HomeMy Public PortalAboutM 1946-05-21 - CC~~~ REGULAR MEETING N1AY 21, ~,94~ The City Council of the City of Lynwood met in a ~ ' regular session in the Council Chamber of the City Ha11, 11331 Plaza Street, on' above date at '7:30 P. Pdt. ' Pnayor Doty in the chair. Councilmen Shrock, th'illiams, Jensen, Wiggins and Doty answered the roll call. It was moved by Councilman Shrock and seconded by Councilman Jensen that the minutes of the previous regular meeting of May 7, 1946, be approved as written. All members of the City Cou ncilm voting aye, the ft4ayor declared the motion duly carried. A communication was received from the Lynwood Progress- ive League signed by Herman E. Nesbitt with proposed resolution recommending extension of the O• P. A. attached; said league requesting that the Council take favorable action on said res- o1~ut~ion. City Attorney Barnes informed the Council that it was not a municipal action. Councilman Shrock inquired why it wasn't and stated that other cities have done so. It was moved by Councilman ~~'iggins, seconded by Councilman Jensen that said communication be tabled. Roll Call: Ayes: Councilmen Doty, Jensen, Wiggins and Williams. Noes: Councilman Shrock. A communication was received from the W. I, Hollings- worth Company requesting hearing before granting any other pro- posed business zones in this area. It was moved by Councilman Wiggins and seconded by Councilman Williams that said communication be filed. All members of the City Council voting aye, the Mayor declared the motion duly carried. A communication was received from City Engineer Graves in regard to the weed abatement work showing the total costs and the breakdown cost as per size of lot. It was moved by Council- man Wiggins and seconded by Councilman Shrock that said report be accepted. A petition was received signed by Mrs. Beverly Jones, 10925 Otis Street and seventeen others requesting sidewalks, curbs, gutters, and driveway aprons on Otis Street between Imperial Highway and Abbott Road, excepting the Upston Tract. It was moved by Councilman Williams, seconded by Councilman Wiggins that said petition be ref erred to the City Engineer. All members of the Council present voting aye, the Mayor declared the motion duly carried. An application from John Kazarian for trash hauling license under Section 46~- of Ordinance No. 418 was received, said application meeting all the requirements of said ordinance. It was moved by Councilman Wiggins and seconded by Councilman Jensen that the application be accepted and license granted. All members of the City Council voting aye, the Mayor declared the motion duly carried. The City Engineer's Report on petition for cement curbing on Cornish Avenue, Block B, Tract 11269, was submitted, reporting that only 42.8 per cent of the listed property owners were on the petition. Councilman Shrock inquired if 51 per cent was mandatory. Attorney Barnes ruled that it wasn't but was preferable to save protests at a later date, throwing the proceedings out. It was moved by Councilman Williams, seconded by Councilman Jensen that said petition should be referred back to the Engineer, requesting that department to contact the petitioners and find out if they could get more signatures. All members of the City Council voting aye, the PJtayo r declared the motion carried. A communication was received from the Lynwood. Playground and Recreation Commission requesting that the City Council appoint the City Treasurer to audit the books of the old Lynwood. Play- ground and Recreation Committee so that the new Commission will be able to operate. It was moved by Councilman Shrock, seconded by Councilman Williams, that the City Treasurer be instrracted to audit said books and report his findings. All members of the City Council voting aye, the Mayor declared the motion carried. CITY MANAGER'S F.EPORT: Report on the nursery school located at State and Imperial Highway inforred the Council that the Federal Government ~~a~. had filed condemnation proceedings against the property on which the nursery school is built, said property being c9.ty owned. The only way to stop condemnation proceedings is to purchase said building. The Manager pointed ot~t that the 1945 appraisal on the property was approximately X5,000.00 and the present value~is pro- bably higher and if the condemnation