HomeMy Public PortalAboutM 1945-04-03 - CC9~4 REGULAR MEETING APRIL 3, 1945 The City Council of the City of Lynwood met in a regular session, in the Council Chamber of the City Hall of the Council Chamber, 11331 Plaza Street, on above date, at 7:30 P.M. Mayor Wi~~~~ins in the chair. Councilmen Shrock, Mey.er,. Tucker and Wiggins answered the roll call. Councilman Looney. was absent. It was moved by Councilman Tucker and seconded by Council- man Shrock that the minutes of the previous regular meeting of March 20, 1945 and of the ad,jot~rned regular meeting of March 22, 1945 be approved as written. All members .of the City Council voting aye, the Mayor declared the motion duly carried. WRITTEN COMdiUNICATIONS A communication was received from Wrn. K. Carson, Manager of Carson Brothers, making application to operate a repair shop ~ at 11117-9 Long Beach Blvd. It was moved by Councilman Tucker and seconded by Councilman Shrock that permission be granted and that the License Collector be authorized to issue license therefor. All members of the City Council present voting aye, the Mayor de- clared the motion duly carried. A communication was received from Leland H. Dobbs, peti- tioning the City Council to move a 8 x 16 building on the East half of Lot 166, Tract 2551 to be used as a real estate office and builders office, building to ,be finished with brick veneer exterior. Thereupon it was moved by Councilman Shrock and seconded by Councilman Meyer that permission be granted for the duration of the war, and that the applicant be required to put up a X100.00 cash bond as a guarantee that he will move said building off at. the end of such period, and if it is not thus moved off that the City may enter the property to remove the building in which case the X100.00 would become the property of the City of Lynwood, and that ~n Agreement be drawn up to comply with this requirement and to be signed by Mr. Dobbs and Mr. Dreher, owner of the property. Mr. Dobbs addressed the Council to the effect that this condition is satisfactory to him. All members of the City Council present voting aye, the Mayor declared the motion duly carried. The hour of 8 P. M. having arrived, said time being the hour fixed for receiving any and all bids in connection with the construction of concrete gutters, curbs and sidewalks on Platt and Walnut Avenue as said streets exist in Tract No. 11862, as per notices pu blished according to law. Thereupon it was moved by Councilman Shrock and seconded by Councilman Tucker that the bids be p?jblicly opened and declared. All members of the City Council present voting aye, the Mayor de- clared the motion duly carried. The following firms submitted bids: Vi do S. Prce & Glenn Graham. Vi do Kovacevich Co. Goode & Schroeder Concrete Co. Thereupon it was moved by Councilman Meyer and seconded by Councilman Shrock that the bids be referred to City Engineer Graves for checking and report. A communication was received from Chief of Police Kerr recommending that the salary of Olin Habegger as motorcycle officer be increased by X10.00 per month. Thereupon it was moved by Coun- cilman Shrock and seconded by Councilman Meyer that the salary of Police Officer Habegger be increased from 210.00 per month~to X220.00 per month. Noes: None Absent: Councilman Looney A communication was received from the Coordinating Council requesting the Council to exert every effort to endeavor to get suitable accommodations for the youth of our City for their recre- ational facilities: There being no objection, sa-id communication was ordered filed. ~~ A communication was received from City Engineer Graves regarding the opening of a street in a proposed su bdivision at the north extension of EIm Street, between Pendleton Street and Abbott Road. Thereupon it was moved by Councilman Meyer and seconded by Councilman Ti3eker that said matter be referred to' the Planning Commission for study and report. All members of the City Council present voting aye, the Mayor declared the motion duly carried. A communication was received from John S. Butcher request- ing that his lots be rezoned from R 1 to R 4, being Lots 11, 12, 13 and 14, Tract 7797, Block 5, at Pinehurst St. and Abbott Road. stating that he is desirous to 'build a court on said Lots. There- upon it was moved by Councilman Tucker and seconded by Councilman Shrock that said matter be referred to the 'Planning Commission for study: All members of the Council present voting aye, the `M`ayor declared themotion duly carried. ' A communication wa.s received from Fire Chief Daetweiler stating that the City has a contract with Drake Supply Co. in connection with fire protection 'rased on a charge of 30¢ per~100.00 