M. ' Mayor Wiggins in the chair. Councilmen Looney, Shrock, Meyer, Tucker and Higgins answered the roll call. ' It was moved by Councilman Shrock and seconded by Council- man Meyer that the minutes of the previous regular meeting of August' 15, 1944 be approved as written. All members of the City Council voting aye, the Mayor declared the motion carried. WRITTEN ICOIiMUNICATI0N8 A communication was received from 0. ~'. Cooley, Road Commissioner to the effect that the City of Lynwood~s apportion®ent of 1944-45 County Budget Appropriation for aid to Cities from gasoline tax would be X8,455.93, which would be paid upon written requwst to the Road Commissioner after allocation has been made to a spedific project, or pro3ects, as it becomes available in the County Treasury. There being no objection, said communisation was ordered filed. A communication was received from Warren L. Daetweiler, Chief of the Fire Department attaching a letter from Mr. 8. L. Crawshaw, Manager of Western Gear Works, regarding the low water pressure during the warm days, which letter was also read. Chief Daetweiler, stated that upon contacting Engineer Graves regarding the matter it was determined that this low pressure would be a111eviated when the new water well is connected as contemplated, stating that he has so informed the Western Gear Officials. There being no objection, said communications were ordered filed. - An offer to purchase Lots 62 and 63, Hloek I8, Mod~es~ka Park for the sum of X500.00, free and clear of indebtedness, and City to furnish a merchantable title thereto was received from Bruce R. Almas. There being no one present who wished to increase said bid and the offer being within the appraisal of said Lots, it was moved by Councilman Meyer and seconded by Councilman Shrock that the offer be accepted. Noes: None An offer to purchase Lot 43, Block 2, Mod~eska Park for the sum of X310.00, free and clear of all indebtedness sad City to furnish a merchantable title thereto was received from Lynn T. Doerr, 290'? Loa Flores Blvd., Lynwood. This offer being within the appraisal of said Lot and there being no one present who wished to increase the offer, it was moved by Councilman Shrock-and seconded by Councilman Tucker that the offer be accepted, and sold to the offeree. - Ro 11 Call Ayes: Councilmen Looney, Shrock, Meyer, Tucker and Wiggins. UNFINISHED BUSINESS The application of the Lawrence Pipe Company for a license to operate a pipe and machinery business on Alameda Street and Lynwood Road, was brought up for further consideration. Mr. Lawrence Levin was present and addressed the Council regarding the matter to the effect that they will keep a neat yard, comply with all the ordinances effedting such business; also-that they would use Alameda Street as the egress and ingress street and not use Lynwood Road East of Alameda Street for trucking their equipment. Af ter due consideration of the matter, it was moved by Councilman Meyer and Seconded by Councilman Shrock that permission be Grated to the Lawrence Pipe Co. to conduct their business at Alameda and Lynwood Road upon the conditions specified in existing ordinances with the understanding that Lynwood Road shall not be used for trucking purposes and that the yard shall be kept in a tidy manner; also that the applicant shall be required to set back buildings and fence 20 feet from present property line, ata~. that the License collector be authorized to issue license therefor. An Agreement between the City of Lynwood and H©ward Hemenway in.conneetion'with clearing title to~certain tax deeds$ property, fixing a retainer's fee of X15.00, and X35.00 upon eon» pletion of clearing title, with 3~ of selling price above 2,000.00 consideration. Thereupon it was moved by Councilman Tucker and " seconded by Councilman 9hroek that the Agreement be accepted and that the .Mayor be authorized to execute it for and on behalf of the City of Lynwood. Roll Call: Ayes: Councilman Looney, Shrock, Meyer, Tucker and Wiggins. Noes: None The matter of application for franchise to operate a bus line in the City of Lynwood by Carson Brothers as requested at the last ,meeting of the City Council, was brought -up for further consideration. ~ It was moved by Councilman Tucker and seconded by Councilman Looney that the matter be referral to the City Attorney •~, with instructions to draw up a proposed form of franchise for s,~ consideratbn of the City Council at a 'later date, and that he be instructed to first contact the applicant to secure what information he way need. All members of the City Council voting aye, the Mayor declared the motion duly carried. Mr. Finney, President of the Chamber of Commerce adlreesed the Council requesting that the proposed franchise be referred to. thel'r body for study too. NEW BUSINESS: • • The proposed budget for fiscal year 1944-45 calling for an estimated revenue of X264,19?.?4, and 'expenditures of ~2fi3,792.07, was submitted for conslderatior~ of the City Council. A General discussion ensued regarding the expenditures contained in the budget, the following addressing the Council ob~scting to any increase in the tax rate: Mssrs. Finney, representing the Beard of Directors ®P .the Chamber of Commerce, David Good, Mr. 9neddon, Hr. Groves, Dr. Wiseman, Mrs. Hoakett, and Mr. Bush; also Councilman Lo©ney. Mayor Wiggins, Councilman Meyer and Ceunci].