proceedings go ahead, the City would undoubtedly realize very little. It .was moved by Councilman Jensen, seconded by Councilman Shrock that the City Manager be authorized to negotiate with the Federal Government for the purchase of said nursery school building. Roll Call: Ayes: Councilmen Doty, Jensen, Shrock, Wiggins and Williams. _ Noes: None. ~ The City Manager presented two applications 'to sell ice cream from a vehicle at the schools and park. Ordinance No. 404 of the City of Lynwood require's councilmanic action on said~appli- cations. It "was moved by Councilman ti~~iggins, 'seconded by Councilman Jensen that the City Manager contact the P. T. A. as to their approval for such applications and report back to the Council. All members of the City Council voting aye, the Mayor declared the motion duly carried. The Cit"y Clerk addressed the Council informing them that it wotald be necessary to clear up the last remaining tax deeded lots with the County of Los Angeles, to transfer funds in the amotant of X4335.81 from the Special Assessment and Tax Relief Fund to the Tax Deeded Land Fund, such money to be repaid to the Special Assess- ment and Tax Relief Fund when money still owing Tax Deeded Land Fund from the purchasers of said lots is received. Tt was moved by Councilman Wiggins, seconded by Councilman Shrock that such transfer be authorized. Roll Call: T Ayes: Councilmen Doty, Jensen, Shrock, Wiggins and Williams. Noes: None. Thereupon Resolution No. 1958, entitled "RESOLUTION OF THE CITY COUNCIL OF TH'E CITY OF LYN4ti~00D REPORTING ON THE SALE OF TAX DEEDED PROPERTY AS REQUIRED BY AGREEMENTS NUMBERED 159, 173 AND 275 BETWEEN THE COUNTY OF LOS ANGELES AND THE CI'1:'Y OF LYNV6'OOD, was read. It was moved by Councilman Wiggins and seconded by Councilman Williams that said resolution be adopted. Ro 11 Call : Ayes: Councilman Doty, Jensen, Shrock, Wiggins and Williams. ' Noes: None. An ordinance of the City of Lynwood to amend Ordinance No. 422, Section 5, Sub-section A2 by adding a new section thereto, to be known as Sub-section A2(a) to provide for a second dwelling in an R-2 zone was read for the first time. It was moved by Councilman Shrock, seconded by Councilman Williams that said ordinance be accepted as read and Hass to the second reading. Roll Call: Ayes: Councilmen Doty, Jensen, Shrock, Wiggins and ~ Williams. ' Noes: None. ' The hour of 8 P. M. having arrived, said hour being the time fixed for receiving any and all bids in connection with purchase of cad iron pipe and one pump as per specifications and as per notice published in the Lynwood"Press as required by law. The Mayor announ- ced that this was the time and place for receiving bids, inquiring if there was anyone present who wished to submit a bid. There was no response. The City Clerk stated that four bids had been filed with him. Thereupon, it was moved by Councilman ~liggins, seconded by Councilman Shrock, that the bids be publicly opened, examined and declared. Thompson of 2,656 East 108th Street addressed the Council in regard to Tract 5418, commonly known as Palomar, as to why it was zoned R-1 and what they could do to have it zoned at least to R-2... Councilman Shrock inquired the size of the lots in that tract. Mr. Thompson stated that they are 40 x 135 feet. Councilman Shrock informed him that size would not allow sufficient room for R-2 zoning but with ,joining two lots it might be done. Mr. Thompson was also informed that applictttion for change of zone should be referred to the Planni-ng Commission. Mr. 'Thompson also inquired why there were no street lights at Fernwood and Alameda as they are badly needed. He was informed by the City Manager that he is in contact with the Edison Company in regard to lights at that point. Mr. Thompson inquired as to whether Almas' House Moving Company was infringing on the zoning ordinance at their location on Century, explaining that they have a f enced yard extending back into R-1 district that they use for storage of trucks and other things pertinent to •their business. Mayor Doty stated that the Council would have the Manager look into it and see what the situation is. The City Manager explained that he had already looked into it and that they are using an R.