber mat for the public to walk on during rainy weather; also statingthat she did report her fall shortly of ter it happened and spoke to the City Clerk and City Attorney about it. No action was taken thereon. Mr. Earl Bacon addressed the Council regarding the appoint- ment of a Park Committee; also Mrs. Gladys Clouse and Mrs. Eva with. Thereupon Mayor Willard submitted the names that he had selected to serve on said committee, as follows: Messrs. Earl Bacon, W. J. Patillo, Robert Elgard, Clif f J. Shrock, and Mesdames C. E. Austin, Katherine Haskell, Eva Smith and Mrs. Irin Bennett. Whereupon it was mooed by Councilman Lake and seconded by Councilman Wiggins that said persons whom the Mayor has selected as sn Advisory Board to work on the matter of development of the City Park be confirmed by the City Council. All members of the City Council present voting aye, the Mayor declared the motion duly carried.. Discussion was had regarding space in the City Park for Girl and Boy Scouts, but no action was taken thereon and will be consid- ered by the new committee. UNFINISHED BUSINESS: he resignation of W. J. Zimmerman as a member of the Civil Service Commission was brought up for consideration. It was .moved by Councilman Wiggins and seconded by Councilman Lake that the resignation be accepted. All members of the City Council present voting aye, the Mayor declared tl~e motion duly carried and it was so ordered. ORDINANCE NO. 389, entitled: "AN ORDINANCE OF THE CITY OF LYNWOOD, CALIFORNIA PROVIDING FOR THE CITATION OF PERSONS FOR VIOLATING TRAFFIC ORDINANCEB OF THE CITY~OF LYNWOOD, CALIFORNIA AND ~dAKING THE VIOLATION OF SUCH CITATIONS AN OFFENSE AND ESTAHLI SHING A PUNI SH~[SNT THEREFOR, " was read for the second time by caption. It was moved by Councilman Lake and seconded by Councilman Wiggins that the further reading of said Ordinance be waived. All members of the City Council present voting aye, the Mayor declared the motion duly carried. It was moved by Councilman Lake and seconded by Councilman Wiggins that said ordinance No. 389 be adopted as read the second time, finally pass and be published as required by law. Absent: Councilmen Christensen and Meyer. pn Ordinance, entitled: "An Ordinance of the City of Lynwood, California, amending Section8 6, ?, 9 and 12 of Ordinance No. 382 of said•City of Lynwood and establishing and fixing rates for water service by the said City of Lynwood, within and without the corporate limits of said City of Lynwood, California; and repealing Sections 6, 7, 9 and 12 of said Ordinance No. 382 as heretofore existing", was read. It was ®oved by Councilman Lake and seconded by Councilman Wigging that said Ordinance be accepted as read the first time and pass to the second reading. A communication was received from City Attorney Ruby submitting his opinion regarding the claim of L. J. Bender who alleges that he secured in,}uries to himself and motorcycle when he fell off his motorr .cycle, claiming neglect on the part of the City as the Street Department had spilled oil on the street thus causing hie vehicle to skid. City Attorney Ruby rules that in his opinion there is no liability on the part oP the City of Lynwood. Mazy, dated November 4, 1943, whereby they convey their interest in and to Lot 26, Tract 2551 to the City of Lynwood, was submitted. A Quitclaim Deed, dated November 2, 1943, and signed by Mre. Frank Morra, whereby she conveys her interest in and to Lot 26, Block 1, Tract 5418 to the City of Lynwood, was submitted. A Corporation Quitclaim Deed signed by the Board of America National Tryst & $avinge Association, by its Officers, and dated October 26, 1943, whereby they convey their interest in and to Lot 137, Tract 921 to _the City of Lynwood, was submitted. A Quitclaim Deed, dated November 5, 1943, and signed by Lulu G. .Miller and Rolland C. Miller, whereby they convey to the Gity of Lynwood, their interest in and to lot 1344, Tract 3351, was submitted. Thereupon it was moved by Councilmen Lake and seconded by Councilman Wiggins that said quitclaim Deeds and Grant Deed be and the same are hereby accepted, and that the City Clerk be and he is hereby instructed to cause said instruments to be recorded in the Office of the Recorder of Los Angeles County. Skelton covering the month of October, 1943, chile engaged in his work as Civilian Defense Coordinator, wag submitted. Two proposals to paint the City Jail and the interior of the Police Station, was submitted, the low bid being presented by Edward Scheid, for the sum of X225.00. After due consideration of the matter, it was moved by Councilman Lake and Seconded by Councilman Wiggins that Chief of Police Paul M.
