Mayor Wiggina in the chair. ' Councilmen Looney, Shrock, Meyer and Wiggina answered the roll call. Councilman Willard ~-as absent. ' It was moved by Councilman Meyer and seconded by Councilman Shrock that the minutes of the previous regular meeting of April I8, 1944 be approved as written. All members of the City Council present voting aye, the Mayor declared the motion duly carried and it was so ordered. ~VRi'Y`I Eiy COMNiU iv T CA'1'I O~ S A communication was received from J. Jack Willard to the _effect that he has been inducted into the armed forces of the United States and has entered such service for the duration of the war, and as a result thereof he can no 1©nger serve as a member of the City Council and that therefore in accordance with the laws of the State of Galifornia that the temporary vacancy of his office should be filled during his absence, stating that he will return to his duties as soon as it is possible when discharged from the military service. Thereupon it was moved by Councilman Meyer and seconded by Councilman Looney that the City Gouneil declare the Office held by J. Jack Willard as' temporarily vacant, and that Mr. Ray Tucker be appointed to fill the vacancy duri ng his absence. ROLL CALL: Ayes: Councilmen Looney, Shrock,' Meyer and Wiggina. Noes: None. ' Absent: Councilman Willard. Whereupon Mr. Tucker came forward and the Constitutional Oath of Office was administered by the City Clerk and he was there- upon inducted into Office and took his seat at the Gounell table. A communication was received from W. R. Haughey, Organizer and Sales Manager member of the New York State 'Bar, offering his service in the matter of adviser in connection with post war problems. A communication was also received from William Allen & W, George Lu tzi, Architects, off ering their services in connection with any new structures that need architectural work on and to be conatructed'during the post war period, There being no objection, said communication8 were ordered filed for future consideration. A communication was received from the Division of Highways of the State of California setting forth the amount of money that is due the Gity from the ~} cent gas tax 'funds covering Streets of Ma,~or Importance, for fiscal year ending June 30, 1945, the Bum `being X6,280.00, stating that in addition X28,901.8?.has been accumulated for future work in the City of Lynwood, submitting a Project Statement. Thereupon the Project Statement was submitted calling for the accumulation of funds. Whereupon RESOLUTION N0. 1662, entitled: "RESOLU'1'IO1V OF THE CITY COi3ivCIL OF 'THE CITY OF LYIVWOOD 'APPFtOVI~iG A PkOJEC't' S`T'ATEMENT FOR `THE ACCUMULATION OF 1/4 CENT GAS '1`AX ALI.,OCATED FOR S`T'REETS OF BdAJON. IDdPOt`tTANCE, " was read. Thereupon it was moved by Councilman Shrock and seconded by Councilman Meyer that said Resolution IJ4. 1662 be adopted. Roll Call: Ayes: Councilmen Looney, Shrock, Meyer, Tucker and Wiggina. Noes: None A communication was received from the Federal Works Agency regarding Water facilities to accommodate Western Gear Works Factory, for which the U. S. Government furnished the pipe to do the work, including labor, now requesting that City pay them X558.00 per year as payment therefor fr©m revenues received from the consumers in the City of Lynwood. After consideration of the matter,' it was referred to City Attorney Ruby to check into. as he had previously conferred with them regarding the matter together with Water Superintendent Blain. A communication vuas received from the Department of Gommerce, Bureau of Census, by J. G. Capt, Director, enclosing two copies of the formal Agreement relating to a special census for` the Gity of Lynwood, requesting that it be executed and that a check be deposited in a bank to the credit of Miss Claire F. ~ ' Cahill who is to be the supervisor. Thereupon it was moved by Councilman Meyer and Seconded by Councilman Tucker that the Agreement be accepted and that the City Clerk be authorized to execute said instrument for on behalf of the -City of Lynwood, and that a warra:t be drawn on the City Treasurer in favor of Miss Claire F. Cahill in the sum of X340.00 and that it• be deposited in the First Security National Bank of Lynwood, and be included in the list of demands to be allowed later in the meeting. Roll Call: Ayes: Councilmen Looney, Shroek, Meyer, Tucker and Wiggins. Noes: None. A communication was received Prom the Development Engineer, Inc. by Arthur C. Wright to the effect that as a consideration for rental of yard and v~arehouse at 11345 Chester Street for the dur- ation of his construction program that will be approximately five months, that he will make the following improvements and leave them on the property when finished: Construct wire fence around property in the manner which has already been completed, and Build Concrete apron from curb to sidewalk at gate entrance to property, or the alternate of paying