HomeMy Public PortalAboutM 1945-10-16 - CC__ __ ~~~ REGULAR MEETING OCTOBER 16, 1945 The City Council of the City of Lynwood met in a regular session in the Council Chamber of theCity Hall, 11331 P1a~a St., on above date, at 7;30 P. M. Mayor Wiggins in the chair. Councilmen. Shrock, Meyer, Tucker and Wiggins answered the roll call. Councilman Looney was absent. It was moved by Councilman Shrock and seconded by Council- man Meyer that the minutes of the previous regular meeting of October 2, 1945 be approved as written. A11 members of the City Council present voting aye, the Mayor declared the motion duly carried and it was so ordered. The hour of 8 P. M. having arrived, said time being the hour fixed for hearing any ~b~ections or protests in connection with the construction of cement concrete gutters and curbs in Tract 10503, as per notices posted, published and mailed as re- quired, by law. The Mayor announced that this was the. time and place for said hearing, inquiring if there was any one present who wished to protest in connection with said matter. There was no response. Thereupon the Mayor inquired of the City Clerk if any written protests had been filed. The City Clerk stated that Petitions and a communication had been filed requesting that the present proceedings be aban- doned and that new proceedings be initiated for the construction of side walks as well as gutters and curbs, and aprons. Said Petition being signed by 64~ of those in the district that pur- port to be the owners, and.55~ of those who have been determined definitely that they are the t~wners, according to the City Engineer's office. Absent: Councilman Looney. rr Thereupon RESOLUTION N0. 1867, entitled: "IN THE MATTER OF THE PROPOSED IMPROVEMENT OF THAT PROPERTY IN TRACT 10503, IN THE.CTTY OF LYNWOOD, LYING SOUGH OF FERNWOOD AVENUE AND BETWEEN , BULLIS ROAD ON THE WEST A~iD MURIEL DRIVE ON THE EAST, EXCEPTING LOTS 1 AND 109 TO 116 INCLUSIVE, BY CONSTRUCTIND SIDEWALKS, CURBS, AND GUTTERS COMPLETELY WITHIN THE ABOVE DESCRIBED BOUNDARY, RESOLU-. TION PROPOSING TO INSTITUTE IMPROVEMENT PROCEEDINGS AND DIRECTING PREPARATION OF REPORTN, was read. An Ap~lieation in the matter of the application of Dean Carson for a franchise to .operate Pass.en~er ,Motor Bus Lines within the City of Lynwood as intra-municipal motor bus, lines, for a term of 20 years, on streets to be designated by City Council, payment of 2~ of gross annual reaeipt$ after the fifth year, setting forth minimum and .maximum rates, as well as,insura.nce to be carried by Grantee and bond in connection .t herewith. Thereupon it was moved by Councilman Tucker and seconded by Councilman Meyer. th~a t the application of Dean Carson for a Franchise to operate motor busses for the transportation of passen- gers a.nd their hand baggage For hire in the City of Lynwood be received and filed; that the fact, of the filing of said application be advertised by the City Clerk as required by statute; that sealed bids for such franchise be received. at the office of the City Clerk until 10 A. M. on the 4th day of December, 1945 and to be opened at 8 o'clock P. Carson making application fcr special permit to conduct passenger motor bu lines covering two motor busses, pending the granting of a permanent franchise for 20 years as heretofore mentioned. Thereupon RESOLUTION N0. 1868, entitled: "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF I~YNWOOD GRANTING TO DEAN CARSON A REVOC_ ABLE PERMIT TO EST',BLISH AND THEREAFTER CONDUCT, MAINTAIN AND OPERA ATE, ON REGULAR SCHEDULES, IN'TRA_MUNICIPAL MOTOR BUS LINES FOR THE TRANSPORTATION OF PASSENGERS AND THEIR HAND BAGGAGE, FOR HTRE, WHOLLY WITHIN THE CITY OF LYNWOOD, OVER, UPON AND ALONG STREETS, HIGHWAYS, ALLEYS, BOULEVARDS, AVENUES, ROADS, AND 0~1'HER PUBLIC PLACES; AND SPECIFYING 2'H~: TERMS AND CQNDITIONS OF SAID PERr,QIT", was read. Noes: None. .Absent: Councilman Looney. ORAL COP~rIUNICATIONS~ Mr. Jackson, 3821 Louise St. Addressed the Council on the franchise to Mr. Carson to operate. buses, as to the route to be maintained. Attorney Bruce A:~ason addressed the Council explaining why such route will not be set up in the franchise as then the Council would have no power to change the routes. A communication was received from Chief of Police Kerr recommending that the salary of Harry D. Speer be increased to X220.00 per month as motorcycle officer. Thereupon it was moved by Councilman Meyer and seconded by Councilman Shrock that said recommendation