REGULAR MEETING FEBRUARY 20, 1945
The City Council of the City of Lynwood met in a regular
session., in the Council Chamber of the City Hall, 11331 Plaza St.,
on above date, at 7:30 P. M.
Mayor V4'ig~•ins in the chair.
Councilmen Shrock, Meyer, Tucker and Wig~,ins answered the
roll call.
Councilman Looney was absent.
It was moved by Councilman Tucker and seconded by Council-
man Meyer that the minutes of the previous regular meeting of Feb-
ruary 6, 1945 be approved as written. All members of the City
Council present voting aye, the Mayor declared the motion carried.
WRITTEN CCDI~viUNICATIONS:
A communication wa.s received. from the Lynwood School Dis-
trict thanking the Council for illuminating the lights on the west
side of Locust, between Sanborn and Alberta Avenue at the Washing-
ton School. There being• no ob~je~ction, said communication was or-
dered filed.
A communication was received from Mr. SoI Tyroler making
application to operate an aluminum brass foundry at 11686 Atlantic
Ave., stating that they have an ordnance contract that is to be
,produced at once, and that they have purchased. the property.
Mr. Tyroler was also present and addressed the Council
stating that the former owner had been authorized to operate a
foundry a.t said location.
Thereupon it was moved by Councilman Meyer and seconded by
Councilman Shrock that permission be granted to said applicant to
operate a foundry at 11686 Atlantic Ave. for the duration of the
war and six months thereafter. All members of the City Council
present voting aye, the Tl~ayor declared the motion duly carried..
A communication was received from W. W.. Strickler calling
attention to a strip of paving approximately 50 feet long in front
of his service station at 3188 imperial high~ray that should be re-
paired, stating that if necessary he will pay a part of the cost
for such repair. There being no objection, this matter was referred
to City Engineer Graves for investigation and report to the City
Council.
A communication was received from Mr. Robin A. CTraves, City
Engineer, retorting that there are two poplar trees on Etaclid Ave.
one at 3157 and one at 3179, west of Long Beach Boulevard, that
need to be removed, stating that the City does not have the equi~-
ment to do the work and that the United Tree Service have submitted
an offer of X90.00 to have the trees removed..
Mr. Clifford Wallace, Park Superintendent, also addressed
the Council regarding the matter stating that the trees are appro-
ximately 57 feet tall and that one tree is leaning considerably.
After due consideration of the matter, the City Council
decided that the trees srlould be taken out by the men employed
in the Park Department, and if we do rot have the equipment that
we should get equipment suitable for such purpose.
The hour of 8 P. M. having arrived, said. time being the
hour fixed to receive any objections or protests in connection with
rezoning Lot 175, Tr~~ct 8716 from Zone R1 to Zone C3, as published
and posted as required by law.
The R~ayor stated that this was the time an3 place for
hearing any and all such protests, inquiring of those present if
there was any one present who wished to be heard. There v+~as no
response.
The City Clerk stated that no written protests or objections
had been filed in connection with the Tentative report that was a-
dopted at the last meeting of the City Council in connection with
said rezoning.
Thereupon an Ordinance, entitled: "An Ordinance of the
City of Lynwood, California, transferring certain lands from lone
R-1 into Zone C-3~~, was read for the first time. It was moved by
Councilman Meyer and seconded by Councilman T~~eker that said Ord-
inance be accepted as read the first time and pass to the second
tea ding .

A communication was received from City Engineer Robin
A. Graves recommending that P,?r. Ollie M. ~ihlgren be employed as
Street Sweeper Operator to fill the vacancy created by the leaving
from the employ of the City, a man who is going into the Army,
suggesting a salary of X210.00 per month. Thereupon it was moved
by Councilman Shrock and seconded by Councilman Meyer that Mr.
Ollie A1I. Kihlgren be employed. as Street Sweeper ®perator at a
salary of X210.00 per month to fill said vacancy.

