M. Mayor Wiggins in the chair. - Councilmen Looney, Shrock, Meyer, Tucker and Wiggins the roll call. It was moved by Councilman Tucker and seconded by Coun- cilman Meyer that the minutes of the previous regular meeting of January 2, 1945 be approved as written. All members of the City Council votingg aye, the Mayor declared the motion duly carried. WRITTEN COMMUNICATIONS: A communication was received.. from the L. A. County Divi- sion of the League of California Cities announcing their next regular meeting to be held on January 18, at Lynwood, when the Board of Supervisors are to be the participants in the program. All who intend to attend were requested to so notify the City Clerk in-order that reservations may be made, and the communica- tion was ordered filed. A communication was received from Edward Bishop making application for a license to operate a used car lot on Lots 314, 315, 316, Tract 2551, on Long Beach Blvd. There being no ob- ~ection, this matter was tabled until the next meeting for in- vestigation by the~Chief of Police; also that the City Clerk re- quest the applicant to appear before the City Council at their next meeting for questioning. A communication was received from Apex Builders, Inc. to the eff set that they are about to complete 24 buildings on Abbott Road, and that as a part of the acceptance agreement with Federal Housing they require that curbs, gutters and sidewalks be installed, as well as a strip of pavement be completed from the gutter to existing pavement, Stating that they have completed the curbs, gutters and sidewalks, but that they desire the City to assist in paving the Street. After due consideration of the matter, it was moved by Councilman Looney and Seconded by Councilman Meyer that the Apex Builders, Inc. be permitted to resurface the street on Abbott Road, between Washington and Pinehurst Aves. at their own expense, and that such work be done in a way that will be satisfactory to the City Engineer. All members of the City Council voting aye, the mayor declared the motion duly car- ried. A communication was received from Mr. Jas. P. Reynolds to the effect that he has received partial payment for Bond 19~ Series AA of the 1915 Act Bonds issued for paving of Peach St. on a par plu s basis, requesting that the City complete payment on this bond, together with X4,000.00 worth of other bonds that he holds against the district, plus interest. There being no obsection this letter was ordered filed, and the City Clerk was directed to offer Mr. Reynolds 35~ of the par value of said bonds as full settlement. A communication was received signed by Roy W. Tager, 3564 Norton Ave. and 17 other residents residing on Norton Ave* objecting to the pasturing of many head of cattle across the street from their premises, Stating that they are greatly annoyed and that it constitutes a nuisance, requesting the City Coun- cil to have the nuisance abated forthwith. It was moved by Coun- cilman Looney and seconded by Councilman Shrock that the matter be fleffered to Chief Kerr to check into existing ordinances to determine if there is a violation; also to determine other means whereby the matter may be abated to the satisfaction of the resi- dents. All members of the City Council voting aye, the Mayor declared the- motion duly carried. A communication was received Prom the Playground and Re- creation Committee submitting a copy of minutes setting forth that Mrs. Ralph McCone was elected Chairman and Wm. W. Jones, Secretary at a recent meeting, requesting that the Council ratify such ap- pointment, also that the Council appoint one of their members to act on the committee. Thereupon it was moved by Councilman Shroek and seconded by Councilman Meyer that such election be approved by the City Council and that Mayor A. J. Wiggins be appointed as the representative to serve for the City Council. All members of the City Council voting aye, the Mayor declared the motion- duly car- ried and it was so ordered. A communication vlas received from Chief of Police Kerr recommending that a bycycle ordinance be drawn following the pat- tern of the California Highway Patrol; also that a small fee be charged for license plates, sug eating 50¢ per year per regis- tration. Thereupon it was move by Councilman Shrock