HomeMy Public PortalAboutM 1945-10-02 - CC~e~ REGULAR MEETING OCTOBER 2, 1845 The City Council of the City of Lynwood met in a regular session, in the Council Chamber. of the City Hall, 11331 Plaza Street, on above date, at 7:30 P. M. Mayor Wiggins in the chair. Councilmen Shrock, Meyer, Tucker and Wiggins answered the roll call. Councilman Looney was absent. It was moved by Councilman Meyer and seconded. by Coun- cilman Tucker that the minutes of the previous riegular meeting of September 18, 1945 be approved as written. All members of the City Council present voting aye, the Mayor declared the motion duly carried. WRITTEN COIyIMUNI CATI0IQ5: A communication was received from the Board of Fire Underwriters of the Pacific, By•H. N. Swift, Engineer, making certain recommendations regarding proper fire zones for the .City of Lynwood. This matter was laid on the table for further study with the Fire Chief. A communication was received from City Engineer Graves recommending that the salary of Mr. E. E. Davis of the Street Department be increased from an hourly wage of X1.00 per hour to X190.00 per month. Thereupon it was moved by Councilman Shrock and seconded by Councilman Meyer that the salary of E. E. Davis be increased as recommended by City Engineer Graves. Roll Call: Ayes: Councilmen Shrock, Meyer, Tucker and Wiggins. Naes: None. Absent: Councilman Looney. A communication was• received from City Engineer Graves to the effect that .the Building Inspector and himself appointed• a Mr. W. A. Harris as assistant in the Building Inspect©r's of- face, but that his services were not satisfactory, therefore, he has been dismissed as of the date of the letter October 2, atatin~; that they will advertise for a qualified person to fill the position. Thereupon it was moved by Councilman Meyer and seconded by Councilman Tucker that the City Engineer and Building Inspe- ctor continue to interview applicants and when they find a suit- able and qualified person to make recommendation to the City Council for his appointment. All member8 of the City Council present voting aye, the Mayor declared the motion duly carried. A communication was received from Assistant Building Inspector Ha11 requesting a clarification oP his position as As- sistant stating that he believes that since the resignation of Mr. Evans that he should be appointed as the Building Inspector. This matter was deferred until the next meeting of the City Coun- cil. A communication was received from Mr. Howard Hemenway, Attorney at Law offering on' behalf of his client, Freda Eraft, the sum of X400.00 for Lots 11 and 12, Block 19, Mod,jeska Park, free and clear and City to clear title thereon. After due con- sideration of the matter, it was moved by Councilman Tucker and seconded by Councilman Shrock that the offer be rejected and that a new appraisal be made of the property. All members of the City Council present voting aye, the Mayor declared the mo- tion duly carried. A communication was received from the L. A. County Div- ision League of California Cities, by Ray Meyer, Treasurer, ~al- ling attention to increase in dues from X10.00 to x'17.50 per year. Thereupon it was moved by Councilman Shrock and seconded by Councilman Tucker that the City take out a membership therein and the dues be paid. Roll Call: Ayes: Councilmen Shrock, Tucker, Meyer, and Wiggins. Noes.: None. Absent : Co~?ncilman Looney. A communication was received from Mr. ~'T, T. Fahey, Asst. Engineer, to the effect that the matter requested in the petition to clean walks of weeds and dirt is going to be taken care of by the Street Department at an early date. There being no ob~jeetion said communication wa.s ordered filed. ~ej~ A communication was received from Chief of Police Kerr recommending that the salary of Miss Barbara N. Bitting, Secretary in the Folice Department be increased to the base pay of X145.00 per month, plus the war bonus of `10.00, stating that there are funds :Ln the present budget to pz'ovide for such increase. It was determined from the discussion that Piss Bitting was working the same hours as the Police Department, 7~ hours a day, w~~ich is not in 1ir_e with other Stenographers and. Clerks in the same work, therefore, it ~~~s moved by Councilman Tucker and seconded by Councilman Meyer that the increase in salary be made with the understanding that Miss Bitting be required to work 8 hours a day and. 4 hours on Saturday, thus making her hours to conform with other help in similar work. A communication was received from Chief of Police Kerr recommending that the City Attorney look into the matter of the Civil Service Ordinance regulating his Department with respect to Motorcycle Officers, stating that inasmuch as this branch of Folice service i s q~~ite hazardous, the officers very often wish to transfer to radio car work, however, that the City of Los Angel es. Police Department have been able to prevent this by ,~=~iving their men civil service rating not as motorcycle officer, and t~_ose who work as I~,~otoreycle Officer are given a bonus of about 10 per cent over their base salary. Chief of Police Kerr also addressed the Council regard- ing this matter, suggesting that such a plan be devised, stating that the motorcycle officers who are now working as such are getting a higher salary by 6~fo, or X220.00 per month as against X210.00 per month for motor Patrolment, stating that he