be accepted and that the salary of Eqr. Speer be increased to X220.00 per month. Rowlands to the effect that he understands that the City of Lynwood is contemplating on employment of a City Manager, making application for such positiGn giving his qualifications. There being no ob- ~ection, said application was ordered filed. _ A communication was received from the Chief of Police to the effect that the Police Department incooperation with the Fire Department are sponsoring a barbecue for the City Council and employees and ladies to be held on October 2?, between 3 P• M. and 5 P• M. with dinner served at 5 P. M., requesting use of City Park; also inviting City Council to attend. It was moved by Councilman Tucker and seconded by Councilman Meyer that permission be granted to hold said picnic and that space be set aside in the City Park for such propose. All members of the City Council voting aye, the Mayor declared the motion duly carried. An offer to purchase Lot 49, Tract 25.51 for the sum of. X1,800, free and clear of all indebtedness and City to furnish a merchantable title thereto, or X2,000.00 and City remove the Palm trees on the Lot, was received from L. A._ Evans. The rJlayor inquired if -there was any one present who Wished to raise said offer. Thereupon Mr. V. A. Nation, stated that he would raise the bid to ~1~825.0~', however, it was determined that the appraised value mff said Lot is X2,000.00 and City of Lynwood not to remove the trees, which was thus announced. Whereupon Mr. V. A. Nation, off eyed to .purchase the Lot for ~2, 025.00 without such removal. Thereupon it was moved by Councilman Shrock and seconded by Councilman Tucker that said bid be accepted. Noes: Mons: Absent: Councilman Looney. __ __ __ A communication was received from Building Inspector Hall making certain suggestions for amendment to the Building Code to improve construction in the City of Lynwood. There being no objection, this matter bras laid on the table for future consid- eration. An appraisal report covering certain Lots in the City of Lynwood was received. There being no objection, said report was ordered filed. Application for employment as Building Inspector Assis- tant was received from Paul Franklin Wait, Floyd N~. Peankueh, Glen H. Hickman, Fred W. Gardner, John C. Shaubell, Frank Wm. Simmons; also application for employment as Office work from Evelyn Foster. There being no o b,jeetion, said applications were ordered filed, stating that the Council would confer with those present regarding the bail ding inspector post. Reports of City Court for month of September; also re- port of Fire Department, and report of gasoline consumed. There being no ob~ection, said reports were ordered filed. WR T `1`EN COIItMUNI CA'T'I ONS : - A communication was received from the L. A.: County League of California Cities annoucing their meeting to be held on October 17,1945, at 7 P. M. There being no objection, said communication was ordered filed. A communication was received from Chief of Police Kerr submitting a bill for his expenses in connection with his tr~n to Salinas to a Peace Officers Association convention, being i.n the amount of X39.?2. Thereupon it was moved by Councilman Tucker and seconded by Councilman Meyer that said demand be allowed and in- cluded in the list of demands. Roll Call Ayes: Councilmen Shrock, Meyer, Tucker and Wiggins. Noes: None. Absent: Councilman Looney. A communication was received from the L. B. Construction Company requesting permission to place two temporary sales and -demonstration structures on the lot at the southwest corner of Tweedy and Long Beach Blvd. for sales purposes. Mr. Matheny was present and addressed the Council on the matter of submitting a sketch of the buildings. . Thereupon it was moved by Councilman Tucker and seconded by Councilman Shrock that permission be granted for a term of one year, at which time tt shall be removed from the property within 30 days notice from the City• and if not thus removed that City may thus remove the building and to be paid from a 100.00 deposit to be left with the City as a guarantee. Absent; Councilman Looney. - NEV~ BUSINESS: The City C1 erk stated that the insurance policy covering Motorized equipment against P. L. and P. D. expired on November I0. The City Clerk was instructed to give the council information as to present agent who have insurance. Bids to do painting in the City Hall was submitted from J. P. Gilpatrick e,nd E. L. Renfro. There