HomeMy Public PortalAboutM 1945-09-18 - CC REGULAR_MEETING SEP`IETui13ER 18, 1945 The City Council of the City of Lynwood met in a regular seesion, in the Council Chamber of the City Hall, 11331 Plaza Street, on above date at 7:30 P. M. Mayor Wiggins in the chair.' Councilmen Shrock, Meyer, Tucker and Wiggins answered the ro11 call. Councilman Looney was absent. It was moved by Councilman Shrock and seconded by Council- man Tucker that the minutes of the previous adjourned regular meeting of September 6, 1945 be approved as written. All members of the City Council present voting aye, the Mayor declared the motion duly carried. 1~'RI`I"1'EN COPf~r~UNICA'1'IONS: A communication was received in the form of a petition signed by Lee Anderson and 16 others requesting that the side- walks be cleaned of dirt and weeds as they are very unsightly. There being no objection, said matter was referred to the City Engineer for action. A communication was received from City Engineer Graves to the effect that Fire Chief Daetweiler has discussed with him- the need for a 12 inch cast iron water main along Alameda Street to serve the India Paint and Lacquer Co., stating the price to be X3,700.00, stating that the money for such installation is not set up in the 1945-46 budget, but if possible should be undertaken. There being no objection, said matter was referred to Water Corrnni ssioner Tucker for further study. A communication was received. from Chief of Police Kerr requesting that he be allowed expenses to attend a state conven- tion of the State Peach. Offi"cer's Association to be held in Salinas on October 8, 9 and 10, stating that he will use his va- cation period for such attendance. Thereupon it was moved by Councilman T>>eker and seconded by Councilman Shrock that Chief of Police Kerr be permitted to attend with expenses paid by` City. All members of the City Council present voting aye, the Mayor declared the motion duly carried. µ A communication was received from Lynwood School District regarding need for a map to show their property as proposed north of Alma Avenue, as it may exist north of Tract 5632 and west of Mallison, as requested by the City Council at a recent meeting, stating that City Engineer Graves has prepared a map showing the location thereof. There~ipon it was moved by Councilman °i5hrock and seconded by Councilman Tucker that the map be approved and that the City Attorney be instructed to commence proceedings to vacate proposed Alma Avenue between Ruth Street and San Vincente in return for a deed for the widening of Alma Avenue between Ruth St. and Mallison, and for deeding (when acquired by School) necessary right of way for the orening of San Vincente Avenue west of their property, it being understood that the School contemplates purchasifig enough property west of present holdings to include one-half of width needed fmr opening of San Vincente through to Abbott Road. A communication was received from the Lynwood School District thanking the Council for their offer to allocate any funds from the funds to be furnished. under Chapter 47 of the State of Calif- ornia for plans preparation to the School, provided that the City does not have enough projects in mind to use it. There being no abjection, said communication was ordered filed. A communication was received from Donald R, Warren Co• offering their services in connection with designing the building contemplated by~the City for a Fire Station, There being no ob- jection, said communication was ordered 'filed. A communication was received from C. A Me>ieeri objecting to the maintenance of a flock of young roosters in the property next to him within 14 feet of his bedroom window, stating that their crowing is very annowing to their peace and comfort. Thereupon it was moved by Councilman Shrock and seconded by Coun- cilman Meyer that the matter be referred to the Committee that ~~~ ' will be appo`nted to check into the matter of keeping fowls within the City, ho•,~~ever, that in the meantime that the owner of the roosters be required by the Police Department to move them 30 feet from the house of the complainant, as per existing ordinance. All members of the City Council present voting aye, the Mayor de- clared the motion d~~l~r carried. The hour of 8 P. PR. having arrived, said time being the hour fixed for hearing any objections or protests in connect- ion with the construction of cement concrete gutters a"nd curbs in Tract 10503 and upon t~":e report as filed by the City Engineer, pursuant to the provisions of the "Special .Assessment Investiga- tion, Limitation and PJia,jority Protest Act of 1931, " as amended, notice of said hearing having beenglven as required by law. The Mayor announced that this was the time and place for hearing any and all protests, inquiring of the City Clerk if any written protests had been filed. Thereupon the City Clerk presented and read a petition ,.,~ signed by Franklin L. Clure and 54 others protesting to such construction on the ground that they believe that the work may be done at a later date when more men and supplies are availablea which may also res~~lt in financial assistance from other Govern mental Agencies. Whereupon the Mayor inquired if there was any one present who wished to protest orally. Mr. Harold emmons,' 11600 Ernestine Street, addressed the Council protesting on the grounds that the cost as proposed b'y the City Engineer's estimate is too high. A~Tr. Don E. Low, 3865 Louise St. also addressed the City Council augmenting his written protest as represented by said petition, objecting to the cost, stating that he believed that the work 'should be done at a later date. Mr. Richard Jensen, 3861 Louise St., also addressed the Council in favor of the proceedings, but stating that he