M. havin~• arrived, said hour being the time fixed to hear any objections or rrotests in connection with Rezoning the E. 80 feet of the South 2'70 feet of Lot 15, Tract 5103 from Zone Rl to Zone C3. The T~Rayor announced that this galas the time and place fixed for said hearing, inquiring of t,ose present if there was any one present who wiehed to protest in connection with said matter. e~ ~ J Thereupon T+~`r. Frank. Palmer v!!ho resides at 4341 Linden St. addressed the Council nrotestin~~ t'r.e rezoning of said property on the grounds that it would have a tendency of lowering the value of his residential property; also alleging that the proceedin~~s for rezoning ~~ere not followed accordance to ordinance. 11~Tr. F. Palmer also called attention to a business enterprise next to t~~here the rezoning is proposed where the o~~!ner is manufacturing in violation to zoning reg~~la.tions for Zone C3, therefore, stating that eventually this Lot if rezoned ma,y be used for a similar ven- ture; also stating treat he is not in favor of extending the busi- ness district any farther vest on Imperial Highway. At this time Councilman Looney arrived and took his seat ~t the- Council table. P.~~rs. Tiller, 4031 Ios Flores Blvd, also addressed the Cotancil on the matter of rezoning protesting on similar grounds as ;lr?r. Palmer, also speaking on the a~~~noyance to residents caused by the firm making and repairing tanks on Imperial Highway. IUir. BenF'ranklin, 5059 Imperial High~~a,y, owner of the Lot that is proposed to be rezoned for business addressed the Council on the matter of rezoning, calling attention to the need. for such rezoning in order that he may continue his business that he has worked hard in order to maintain and get on a sound financial basis; also stating' that he had visited. all the neighbors in the neigh- borhood and had. secured signatures. on a. petition a~=proving of such change, stating that all excepting those protesting that he had contacted fa~ror the zone change. 1'~r. Frankl in, Jr. , al sa addressed the Council on their proposed business enterprise to the effect that they are contem- plating on bi.ailding~ a nice stucco building that will add. to the P~eneral appearance of the street and will help to hide the other business that the Protestants are complaining about, statins?~ that he does not believe that it will .tend to lower the value of resi- dential property. Mr. Franklin presented a Petition signed by T~~rs. John ~regnes and 37 other persons owning property in. that area to the effect that they have no objections to the rezoning of said property. A"rs. h~~iller, 4031 Los Flores Blvd. addressed the Council seeking information as to what can k~e done to cease further re- zoning for business on Imperial Highway, stating that she owned some lots on Imperial High~~iay further west and that she does not want further business encroachment, however, that she is not r~ro- testing the present ~rox~osed rezoning. ><Tiss Jane G. Frye also addressed the. Council along the ramie line of thought. The r~Ta,yor stated the procedure in cases of rezoning, stating that any one has a right to request that their property be rezoned, and. if the Council believes that there is any merit in the request they hold_ hearings v!~hen intere~ed persons ma.,y protest such. rezoning, s-tating further that this Council may. set up a policy in connection with such matters, but that they can not bind the hands of future Coy-ancils. - The City Clerk stated that no written protests had been filed. .After a full and impartial hearing when all present were given an orport~anity to be heard, An instrument entitled: "FIvAL REPOxT OF THE CITY COUNCIL Ot~ `~F~:E CITY OF LYNVti'OUD GA_LIFCR~vIA, IN hELATIUN TC PROPOSED CHANGE OF ZCi~TE," covering said property, fixing a hearing on said Final report for December 19, 1944, was read. It was moved by Council- man NTeyer and seconded by Councilman Shrock that said Report be adopted. Roll Call Ayes: Councilmen Looney, Shrock, It~eyer, Tucker and ~liggins. Noes: None The hour of 8 P. M. having arroved, said hour being the time fixed for hearing any objections or protests in connection with. rezoning Lots 1296, 129? and 1298, Tract 3335 from Rl to lone R3, as posted and c?ublj shed as required by Iew. The ItiRa,yor announced that this wa.s the time and place for holding said hearing, inq~iiring of the audience whether or not any one wished to protest in connection ~~ith said matter. The City Clerk stated that no written protests had been filed. 3 X34 Thereupon an Ordinance, entitled; "An Ordinance of the City of L;,7nwood, California, transferring certain lands from Zone R-1 into Zone R-3", was read for the first time. It wa_s moved , by Councilman Meyer and seconded by Councilman Shrock that said Ordinance be. accepted as read the second tune and pass to the second reading'. Roll Call Ayes ~ Co~_~ncilmen Loone;r, Shrock, ?vTeyer, Tucker and Wiggins. Noes: None. '- A communication was received from Robin A. Graves, City Engineer recommending that an hydra~,lic truck hoist be purchased for use in the Fark Dex~artment as it would gave time, stating that one can be purchased from the Car Wood Company for X275.00 installed. Thereupon it was moved by Cot~ncilma.n Shrock that said roi st be purchased a s recommended by Engineer Graves, which rno ti on !