A communication was received from A. H. Adams, Engineer
of the Regional Planning Commission, requesting a list of projects
that the City of Lynwood is proposing ,jointly with the County of
Los Angeles for 1945-46 Public works program as the County desires
to show it in their County budget. There being no objection, this
matter was referred to City Engineer Graves and to Planning Sup-
ervisor W~zitnall to check into and report such projects as should
be ,jointly prosecuted.
A communication was received from William S. Heytz, 1154
Elm Street, calling attention to two ambulances that he has avail-
able far emergency calls, stating that he would be glad to take
care .of calls from the Police or Fire Department, giving a list
of charges to various points. There being no objections, this mat-
ter was referred to the Police Chief with the instructions that
he get an interpretation of whether or not the City would be liable
for payment of any claim if the recipient of the service did not
pay for it; also it was the opinion of the City Council that if
the service rendered by this person who is a local resident would
be as good as other service and prices being as good or better,
then the service should be tried out.
A communication was received from George E. Kennedy, At-
torney foe Rev. Charles J. O'Carrofil, Pastor of St. Emydius R. C.
Church of ~,ynwood, requesting an interview with the Council regard-
ing the purchase of the property at the northeast corner of Calif-
ornia and Norton. Ave. for use as a school and church, the City
having the tax title to approximately .88 acres. No action was
taken on this matter, however, it was decided to meet to consider
the matter at a later date. '
~~" A communication was received from Fire Chief, Warren Daet-
weiler, recommending that Engineers C. D. Lorton and Robt. Rutter.
have successfully passed their probationary period of six months,
therefore recommending that their appointment be made permanent as
Engineers. Thereupon it was moved by Councilman Tucker and seconded
by Councilman Meyer that action on this matter be deferred until the
City Attorney checks into the matter'of postpofing any promotions
until after the war when those in the armed service have the oppor-
tunity to compete for the rank, in line with the Ordinance hereto-
fore adopted by the City Councils and other resolutions in connect-
ion therewith,
A communication was received from Chief of Police Paul
W. Kerr, recommending that Police Officer Wesley Legg be promoted
to the ?~asit7_on of Sergeant to rill the vacancy created by the
promotion of fir. 0' Shaughnessy, at a salary of 4$230. 00 per month.
It was moved by Councilman Tucker and seconded by Co~zncilman Shrock
that this matter also be ref erred to the City Attorney for checking
and report. All members of the City Council present voting aye,
the Pl~ayor declared the motion carried.
A commu nication was received from Howard Hemenway, Attor-
ney at Law, to the effect that in clearing tax deeded property,
that he has engaged a N1r. Ganahl to eecure the addresses of vestees
which. action the City Council have previously ar..~~~roved, which runs
X5.00 per person, and where there is two persons in one household
then ,just one charge of X5.00 is made. N1r. Hemenway stated that
in cases where it becomes necessary to publish in order to q~_ziet
title it will.. be necessary to research tre records as the Court
will not accept any search over 15 days previous to the filing of
Order far Publication, therefore recommending that Mr. Ganahl be
p8rid another fee for this second search, stating that there are
about a dozen such oases pendir..g. Thereupon it eras moved by Coun-
cilman T~~cker and secQiided by Councilman Meyer that this additional
charge be approved by the City Council.

A communication was received from rair. Clifford Wallace,
Superintendent of Parks recommending that something be done about.
a uniform system in connection with planting trees in parkways,
also regarding the width of the parkway, stating that in the past
no uniformity has been maintained and established and in some in-
stances trees have been planted that are of the type so that the
roots from the trees have damaged the sidewalk and curbs where it
ria.s been planted. There being no objections, this matter was laid
on the table for later consideration in connection with the new
planning survey that is about to get under way.
An offer to ptmchase Lots 17 and 18, B~ c;ck 6, Mod,jeska
Park for the sum of 200.00, free and clear of all debt and City
to furnish a merchantable title thereto, from Edward P Krug, was
read. This offer being within the appraisal thereof, a.nd there
being no one present who desired to increase the offer, it was moved
by Councilman Shrock and seconded by Councilman I~~eyer that it be
sold to said person for said amount.

An offer to purchase Lot 36, Block 6, Mod,jeska. Park for
a total consideration of ~"300.OO,free and clear of all debt and
City to furnish a merchantable title theret"o was read, from W. G.
1VTagee. This offer being within the appraisal thereof, and there
being no one present who desired to increase the offer, it was
moved by Councilman Meyer and seconded by Councilman Tucker that
the offer be accepted.

A communication was received from Rudolph E. Ratliff
offering to purchase Iaot 61, Tract 921 for. the sum of. X275.00,
free and clear of all debt, and City to furnish a merchantable
title thereto. This offer being within the appraisal thereof, and
there being no one present who desired to increase the offer, it
was moved by Councilman Meyer, and seconded by Councilman Shrock
that the offer be accepted and.. the Lot be sold to said purchaser.

