M. Mayor Wiggins in the chair. Councilmen Shrock, PReyer, Tucker and Wiggins answered the roll call. Councilman Looney was absent. • It was moved by Councilman Shrock and seconded by Council- man Meyer that the minutes oY the previous regular meeting of Nov- ember 6, 1945 be approved. as written. All members of the City Council present voting aye, the Mayor declared the motion duly car- ried. The hour of 8 P. M. having arrived, said time being the hour fixed for hearing any ob,)eetions or protests in connection with. the installation of sanitary sewers in portions of Tracts Nos. 13245, 9288 and 6728, as per notices published, mailed and posted as required by law, said hearing being in connection with the Re- solution of Intention No. 1874. The Mayor announced that this was the time and. place for said hearing, inquiring of those present if there was any one who wished to protest in connection with said matter. There was no response. The City Clerk stated that no written protests had been filed. In the opinion of the City Council of the City of Lynwood the public interest and conveni~n.ce require and said City Council having acquired ,)urisdiction so to do, the following work, or improvement, is hereby ordered to be done, to-wit: the construction of vitrified clay pipe sianitary sewers, together with house connections, manholes, lampholes, and all appurtenant work, including the resurfacing of trenches with bitumin us macadam pavement in the streets and alleys in the City of ~-nwood, County of Los Angeles, State of California, described as follows: Beginning at the mo•rthwest corner of Tract 13245; thence east to the northwest corner of Lot 1, Block I, Tract 9288; thence southeasterly along the north Line oP Block 1 to a point of intersection with a line 50 feet (50') north of the north boundary of Block 8; thence east paralleling.*he north line of Block 8 to a point of inter- section with thenortherly prolongation of the west line of Lot 12, Tract 6728; thence south along the west line of the southerly prolongation of Lot 12, Tract 6728 to the southwest corner of Lot 55, Tract 6728; tffience west along the south boundary of Lo•t 11, Tract 6728 to the southwest corner of said Lot; thence soLathwesterly to the south line of Lot 18, Block 6, Tract 9288; thence west to ~9 the southeast corner of Lot 19, dock 6, Tract 9288; thence north to the northeast corner of said Lot; thence west along the north line of said Lot and its westerly prolongation to a point of intersection with the west boundary line of Tract 13245; thence north along said boundary to a point of beginning, That all the work and improvement aforesaid shall be done and performed as contemplated in Resolution No,. 1874 of the City Cou Heil of the City of Lynwood, California, and as shown on and in accordance with and to the grades shown on the plans, profiles and specifications No. 1945B therefor filed in the Office of the City Clerk in the City Hall of said City of Lynwood. Said Resolution and plans are hereby ref erred to for a full-and detailed description of said proposed work and for the grade to which the work is to be done and are made a part hereof. Section 2. That., pursuant to the provisions of Sectiona 3a and b of the "Improvement Act of 1911", as amended, the City Coz~ncil of the City of Lynwood proposes to do the above work, or improvement, by contract; no contribution of either labor or material will be made by the City, and the entire coat of said improvement is to be paid by special assessments upon benefited property. Section 3. All of the work, or improvement aforesaid, des- cribed in Section 1 hereof shall b e done in accordance with and to the grade shown on Flans and Specification No. 1945B for the improvement of the aforesaid streets, avenues, alleys and intersections by the construction of sanitary sewers, house connections and appurtenant work as described in Specifications 1945B, on file in the office of the City Clerk oY' the City of Lynwood, California. Said Plans and Specifications are hereby referred to for a full and detailed description of said proposed work, or improvement, and for the description of the grade to which the work is to be done and are made a part thereof. Section 4. The work, or improvement, for the furnishing and deli very by the Contractor of all labor, materials and supplies, shall b e furnished and delivered in~accordance with Plana and Speci- fications No. 1945E for furnishing and delivering materials in con- nection with the improvement of said streets, avenues, alleys, and intersections by the construction sanitary Sewers, house connections and appurtenant work as spec3ified by said plan on Pile in the office of the City Clerk of the City of Lyr~ood, California. Said Plans and Specifications are hereby referred to for further particulars and are made a part hereof. Section 5. Said contemplated work, or improvement, in -the opinion of the City Council, is of more than local or ordinary public benefit, and the City Council hereby determines and declares that the district to be benefited by Said work, or improvement, and