Public Hearings: Mayor Fran Cook; Mayor Pro -Tem Steve Sumrall; Trustees: Adam Cwiklin, Scotty Brent, and Eric Hoyhtya Town Manager Jeff Durbin, Finance Manager Nat Havens, Public Works Director Allen Nordin, Town Planner, Catherine Trotter and Chief Glen Trainor Others: See attached list Mayor Cook called the meeting to order at 6:10 p.m. 1. Roll Call 2. Approval of Agenda: Trustee Sumrall moved, and Trustee Hoyhtya seconded the motion to approve the Agenda. Motion carried: 4 -0. 3. Workshop Fraser Sanitation District Board (Trustee Cwiklin arrived at 6:14 p.m.) TB and FSD discussed the proposed Wastewater Management Plan which outlines how wastewater personnel would be incorporated into the organizational structure of the Town and how JFOC services would be provided to the JFOC partners. There is an upcoming JFOC meeting scheduled for February 26, 2009. a) Minutes- February 4, 2009 Trustee Sumrall moved, and Trustee Cwiklin seconded the motion to approve the consent agenda. Motion carried: 5 -0. a) B &K Investigations, LLC. introduced themselves to the TB. They are a new private investigation business in town. 8. Discussion and Possible Action Regarding a) Animal Control Chief Trainor gave a PowerPoint presentation on animal control. He discussed current animal control regulations, current enforcement activities and some suggested changes to our regulations. Audience and TB asked questions and made comments. TB will review draft ordinance and get comments to Glen Trainor by March 13 2009. (b) Resolution 2009 -02 -06 Annexation of Fire Station TM Durbin outlined the resolution. This starts the annexation process. TB will consider adoption of ordinance annexing and zoning property on April 1, 2009. Todd Holzworth addressed the TB and stated that hooking to the Fraser water system is the main reason for annexation. Trustee Sumrall moved, and Trustee Brent seconded the motion to approve Resolution 2009 -02 -06 Initiating the Annexation of a certain enclave of property within the Town of Fraser owned by the East Grand County Fire Protection District #4. Motion carried 5 -0. (c) FVMRD Intergovernmental Agreement Amendments The Town would like to formalize our snow storage relationship with the District as identified in the proposed paragraph 8 of the agreement. The District has requested that we split the cleaning costs at the Church and split costs of a portable restroom at the Old Schoolhouse Park. TB asked the manager to proceed with the amendment and bring it back for action at a future TB meeting under consent agenda. (d) FVMRD Recreation Center Construction Guarantee Agreement FVMRD wants to get the surety associated with their Construction Guarantee Agreement reduced. Staff is working to this end. Pending action next TB meeting. Page 2 of 3 (e) Resolution 2009 -02 -07 Authorizing Release of Performance Guarantee Funds TM Durbin reviewed the resolution with the Board outlining the need for releasing such funds. Trustee Sumrall moved, and Trustee Cwiklin seconded the motion to approve Resolution 2009 -02 -07 Authorizing the Release of the Performance Guarantee Funds for Village off -site water, sanitary sewer and storm sewer and declining of such improvements. Motion carried: 5 -0 (f) Village Improvement Agreement TM Durbin reviewed the current status of Grand Park public improvements and how the Town might proceed with amendments to the agreements regarding the Village and Willows infrastructure. TB discussed conditional vs. unconditional lien waivers, final acceptance of infrastructure without preliminary acceptance. TB directed TM Durbin to proceed with amended agreements and bring back for action on March 4 2009. Trustee Sumrall moved, and Trustee Cwiklin seconded the motion to approve a reduction of the Performance Guarantee Funds for Village Filing 2A to 20% of the original surety requirement. Motion carried: 5 -0 9. Action Items a) GCWSD Pond Lease TM Durbin reviewed the amendments to the lease. 10. Committee Reports: a) Water Committee met recently. 11. Staff Reports: Town Clerk- None. Public Works Director- TB happy with extended PW schedule. Catherine Trotter, Town Planner Page 3 of 3 (g) Solid waste management TM Durbin brought up the proposed transfer station in HSS. TB discussed the mandatory trash pick -up recently adopted in Grand Lake. We will continue this discussion in the future. Trustee Cwiklin moved, and Trustee Hoyhtya seconded the motion to approve the Intergovernmental Lease Agreement between GCWSD No. 1 and the Town of Fraser. Motion carried: 5 -0 Finance Manager- Sales tax for year -end exceeded budgeted number, up 4.3 Detailed financials will be in the next TB packet. Town Planner- GP MSP First Amendment will be reviewed at the 2/25/09 PC meeting. Survey results still being tallied. Trustee Sumrall has created a database for the results. Chief of Police- TB discussed the PowerPoint on animal control. Traffic light problems last week. Recent Fraser calls on domestic violence. Town Manger- Fraser will appoint Kajsa Wiberg to HTA. 12. Other Business: Trustee Cwiklin moved, and Trustee Hoyhtya seconded the motion to adjourn. Motion carried: 5 -0.