and secon- ded by Councilman Tucker that the City Attorney be instructed to draft 8ueh an Ordinance and that the Pee be fixed at 50¢ for each bycycle per year to cover part of the cost of such regis- tration. Roll Call: Ayes: Councilmen Looney, Shrock, Meyer, Tucker and Wiggins. Noes: None. A communication was received from Chief of Police Kerr suggesting that a~ new type of light standard- be tried out at the intersection of Lynwood Road and Long Beach Blvd. of the type that will reflect more of the light downward. A communication was also received from City Engineer Graves along the same line stating that the Union Metal Co. have five standards that would coat X126.78 each, plus tax, of the type that the City is contemplating on installing, if the Cotancil ap- proved of such trial, stating that the old standard could be used in places where a light standard is wrecked by automobile, or otherwise, stating that there are two such wrecked standards at the present time that have not yet been replaced. Thereupon it was moved by Councilman Shrock and seconded by Councilman Tucker that the City of Lynwood purchase Pour of these lighting standards for trial a t the intersection of Lynwood Road' and Long Beach Blvd, Roll Call: Ayes : Councilmen Looney, Shrock, Meyer, Fucker and Wiggins. Noes: None. A communication was received from the City Employees s Retirement Committee, by Warren Daetweiler, Chairman, suggesting that some study be made of Ordinance 229 which covers civil ser- vice regulations for the Police and Fire Department with the thought in mind to have all City employees included in such a system to be voted upon at the next regular meeting to be held in April 1946. A communication was received from the City Employee's Re- tirement Committee to the effect that an acturial survey be com- menced not later than June 1945 for the inclusion of City Emp1mT- ees in the State Employee's Retirement System, to be voted upon at the April, 1946 election. Thereupon it was moved by Councilman Tucker and seconded by Councilman Meyer that the City Council authorize an actuarial survey for the cost of inclusion of all employees in the State Retire- ment system, January 1, 1947, and be commenced early enough so that the figures may be available for the electorates information when submitted to them in the April, 1946 election; also that a study be made by the City Attorney regarding a suitable Civil Service Ordinance for su~nission to the electors at said election. Adams, 9621 San Antonio, South Gate, addressed ;'"~ the Council on the need for an airport in this vicinity to care Yor the needs of those who wish to travel by plane after the war, stating that South Gate has been considered, but that the cost would be prohibited due to the need for removal of transmission lines, stating that there is no need for a large field for large air liners, but for small private planes after the war that would ' be of the less noisy type, There was no action taken regarding the matter. Mr. Sneddon addressed the Council on the matter of secur- ing permission to connect wiring for a meter for light and so that a telephone booth may be operated on his vacant Lot 496, Tract 2551 on Long Beach Blvd., stating that the present office building there for the taxi cab service is temporary arrangement. Thereupon it was moved by Councilman Shrock and seconded by Councilman Looney that permit be granted to Mr. Sneddon to install such service at said location. All members of the Council voting aye, the Mayor declared the motion carried. WRITTEN COMMUNICATION: CONS'. A communication was received Prom Chief Kerr to. the ef- fect that he has been handed the resignation of Everett H. Keneipp as a member of the Police Department due to ill health, recommend- ing that his resignation be accepted as of January 6, 1945. There- upon it was moved by Councilman Tucker and Seconded by Councilman Meyer that the resignation of Mr. Keneipp be accepted. All members of the City Council voting aye, the Mayor declared the motion duly carried. A communication was received from Chief of Police Serr recommending that one of three names submitted be appointed as a member off' the Police Department, being Archie Legg, W. F. Possone and Harry Spear. Chief Kerr Addressed the Council