HomeMy Public PortalAboutM 1945-02-06 - CC__ _ _ REGULAR MEETING FEBRUARY 6, 1945 The City Council of the City of Lynwood met in a regular session, in the Council Chamber of the City Ha11, 11331 Plaza Street; on above date, at 7:30 P.M. ` Mayor Wiggins in the chair. ' Councilmen Shrock, Meyer, Tucker and Wiggins answered the roll call. ` Councilman Looney was absent. ' It was moved by Councilman Shrock and seconded by Council- man Tucker that the minutes of the previous regular meeting of January 16, 1945 be approved as written. All members of tree City Council present voting aye, the Mayor declared the motion duly carried. The hour of 8:00 P. M. having arrived, said time being the hour fixed for hearing any objections or protests in connection with the 'Tentative Report proposing to rezone Lot .175, Tract ;8716 from Zone R1 to Zone C3, said hearing having been published and -•+, posted as required by law. The Mayor announced that this was the time f6r hearing any and all such objections and protests, inquiring of the audience if there was any one present who desired to be heard in said matter. There was no .response. The City Clerk stated that no written protests or ob~jee- tions had been filed. Thereupon FINAL REPORT OF THE CITY COUNCIL OF THE CITY OF LYNWOOD, CALIFORivIA IN RELATION TO PROPOSED CHANGE OF ZONE in con- nection with said matter was read, fixing February 20, 1945, at 8 P. M. as the time for hearing in connection with said matter. It was moved by Councilman Meyer and seconded by Councilman Shrock that said Report be adopted. Roll Call: Ayes: Councilmen Shrock, Meyer, Tucker and Wiggins. Noes: None Absent: Councilman Looney. The hour of 8 P.M. having arrived, said time being the hour fixed to hear any and all protests or objections in connection with the construction of curbs, gutters and sidewalks in all of Tract No. 11862, as per notices misled to the property. owners in the District as evidenced by an Affidavit of Mailing by the City C1 erk, said hearing being upon the Investigation Report heretofore adopted by the City Council, as required by law. The Mayor announced that this was the time and place fors hearing any such objections or protests, inquiring of these pre- sent if there was any one who desired to be heard in connection with said matter. There was no response. The City Clerk stated that no written objections or pro- tests have been filed. Noes: None Absent: Councilman Looney. ~J WRITTEN COIu'iMt~NICATIONS: A communication was received from Mr. Aaron.Dudley request- ing that the alley in the rear of his premises located at 4251 ffiorton Road be opened by the City of Lynwood as when he constructed his residence he was assured that the alley would be opened so he faced his garage on the alley, and that because the alley is not open he must trespass on another .person's property to get into his garage. There being .no objection, this matter was referred to City Engineer Graves for investigation on and report back to the Council his findings. A communiea tion was received Prom .Mr. Henr~r 8. Dunning requesting that the sidewalk in front of Lot 42, Tract 6554 be repaired as it is in bad condition. There being no objection, this matter was referred to City Engineer Graves for investigation and report back to the Council his findings. A communication was received from Mr. W. A. Rice to the effect that ARr. Graves has misintrepreted his intention of his. proposal in regard to payment of X200.00 for moving expen9e of eQuipment to well site, whereas the intent was an additional charge, not an advance payment. There being no objection, this matter was ref erred to the City Attorney to check the contract in connection with its contents. ~A communication was received from Al S. Waxman, Chairman of the Smoke and Fumes Commission submitting a report of their Committee and a proposed ordinance in connection with said matter, requesting the Council to offer any additions, corrections or sug- ~estions. A copy of this Ordinance and report having been furnished the City Council, the report was ordered filed and. no further action was taken. A communication was received Prom A. L. Young, reporting that a ~I0,000.00 fire insurance policy covering btaildings and con- tents owned by the City of Lynwood, will expire on February 18. fl~hereupon it was moved by Councilman Tucker and seconded by Council- man Shrock that A. L. Young be requested to renew