M. Mayor Wiggins in the chair. Councilmen Looney, Shro,ck, Meyer, Tucker and Wiggins answered the roll call. It was moved by Councilman Meyer and seconded by Council- man Tucker that the minutes of the previouw regular meeting of November 8, 1944 be approved as written. All members of the City Council eating aye, the Mayor declared the motion duly carried. The hour of 8 P. M. having arrived, said time being the hour fixed for hearing any objections or protests in connection with rezoning Lots 1296, 129? and 1298, Tract 3335~from Zone R1 to Zone R3, as posted and published as required by law. The Mayor announced that this was the time and place for said hearing on the Tentative Report as adopted at the last meeting of the City Council, inquirl.ng if there was any one present who wished to voice their objection to said rezo ping. There was no response. The City Clerk stated that no written objection had been filed. Thereupon Final Report of the City Council of the City of Lynwood, California, in relation to proposed change of Zone, as stated above, was read, fixing the he.-ring date as December 5, 1944. Thereupon it was moved~by Councilman Tucker and seconded by Couneil- man Meyer that said Tentative Report be adopted. Roll Call: Ayes: Councilmen Looney, Shrock, Meyer, Tucker and Wiggins. Noes: None. ORAL CObIMUNICATIONS; Mr. Richard Bath, 10903 Standard Ave.. addressed the Council regarding the unsanitary condition that is caused by the Hansen dairy that is located ,just north of their premises, stating that during the last rain said dairy drained the mater down Standard Ave. thus aggravating the matter considerably, requesting that the City Council do something about having the dairy moved. Councilman Meyer addressed the Council explaining the situa- tion that the City Council finds itself in on account of said dairy having been there for a number of years. Mrs. Irene Manuel Addressed the Council on the unsanitary condition caused by said Hansen dairy also, +stating that there are 18 children on Standard Ave. and they play in the street in the water that overflows from said dairy that certainly does not add to the comfort of the residents; also speaking on the matter of flies that breed and accumulate as a result of said dairy, stating that it's useless for them to paint their home a.s it will become fly specked. within a short time and need painting; also calling attention to the danger of spPeading of deseases by such flies; also regarding odor that is very obnoxious, can't have house guests for mea.ls~on account of the odor. After due consideration of the matter, the City Attorney read a letter that the City had received on May ~26, 1944 in response to their reouest to the State and County of Los Angeles Health Dept's. that something be done to get rid of said dairy. ~ Said communica- tions indicated that it is difficult to eliminate a dairy as a public nuisance, but°that a private action has a better chance in Court as a diary may not be a public nuisance, but it certainly can become a rrivate nuisance. WRITTEN C01-~UNICATIONS A communicatio n was received from Faulknep,3 Oakes, & Faulkner wishing to do the auditing of City Books, but the City having already engaged an auditor to do such work, no action was taken and the communication was ordered filed. A communication was received from Franklin Auto Supply, by B, J. Franklin requesting the City Council to rezone the Easterly 80 feet of the Southerly 2?0 feet of Lot 15, Tract 5103, which property adjoins a Zone C3 (Commercial), from R1 to Zone C3 so that they may construct a business building thereon, stating that when they pur- chased. the Lot they thought that it was in a commercial district, but found out when they endeavored to secure a .permit to build that it could not be granted on account of not being zoned for business. 3 `7 ~~ Mr. Ben Franklin was present and addressed the Council re- garding his application; also requesting speedy action as he is de- sirous to proceed as soon as possible with the building. The City Council stated that they had no power to grant him a permit until the zoning proceeding had been •completed, however, trat they urould commence the proceedings at once. Noes: None Thereupon TENTATIVE REPORT OF THE CITY COUNCIL OF THE CITY ~' OF LYNWOOD, CALIFORTdIA IN RELATION TO PROPOSED CHANGE OF ZON E, fixing December 5, 1944, •at 8 P. T44. as the time for a he?ring, was read. It was moved by Councilman r.~leyer and seconded by Councilman Tacker that said Tentative Report be adopted. Ro1J. Carson, offering to pur- chase Lots 21, 22 and 23, Block 20, Mod,jeska nark for the sum of X750.00, free and- elea.r of all debt and City to furnish a merchant- able title thereto. This offer being within the appraisal thereof, and there being no one present who wished to increase said offer, it was moved by Councilman Meyer and seconded- by Councilman Shrock that the offer be accepted. Roll Call :• Ayes : Councilmen Looney, Shrock, Meyer, Tucker and Wiggins. Noes: None A communication was received from Chas. A. Ruby offering to purchase Lot 1, Tract 921 for a total consideration of X280.00, free and clear of all indebtedness, and City to furnish a merchantable title thereto. This offer being within the appraisal thereof, and there being no one present who wished to raise said bid, it was moved by Councilman Meyer end seconded by Councilman Shrock that said offer be accepted, Roll Call: Ayes: Councilmen Looney, Shrock, Meyer, Tucker and Wiggins. Noes: None A communication was received from the Federated Church Brotherhood of Lynwood inviting the Council to attend a community thanksgiving service at the Lynwood Junior High School at 7:30 P. M. when special music will be rendered under the direction of Dr. Herbert (~. Tovey. There being no objection, said communication wa.s ordered filed. A communicatio n was received from Chief of Police