of the assessed valuation of said firm,, stating that the City has heretofore collected X115.22 for 1943-44 and X252.57 for 1944-45, stating that there will possibly be an income from this source of X250.00, stating that he sould'like this fund set aside in a special fund for purchase of necessary fire fighting equipment. Thereupon it was moved by Councilman Shrock and seconded by Councilman Tucker that the Chief's recommendations be complied with and that the money already collected for such purpose be transferred to the Fire Dep- artment Cayoital Fund, and future payments be deposited in said fund also. Lyta.l offering to sell Lot 229, Tract 5222 at the intersection of Long Beach Blvd. and State Street for the sum of ~1, 575.00 for park and beautification purposes. It was moved by Councilman Tucker and seconded by Councilman Shrock that the communication be filed. All members of the'City Council present voting aye, the Mayor declared the motion duly carried. A communication was received. from Chief of Police Kerr recommending that ~10.DO be sent to the Investigators Gouneil in care of Deputy Sheriff P. M. Fallis Sheriff's Office, Norwalk, California, for expense in connection with detective service that the City is receiving from their organization in their ps,r- ticipation. Thereupon it was moved by Councilman Tucker and seconded by Councilman Meyer that the City allow a warrant in the sum of X10.00 for such purpose. Roll Call: Ayes: Councilmen Shrock, Meyer, Tucker and Wiggins. Noes: None Absent; Councilman Looney. A communication was received Prom Grimm and Newman making application for a license to operate a taxi-cab from 11175 Long Beach Blvd. within the City of Lynwood. It was moved by Councilman Tucker and seconded by Councilman Meyer that the matter be tabled for further investigation. All members of the Council present voting aye, the Mayor declared the motion duly carried. A communication was received from L. J. Cleary objecting to a weed tax that was assessed in the 1944-45 taxes as affecting his Lot 9, Block 3, Tract 9337, stating that he cleared the weeds off of said lot himself. There being no objection, this matter vas ref erred to the City Engineer for checking and report. ' A communication was received Pram F. E. Roberts making application for rezoning as affecting Lots 26, 27, 28, 29 and 30, of Licensed Surveyor's Map, between Bullis Road and Carson Drive. There being no objection, said matter was referred to the Plan- ning Commission. An Offer to purchase Lot 18, Tract~921 for the sum of X275.00, free and clear of all assessments and bonds, and City to clear title thereon, was received from D. F. Wagenhauser. This offer being within the appraisal thereof, and no one present after having been given an opportunity to increase, said offer desired to do so, it was moved by Councilman Meyer and seconded by Council- man Tucker that said offer be accepted. Noes: None Absent; Councilman Looney ~~ An offer to purchase Lot 1, Block 9, Mod,jeska Park for the-sum of X200.00, free and clear of all assessments and bonds, and City to clear title thereon, was received from Conrad C. Gep- hardt. This offer being within the appraisal thereof, and no one present after having been given an opportunity to increase said offer, desired. to do sa, it was moved by Councilman Shrock and seconded by Councilman T~_~cker that said offer be accepted. An offer to purchase Lots 13 and 14, Block 1B, Mod~eska Park for the sum of X350.00, free and clear of all assessments and bonds and City to clear title thereon, was received from P. E. Beutke. This offer being within the ar,pra.isal thereof, and no one present after having been given an opportunity to increase said offer, desired to do so, it was moved by Councilman Tucker and seconded by Councilman Shrock that paid offer be accepted. Roll Call: Ayes: Councilmen Shrock, Meyer, Tucker and Wiggins. Noes: None Absent: Councilman Looney. A bond in the sum of X1,000.00 covering Foy Dewey Evans as Building Inspector, was submitted. Thereupon it was moved by Councilman Meyer and seeonc?ed by Councilman Tucker that said bond be approved. All members of the City Council present voting aye, the Mayor declared the motion duly carried. A Report of work done in connection with purchasing by the City of Lynwood and selling tax deeded lots, was received from City Clerk Anderson, recommending that the City Council request an extension of the option that the City has with the County of Los Angeles that expires on June 15, for one year as all the properties have not yet been cleared up. Thereupon it was moved by Councilman Tucker and seconded by Councilman Meyer that the County of Los Angeles be requested