Laporte Also attending: Mrs. Kirton, Mrs. Dickinson, and Messrs. Pope, Koch, Shetler, Colhoun, Nilsen, Johnston, Tyler, Lilenthal and Anderson. Meeting was called to order by Mayor Dodson. He then asked for a discussion of the drainage report sent to the various property owners in the vicinity of Oleander Way. Mr. Shetler stated that it was unfair to assess him for drainage when his property would not be benefited. Mr. Johnston stated that he had submitted the original petition, requesting some- thing be done about the drainage, for Mrs. Dickinson. But in view of the cost and proposed assessments, he requested the matter be tabled. Mrs. Dickinson said that her understanding was that this drainage was to have been done three years ago. Mr. Anderson of Brockway, Weber & Brockway stated that in their original drainage survey this area was included. This report was proposed in 1958. Mr. Koch replied that at that time the Town did not have the funds to do the job as laid out by Brockway. Mr. Pope stated that to assess property owners for drainage is contraty to the Town's policy of assessment by. taxation, citing the recent policy to finance water works from water sales profits. The Commissioners pointed out that this drainage is entirely new construction and not repairs and maintenance work as is the water project. Mr. Anderson pointed out that they did not propose to widen or raise Oleander Way, but to cut into it and even it out so that pockets of water would not accumulate. Mayor Dodson asked Mr. Anderson to point out the limitations of these proposals. Mr. Anderson stated that you could expect normal drainage only; any flooding conditions or excessive rainfall would not be drained immediately. Mr. Johnston displayed a sketch he had prepared that he thought would solve the problem at a low cost. Mayor Dodson appointed Mr. Johnston to form a committee of his choosing and to report back when they had some recommendations. 2- T- /P � i Mr..ar explained to the Commission the flooding that occurs along Gulf Stream Road in the vicinity of his house now that the Webster property has been filled. He said that the entire street is inexcessable during heavy rain. Mr. Lilienthal stated that the Town is not responsible for the filling of lots and thus throwing water into the streets. Mayor Dodson read a letter signed by the property owners along Gulf Stream Road objecting to the wooden fence installed on the Webster property. Mayor Dodson stated the Town ordinances have not been violated by the fence, but he stated that the deed restrictions on his property may have been. He read the deed restrictions on his property which included, "no fence over 4 feet high or closer than 25 feet of Gulf Stream Road shall be erected." Mr. Lilienthal stated that the Town cannot enforce deed restrictions, but the individual property owners can do so. It was agreed that the Town would forward the letter signed by property owners on Gulf Stream Road to Mr. Webster. Mayor Dodson said that he would take up the matter of deed restric- tions with Mr. Webster. The minutes of the meeting held March 11, 1961, and the Financial and Water Reports for March 1961, were read, approved and adopted. The Police Reports were read and approved. The minutes of the meeting of the Board of Equalization held March 21, 22, 23, were read, approved and adopted. A motion to allow the burning of trash on the Frelinghausen tract of land west of the Waterway after May 1, 1961, at the Police Chief's discretion was made, seconded and passed unanimously. A letter from H. F. Johnson, regarding the nursery on his property, was read to the Commission. There was a general discussion of the nursery. Mr. Iglehart moved that the Town write a letter to Mr. Johnson setting forth the Town's position regarding a commercial nursery, firearms being discharged in the area, the burning of trash, and excessive traffic caused by trucks removing trees and plants from the nursery. 3 - Mr. Koch stated that he had talked briefly with Delray Beach about fire protection, but said he would like to arrange a meeting next week with City Manager Mingle and Fire Chief Gregory, Mayor Dodson and himself. There was a discussion of the possibility of forming our own fire department with possibly Briney Breezes and Ocean Ridge joining us in a community fire station. Mr. Koch said he would find the name of the proper official to help us in planning such a venture. Mr. Hart moved that the Town write a letter to Col. C. P. Young stating that the "For Sale" on his property is in violation of the Town Ordinances and that said sign must be removed within three days from receipt of this letter. Motion seconded and passed unanimously. Resolution #p506 which is included as part of these minutes was passed unanimously. Deputy Town Clerk Gwynn presented a study of the various occupational licenses fees charged by Delray Beach, Boynton Beach and Boca Raton. There was general discussion of the subject and Mr. Gwynn was instructed to prepare an ordinance raising the fees to be charged by the Town to $75.00 for General Contractors and $30.00 for all other occupations and classifications. Said increases to become effective October 1, 1961. There was a general discussion of the possible annexation of properties on the south side of Pelican Lane in the vicinity of and including Mr. Paul Knowles property. Further discussion of this subject was tabled until the new water lines are installed and have been tested. Mr. Henry Pope discussed with the Commission the possibility of imposing a personal property tax on all personal property in the Town of Gulf Stream. There was a short discussion of this matter. Mr. Hart moved that the Town not impose or discuss imposing a personal property tax at this time. Motion seconded and passed. Mr. Hoyle abstained from voting. M There being no further business to come before the Commission, the meeting was adjourned. r— �lr�G4- Attest Resolution 0 506 BE IT HEREBY RESOLVED: that all outstanding U. S. Treasury Bonds, Series "J" , representing original cost of $15,840.00, and a redemption value as of May 1, 1961, of $17,610.00, be redeemed and all proceeds be deposited in the Water Fund checking account with the First National Bank of Delray Beach, Florida; and be it further resolved that a Certificate of Deposit in the amount of $8,000.00 in the name of the Town of Gulf Stream Reserve for Depreciation Fund be redeemed at maturity date, April 16, 1961, and the principal proceeds deposited in the Water Fund checking account; and be it further resolved that the sum of $4,000.00 be transferred from the Reserve for Depreciation checking account to the Water Fund checking account. The above mentioned $8,000.00 and $4,000.00 represent a loan to the Water Fund from the Reserve for Depreciation Fund. This loan shall bear interest at the rate of 3% per annum. Principal payments to be made each year, amount to be set by the Town Commission.