®an Shrock addressed those in attendance explaining the budget and the need for a raise in the tax rate in order to balance the budget. Af ter due consideration of the matter, it was moved by Coui~ei3.man Tgaker and seconded by Councilman Meyer that the budget be adopted. Thereupon ORDINANCE N0. 400, entitled: "AN ORDINANCE OF THE INCORPORATED CITY OF LYNWOOD, CALIFORNIA, ESTABLISHING • TAX DISTRICT N0. 1 AND N0. 2 @F SAID CITY, FIXING THE RATES OF TAXES AND LEVYING TAXES FOR THE FISCAL YEAR BEGINNING JULY 1, 1944 AND•ENDING JUNE 30, 1945,N was read for the second time by caption. Thereupon it was moved by Councilffian Shrock and seconded by Councilman Meyer that the further reading of said Ordinance . be waivel. A communication was- received from the Title Insurance and Trust Company regarding a small strip of land that had erroa- eou8ly been transferred to the City of Lynwood by the County of Los Angeles when issuing a tax deed on a portion of the 08car Tower A11®ttment and oP the J. G. Denman All®ttment in Tract No. 1 of Partition of a portion of the Home Tract of Antonio Maria Lugo and M=via German Lugo and being a portion of the Rancho San Antonio thereby clouding the title to several persons property facing on Plums St., requesting that the City of Lyltwood convey this ps-rtion of the property back to the respective record owners of the land.. Thereupon Grant Deed whereby the City of Lynwood prc~po$ed to convey its interest in and to said property to the respective record owners of the land described in severalty and upon the ease tenure as their respective interest appear of record in the office of the County Recorder of Los Angeles County, was submitted. Whereupon RESOLUTION N0. 1718 entitled: "RESOLUTION SELLING CERTAIN REAL ESTATE AND AUTHORIZING THE EXECUTION OF A DEED UPON PAYMENT OF THE CONSIDERATION NAMED THEREIN", was read. Thereupon it was moved by Councilman~Meyer and seconded by Councilman Tucker that said resolution No. 1718 be adopted. Roll Call: Ayes: Councilmen Looney, Shrock, Meyer, Tucker and Wiggins. Noes: None -- A communication was received Prom City Engineer Graves reporting on the bid of W. A. Rice for the drilling of a water well, stating that the•bid did not comply with the requirements, therefore, recommending that the bid be re;~ected. Thereupon it was moved by Councilman Tucker and seeot~ded bq Councilman Shrock that the bid be rejected, and that the City Clerk action in readvertising for bids be confirmed. All members of the City Council. voting aye, the Mayor declared the m~timn duly carried. A Q~.iitclaim Deed, dated August 22, 1944 anc~ signed by Theresa P. Hahn, whereby she conveys her interest in and to Lot 128, Tract 921 to the City of Lynwood, was submitted. It was moved by Councilman Shrock and seconded by Councilman Meyer that said deed be accepted and that the City Clerk be in structed to cause said instrument to be recorded in the office of the Recorder of .Los Angeles County. ~~ Roll Call Ayes: Councilmen Looney, Shrock, Meyer, Tucker and I-iggins. Noes: None The City Clerk stated that the Fire and Theft Insurance covering all m~tvr vehicles owned by the City of Lynwood expires on September 14, 1944, stating. that the agent who wrote it la.et year was Calude E. Reber. Thereupon it was moved by Councilman Tucker and seeonde8 by Comneil®an Meyer that Mr. Reber be instructe8 to have the insurance renewed tar another year. All members of the City Council present voting aye, the Mayor declared the motion duly carried. RESOLUTION NO. 1719, entitled: "RESOLUTION ESTABLISHINC# RATE OF PAY OF TRUSTY PRISONERS WHO PERFORM WORK FOR THE CITY, UNDER DIRECTIONOF THE POLICE CHIEF", was read. It was moved by Councilman Meyer and seconded by Councilman Tucker that said Resolution No. r?19 be adopted. Roll Call: -Ayes: Councilmen Looney, Shrock, Meyer, Tucker and Xiggins. Noes: None. It was moved by Councilman Shroek and seeonde8 by Ccuneil- man Meyer that the City Clerk be instructed to check with the U: 8. Civilian Def erase, otficiale, the State Civilian Defense oftiee and the local Civilian Defense on the possibiility of having one o! the Fire Equipment trucks dismantled, so that it may be used for. the Park Department, as it is badly needed there.