believes by this method a Police Officer may be transferred from Patrpl-. men or other position in the Police Department to motorcycle officers without changing his status as far as his Civil Service rating rna,y be, but that such officers would then be entitled to the increased pay. Thereupon it was moved by Councilman ~lieyer and seconded by Councilman Shrock that the plan as outlined by Chief Kerr be adopted for h:~s Department a_s affecting said motorcycle officers. A communication wa.s received from the Lynwood Planning Commission recommending that a variance of zoning be allowed as affecting Lot 1057, Tract 3025 so that an e~uto court may be con- structed thereon as it is the plan of the Commission to place said Lot -i n such a zone when the nev~~ zoning mar and Ordinance is finally adopted, however, the ordinance will not be adopted for approximately three months, aged constrtaction may be commen- ced. before said time. il;-Ir. George Kenney addressed the Council in favor of said application. Thereupon it was moved by Councilman Tucker and seconded by Couneilrnan Meyer that the present zoning as affecting said Lot be waived so that an auto court may be constructed thereon in view of the intent of the Planning Commission to thus zone said Lot when the ne~~ Ordinance is proposed. __ Roll Call: Ayes: Councilmen Shrock, r~2eyer, Tucker and Wiggins. Noes : Alone . Absent: Councilman Looney. A communication was received from the. Lynwood Planning Commission to the effect that they ha_d approved a proposed sub- division of Lbt 8 of the Downey & Hellman Tract into 30 Lots to be 51. feet by 115 feet, with no dedication for widening of Pendleton Street, it being the thought that said street not be opened any farther West a.s it cannot go through all the way West to Century Boulevar°d anyway, so eventually the existing 20 foot r3.ght of way should be abandoned. ~~~ A communication was received from ?fir. Eilert Voge the applicant to the effect that he wotald like to secure the Council's reaction so that he may survey the land and proceed with securing the subdivision map. . Mr. Voge also addressed the Council on behalf of the application, as well as City Engineer Graves, the latter stating that he believes that it would be all right nat to require a street at the extreme South end .of said proposed .tract (Pendle- ton) as the street could not go through anyway. No action was taken on the matter, other than the Council st-~ted to Mr. Vo ge that they would approve the subdivi- sion map as per tentative map filed. A communication was received from Chief of Pollee Kerr to the effect that the new state vehicle laws as amended Sep- tember 15, 1945 provides that cities are now permitted to create speed limits otY~er than the limits set by the State Legislature in the California Vehicle Code, suggesting that 35 miles per hour be established on Imperial Highway where it is not already 25 miles per hour, stating verbally that Ordinance ftto. 404 is broad enough to cover such new regulation. Thereupon it was rrroved by Councilman Tucker and seconded by Councilman Meyer that a speed of a maximum of 35 miles per hour be established on Imperial Highway, as suggested by Chief Kerr, Roll Call Ayes: Councilmen Meyer, Shrock, Tucker and Wiggins. Noes: None. Absent: Councilman Looney. A communication was received from City Engineer Graves requesting his two weeks vacation between October 3, 1945 and October 16, 1945. Thereupon it was moved by Cou neilman Shrock and seconded by Councilman Meyer that Mr. Graves be allowed to go on his vacation durin~• said period. All members of the City Council present voting aye, the Mayor declared the motion duly carried. . An Annual Report of the Playgrounds activities of the City of Lynwood from June to September, both inclusive, 1945. There being na ob,jection, said report was ordered filed. A communication was received from the office of Price Administration thanking the City Council for their generosity in furnishing office space in the City Hall for the local war price and rationing. There being no objection, said communication was ordered filed. ORAL C014~'~~iUNI CATIONS Mr. George Kennedy addressed the Council regarding the need for an amendment to the present Civil Service Ordinance that would give preference ratings to those who had served their country in the armed forces in giving examinations, similar to credits given by the State of California and-the Federal govern- ment, 3. e.; 5~ for those who have served in service of their country; 10~f for disabled war veterans; 10~o for widows of those who died in service; 10~ to wives of veterans who were injured wrile in service so they cannot earn a livelihood, stating that this is to apply now before the proposed Civil Service Ordin- ance that may be adopted at the City election, so that such per- sons may get such benefits that they may be entitled to. Mr. Kennedy sugQ~ested that a Committee be appointed from the City Council to meet with their group to work out suitable amendment. It was moved by Councilman Shrock and seconded by Coun- cilman Tucker that the Mayor be•authorized to appoint a committee to consist of cne member from the American Legion, one from the Veterans of Foreign Wars, one from the City Council, together with the City ..Attorney to draw up suitable amendment for consi- deration of the City Council. All members of the-City Council present voting aye, the Mayor declared the motion duly carried. Mr. Thompson addressed the Council regarding several matters: The need for Street Improvement in his district, oil dripping from trucks operating off of Drury Lane, inadequate street lighting in ris district. The Chief of Police was instructed to check into the matter of oil dripping off of oil truck s. ~~~ The City Engineer stated that the reason why lights have not been functioning properly in the distr'..