believes that the estimates as made by the City Engineer are erroneous and too high. City Engineer Graves addressed the Council to the effect that the estimates were based on the last curb, gutter and side- walk job installed on Platt and Walnut Street, east of Bullis Rd. P~Tr. C. Schwank addressed the Council on the matter to the effect that he is not opposed to the bro,ject, but that he believes that the estimate as given by the City Engineer is ex- cessive; also calling attention to holes in the streettYiat have not been filled in and that he v!?as not allowed to fill it in him- ~elf; also inquiring if the street would be improved. Mr. Harry Taylor, 3912, Lotaise St., a^dressed the Council regarding the matter of paving between the present pavement and gutters as proposed on Louise St., et al. Mr. Taylor was informed by the City Engineer thatit is contemplated to put a light coat of oil surface in between the present paving a.nd the proposed gutter. Mr. Jensen, 3861 Louise St. again addressed the Council regarding why the first project for curbs, gutters and sidewalks did not go in, statn~~ that it v~ias on account of War production limitation of expdnditures in excess of X10,000..00, however, that now he believes that the sidewalks should be constructed too as ~, there "is no such limitations. Pers. Robt. Smith, 11624 Nichols St. stated that he ig in favor of the project, however, that he believes that the estimate is too high. Mr. Steve Johnson, 383Q Lo~~ise St., addressed the Council on the proposed construction to the effect that a two foot gutter, that he had occasion to inquire about does not run more than X1.15 per foot. ~,~~ Mayor Wiggins stated to hose who objected to the estimates th.~=t when the time comes, that the contract will be let to the lowest responsible bidder and of course if the bid is less than the estimates, the low one will'be accepted. Mr. Wick, 11610 Ernestine Avenue addressed the Council regarding need of street improvement also. Mr. Jensen >idclxessed the Council nn the matter of cleaning the street of weeds. - Thereupon it was moved by Councilman Tucker and seconded by Councilman Shrock that said Resolution No. 18 54 be adopted. ORAL COMI~TUNICA`T'IONS: Mr. John Crowl, 3547 Palm Avenue addressed the Council re- garding the committee to regulate poultry raising, inquiring if the committee has been appointed, stating that the Pountry Organi- zation, of wt,_ich he is President would like t© be represented on the committee. Mayor Wiggins stated to I~Ir. Crowl that the committee had not been appointed and that they will see that-their organization is represented on the committee. r.2r. George Haimer, 3fi~54 Abbott Road addressed the Council to the effect that the Building Inspector called at his place where he is putting new underpinning under his house ordering that he put in a cement foundation, stating that the work would be less than X50.00; therefore, he did not think that a permit was regmired.- Buil ding Inspector Hall addressed the' Council to the ef- fect that Mr. Haimer was installing redwood timbers under the house and that the ordinance calls for a cement foundation when any alterations are made, therefore he suggested that the work be stopped until the Council determined what should be required. Mayor Wiggins spoke regarding the need of bhe removal of the house as it will be in the way for the extension of Hulme Avenue when it is opened. ~. ~~ Mr. Haimer was asked if he would be willing to deed the right of way for Hulme Avenue for future opening, and that the house would then be permitted to be repaired as he contemplated with the understanding that it be removed when street is required, but Mr. Haimer refused to d:o so. Boyle addressed the Council on what the intention of the City Cou nc~l is regarding the turkeys that are kept at the south end of Esther Street, stating that he is nne of the owners and that he cannot sell them at this time becuase of Governmental regulations, stating that he does not believe that he is violating any existing ordinance. Mayor Wiggins informed Mr. Boyle that the City Council had taken action to instruct the Police Department to bring ac- tion to abate said turkey farm as he is conducting a commercial business thereat without a City license, and that it will have to be determined by the Court what the curcumstances are. -_ _ A communication was received from City Engineer Graves recommending that the salary of Mr. E. A. Spicer be increased from X185.00 per month to X210.00 per month as his work has pro- ven satisfactory. Thereupon it was moved by Councilman RReyer and seconded by Councilman Tucker that said recommendation 'be ac- cepted and that the salary be increased as recommended. Essee, representing the Regional Planning Commission of Los Angeles, County, addressed the Council regarding the realign- ment of Santa Fe Avenue in the Industrial District so that it would run at the east end of the Commerce Tract and J. J. Bullis Tract, as it exists west of P:Zod~eska Acres and Mod,jeska Park, stating that the County have approved such realignment, submitting a copy of action taken, however, that the Council desires that the City approve' the Northerly extension of the new Banta Fe alignment North- erly of Imperial Highway to follow along the general line of Bell- inger St. to North Los Flores Blvd; thence northwesterly through Tract No. 92. and Doebler Tract to connect with CS8974 gust So~zth of Century; also that in return for the vacation of Santa Fe Aven'ne as formerly proposed, and now to be vacated, that dedication be se- cured from the owners of property that lies at the East end of said industrial tract for the new alignment for Santa Fe .Avenue (100 feet wide), . Thereupon it was moved by Councilman Shrock and seconded by Councilman Meyer that said realignment of Santa Fe Avenue be approved by the City Council. A Map of the industrial area lying South of_the Pacific Electric Railroad, 1DJest of Mod,~eska Acres and ?