A communication was received from M. L. Namlin offering
to purchase Lot 46, Tract 921 for the sum of X175.00, free and
clear of all deid/, and City to furnish a clear title thereto.
This offer being within the appraisal thereof, and no one present
desiring to inc~- ease said bid, it was moved. by Councilman Tucker and
seconded by Councilman Shrock that the offer be accepted and the
I,ot be sold to said purchaser.

A communication was received from Thomas C. Davis, offer-
ing to purchase Lot 59, Block 19, T,~od,jeska Park for the sum of
X175.00, free and clear of all debt and City to furnish a merchan-
table title thereto. This offer being within the appraisal thereof,
and no one present v~?ishing to increase said bid, it was moved by
Councilman Tucker and seconded by Councilman Meyer that said
offer be accepted and. the Lot be sold to said x~urchaser.

A communication was received from Councilman Joseph A.
L coney to the effect that due to il.l health he is forced to
be absent from meetings of the City Co~~ncil which he regrets very
much. Thereupon it was moved by Councilman Meyer and seconded by
Councilman Tucker that Councilman Joseph a Looney be given a 60
days leave of absence from the Council from the date of this meet-
ing. A1.1 members of the City Council present voting aye, the
Mayor declared the motion dtaly carried.

A communication was received from the Lynwood Junior
High Parent Teacher Association, by Mrs. C. 0. Edington, President,
to the effect that at the Board meeting of the P. T. A, a motion
was carried urging the Council to employ a full-time police woman,
due to delinquency among girls.. There being no ob,jee tion, thi s
matter was tabled for later consideration.
A bond in the sum of X1,000.00 covering Reuben W. Ander-
son as License Collector; also a bond in the sum of X1,000.00 cov-
ering Pearl C. Morris as Deputy License Collector, were submitted.
It was moved by Councilman Tucker and seconded by Councilman Shrock
that said bonds be approved. All members of the City Cot~ncilvot-
ing aye the ~dayor declared the motion duly carried.
A communication wa.s received from the William J. C~raysan
Post No. 85, The American Legion, by W. A. Hockett, Commander
making application for permit to operate a carnival a.t Century and
Long Beach Blvd. from March 26th through Ap^il 1, 1945. It was
moved. by Co~,~ncilman Meyer and seconded by Councilman Tucker that
permission be granted subject to .approval by Chief of Police Kerr
of the firm to show, also subject to existing ordinances in connec-
tion therewith. All members of the City Council present voting aye,
the IvTayor declared the motion dtaly carried.
A communication was received from J.. W. NIcP.~ullen regarding
a notice received that he repair his sidewalk in front of his pre-
mises, a?.leging that the City broke the sidewalk in years past
while, mowing weeds when the operator would run the tractor on the
sidewalk, therefore believing that the City should repair and replace
the sidewalk.
Mr. McMullen was present and add.r.essed the Council regard-
ing the matter.
Also City Engineer Graves spoke regarding the matter.
After due consideration, the matter wa.s referred back to
the City Engineer with the instructions that he~check again to
see if the walk can be repaired with a small expense by patching
any holes to eliminate hazards.
Report of gasoline copsumed by the various departments
of the City, was received and ordered filed.
ORAL CO~riIvUNI CATIONS
Mr. James Cruikshank addressed the Council on behalf of
the Ration Board to the effect that they are cramped for space
for their records and files which makes it very difficult to operate
therefore requesting permission from the City Co~~ncil to take out
the first four front rows in the Council chamber on the west side
to be used for filing space. Rrlr. Crtzikshank stated that by this
plan the applicants and customers could be directed b,y the front
stairs and in the lobby a. person would be stationed to answer
many of the qua=stions thus saving the Council Chamber from so much
use. After due consideration of the matter, it, was moved by Coun-
cilman Tucker and seconded by Councilman Meyer that the Ration
Board be permitted to remove four rows of seats as requested for
use in~connection with their office space. All members of the
City Council voting aye, the Mayor declared the motion duly carried.
Mr. Carl Breckan, 3258 Burton Avenue addressed the Council
to the, effect that he had been referred to the City Council by the
Building Inspector on the matter of building a 30 x 40 building
to be constructed at 3258 Burton Ave, to be used in connection with
his business of painting as it was contrary to zoning regulations,
making application for such permit on the grounds that he needs
the space to continue to employ 4 of his men anc~ for which he has
secured his priority from the War Production Board.
Fire Chief Warren Daetweiler addressed the Council to
the .effect that the State law provides that no person shall store
more than one gallon of Lnflamable material in a residential area,
cautioning Air. Breckan on this matter.
Building Inspector F. D. Evans addressed the Co~.zncil on
a query from the Council as to what size building he could con-
struct as a double garage, to which Mr. Evans, stated that a build-
ing of 20 x 26 could be constructed to be used as a double garage.
Thereur,~on Mr. Breckan was informed to confine his build-
ing program to a double garage, as anything in excess of this would
be construed in violation of zoning regulations.
Mr. David Houck, addressed the Council about the need to
have the south end of Esther Street surfaced as during the winter
it is a3most impassible because of mud and in the summer the dust
is very annoying. After checking up on the matter, it was determined
that this street was included in the streets to be resurfaced and
be paid for from County gasoline funds, therefore Mr. Houck was re-
gtzested to have a little more patience and in due time the work
would be done.