rent for the use of said property at the rate of ~20.A0 per month, in which event he would take off the improvements above stated, stating that the paper8 deposited in the warehouse have been tied up by his men and placed on a platform in the yard and that a cover has been provided over them so that they will not get wet. ' Thereupon it was moved by Councilman Shroek and seconded by Councilman Meyer that the yard and warehouse be rented to .the Development Engineer, Inc, with the understanding that the wire fence a`nd post that he has installed on the property .be left there for City use after he is through with the property, also that he be required to construct a concrete approach to the gate at his own expense to conform with requirements of Street Superintendent Blain. Roll Call: Ayes: Councilmen Looney, Shrock, Meyer, Tucker and Wiggins. Noes : None. A communication was received from Mr. Herman E. Nesbitt requesting that Zoning restrictions be waived so that he would be permitted to move into his garage on Louise St. as he is compelled to move from his premises at 10631 Capistrano Ave., South Gate, and he has not completed his residence on Louise Street. After due consideration of the matter and after Mr. Nesbitt had addressed the Council on behalf of his application, it was moved by Councilman Meyer and seconded by Councilman Tucker that the request be denied, the Mayor explaining on behalf of the City Council that they cannot violate thelr own ordinance. Roll Call: Ayes: Councilmen Looney, Shrock, Meyer, Tucker and Wi~gin8. Noes: None. The hour of 8 P. M. having arrived, said hour being the time fixed to hear any objections or protests in connection with the abatement of dry and drying weeds as established by Resolution No. 1659 heretofore adopted, and as per notices posted on al 1 property as required by law. The Mayor announced that this was the-time and place to hear any and all such protests, inquiring of the audience whether or not any one wished to protest to the 'abatement of said weeds. Thereupon Mr. Bush addressed the Council requesting that the weeds be mowed on Seminole St. so that pedestrians can walk on the sidewalks without obstructions. The City Clerk stated that no written ob,~ections or protests had been filed in writing. Noes: None A communication was received from Street Superintendent John A. Blain submitting a proposed contract for the mowing and burning of weeds in the City two times a year as offered by a Mr. M. H. Hooks of Compton, stating that the total cost based on last year's weed assessment roll would be X4,430.10, setting forth that the cost of the City doing the work last year was X2929.19 with a total collection for such cleaning of X3,350.00 with a total levy of ~4, 633.14. City Attorney Ruby advised that contract for the entire 2~`~ City could not be made without advertising as it exceeded X1,000.00. Thereupon it was moved by Councilman Tucker and seconded by Council- man Looney that we enter into a contract with Mr. Hook to clean weeds and rubbish from vacant Lota in Lynwood north of Fernwood and west of Long Beach Boulevard, and that work be commenced at an early date. Roll Call: Ayes: Councilmen Looney, Shrock, Meyer, Tucker and Wiggins. Noes: None. . ORDINANCE N0. 395, entitled; "AN .ORDIivAivCE OF' TtiE CITY OF LYNY~OOD, CALIFORNIA TRANSFERRING CERTATiV LANDS FROM ZONE Rl INTO ZONE C3," was read, eai~d Ordinance calling for rezoning of Lot 835, Tract 3078, for the second time by caption. Thereupon it was moved by Councilman Meyer and seconded by Councilman Looney that the further reading of said Ordinance be waived. All members of the City Council voting aye, the Mayor declared the motion duly carried and it was so ordered. • Thereupon it was moved by Councilman Meyer and seconded by Councilman Shrock that said Ordinance be adopted as read the second time, .finally pass and be published as required by late. ORDINANCE N0. 396, entitled: "AN ORDIiJANCE OF THE CITY OF LYNWOOD, CALIFOR~~vIA, TRANSFERRING CERTAIN LANDS FRObd ZONE ~, IN't'0 ZONE C3," was read for the second time by caption, said Ordinance calling for the rezoning of Lot 11, Block A of Tract 12197. Thereupon it was moved by Councilman Shrock and seconded by Councilman Looney that the further reading o!' said Ordinance be waived. Thereupon it was moved by Councilman Meyer and seconded by Councilman•Shroek that-said Ordinance be adopted as read the second time, finally pass and be published. as required by law. A communication was received from Mr. Bazil Bilder, 12021 Cornish Aver calling attention to the lack of good garbage service, stating that the pickups are very irregular, they do not remove all garbage from the can, and change dates thus confusing the citizens, requesting that something be done to correct the situation. There being no ob,~ection, said communication was ordered filed and the . City Clerk was directed to communicate with Mr. Bilder to the effect that the