M. Mayor Willard in the chair. Councilmen Christense'ri,y Lake, Meyer, Wiggins and Willard answered .the roll call. It was moved by Councilman Christensen and seconded by Councilman Lake that the Minutes of the previous regular meeting of December 21,.1943 be approved as written. All members of the City Council voting aye, the Mayor declared the motion duly carried. WRITTEN COMIJNNICATIONS: -~^ A communication was received from Mrs. Mary Barton to the effect that a pack of dogs struck her child at High School and upon investigation they found that the child's leg was punctured, requesting that she be allowed damRges for doctor bills and other debts that may accrue as a result of said experience. After due consideration of the matte it was moved by Councilman. Lake and seconded by Councilman Meyer that the claita be disallowed, and that the Poundmaster be n~tlfied to pick up , all stray dogs. All members of the City Council voting aye, the Mayor ~ declared the motion duly carried, and it was so ordered. =~ The hour of 8:00 P. b1. having.2rrived, that hour being the time fixed for hearing any appeals, protests or objections in connection with the proceedings and assessment to be levied in connection with Lynwood Sewer District No. 3, the Manor announced that this was the time and place for hearing any and all appeals, protests or objections in~eference to said proceedings and assessment, as provided by law. The City Clerk stated that no written appeals, protests, or ob,j ections had been filed. Thereupon the Mayor announced that this was the time and place of hearing and asked if there were any persons present who wished to be heard in connection with said matter. Thereupon the Council heard fromMii. Shirley L. Manuel, A,?r. Peter Braden, Mr. Alfred J. flack, Mr. Ed Rouleau, Mr. LaRoe, Mr. Richard Beatty, Mr. Ray Magnuson, Mr. 0. B. Gordon, Mr. Floyd Lange, Mr. Kellin, Mr. Horn, Mrs. R. S. Sunder.lin and Mr. Roache. At the time Mr. Alfred J. Plaek addressed the Council he ' "~" submitted a letter to the Council embodying certain objections that ~ he stated in connection with the construction of the work. The Council also heard Prom Building Inspector Evans, and Superintendent of Streets John A. Blain was sworn upon oath administered by the City Clerk and gave evidence before the Council in reference to all phases of the proceedings embodied. in the matters presented by the foregoing named persons and in connection with the construction of the work by the contractor and the spreading and levying of the assessment. The City Clerk also .advised that notices of this hearing had been duly and regularly given in accordance with law, and that affidavlts of posting, mailing and publication of such notices were on file in his office. After a full, fair and impartial hearing and an opportunity. having been given to all persons to be heard in connection with the improvement, and after the taking of evidence and testimony, the Council being fully advised thereupon: It was moved by Councilman Lake and seconded by Councilman Christensen that the following Resolution No. 1623 be adopted: '"~ ~~A RESOLUTION SETTING FORTH FAC'T'S OF HEARING AND FINDINGS AND CONFIRMING ASSESS~dENT IN AND OF "LYNWOUD SEWER DISTRICT N0. 3" OF THE CITY OF LYNWOOD, CALIFORNIA. " +~ 'T'HAT THE CI'T'Y COUNCIL OF THE CITY OF LYNWOOD, CALIFORNIA, DOES ~ - H~REBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: "SECTION 1, That the Resolution of Intention, No. 1557, .,~„ was duly adopted and contains all the matters and things required by law and is in every respect legal and sufficient. That said Resolution 1 was passed at the time and in the form and manner by law required and that notices of passage of said resolution of intention and of the proposed work, or improvement, therein described were posted at the time and as by law required; and that the notices of adoption of said Resolution of Intention were mailed postage prepaid at the time and in the manner a.nd to the persons required by law and affidavits of such passage, posting a.nd mailing were duly filed as required by law in the office of the City Clerk of the City of Lynwood, California. "That a hearing was held pursuant to said resolution at the time and place stated therein, that there were no protests filed ob~ ,jecting to the proposed work, or improvement; and that Resolution No. 1562 of the City Council was duly passed and adopted determining that the City Council had acquired ,jurisdiction to arder the proposed work, or improvement, of "Lynwood Sewer District No. 3". "That Fesolution No. 15?4 of this City Council, ordering work, or improvement, of "Lynwood Sewer District No. 3", to which resolution reference is hereby made for further particulars, was on the 29th day of June, 1943, duly adopted. 