The matter of reouest Por rezoning of Lot 493, Tract 2551
from R-1 to Zone C-3 as petitioned for br propert,y owners and
by the owner of said Lot E. J. K,jose, was again considered, Mr.
K,jose having secured more signatures..

read. It was moved by Councilman Tucker and seconded by Cou neilman
Meyer that said Tentative report be adopted.

A communication was. received from City Engineer Rabin A.
CTraves reporting on the matter oP opening the alley in the rear
oP 4251 Morton Road as requested by Aaron Dudley, stating that the
cost of breaking the curb a.nd removing trees would be approximately
$100.00, and if it is graded, X300.00, and if surfaced X1,200.00.
Thereupon it was moved by Councilman Shrock and seconded by Coun-
cilman Tucker that the City Engineer be instructed to break the
curb and remove the trees. so that the a~ley may be used for access
to P.4r . Dudley' s garage. All members o f the City Co~_~ nci.l pre sent
voting aye, the .Mayor declared the motion duly carried.
T'ne matter oP employing PRr. Ernest Alfred Spicer who is
now working in the ~R~ater Department on a monthly basis of X1'72.00
per month in lieu of an hourly rate, was brought up for further
consideration. It was moved by Councilman Tucker and seconded by
Councilman Meyer that Per. Ernest Allred Spicer be changed from an
hourly rate to the monthly rate of X172.00 per month,•and that he
continue as a tetporary employee until the house connections are
connected on Sanborn, rJ`ulford and Beechwood Avenues.

The matter of whether or not to purchase a used 1928
1l~TOdel Elgin Street Sweeper fr^m the City of Huntington Park,
was brought up for further consideration. Councilman Shrock stated
that he visited Huntington Park and looked over the machine and
that in his opinion it is in good repair; also that it would. in-
clude a mac; ne for putting new brushes in the broom that is auto-
matic and is worth approximately X500.00, and would save one
mans time, stating that he believes that the City should put in
an offer to purchase it. Thereupon it wds moved by Councilman
Shrock and seconded by Councilman Tucker that the City of Lynwood
offer to the City of Huntington Park. up to X2,250.00 for said
Elgin Street Sweeper.

City Engineer Graves reported on the matter of repairing
the sides^~alk in front of Lot 42, Tract 6554, stating that Mr.
Dunning is going to fix the sidewalk himself. Thereupon, tre
communication was ordered filed.
NEVI BUSINESS
A Quitclaim Deed, dated September 2'=, 1944, a.nd signed
by F. M. Smith, Special Deputy of Frank C. Mortimer Building and
Loan Commissioner. of the State oP Ca]_iforni8, whereby they convey
their interest in Lots 6, '7 and 8, in Block 1, Tract 9288 tc the
City of Lynwood, was submitted; also a Quitclaim Deed dated Feb-
ruary 13, 1945, and signed by the Trtast Officer and Assistant
Trust Officer of thy; Bank oP Italy National Trust and Savings Ass-
ociation (Bank of America), wherein they convey their interest in
Lots 14, 15, 16, 17 and 19, Block 5, Tract 9288, to the City of
Lynwood, was submitted. Thereupon it was moved by Councilman
Meyer and seconded by Councilman Tucker that said Deeds be accepted
and that the City Clerk be instructed to cause said instruments
to be recorded in the Office of the Recorder of Los Angeles
County.