~~as duly seconded by Councilman A^'.eyer and upon roll call showed the following; res~?lt: Ayes: Councilmen Looney, Shrock, Af!e,yer, Tucker and Wiggins. Noes: None. A communication was received from Robin A. Craves, City Engineer recommending that an hydra~_~lic Truc Hoist be purchased for the Street Department and to be mounted on the trrac~ that will be dismantled now in use by the Civilian Defense, stating that the cost of such hoist would. be 4375.00, plus X9.38 tax. City Engineer Graves also ad~res~ed the Cot~ncil on the matter of such hoists stating that the one to be used in the Park Department will. not interfere with its continuance use in Civilian Defense activities in case of need, however, that he does not 1~now if the latter truck can be converted so that the pump can be slid on the track or not. Thereupon it was moved by Councilman Tucker and seconded by Councilman Meyer that the ma±ter of purchasing a hoist for the Street Department be held in abeyance for further ~.nvestiga.tion and report. A1.1 members of the City Cotancil voting aye, the Mayor declared the motion duly carried. A communication was received from R. M. Downey t~ the effect that he purchased Lot 49, Tract 2551 from the City of Lyn- t~Tood and that the City have been unable to c1~=ar title, GtatinQ~ that he secured the tax bilk for X60.55 for current year, stating that he was not to do any work at all on same until he had. the clear title, therefore asking for a ref~~nd for taxes. It was moved by Councilman Meyer and seconded by Councilman Tucker that the City Clerk inform Nr. Downey that the City will. refund the x~urchase price of the ILot and assume the tax if ;~,~~r. Downey does not want to ~~~ait for the clearance of the title, otherwise no refund will be made for taxes that ma.y have been paid. All members of the City Council voting aye, the Mayor declared the motion carried. A cor.~:;unication was received from the Department of Char- ities, by C. G. Thompson submitting a bill for 4$17.00 for taking care of emergent cases at their Emergency Hospital, resulting from accidents for October and Plovernber. Inasmuch as the City does not have any agreement for payment for such service and the ta.x- nayers at large ray for such Coy my service, the City Clerk was in- structed to secure further information relative to matter. A communication utae received from the Grand Jury, County of Los Angeles, by G. E. Armstrong, Foreman, attaching a coY>y of Resolution adopted by them having to do with the Ganitation con- ditions where food is served i_n cafeterias at schools, suggesting that Cities check up on their Ordinance on health reg~~lations to determine if it covers sch~~ols as !yell, and if not, then that the Ordinance be reg•ulated_ to provide sanitary req>>irements. a.t schools where food is being• served. There being no objection, the matter was referred to the City Attorney to eheck existing ordinances to see if it includes sanitation reg~?lations at School Ca.fet.erias within the City. A request for refund of weed assessment paid on Lot 11, Tract 6728 was received fr•;m Bernard. G. Hotz, in the sum. of 4"2.65 alleging that h.e cleaned the weeds off himself. There being ne objection, this matter was referred to City Engineer Graves for investigat_on and report his findirg•s. ._ ~~ A communication wa.s received from the Standard Oil Co. of California wishing permission to cut the pavements in crossing P.~agnolia Ave., Cedar, Agnes, Virginia, Josephine, Louise, Lynwood Road, Fernwood Ave„Lugo, V~'alnut, Flatt and Bzzllis Road a.s they are replacing their fuel line. Thereu?~on it was :moved by Cot.~ncil- man,nleyer and seconded by Councilman Shrock that permit be granted. City Council at their recent r!ieeting, that he moved that the City 1a~ngineer be instructed to proceed with the.. following work on the west end of the Park in the following order: Install Shuffle Board, Roque Court, Worse Shoe Pits, tiro shelters and one picnic stove, shrubs around rear of baseball bleachers, which motion etas duly seconded by Coun- cilman ~~Ieyer, a.nd upon roll call shorted the following res~_21t: Ayes: Councilmen Looney, Shrock, Drteyer, Tucker and Wiggins Noes: None The bill board installed next to Dr. Wood's dentist office was discussed, but it was determined that it was installed in accordance to ordinance. It was moved by Co~;ncilman I~~eyer and seconded by Ccuncilman Looney that the City Coz~nci]. invite the Los Angeles County Division of League of California Cities to meet in Lynwood in January, 1945, and that the V'~oman's Atzxilliary of the American Legion be requested to serve the meal.