'What notices inviting bids were duly posted and published. in accordance with the requirements of law and affidavit$ of posting and publishing have been duly filed in the office oP the City Clerk of said City of Lynwood. "That at the time and place provided in said notice, inviting bids, bide ~vere received and publicly opened, examined and declared, and of ter an analysis and report by the Superintendent of Streets of said City and the City Engineer of said City of Lynwood, this City Council did award the contract for said work, or improvement, to the lowest bidder, tb -wit: George Miller, on the 21st day of July, 1943, rejecting all other bids. "That notice of said contract was duly and. properly published in accordance with law and affidavit of publishing has been duly filed with the City Clerk of said City. 'That .pursuant to the direction of said City Council, the City Engineer prepared a diagram of the property included within the district affected or benefited by the work, or improvement, by the Resolution of intention No. 155?, and said assessment diagram was duly and regularly approved by this City Council. . "That on the 16th day of December, 1943, the Superintendent of Streets of said City of Lynwood, California, filed with the City Clerk of said City of Lynwood the assessment, with attached ,diagram for the work, or improvement, aforesaid, and the City Clerk thereupon fixed this time and place, to-wit: the City Council Chambers, City Hall, City of Lynwood, California, at the hour, of 8 o'clock P. M., January 4, 1944 for the hearing on said assessment and published, posted a.nd mailed as by law required the proper notices of this hearing on said assessment. "That a. full, fair and impartial hearing was had before this Council and evidence taken. That this Council finds that the assessment is ,just, in accordance with law, and that all of the acts, determinations, resolutions and orders, and all of the proceedings heretofore take are legal, valid and sufficient, and that the diagram attached to said assessment is legal, valid and sufficient. "That no written appeals, protests or objections were filed prior to the day set for hearing; that one written .pro test was filed during the hearing; that certain oral protests or objections were made to the Council at the time of said hearing, and that no written appeals, protests or objections were filed as required by law. "gEC`1'ION ~~ That all protests of every kind and nature are hereby denied and overruled. "SECTION 3, That this Council is satisfied with the correctness of the assessment, and that said proceedings and said assessment are hereby in all respects and in all a.nd every particular canfirmec~, approved and adopted this 4th day of January, 1944." That said Resolution was adopted by the following vote: Ayes: Councilman Christensen, Lake, Meyer, Wiggins and Willard. Noes: None. A Petition was received signed by Richard A. Burnett, and l.fi other property owners requesting that Otis Street be improved full width to eliminate dust and mud; also that something be done to widen Otis Streit full width so that the old.house may be moved back as it is an eyesore to the neighborhood. Thereupon it was moved by Councilman Lake and seconded by Councilman Wiggins that the City Attorney be instructed to negotiate with the owner of the tract of land known as Upston Tract for right oP way to~ open Otis Street to its full width. All members of the City Council voting aye, the Mayor declared the motion duly carried and it was so ordered. A communication was received from Ruby Cagle making application for permission to show religious pictures two or three nights each week on Long Beach Blvd., in a building to be secured. This matter was referred.to Building Inspector Evans to check into and if he deems it advisable to grant permission to do so. A communication was received from John C. Terry requesting permission to construct at the northwest corner of Long~Beach Blvd. and Imperial Highway, a covered bench to accommodate serarice men and women who may be waiting for transportation, stating that he agrees to maintain the upkeep of the property and will remove said property from the premises upon orders of the City Council or City Clerk. Thereupon it was moved by .Councilman Christensen and seconded by Councilman Meyer that per- mission be granted, subject to approval of Building Inspector Evans as to location and structure. All members of the City 'auncil voting aye, the Mayor declared the motion duly carried. A communication was received from Attorney Howard Hemenway, requesting authority to employ an attorney needed in connection with answers necessary in eases where probate of estates are necessary in order to complete quiet title action on tax .deeded lots, stating that a Charles A. Thoma sett, 519 Story Building, Los Angeles will serve for X10.00 for each case. Thereupon it was moved by Councilman Lake and seconded