to be assessed to pay the costs and expenses of Furnishing all the materials and supplies necessary to do the above work, or improve- ment, i s bounded and described a s follow s The construction of vittified clay pipe Sanitary sewers, together with house connections, manholes, lampholes, and all appurtenant work, including the resurfacing of tranches with bituminous macadam pavement in the streets and alleys of the City of Lynwood, County of Los Angles , State of Califor- nia, as described as follows: • Beginning at the northwest corner of Tract 13245; thence east to the northwest corner of Lot 1, Block 1, Tract 9289; thence southeasterly along the north line of Block 1, to a point of intersection with a line 50 feet (50~) •north oP the north boundary of Block 8; thence east paralleling the north line of Block 8 to point of inter- section with the northerly prolongation of the west line of Lot 12, Tract 6728; thence south along the west line of the southerly • prolongation of Lot 1L2, Tract 6728 to the southwest corner of of 55, Tract 6728; thence west along the south boundary of Lot 11, Tract 6728 to the southwest corner of said Lot; thence southwesterly to the south line of Lot 18, Block 6, Tract 9288; ~:~7i® thence west to the southeast corner of Lot 19, Block 6, Tract 9288; thence north to the north- east corner of said Lot; thence west along the north line of said Lot and its westerly prolong- ation to a point of intersection with the west boundary line of Tract 13245; thence north along said boundary to point of beginning. Section 6. That it is hereby determined that no part of the cost of said improvement is to be paid by the City of Lynwood. The entire cost of labor, materials and supplies is to be paid by special assessments upon benefited property. All the labor, materials and supplies, the cost of which is to be paid by said special assessment upon benefited property, and which will be furnished and delivered by the Contractor in accor- dance with s~.id Plans and Specifications No. 1945B on file in the office of the City Clerk of Lynwood. Reference is hereby made to said Specifications for a full and complete description and said Specifications shall govern for all details. Section 7. The City Council hereby deter~aines and de- clares that serial bonds shall be issued in the manner and form provided in the "Improvement Act of 1911", as amended, bearing interest at the rate of six per centum per annum to represent each assessment of twnety-five dollars 025.00), or over, remaining un- paid for thirty days of t.er the date of the warrant. Said serial bonds shall extend over a period ending nine years from the second day of January next succeeding the next October fifteenth following their date. Said bonds and interest thereon shall be paid at the office of the City `Treasurer and the same shall be disbursed by him, all as provided in the "Improvement Act of 1911", as amended. Section 8. The proceedings for the aforesa~d proposed work, or improvement, shall be taken under an Act of egislature of the State of California designated as the "Improvement Act of 1911", approved April 7, 1911, and amendments .thereto. Section 9. The City Clerk shall post a notice, conspic- uously, for five days on or near the Council Chamber door of said City Council, inviting sealed proposals, or bids, for doing the work herein ordered to be paid for by special assessments on bene- fit~d property as aforesaid (consisting of furnishing and delivering all labor, materials and supplies, and in accordance with said Plans and Specifications No. 1Q45B;) shall cause notice inviting propos- als, and referring to the said specifications on file, to be pub- lished twice in the Inwood Press, a weekly newspaper published and circulated in said City of Lynwood. and hereby _disignated for that purpose; shall require in such notices that each proposal, or bid, offered be accompanied by a check, payable to said City of Lynwood, certified by a responsible bank, for an amount which shall not be less than ten per centum of she aggregate of such proposal, or bid, or by a bond for said amount and so payable, signed by such bidder and two sureties, who shall ,)ustify befor a any officer competent to administer an oath, in double said amount, and over and above all statutory exemptions; andahall fix a time for the opening of such notices. The Mayor inquired of those present if there was any one who had not turned in a bid who desired to do so, that they may do so at this time. There was no response. The City Clerk stated that several written bids ha8 been filed. Thereupon it was moved by Councilman Tucker and seconded .by Councilman Shrock that the bids be publicly opened and declared. All members of the City Council present voting aye, the Mayor de- clared the motion duly carried. The following firms submitted bids: American Cast Iron Pipe Company. Grinnell Company and United States Pipe and Foundry Company. Thereupon it wSS maed by Councilman Tucker and seconded by Councilman Shroek that the bids be referred to Administrative Of- ficer Shannon for checking and