~:?od,~eska Park; East by Alameda Blvd. and South by the South City limits, was presented, said Map having been approved as amended by the City Council at their meeting held on September 6, 1945, and by the Plan- ning Commission of the City of Lynwood at a meeting held on Septem- ber 10, 1945. Thereupon it was moved by Councilman Shrock and seconded by Councilman Meyer that said Map of laid Industrial Area be approved and adopted as the Official map of said property.. Absent: Councilman Looney. ~~9 A communication was received from Building Inspector I~.11 requesting permission to use the steel file formerly used by Civ- ilian Defense for the Building Department. Thereupon it was moved by Councilman Tucker and seconded by Councilman Meyer that said file be transferred for use in the Building Department as requested. Matheny making application to move a wood frame building on to Lot 2, Tract 5818 located on the East side of Atlantic Blvd., two lots South of Courtland Street to be used for a real estate office. Thereupon it was moved by Councilman Meyer and seconded by Councilman Shrock that permission be granted with the requirement that he deposit with the City ~100.C0 as a guarantee for the removal of said building within a year, or if it is not thus removed that the City may do so and retain the X100.00 deposit. All members of the City Council present voting aye, the Mayor declared the motion dtaly carried. Application for work in the Building Department from George R. Shaw and John W. Dixon, were received; also report of Police department. There being no objection, said applications were referred to the City Engineer for checking, and the report was ordered filed. UNFINISHED BUSINESS: .A Contract for the disposal of Garbage, tin cans, bottles and trash, between the City of Lynwood and Andrew V. Hohn covering a period of three years for. a fee of 9750.00 per month, was pre- sented. It was moved by Councilman Tucker and seconded by Counail- a~an Meyer that the Mayor be authorized to execute said contract for and on behalf of the- City of Lynwood. - Roll Call: Ayes: Councilmen Shrock, Meyer, Tucker and Wiggins. ~ Noes: None. In connection with the application of Grimm and Newman to move their used ear Lot from 111'75 Long Beach Boulevard to 11530 Long Beach Boulevard, the City Clerk reported that the Planning Com- mission finds that such moving meets with present zoning. There- upon it was moved by Councilman Shrock and seconded by Coun~lmaM Tucker that permission be granted and that the License Collector be authorized to iss~.ze license therefor. NEW BUSINESS: A Quitclaim Deed covering Parcel 8? of I:icensed Surveyor's Map, Baok 16, Pace 37, Records of Surveys, dated August 8, 1945, signed by Adolph Brox, whereby he conveys his interest in said Lot to the City of Lynwood; a Grant Deed covering the Northerly 82 . feet of Lot 5, Mod,jeska Acres, signed by Flora M. Holy and dated September 14, 1945, whereby she conveys her interest in said Lot to the City of Lynwood, were submitted. Thereupon a Report in connection with installing ee~ers in the territory described above, ~s prepared by the City Engineer, was submitted, setting forth the information required by the "Special Assessment Investigation, Limitation and Majority Protest Act of 1931", as amended. Thereur~on Mr. T. A. Newcomb, appeared before the City Council on behalf of S. V. Hunsaker & Associates requesting that 16 of t~`ieir Lots in Tract 13245 on Walnut. P.venue be not included in the .Assessment District as the..-homes are about ready for oc- cupancsy and they need sewer facilities within 30 days, stating. that they would like to work out~a temporary arrangement for their own installation and hooking up to Lugo Avenue, and use a pump to pump into the line on Lugo Avenue due to lack of fall, setting forth fully his contentions in his letter dated September 18. Mr. Graves, City Engineer, also addressed the Council on the matter and how it was tentatively set up before the sewering of Tract 9288 was contemplated, which was on a shallow basis with little fall and wo~~ld not work out satisfactory as a permanent i nstallation, therefore, the later method and grade was devised. It was determined to go ahead with the proceedings and if other means is worked out by next meeting that the proceedings could be abandoned. A comrnunieation was received from the City of South Gate enclosing an Assignment in connection with purchasing bonds issued in `refunding A. & I. Districts 3, 4, and 5 of the City of South Gate, the City of Lynwood having purchased bonds on tax deeded Lots 3, 4, 5, 6, 7, $, 9, 10, 12, 13, ~ 14, 16, 17, 2~, 21, 24 and 25, Tract 8300. Thereupon it was moved by Councilman Shroek and seconded by Councilman Meyer that the Mayor be authorized to execute said assignment in connection with said matter for and on behalf of the City of Lynwood. The Annual report of the City Clerk of the City of Lynwood for fiscal year beginning J~~ly 1, 1944 and ending Jane 30, 1945, was submitted. There being no objection said report was orde~~ed filed. Fire Chief Daetweiler addressed the~Council on the matter of Plans for the proposed fire station ~n Imperial Highway, stating that he had conferred with Allen of Allen & Lutzi, Architects, who informed him that the proposed building would run in the neigh- borhood of X60,000.00 stating that PRr. Allen will be glad to serve the City in regard to Architectural services. The Mayor was authorized to confer with Mr. Allen and get an appointment with him when the matter may be discussed further.