Kerr re- commending that Mr. Wm. J. Oeller who has completed his probationary period as policeman be made permanent, and that his salary be in- creased from X185.00 per month to X200.00 per month. Thereupon it was moved by Counci-lman Shrock and seconded by Councilman Meyer that '~'' the recommendation of Chief of Police Kerr be followed and that Mr. Oiller~s salary be increased. to X200.00 per month. Noes: None A comm~.anication was received from Chief of Police Kerr to the effect that Police vehicle No. 9 had been damaged in a collision giving an estimate of the cost of repair, requesting the Council to consider the advisability to trade the car in for a new 1942 ear, stating that the person who hit the car assumes full responsibility and stating further that she was covered by insurance. Thereupon it aras moved by Councilman Tucker and seconded by Councilman Meyer that the matter be ref erred to Councilman Looney to check into the matter and have a report on the cost of a new car and all necessary information for the Council to act on at their next meeting. Noes: None 3 ~'7 A communication was received from the Lynwood Park Comm- ittee seeking information as to their duties, whether their service is needed, financial standing of the Park fund, etc.- No action was taken on this matter at this time, but the Council agreed to meet with the Park Committee in an endeavor to arrive at a mutual understanding regarding their functions. • A Resolution was received from the Federated Church Brother- hood of Lynwood requesting the Council to not grant permits to con- duct dancing to any firms who dispense alcoholic beverages of any kind, including beer and wines, or where such dancing establishment ad~joins• any such liquor dispensing establishment. There being no objection, said Resolution wa.s filed. A communication was received from Mr. and Mrs. J. F. Mc- Ginnis offering to sell to the City of Lynwood Lots 122 and 175, Licensed Surveyor's Map, Book 16, Page 37, for the sum of X850.00. Thereupon it was moved by Councilman Shrock and seconded by Council- man Tucker that said Lots be purchased by the City of Lynwood for Municipal purposes and be paid for out of the• Park Fund. Powell making ap- plication to establish a used car lot on Long Beach Blvd. on Lots 542 and 543, Tract 2551. Thereupon it was moved by Councilman Looney and seconded by Councilman Shrock that permission be granted sub,~eet to necessary requirement for surfacing the Lot to be ap- proved by Mayor Wiggins before license is issued therefor. All members of the City Council voting aye, the May©r declared the motion carried. A report of gasoline consumed for the month of October. UNFINISHED BUSINESS: A communication was received from Sammons & Sons thanking for prompt action in connection 9~ith lighting corner of Century Blvd. and Alameda Blvd. as requested by them. It was moved by Co~~ncilman Shrock and seconded by Councilman Meyer that the lights •be turned on on Century Boulevard from Alameda to Lorraine St. as well, and that all such property thus lighted be included in the Lighting Assessment district when it is levied for fiscal year 1945-46. A communication was received from Chief of Police Kerr re- porting ©n the matter of application by Schooner Cafe oP 12120 Long Beach Blvd, to conduct dances in connection with their business, recommending' that license be not granted. Thereupon it was moved by Co~_ancilman Tucker and seconded by Councilman Meyer that permission be denied. Roll Call: Ayes: Councilmen Looney, Shrock, Meyer, Tucker and Wiggin8. Noes: None A communication was received from Chief of Police Kerr re- porting on the matter of requesting for license to conduct dancing in connection with the Talberts Cafe located at 11216 Atlantic Ave. stating•thet he believes that the issue is whether the City Council ~r•ishes to permit dancing in cafes, and if this one is granted it will establish a precedent for others to come in as others are desirous of opening cafes where dancing is permitted. Thereupon it was moved by Councilman Meyer and seconded by Councilman Looney that the granting of a permit be de~~:ed. Roll Call: • Ayes : Councilmen Looney, Shrock, Meyer, Tucker and Wiggins. Noes: None A communication was received from Chief of Po11ce Kerr re- porting on the matter of request for an exclusive on ambulance service on a Lot to be purchased from the City on Imperial Highway by a Mr. Burton, Cr~ief Kerr reporting that he finds that the~~e is another concern that is contemplating locating here and that the deal is now in escrow, suggesting that we continue as in the past. There- upon i t wa s moved by Councilman Tucker and seconded by Cou neiltaan Looney that the City Council deny Mr. Bur°ton~s off er as it could not be accepted with such a provision. City engineer G~ra.ves reported that he had granted a 60 day extension of time to commence the dril~ing of the water well a s the contractor, Mr. W. A. Fernwood; also on the matter of commencin~~ the planting of seed.lin~;~s and seeds for park- uray trees, stating that the Park Superintendent had planted 10,000 seeds for Streets of the Jacaranda., Niagnolia and. three types of eucalyptus trees. ORDINANCE N0. 402, entitled: "AN ORDINANCE OF THE CITY OF LYNWOOD, CALIF'ORIvIA TRANSFERRING CERTAIN LANDS FROM ZONE R-1 INTO ZONE C_3,~' being approximately 100 acres of land facing on Century Boulevard, between Bullis Road and R~?uriel Drive, was read for the second time by caption. It wars moved by Councilman Shrock and seconded by Councilman Meyer that inasmuch as the permit to locate a sales office at Agnes and Bullis Road was issued temporarily only f,or the sale of the Lots in the Broadacre Tract, and inasmuch as this has been accomplished, that Mr. Russon be notified to cease operating a r eal estate and insurance business there within 60 days, said location being in a residential zone.