said insurance. Roll Call: Ayes: Councilmen Shrock, Meyer, Tucker and Wiggins. Noes: None Absent: Councilman Looney. A communication was received from 0. H. Schoenberger ob- ,jecting to the City Council rejecting his offer to purchase Lots 14, 15, 16, 17 and 19, Block 5, Tract 9288, on the grounds that it was within the appraisal and that the City Council usually ac- cept the appraisal figure as the selling price. An offer to purchase Lots 14, 15, 16 and 17, Block 5, Tract 9288 was received from A. L. Young for his client who previous also included Lot 19 in his offer, for a total consideration of ~1, 200.00. An offer to purchase Lots 16, 17 and 19, Block 5, Tract 9288 for the sum of X1,050.00, free and clear of all debt, was received from Marlem R. Mason. An offer to purchase Lots 14, 15, 16, 17 and 19, Block 5, Tract 9288 for the sum of X1,800.00, free and clear of indebtedness was received from H. A. Hollis. An offer to purchase Lots 14, 15, 16 and 17, Block 5, Tract 9288, at a total price of X300.00 per lot and Lots 11, in Block 4, and 19 and 22 in Block 5, in Tract 9288, at X400.00 each he to clear his own title, which would amount to X63.00 per Lot. Thereupon Mayor Wiggins inquired of the audience if there was any one present who wished to raise any of said offers. . Whereupon Mr. M. R. Mason addressed the Council inquiring what the price would be for Lot 19, Block 5, Tract 9288 separately. Mr. Mason was told that the highest price so far is X463.00. • Thereupon Mr. Mason bid X475.00 thereon. The Mayor inquired if there was any one present who wished to raise said offer, but there. was no reply. Said offer being with- in the appraisal, it was moved by Councilman Meyer and seconded by Councilman Shrock that said Lot 19 be sold to Mr. Mason. Mason addressed the Council to the effect that he would like to submit a bid on one of the 25 foot lots on Atlantic Blvd. via: -Lot 1?, Block 5, Tract 9288. Whereupon Mr. Del Zeiger, real estate agent, stated that he desired to lDid on Lots 14, 15, 16 and 1'7, Block 5, Tract 9288 as a unit, offering X1,500.00 for the four lots. Thereupon Mr. Mason offered 9fi380.00 for Lot 17. Mr. Zeiger offering 9385.00. Whereupon Mr. Mason offered 9400.00 Mr. Zeiger counteroffering at 9405.00; whereupon It4essrs Mason and Zei~•er offered and counteroffered until Mr. Mason offered X500.00 for .said Lot .17. The Mayor inquired if there was any one present who wished to raise said bid, but there was .no response. Thereupon it was moved by Councilman Tucker and seconded. by Councilman Shrock that said offer of Mr. Mason be accepted, this offer being within the appraisal thereof. Ro 11 Call : . Thereupon Mayor Wiggins inquired if there was any one pre- sent who wished to bid any higher on Lots 14, 15 and 16 of X375.00 each as offered by.Mr. Del Zeiger. There was no response. This offer being within the appraisal thereof, it was moved by Councilman Tucker and seconded by Councilman Meyer that said offer be accepted. Roll Call: Ayes: Councilmen Shrock, Meyer, Tucker and Wiggins. Noes: None. 'lt~ereupon Mayor Wiggins inquired of the audience if there was any one present who wished to raise the offer of-~4Q0.~0 each on two residential Lots on Morton Road, being Lots 22, Block 5, and Lot 11, Block 4, Tract 9288, the owner to clear his own title, which would coat 9$63.00 per lot, this offer being made by E. W. Badger. There wa.s no response. This offer is within appr~.isal. Thereupon it was moved by Councilman Tucker and seconded by Councilman Shrock that said offer be accepted. Roll Call: Ayes: Councilmen Shrock, Meyer, Tucker and Wiggins. Noes: None. A comr~ninication was received from Mr. E. F. Fuhrman re- questing that the band stand on Lot 312, Tract 2551 be moved off as he intends to build on said Lot. There being no ob,jectio n,thi8 matter was ref erred to City Engineer Graves with instruction to remove on to the adjoining lot to the south. A communication was received from the Lynwood School Dis- trict requesting that light bulbs be installed in the light posts now installed and illuminated on the west side of Locust, between Sanborn and Alberta. Thereupon it was moved by Councilman Shrock and seconded by Councilman Tucker that said lights be turned on as requested, and the City Engineer be instructed to do the work. Bailey and ? others, requesting that mere lights be installed in Los Flores Blvd. east of California Avenue. -Thereupon it was moved by Councilman Shrock and seconded by Councilman Tucker that the City Engineer be instructed to have one light installed on Los Flores Blvd. as requested by Petition. A communication was received from City Engineer Graves submitting a proposal by Kiefhaber and Taylor for the diseing of vacant lots in the City of Lynwood, the charge being 6¢ per 100 square feet. There being no objection, std matter was laid on the table for later consideration. 