~~~t i.s tY~e lads of ~-de-au ate transformers and difficulty that the Edison Co. is having to secure them. Mr. L. Moore, addressed the Council on the matter of permission to place a fabricated building for displa~r purposes from which quarters he would sell the buildings that he makes suitable for cabins and garage at Century Blvd. and Long Beach, or Long Beach Blvd. and T~reedy Blvd. .After due consideration of the matter, it was moved by Councilman Tucker and seconded by Councilman Meyer that permis- sion be granted to applicant and that he be required to deposit a X100.00 cash bond for removal ,of said building within a year, and if not thus removed, the City May use said money for remou-~ ing same, and that the License Collector be authorized to issue license therefor. A11 members of the City Council present vot- ing aye, the Mayor declared the motion duly carried. Mr. Hendon, and Mr. Smith lsho reside on 109th Street addressed the Cduncil regarding a trucking firm that is operating in the neighborhood against zoning regulations, stating that the former owner of the business was liven a permit for the duration, but that the new owner has not been granted any permit by the City and therefore should be required to move, stating that they are even repairing the trucks in th;~ Street, stating that the noise is almost imbearable to the residents, requesting that early ac- tion be taken to have the nuisance abated. Mr. Kerr, Chief of Police addressed the Council to the effect that he has notified the owners to cease to repair their trucks in the street and cease from parking thereat. Thereupon it ~uas moved by Councilman Shrock and seconded by Councilman Meyer that the City Attorney be instructed to com- municate with the owner of said truck concern instructing him to have the business removed within 60 days. All members of the City Council present voting aye, the Mayor declared the motion duly carried. NEW BUSINESS A Grant Deed whereby the City of Lynwood proposes to co n- vey its' interest in and to Parcels 87, 88, 89, 90, 91, 92, 93, 94, and 95, Licensed Surveyor's Map to Ethel B. Cooper, was submitted. Thereupon RESOLUTION N0. 1864 intitied: ~~RESOLUTION SELLING CERTAIi~1 REAL ESTATE AND AUTHORI~LING THE EXECUTION OF A DEED UPON PAYMENT OF THE CONSIDERATION NAMED THEREIN,u was read. It was moved by Councilman Tucker and seconded by Councilman Myer that said Resolution No. 1864 be adopted. Roll Call: Ayes: Councilmen Shrock, Meyer, Tucker and Wiggins' Noes: None. Absent: Councilman Looney A Grant Deed, whereby the City of Lynwood proposes to convey its interest in and to Lot 46,Tract 921 to Melbourne Louis Nowlin, was submitted. Thereupon RESOLUTION NO' 1865, entitled: "RESOLUTION SELLING CERTAIN REAL ESTATE AND AUTHORIZING THE EXECUTION OF A DEED UPON PAYI~iENT OF THE CONSIDERATION NAMED THERIN~~, was read. Thereupon it was moved by Councilman Tucker and second- ed by CouncilmanMeyer that said Resolution No. 1865 be adopted. Roll Call: Ayes: Councilmen Shrock, Meyer, Tucker and Wiggins. Noes: None. Absent: Councilman Looney. It was moved by Councilman Tucker and seconded by Councilman Meyer that the City Attorney be instructed to commence vae~tion and abandonment proceedings covering Alma Ave., between Huth Street and St. Veneent Ave., and that an easement deed be se- cured from Lynwood Elementary School district covering 25 feet widening of Alma Ave., between St. Vincente Ave, and Mallison Street. All members of the City Council present voting aye,-the Mayor declared the motion duly carried. It was moved by Councilman Shrock and seconded by Councilman Tucker that the City .Attorney be instructed to com- mence vacation and abandonment proceedings covering the Streets to be vacated as per map filed with the City Council covering the industrial area, in return for the street dedications heretofore agreed upon and as shown on said map. All members of theCity Council voting aye, the Mayor declared the motion duly carried. The City Clerk stated tha t a number of complaints had been registered with him regarding the dust that blows from the unsur- faced street at the west end of Fl ower St. adjacent to MacMillian~s plant. There being no objection, this matter was referred to the City, Engineer to study and correct as, soon as possible. It was moved by Councilma n Meyer and seconded by Councilman Tucker that the salary of Bert McI ntyre be increased X20.00 per month for period from October 2nd, 1945 to November 1, 1945, and thereafter X10.00 per month. _ Roll Gall: Ayes: Councilmen. Mr. Earl Gallaher addressed the Council on behalf of Warren Daetweiler, Fire Chief, to the off-ect that the. Fire Depart- ment would like permission to use the ambulance formerly used by ,,,~,, 0. C. D. for inhalator calls. Thereupon itrwas moved by Councilman Tucker and seconded by Councilman Meyer that the fire department be authorized to use said .ambulance for such purpose.