by Councilman Meyer that attorney Hemenway be authorized to engage the services of Mr. Thomassett to act in said capacity for the consideration stated. ORAL COMNCUNICA`t'IO1yS: ~""~~ Mr. Kellin addressed the Council regarding the improvement of the alley off of Standard Ave., also regarding tin cans not being picked up. Superintendent Blain stated that they will take care of it; also the cans will be picked up by the Street D~=partznent. Mr. Bugg, 10834 Otis Street, addressed theCouncil regarding garbage not being picked up and carelessness with garbage cans by the garbagemen ; also that they would not take all cf a hedge that they put out. Mr. H. L. Sutton addressed the Council regarding excessive cost of pound fees that he was compelled to pay to poundmaster when his dog was impounded. Mr. Sz.ztton was told to check with the City Clerk regarding fees to be charged. UNFINISHED BUSINESS: Superintendent of Streets, Mr. Blain reported regarding the cost of certain improvements proposed, or recommended by the Park Committee to proceed. with in the City Park, giving a total cost of X4,450.00 stating that because of the critical material required for the construc- tion of the west half of the picnic circle and the reinforcing steel required for the construction of shuffle board it would be necessary to obtain priority ratings for the materials f rom the War Production "~"" Board. After due consideration of the matter, it was moved by Council- man Wiggins and seconded by Councilman Christensen that Superintendent Blain be instructed to proceed with the improvement of the northwest corner with wooden curbs, lawn and decomposed granite roadway; barbecue stove, including water and sewer lines; also that he be authorized to make application for priorities for the work needing such priorities, and that the Park Committee inform the Council where they want to locate the bleachers„ and the tnzilding now used by elderly men as a recreation center. . A communication was received from Superintendent of Streets Blain reporting regarding the cost to construct sidewalks, stating that the lowest bid was 22¢ per square foot, statLng that 1n view of the present labor shortage and the high bids it is his opinion that thi a work should be deferred until after the war i s finished. ;"'+~ After due consideration, it was moved by Councilman Christen- sen, and seccnded by Councilman Lake that Mr. Blain's recommendations ~ be followed, however, th2t he check into available funds that may be ~ F used from the 1915 Bond account in an effort to repair sidewalks on Long Beach Blvd. between Fernwood and Imperial Highway. All members of the City Council voting aye, the Mayor declared the motion duly ,,..,, carried. It was moved by Councilman Lake and seconded by Councilman Christensen that the City Attorney be directed to draft an amendment to the water ordinance to provide that water used by schools in the City shall be charged on a meter basis. All members.of the Council present voting aye, the Mayor declared the motion duly carried. The matter of survey by the State Employees Retirement System to determine cost to_the City to be included in the State s retirement system, was brought up. It was moved by Councilman Lake and seccnded by Councilman Wiggins that the City of Lynwood engage the Board of Administration of the State Employees' Retirement system to make such a survey, and that the Mayor be authorized to sign an agreement in connection there- with as per their cost therefor a.$ stated in their communication of December 7, 1943, and to inclu de all City employees. %~i~j~_.3 =' Ro 11 Call : f Ayes ~ Councilmen Christensen, Lake, Wiggins, Meyer and Willard. Byram, Tax Collector, dated December 8, 1943, conveying to the City of Lynwood the N. 50 feet of E. 40 feet of Lot 47; N. 50 feet of W. 20 feet of E. 60 feet of Lot 47; Lot 49, Tract 2551; Lot 138, Tract 2551, N. 15 feet of S. 45 feet of Lot 144; Lot 148; W..40 feet of Lot 159, Lot I62, Tract 2551; SE 50 feet of Lot 8, Tract 2794; Lots 1251, 1272 and 1283, Tract 3335, was submitted. It was moved by Councilman Meyer and seconded by CouncilmanChristensen that said tax deed be accepted and that the City Glerk be directed to cause said instrument to be recorded in the office of the Recorder of Los Angeles County. A corporation Quitclaim Deed signed by the Officer of the Security-First National Bank of Los Angeles, dated December 20, 1943, was submitted, wherein they convey Lots 48 and 49 Tract 5456 to theCity of Lynwood. It was moved_by Councilman Lake and seconded by Councilman Meyer that said deed be accepted and that the City Clerk be directed to cause said instrument to be recorded in the Office of the Recorder of Los Angeles Cozanty. Willard dated December,l0, 1943, whereby they convey their interest in and to Lot 434, Tract 2551 to the City of Lynwood, was received.