1 ~. A communication was received Pram Gity Engineer Graves reporting on the matter of the purchase of a used 1928 Model Elgin Street Sweeper from the City of Huntington Park, .the min- imum price being ~2, 000.00; also submitting letters from Bert Dyer, City Mechanic, and From Bert McIntyre, Street Foraman regarding the matter and the advisability of purchasing such a piece of equipment. There being no objection, this matter was laid on the table for Later consideration. A communication was received from City Engineer Graves submitting an application for employment of Ernest l~lfred Spider who has been working in the water department for four weeks at an hourly rate of X1.00 per hour, recommending that he be employed on a monthly basis at X162.00 per month with X10.00 war bonus. It being determined that this would call for the employment of one more man than the 1944-45 budget called for, said matter was tabled. A report of City Court; a.l so of Fire Department, were received and ordered filed. ORAL COMIi+IUNICATIONS: Mr. K. F. Thompson, addressed the Council regarding the extension of the yard of Almas House F~avers to the lots facing on 108th Street, stating that they are storing much of their equip- ment thereon in violation of zoning regulations as this is a.r~ei- .dential district. The Mayor stated that they would look into it and if found to be in violation, it would be curbed. Mr. Johannas addressed the Council regarding what use they can make of the property formerly used as the Hudson Lumber Co. The Mayor promised that he would look into it and give him a reply at an early date. UNFINISHED BUSINESS: A communication was received from Chief of Police Kerr re~aorting on the matter of cattle being pastured north of Norton Ave. , reporting that they are in violation, and that the fence should be moved at least 300 feet away from the nearest residence, stating that the fence is too close on Norton Ave. After due consideration, it was brought out that the cows have now been removed so the apparent nuisance is corrected. There being no objection, said report was ordered filed. A communication was received from Ghief of Police Kerr, to the effect that Mr. VV. F. Possone could not be released from his present employer, therefore, could not go to work for the City as a Motorcycle Officer, however, that a Mr. Harry Speer is avail- able, recommending that he be employed at a salary oP X200.00 per month, .plus x$10.00 ber month war bonus. Thereupon it was moved by Councilman Shrock and seconded by Councilman Meyer that Mr. Harry Speer be employed as recommended by Chief Kerr at a salary of X200.00 per month, plus X10.00 war bo nu s. Chief of Police Kerr, reported regarding the~applica#o~l for the es'~ablishment of a .used ear lot on Lots 314, 315, and 316, Tract 2551 by one Mr. Bishop. The City Clerk stated that Mr. Bishop had been in and withdrawn his application, therefore, no action was taken thereon, and the communication was ordered filed. A communication was received from Chief of Police Kerr reporting on the matter of the bills Prom the Department of Charities for medical care of prisoners of the City of Lynwood; also reporting on bills from County for emergency medical care rendered persons inured in highway collisions, stating that he believes that the one to take care of medical services rendered for prisoners is one that should be honored and that a contract should be entered into with the County for the care of prisoners when they are treated by the County. Thereupon it was moved by .Councilman Tucker and seconded by Councilman Shrock that the bill rendered for medical aid to Lynwood prisoners be paid, however, that the other bill be denied; also that a demand be allowed for X5.00 for League of California Cities expense when meeting was held in Lynwood. Shipley and 11 others requesting that the Lot belonging to E. J. R~jose described as Lot 493, Tract 2551 be rezoned from Zone RI to Zone C3. - .