report. .All members of the City Council present voting aye, the Mayor declared the motion duly car- ried. The Mayor announced that the City Council would hear any person present. who desires to be heard in connection with the pro- posed business license ordinance. Thereupon the following persons addressed the Council re- garding the proposed rates, opposing the increase from the present ordinance. Mr. Moore, Manager of Western Auto Supply co. A representative of Ire-Lyn Dress Shap Mr. Terry of Terry Signs Claude Reber of Three Rebers Mr. George Kennedy who spoke on veterans exemption on taxes and their rights under the G. I. Bill. Mayor Wiggins explained about the need for additional re- venue to carry on the functions of government, stating that the Ordinance will be considered further at an ad3ourned meeting to be held on November 27, at 7:30 P. M. Mr. Earl Bacon addressed the Council on the matter of ap- pointment of City Manager by the City Council which he understands is not permissible without a vote of the people. Mr. C. E. Williams also addressed the Council regarding said matter reading a letter that he had received from the Attorney General of the State of California regarding the procedure to pursue in establishing a City Managger form of Government. WRITTEN COMD~UNICATIONS: A communication was received from A. Lytal requesting that he be permitted to move his temporary real estate office from Lot 138, Tract 2551 to the E. ~ of Lot 168, Tract 2551, both lots being on Imperial Highway. Thereupon it was moved by Councilman Tucker and seconded by Councilman Shrock that permission be granted with the same provision as that made when granting permission on Lot 138, and that the deposit of X100.00 required be held for removal. All members of the City Council present voting aye, the Mayor de- clared the motion duly carried. A communication was received from Chas. M. Hall recommend- ing that a refund be made to C. F. Stevens for gas permit in the sum of X1.75, that was not installed as electticity was used. Thereupon it was moved by Councilman sucker and seconded by Coundilman Meyer that refund be made and the City Clerk be aezthorized to prepare a warrant for payment of said amount. __ __ _ _ __ ~:~-~ Roll Call: Ayes: Councilmen Shrock, Meyer, Tucker and R~iggins. Noes: None. _ Absent: Councilman Looney. A communication was received from C. G. Krahm requesting permission to ~aperate a shop on State Street, dust. north of Tenaya where he would do cabinet and furniture repair work. After due consideration of the matter, it was moved by Councilman Shrock and seconded by Councilman Meyer that permission be granted and that the License Collector be autr~orized to issue license therefor. -All members of the City Council present voting aye, the Mayor .declared the mot ion duly carried. A communication was received from the County Health De- partment submitting their annual report. There being no objection, said communication was ordered filed. A Petition was received signed by George B. Watson and 27 others requesting that something be done to allieviate the nui.s- ance caused by smoke and dust coming from the place of business owned and operated by E. ~'. ~hcDonald at 11039 Atlantic Ave. There being no objection, this matter ~v~a.s referred to Administrative Officer Shannon for checking and see what may be done to have. it eliminated. A communication was also received from Mr. C. M. Hall, Building Inspector regarding said.matteT. A communication was received from Joe B. Marsh, 2914 Poplar Dr. objecting to the charge for weeds on Lots 10, 11, and 12, Block 1, Mod,jeska Par, requesting that adjustment be.made. There being no objection, said matter was referred to the City Engineer to check the assessment roll to determine what the charge is and re- port back to the City Council his findings, and if any adjustment is advisable. A communication was received from George C. Shannon, Ad- mininstative Officer recommending that Police Officer Henry M. Leander be suspended from duty from the 8th of November until November 23, suspension being disciplinary action taken by Ch#:ef of Police Paul W. kern, a copy of letter for grounds. being attached to said letter. Thereupon it was moved by Councilman Shrock and seconded by Councilman Meyer that such suspension be gratified by the City Council. All members of the City Council present voting aye, the Mayor declared the motion duly carried. A communication was received from Western Housing Company offering to purchase Lpts 19. and 20, Block 6, Mod,jeska Park, for the sum of ~45C.00, free and clear oP alldebt and City to clear title with the exception of the record owner, said company being the record owner. Said. offering being within the appraisal and said firm being the record owner, it was moved by Councilman Shrock and seconded by Councilman Meyer that said Lots be sold for said amount to Western Housing company as per offer. ORAL COMMUNICATIONS: Mr. Fred ~-inn addressed the Council requesting that bet- ter marking be maintained to safe-guard the children attending the Central Elementary