stating that he i s in need of a person who can ride a motorcycle. Thereupon it was moved by Councilman Looney and seconded by Councilman. Shrock that Mr. W. F. Possone be appointed as Police Officer at a salary of X200.00 per month, plus X10.00 per month • war bonus. Roll Call: Ayes: Councilmen Looney, Shrock, Meyer, Tucker and Wiggins. Noes: None. A eommunicatio n was received from the Appraisal Committee submitting their appraisals on various tax deeded lots in the City of Lynwood. There being no objection, said communication was or- dered filed. A communication was received Prom Carl L. Willard ®ffer- i.ng to purchase Lot 46, Block 5, Mod~jeska Park for -the sum of X150.00, free and clear of all debt. This offer being within the appraisal of said Lot, and. there being no one present who wished to raise said bid, it was moved by Councilman Shrock and seconded by Councilman Looney that the offer be accepted. Roll Call: Ayes: Councilmen Looney, Shrock, Meyer, Tucker and Wiggins. Noes: None. A communication was received Prom A. L. Young offering to purchase on behalf of a Client Lots 14, 15, 16, 17 and 19, Tract 9288 for the sum of X1600.00 free and clear of all debt and City to clear. title thereto, on terms, and City to pay the Agent- 5~6 Com- mission. Thereupon it was moved by Councilman Looney and seconded by Councilman Tucker that said offer be rejected, with the suggest- ion to the person that offer to purchase the Lots in question that the Council will be glad to consider a new offer with the and®r- standing.that no commission be paid. All members of the Council excepting Councilman Shrock voting aye, the Mayor declared the motion duly carried. A eommunicatio n was received from Audley Lytal offering to purchase Lot$ 122, 123 and i57, Tract 921 fvr the sum of X750.00 free and clear of all debt and City to clear title thereto, on a partial payment. Thereupon Agreement of Sale and Purchase, was submitted. Thereupon•RESOLUTION N0. 1758, entitled " A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD, CALIFORNIA, ACCEPTING BID FOR THE PURCHASE OF CITY OWNED TAX DEEDED REAL PROPERTY," was read. Thereupon RESOLUTION NO. 1~-'S9 entitled.: "RESOLUTION SELLING CERTAIN REAL ESTATE AND AUTHORI~LINa THE EXECUTION OF A DEED t~PON PAYMENT OF THE CONSIDERATION NAMED THEREIN"s was read. It was moved by Councilman Meyer and seconded by Councilman Looney that said Resolution No. 1759 be adopted. Roll Call: Ayes: Councilmen Looney, Shrock, Meyer, Tucker cad Wiggins. Noes: None. The offer to purchase Lot 161, Licensed Surveyor's Map for the sum of 400.00 as made by Mrs. J. B. Chapman, was re- submitted. This off er..being less than the offer for which it was sold, it was moved by Councilman Meyer and sec©nded by Councilman Shrock that the offer be rejected. All members of the City Coun- cil voting aye, the Mayor declared the motion duly carried. An offer wa.s received from Benjamin Decker to purchase the S. 15 feet of Lot 144, Tract 2551 on the installment plan, was submitted, for the sum of ~1?5.00 free and clear of debt and City to furnish merchantable title thereto. There being no one present who wished to increase said bid and it being within the appraisal thereof An Agreement of Sale and Purchase, was submitted. Thereupon RESOLUTION N0. 1760, entitled "A RESOLUTION OF' THE CITY COUNCIL OF THE CITY OF LYNWOOD, CALIFORiJIA, ACCEPT- ING BID FOR THE PURCHASE OF CITY OWNED TAX DEEDED REAL PROPERTY," was read. It was moved by Councilman Shrock and seconded by Coun- cilman Meyer that said Resolution No. x.760 be adopted. Roll Call: Ayes: Councilmen Looney, Shrock, Meyer, Tucker, and Wiggins. Noes: None. The City Clerk. stated that Mr. Frank L. Martin had with- drawn his offer to purchase Lots 31, 32, 33, 34 and 35, Licensed Surveyor's Map. Therefore, said communication was ordered filed and the City Clerk was authorized to return the check in the sum of X100.0® accompanying his offer. An offer to purchase Lots 31, 32, 33, 34, 35,_ 87, 88 and 89, Licensed Surveyor's Map for the sum of 1,250.00, as amended was received from A. L. Young, with commission to be paid to Mr. Young, Thereupon it was moved by Councilman Tucker and seconded by Coun- cilman Meyer that said offer be rejected. All members of the City Council voting aye, the