being no objection, ac- tion on this matter was deferred for further quotations. A Grant Deed, dated October 8, 1945, signed by Mrs. Jane Holy whereby she conveys her interest in the Southerly 41 feet of the Northerly 82 feet of Lot 5, Mod,jeska Acres to the City of Lynwood; also Quitclaim Deed covering the South 130 feet oP Lot 49, Tract 2551, dated Au gust 4th, 1945 and. signed by Ellen LeBlanc, also Quitclaim Deed covering Parcels 88, 89, 90, 91, 92, 93, 94 and 95 of Licensed Surveyor ~ s Map, Book 16, page 3? of Surveys, signed by Myrtle Spence Anderson and being dated May l5, 1945, were submitted. Thereupon it was moved by Councilman Shrock and seconded by Councilman Meyer that said deeds be accepted and that the City Clerk be instructed to cause said instruments 'to be recorded in the Office of the Recorder of Los Angeles County. OF TAX DEED- ED PROPER~i'Y AS, REQUIRED BY AGREEMENTS NUMBERED 159, ' 173, AND 275 BETWEEN THE COUNTY OF LOS ANGELES AND THE CI'T'Y OF LYNWOODt1, was read. Absenti Councilman Looney. A Grant Deed whereby the City of Lynwood proposes to convey its interest in and to Lots 65, 66, 67, and 68, Block 20, Mod,jeska Park, was submitted. Thereupon RESOLUTION N0. 1870, entitled: 'RESOLUTION SELLING CERTASN REAL ESTATE AND AU"1'HORIZING THE EXECUTION OF A DEED UPON r'AYMENT OF THE CONSIDERATION NAMED THEREIN+, was read. Thereupon.it was moved by Councilman Tucker and seconded by Coun- cilman Shrock that said Resolution No. 1870 be adopted. Roll Ca112 Ayes:. Councilmen Shrock, Meyer, Tucker and Wiggins. Noesi None. An Ordinance, entitled: '~An Ordinance providing for a set back building line on both sides of Long Beach Boulevard from Fernwood Avenue on the North to Orchard Avenue on the south, and from Imperial Highway on the Bouth to Century Boulevard on the North, in the City of Lynwood, California°, was read for the first time. Thereupon it was moved by Councilman Shrock and se- conded by Councilman Meyer that said. Ordinance be accepted as read the first time and pass to the second reading. Roll Call: Ayesi Councilmen Shrock, Meyer, Tucker a.nd Wiggins. Noesi None. Absent: Councilman Looney. It was moved by Councilman Shrock and sec©nded by Coun- cilman Tucker that the City Council adopt a Tentative Report incon- nection with employing a City Manager, and that the City Attorney draar up the necessary instrument for consideration of theCity Council. All members of the City Council present voting aye, the Mayor declared the motion duly carried. It was moved by Councilman Tucker and seconded by Coun- cilman Meyer that the City permit a rubber firm to cross Imperial Highway with a spur track at the P• E. Railroad crosGing with the understanding that they shall protect the culvert thereat con- structed and not obstruct the flow of water. Roll Call: _ Ayes: Councilmen Shrock, Meyer, Tucker and Wiggins. It was moved by Councilman Meyer and seconded by Council- man Tucker that the City Clerk be instructed to readvertise for bids gor the drilling of a water well in the Lynwood Press and in the Southwest Builders. All members of the City Council present vot- ing aye, the Mayor declared the motion duly carried. It was moved by Councilman Shrock and seconded by Coun- cilman Meyer that the City hire a man for two rweeks to work on the matter_of securing right of way far alleys along Lon Beach Blvd. where alley do not already exist, for a salary of 125.00 for two weeks. Roll Call: Ayes: Councilmen Shrock, Meyer, Tucker and Wiggins. Noes: None. Absent: Councilman Looney. Chief ?of Police Kerr presented Don Carver who has gust. returned from U. S. service and is back on the Police force. Mr. and Mr. Banister, 2022 W. Adams, . Los Angel e s who are constructing a residence and garage on Plum Street, addressed the Council requesting permission to move into the garage temporar- ily as they are compelled to move from their present quarters, and thought that they had a house rented at Walnut Park but it did nv work out, stating that they will proceed with the construction of their house as much as possible, stating that the foundation and ~~ subfloor is now in. After due consideration of the matter it was moved by Councilman Shrock and seconded. by Councilman Meyer that the City Council grant Mr, and Mrs. banister a temporary permit to reside in their garage on Plum Street for a period of six months. All members.of the City Council present voting aye, the Mayor declar- ed the motion duly carried. .