School at Platt and Bullis Road, submitting a petition requesting the following measures: 1. Painted ero~sswalk on Bullis Road. 2. School crossing signs painted. on Bullis Road (Slow--School Cros~ing ahead) 3. fetal figure of a child to stand in the crosswalk 4. Crossing guard during school hours; a1_so Mr. 9Pinn stated that action need be taken for crossing at Century and Bu~.lis Road. There being no ob~ectipn, said matter ~~~ s referred to Administrative Officer Shannon for checking and action. Mr. C. E. Williams addressed the Council ~n the matter of the lights that have only partially been installed in Tract 8716, inquirying whin the Edison Company will complete installation. The City Manager was directed. to check into the matter. ~~~ UNFINISHED BUSINESS:- A communication was received from George C. Shannon, Ad- ministrative i'fic~.er repor~ing on bid of Roscoe Moss Co. to dri]~1 a water well No. 9 in the ity of Lynwood, stating that he would recommend that the bid be accepted and that the contract be let to said company. Thereupon it was moved by Councilman Tucker and seconded by Councilman Meyer that said. recommendation be accepted and that the well be drilled at the. location to be decided at a 3ater date, and that the Mayor be authorized to execute a contract therefor. A cammuni~ation was received.from City Engineer Graves reporting on the cost of paving of alley between Sanborn and Mulford Ave. and other alleys. It was moved by Councilman Tucker and seconded by Co ncilman Shrock that said matter be referred to Administrator Shannon for study and appropriate action, and if there is money available in the budged to do. the work.. All mem- bers of the City Council present voting aye, the 1~iayor declared the motion duly carried. A communication was received from City Engineer Graves reporting on the water condition of Caress St., between Century E~lvd..and Fernwood, stating that there is no permanent solution un- til adequate underground drainage is established, however, that it will be helped when Hunsaker installs sidewalks and curbs in his subdivision. ~`"~~~ ~' A communication was received from Administrator George C. Shannon to the effect that the mutual aid plan submitted by the Los Angeles County Disaster Relief Authority has been gt~died and found to be an appropriate plan, which, in his opinion, the Coun- cil of Lynwood should approve, as in the. event of unusual disaster the City will obtain aid automatically from the County and joining community, without additional expense. jhereupon it was moved by Councilman Tucker and seconded by Councilman Meyer that the City Council approve said plan. _ Roll Call: Ayes; Councilmen Shrock, ~`eyer, Tucker and Wiggins. Absent: Councilman Looney. The City Clerk stated that he had contacted the owner of Lot 151, Tra.~t 10503 and that.it may be purchased by .the City of Lynwood for the sum of600.00, free and clear. Thereupon it was moved by councilman Tucker and seconded by Councilman Meyer that the City purchase said Lot for Baid amount from the owner. It was moved by Councilman Meyer and seconded by Council- man Shrock that the City Attorney be instructed to commence vacation proceedings covering the intersection ad,~acent to said Lot 151, Tract 10503 as ~xisting westerly and northerly from said Lot. Warren Co. to make this survey at their bid price of X500.00. Thereupon it was moved by Councilman Shrock and seconded by Tucker that such contract be entered into with Warren Co. Garatan~ re- questing temporary permission to move a real estate office on Long Beach Blvd., between Tweedy Blvd. andState St., exact location not having yet been determined, size of building to be 12 x 18 feet. No action was taken on this matter until more difinite information may be obtained as to exact location. A communibation wa.s received from the L. B. Cor~~truction Co., by C. !~. Beck making application to have his permit to operate a sales lot for selling ready cut houses transferred from Tweedy and Long Beach Blvd. to Lots 124 and 125, Tract ?046. Thereupon it was moved by Councilman Shrock and seconded by Councilman Meyer that permission be granted on the same basis as former permit with the ~~~ addition of another X100.00 deposit for display of both garage and house on said Lots. All members of the City Council present voting aye, the Mayor declared the motion duly carried. • A communication was received from Eilert Voge, submitting Sheet l and Sheet 2, Surveyor's Map of Tract 13633, being a sub- divi sion of a portion of Lot 8, of Downey and Hellman Tract, to- gether with proposed tract restrictions. Thereupon, sAd Tract Map was displayed. It having been determined that the Map had been approved by the Planning Commission of Lynwood, it was moved by Councilman Shrock and seconded by Councilman Tucker that said map be approved by the City Council, together with restrictions that included ra- cial restrictions, with the understanding that sewers be installed in `he Tract; that streets, gutters, curbs, and sidewalks be con- structed to conform with requirements of the City Engineer's office.