to give us 2n extension on skid agreement for a period of one year. ' A Petition signed by Richard Hambly, 10821 Pine Ave. and 14 other property owners owning property on Pine Ave. between Pendleton and Abbott Road, requesting that the City cause to be constructed concrete curbs on both sides of said street, for which they proposed to pay for in cash. " ' Mr. Hambly also addressed the 'Council on the matter to the effect that most of the people are also desirous that sidewalks be constructed as well. Thereur~on it v~r~s moved by Councilman Shrock and" seconded by Councilman Tucker that the City Engineer be instructed to figure out approximately how much the amount"would be for curbs alone for each Lot, and also for curbs and sidewalks, so that the amounts necessary to be collected may be deposited with the City Clerk, and after sufficient money is collected, that the City Engineer be authorized to proceed with the work. UNFINISHED BUSINESS: The application for a license to operate an assembly and storage for cabinets for the Navy, no mill machinery to be used as considered by the City Council at their last regt:Iar meeting and a s a~~;rli ed for by West Coast Hardwood Furniture lf~fg. Co. , was again considered. Thereupon it was moved by Councilman Tucker and seconded by Councilman Shrock that permission be granted to said firm and to H. E. Sawyer Cabinet Works who are also operating from said location, being 3250 Sanborn Avenue, for the duration of the scar, as they are doing v+~ar work. ORDINANCE N0. 409, entitled "AN OhDINANCE OF THE CITY OF LYNWOCD, CALIFORNIA, TRANSFERRING CERTAIN LANDS FRCi~~ ZONE ~ INTO BONE C3," was read.. Thereupon it was moved by Councilman Meyer and seconded by Councilman Shrock that said Ordinance No. 409 be adopted as read the second time, finally pass and be pub- lished as req~?ired by law. Roll Call: Ayes: Councilmen Shrock, Meyer, Tucker and Wiggins. Noes: None . Absent: Councilman Looney. The matter of Petition for Rezoning from R1 to lone C3 as affecting Lots 122, 12,3, 124, 154, 155, 156 and 157, Tract 921, as .signed by J. D. Terry and 9 others and as requested by Audley Lytal, was again considered, after the Planning Commission who are acting in an advisory body, decided that they should not act as Ordinance INTO. 408 is not yet effective. Thereupon it was moved by Councilman Tucker and seconded by Councilman Shrock that the City Clerk -re directed to give notice of hearing in canneetion with said matter to be held on May 3, 1945, at 8 P. A communication was received. from City Engineer Graves reporting on the matter of request for curbs and gutters on Louise Street, east of Bullis Road, reporting that while the petition d©es not call for a majority of the district, however, that the Former petition that was presented for sidewalks, curbs and gutters bore the signatures of 770, therefore he believes that the property owners are in favor of going ahead with the work, therefore, recom- mending that the City proceed with the work. Thereupon it was moved by Co~~ncilman Tucker and seconded by Councilman Shrock that the City Engineer be instructed to proceed with the work necessary in ce~rneetion with the Investiga- tion and Majority Protest Act, as required under the 1911 Bond Act for' further consideration of the City Co~rncil. ' A communication was received from the Gity Engineer re- porting"on the matter of request that alley be opened in the 4100 block on Josephine, stating that the a1_ley is being opened and graded.' There being no objection, said communication was ordered filed. " NEW BUSINESS: ' A quitclaim Deed, dated December 1, 1944 and signed by Frank Cappo, Elizabeth Abradwich Wallis and Rosie Maggiora, whereby they convey their interest in Lot 85, Tract 921 to the City of Lynvaood; was submitted. Thereupon it was moved by Councilman Meyer and seconded by Councilman Tucker that said Q~xitelaim Deed be accepted and that the City Clerk be instruc~ed to cause said instrument to be recorded in the Office of the Recorder of Los Angeles' County, California. Byrom County Tax Collector. 174 791,26 TOTAL 4,552.90 It was moved by Councilma n Tucker and seconded by Councilman Meyer that the Water Clerk be authorized to charge for water for victory gardens on the same basis as last year, viz; "That it shall be the policy of the City Council to permit the cultivation of 2000 square feet for victory gardens in addition to an average 50 foot Lot without additional charge, and that ground used in excess thereof be charged at the rate of. 75g~ per month for additional 50 foot lots used other than an owner's own Lot which shall be charged on the basis of present charges as required by Ordinance."