Mayor declared the motion carried. A communication was received from E. J. K~ose, accompan- ied by a check in the sum of X25.00 requesting xezoning Prom . R1 to C3 as affecting Lot 493, Tract 2551. Thereupon it was moved by Councilman Shrock and seconded by Councilman Meyer that Mr. K,~ose be required to File a petition signed by at least ten person within a radius of 300 feet of said property petitioning for such rezoning, after which the Council will consider the application further. All members of the City Council voting aye, the Mayor declared the motion duly carried. A bond in the sum of ~1, 000 covering Mary Molidor; also one in the sum of X1,000 covering Westana Lott as Court Clerk, were submitted. It was moved by Councilman Meyer and seconded by Councilman Tucker that said bonds be accepted and approved. All members of the Council voting aye, the Mayor declared the motion duly carried. Report of the gasoline consumed for the month of December. There being no objection, said report was ordered filed. UNFINISHED BUSINESS: A communication that was presented to tie Council at the last meeting whereby Mr. Ira Presson offers to purchase the wrecked truck for X150.00, was again considered. There being no one present who wished to raise said offer, after it having been advertised, it was moved by Councilman Looney and seconded by Councilman Tucker that said truck be sold to Mr. Presson as. per his offer. . A, Nation in connection with Rezoning Lot 175, Tract 8716, from R-1 to C-3, which was signed by 10 property owners as required by the zoning Ordinance. Thereupon "TENTATIVE REPORT OF THE CITY COUNCIL QF THE CITY OF LYNWOOD, CALIFORNIAN IN RELATION TO PROPOSED CHANGE 0~' ZONE,a as affecting.. said Lot, was read, fixing February 6, 1945 as the date for said hearing at 8 P. M. on said report. There- upon it was moved by Councilman Tucker and seconded by Council- man Looney that said Tentative Report be adopted. A communication was received from City Engineer Graves requesting an interpretation regarding the charge for repairing excavations as defined in Ordinance No. 394, especially as affect- ing bar holes cuts made by the Southern. California Gas Co. and not repaired by City. It was moved by Councilman Shroek and seconded by Councilman Tucker that this matter be referred to City Attorney Barnes to check into the matter and report to Mr. Graves and the Council his interpretation of the Ordinance relative to said matter. All members of the City Council voting aye, the Mayor declared the motion carried. . A communication was received from City Engineer Graves regarding how far to go in connection with the matter of repairing sidewalks as directed by the City Council some.time ago when a person. refuses to repair the hole himself and also.ob~eets to the City doing so because of a contemplated building construction as soon as conditions permit. No action was taken by the City Council in connection with this matter, however, it was the consensus of opinion that there should be no favorites shown, however, that if the owner wishes to do the work himself then he shall be permitted to do so in whatever manner he desires in order to eliminate any hazard. to pedestrians using the sidewalk, however, that extensive repairs should not be made if it is to be taken out later of a dif- ferent solar. A communication was received from City Engineer Graves submitting supplemental Agreement in Conneetlon with the instal- lation.of culverts under Imperial Highway on the south side. of the Pacific Electric right of way and. the payment therefor from the 1/4 cent gas tax funds. Thereupon said Aggreement was presented. Noss: None. Councilman Shrock brought up the matter of increase of the salary f'+®r Mr. R. W. Bell in the Park Department, stating that while he is old, he is doing the work assigned to him, and that he has been employed with the City for 17 years, therefore, making a motion that his salary be increased from 185.00 per month to X200.00 per month which includes the war bonus, which was seconded by Couricilman Tucker. Roll Call: Ayes: Councilmen Looney, Shrock, Meyer, Tucker and Wiggins. Noes: None. ' It was moved by Councilman Looney and seconded by Council- man Meyer that the meeting adjourn to February 6, 1945, at ?:34 P. M.