-1 lot •and that it is an infringement and they are trying to get a court decision as to how to cope with it, to set a precedent for other similar cases. Mr. Thompson inquired as to why McKittrick Corporation are making bricks in an R-1 Zane. The City Manager stated that the bricks being made for for the houses that are to be built on the two lots where the manufacturing; is taking place and that the Police Department is checking to see that no material is being manufactured for resale. Mr. Louis Fisher, Chairman of the Chamber of Commerce Aviation Committee, of 3241 Virginia, presented a letter to be read, said letter requesting permission to hold a demonstration of the latest models of personal aircraft at the tract of land commonly known as the Hollingsworth Tract. It was moved by Councilman Shrock, seconded by Councilman u'iggins that such permission be granted. All members of the City Council voting aye, the A,7aynr declared the motion duly carried. Whereupon, Mr. James Osborn, 11038 Eve Avenue, addressed the Council and stated that he was absolutely opposed to such a demonstration and that the property owners in the district, if necessary, would get a restraining order preventing same from taking place. Ms. Carl A. Bristol, 4044 Morton Road, addressed the Co~zncil in agreement with Mr. Osborn's remarks and suggested that before any such air show be allowed that there be a vote by the people. lUlr. Mr. Bagdanski of 1261'6 Elmdale Avenue, Compton ( County ) addressed the council to the effect that he was of the impression that annexation proceedings weinstosuchinroceedidg$t tonight's meeting and that he had a petition aga P Councilman Shrock informed him that no such procedure was to be taken. Whereupon, he insisted on leaving his petition which was followed by ten others. After a discussion they agreed to retain their petitions until they-were needed. A communication was received from Cross Town Bus Lines in regard to 'a change of bus route. Yhereupon, Gouncilman Wiggins stated that i:t should have gone on the agenda for any proper action. Councilman Wiggins made a motion, which was seconded by Councilman Jensen, that 'said matter be referred to the City Manager. All mem- bers of the City Council voting aye, the Mayor declared the motion duly carried.' Mr.' Maore, 11411 Long Beach Blvd., addressed the Council in regard to 'stop signs or signals at Long Beach Blvd. at Mulford and Fernwood,' explaining the danger involved in crossing Long Beach B?lvd. at those two intersections. The City Manager explained that the Chief of 'Police is investigating the traffic situation at said intersections. Chi.:f Kerr being present, explained that if it were requested, at the next meeting he would give a detailed report as to past results and proposed new regulations regarding the two inter- sections. TYie City Manager said that he would have a report on the situation for the next meeting. A corporation quitclaim deed signed by the Sterling Com- pany, whereby they convey their interest in and to the South 42 feet of the easterly one-half of Lot 4, Mod,jeska Acres to the City of Lynwood, was `submitted. This is the proposed site for the cityts new Esther Street water well. It was moved by Councilman Wiggins, seconded by Councilman Shrock that said deed be accepted and that the City Clerk be directed to cause said instrument to be recorded in the Office of the Recorder of Los Angeles County. All members of the City Council present voting aye, the Mayor declared the motion duly carried.' A quitclaim deed signed by Perle Rose Davis, also known as Perle R. Davis, whereby she conveys her interest in and to all !^ of that portion of Lot 483 of Tract 2551, i'n the City of Lynwood, Count~t . of Los Angeles, State of California, as per map recorded in Book 24, Pages 78, 79 and 80 of Maps in the office of the County Recorder of said County, described as follows: Beginning at the NE corner of 'said lot; thence southerly along the east line of said lot, 50 feet; 'thence westerly and parallel with the north line of said lot, 80 'feet; thence northerly 50 feet to the north line of said lot; thence easterly along the north line of said lot, 80 feet to the point of beginning, was submitted. It was moved by Councilman Shrock, seconded by Councilman Williams that said deed be accepted and that the City Clerk be directed to celuse said instru- ment to be recorded in the office of the Recorder of Los Angeles County.