City is in the process of changing the contract for garbage service and that they believe that the matter will be satisfactorily taken care of. A communication was received from Mr. W. J. Patillo to the effect that next Sunday, May 7th, the Boy Scouts of Lynwood are going to plant trees and level the grounds at the Boy Scout site in the City Park, requesting that a stand pipe be installed at the Scout site so that the trees may be watered. Thereupon it was moved by Councilman Shrock and seconded by Councilman Meyer that the Water Superintendent be instructed to have installed a water line so that the trees may be watered. Roll Gall: Ayes: Councilmen Looney, Shrock, Meyer, Tucker and Wiggins. Noes : None. ~ A communication was received from the Los Angeles County Health Department, By H. 0. Swartout, ;~. D. announcing their having been awarded a prize in the National Health Honor Roll contest for-1943, thanking the City of Lynwood for the cooperation with the Health Department. There being no ob,~ection, said communication was ordered filed. A communication was received from John B. Herndon, Local Manager of the War MAnpower Commission to•the effect that the City of Lynwood may be covered by their Employment Stabilization program, which would afford them protection in the recruitment and retention of employees. In considering the matter, it was deter- .mined by the City Council that it would be for the best interest of the City not to become a part oi' said program, therefore the communication was ordered filed and no further action was taken thereon. ~~~ _ A communication was received from 0. F. Cooley, Road Commissioner of the County of Los Angeles informing the City that the application for .authority to construct traffic signals at Alameda Street and Imperial Highway has been approved by the filar Production Board, however, due to uncertain deliveries, the time required to secure the supplies and materials cannot be accurately determined. There being no ob,~ection, said communication was .ordered filed. An offer to Purchase the E. 40 feet of Lot 73, Tract 2551 for the sum of X350.00 was received from .R. 0. Schmidt. Inasmuch as this offer is below the appraised value of said Lot, it was moved by Councilman Shrock and seconded by Councilman Meyer that the off er be rejected. All members of the Council present voting aye, the Mayor declared the motion duly carried. A communication was received from T. G. Dummett, City Treasurer, recommending that the salary of Claire Pratt, Clerk in his office be increased Prom X110.00 per month to X125.00 per month. Thereupon it was moved by Councilman Meyer and seconded ~ by Councilman Tucker that Mrs. Pratt's salary be increased to X125.00 per month as per recommendation of the City Treasurer. Roll Call Ayes: Councilmen Looney, Shrock, Meyer, Tucker and 1Yiggns. Noes: None. An application for employment was received from Mildred K. Nelson. There being no ob,~eetion, said application was ordered filed. ORAL COMA°iUvl CATIONS: Mrs. Caywood addressed the Council on behalf of the _ American Legion Auxiliary requesting permission to sell poppies on the Streets of the City of Lynwood on Txay 26 and 27. Thereupon it was moved by Councilman Meyer and. seconded by Councilman Looney that permission be granted. All members of the City Council present voting afire, the Mayor declared the motion duly carried. Mr. R. M. Downey addressed the Council regarding the matter as to when the title will be cleared on Lot 49 Tract 2551 .that he purchased from the City of Lynwood some time. ago. He was informed that quiet title action wa.s commenced, but in serving the papers it wa.s found that one of the parties to the suit had died., therefore new a.etion must be commenced, • UNFIIySSHED BUSINESS: It was moved by Councilman Meyer and seconded by Council- man Looney that the City of Lynwood enter into a contract with Mr. A. Hokin for the collection of garbage, tin cans, bottles, trash, (including lawn clipping) and ashes for a t®tal consid- eration oP X500.00 per month, and that the City Attorney be in- structed to draft a contract on said basis, which the Mayor is authorized to execute for and on behalf of the City of ,Lynwood. Fuhrman and 61 other business men of Lynwood petitioning the City Council to provide trash receptacles to be placed in the streets in the business section for the purpose of depositing any trash, papers, etc., that is now being thrown on the sidewalk and in the Street. .There being no ob,~ection, said matter was referred to the Street '" Department to check into and recommend to the City Council what would be necessary to relieve the situation. Delaney, Frances, L. Delaney and Gladys M. Lightner; also Quitclaim Deed to Lot 142, Tract 921 signed by Ralph P. and Enith Holloway; also Quitclaim Deed to Lot 42 and 43, Blook 3, Mod,~eska Park signed by Anna Martin; also Quitclaim Deed to Lots 66 and 67, Block ~ of Mod~jeska Park, signed by C.
