HomeMy Public PortalAbout19991115REGULAR COUNCIL MEETING NOVEMBER 15, 1999 CALL TO ORDER The Regular Council Meeting of November 15, 1999, was convened at 7:30 P.M. by Mayor Tom Rackers. Prayer was offered by Councilman Carl Jaynes, followed by the Pledge of Allegiance. ROLL CAL The following Council Members were present for the roll call: Present: Blaney, Jackson, Jaynes, Landwehr, Nelson, Nilges, Stella, Vincent, and Vogel Absent: Weber A quorum was declared present. Mayor Tom Rackers stated that if there were no objections from Council, he would like to move Resolutions up on the agenda at this time so those persons being honored by those resolutions could leave after the presentation. There were no objections to Mayor Rackers' request. RESOLUTIONS Rezoning 1006 Geneva Street from RC (Conservation District) to RS -2 (Single Family Residential) — Charles Lansford, Interim Director of Planning & Code Enforcement, made a presentation outlining the background of the request for rezoning. Following Mr. Lansford's presentation, no one present wished to speak in favor of, or opposition to, the request for rezoning. Mayor Tom Rackers declared the public hearing concluded. Rezoning northeast corner of 1.0 acre tract of land located at 1907 E. McCarty Street from RS -2 (Single Family Residential) to C -4 (Planned Commercial) — Charles Lansford, Interim Director of Planning & Code Enforcement, made a presentation outlining the background of the request for rezoning. Following Mr. Lansford's presentation, no one present wished to speak in favor of, or opposition to, the request for rezoning. Mayor Tom Rackers declared the public hearing concluded. PRESENTATIONS FROM STAFF AND CONSULTANTS Mr. Frank Newell,, President of the Cable Quality Commission, made a presentation detailing the current goals, achievements and activities of the Commission. He also REGULAR COUNCIL MEETING NOVEMBER 15, 1999 explained briefly the status of cable television in the city since the acquisition of ICI by AT &T, and what that acquisition might mean to Jefferson City cable subscribers. He stated that Jefferson City is far ahead of even the larger cities in the state where fiber optic installation is concerned. CONSENT AGENDA The following items were presented for approval on the Consent Agenda: a. Minutes of November 1, 1999 City Council Meeting b. Permissive Use of Right -of -Way at Lot 49 (Meadows by the Club) c. Permissive Use of Right -of -Way (Freeman) A motion was made by Councilman Larry Vincent to approve the Consent Agenda as presented, seconded by Councilman Leonard Stella, and approved unanimously. MINUTES AND REPORTS RECEIVED & FILED Mayor Tom Rackers announced that the following reports have been received and are on file for public viewing in the City Clerk's Office: a. Firefighter's Retirement System, July 29, 1999 b. Cable Quality Commission, June 17, 1999 and September 16, 1999 c. Historic Preservation Commission, August 24, 1999 & September 28, 1999 d. Board of Adjustment, October 12, 1999 e. Parks &Recreation Commission, October 11, 1999 ANNOUNCEMENTS BY THE MAYOR Mayor Tom Rackers announced that he was very impressed with the recent State Cross Country competition held in Jefferson City, and commended our Parks & Recreation Department for the hard work they put into sponsoring such a successful event. He also thanked the Elks Club for serving food during the event, and to the parents and other city employees who participated in that event. Mayor Tom Rackers announced that he and City Administrator Rich Mays had visited with the City officials of Columbia, Missouri to learn what things that city is doing that our city could also benefiically do in Jefferson City. MAYORAL APPOINTMENTS REGULAR COUNCIL MEETING NOVEMBER 15, 1999 Mayor Tom Rackers made the following recommendation for appointment to the Jefferson City Police Department: Police Officer — Anthony Ferrell A motion was made by Councilman Carl Jaynes for approval of the appointment as presented, motion was seconded by Councilman Rick Nilges approved unanimously. BILLS INTRODUCED Bill 99 -78, sponsored by Councilman Vincent, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO ENTER INTO A SUPPLEMENTAL AGREEMENT WITH THE MISSOURI DEPARTMENT OF TRANSPORTATION FOR PEDESTRIAN /BICYCLE FACILITIES. Bill 99 -79, sponsored by Councilman Vincent, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO ENTER INTO A SUPPLEMENTAL AGREEMENT WITH THE MISSOURI DEPARTMENT OF TRANSPORTATION FOR PEDESTRIAN /BICYCLE FACILITIES. Bill 99 -80, sponsored by Councilman Landwehr, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH CAPITAL MAINSTREET, INC. FOR DOWNTOWN BEAUTIFICATION PLAN. Bill 99 -81, sponsored by Councilman Blaney, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING ACCEPTANCE OF THE TRANSFER OF WOODLAND CEMETERY TO THE CITY. Bill 99 -82, sponsored by Councilman Jackson, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, DECLARING CERTAIN PROPERTY AS SURPLUS AND AUTHORIZING THE DISPOSAL OF SAID PROPERTY. REGULAR COUNCIL MEETING NOVEMBER 15, 1999 Bill 99 -83, sponsored by Councilman Blaney, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, DECLARING CERTAIN PROPERTY AS SURPLUS AND AUTHORIZING THE DISPOSAL OF SAID PROPERTY. Bill 99 -84, sponsored by Councilman Blaney, entitled: AN ORDINANCE AMENDING THE CODE OF THE CITY OF JEFFERSON, MISSOURI, SECTION 19 -401, (STREETS AND HIGHWAYS), SCHEDULE (J), (PARKING PROHIBITED), SUBPARAGRAPH (A), BY THE ADDITION OF A PORTION OF JACKSON STREET. Bill 99 -85, sponsored by Councilman Jaynes, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING CHAPTER 8 OF THE CODE OF THE CITY OF JEFFERSON, MISSOURI, TO PROVIDE FOR THE LICENSING OF ELECTRICAL MAINTENANCE PERSONNEL. Bill 99 -86, sponsored by Councilman Jackson & Vincent, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, VACATING AND DISCONTINUING A PORTION OF AN UNNAMED RIGHT -OF -WAY OF HICKEY'S SUBDIVISION, COMMONLY KNOWN AS ROMAR PLACE AND GRANTING A LICENSE TO UTILIZE CITY OWNED PROPERTY FOR CERTAIN PURPOSES. Bill 99 -87, sponsored by Councilman Nilges, Blaney, and Nelson, entitled: AN ORDINANCE AMENDING, SECTION 22 -74 OF THE CODE OF THE CITY OF JEFFERSON, MISSOURI, PERTAINING TO PARKING FEES, AND SECTION 1 -13(E) PERTAINING TO GENERAL PARKING. Councilman Rick Nilges requested that the rules be suspended and Bill 99 -87 placed on third reading and final passage. There were no objections to the request for suspension of the rules. Bill 99 -87 was then third time by title and placed on final passage. Following a brief presentation from City Administrator Rich Mays regarding recent meetings with downtown merchants, and explaining recommended amendments contained in a Substitute Bill 98 -87 which was distributed to Council immediately prior to the meeting. Rick Nilges made a motion to amend the bill by changing 22 -74 to 50¢ for the first four hours and $1.00 each hour thereafter, and also change the 10¢ validation charge to a $5.00 per month flat rate. Motion was seconded by Councilman John Landwehr. Following discussion, Councilman Rick Nilges withdrew his motion, Councilman John Landwehr withdrew his second. REGULAR COUNCIL MEETING NOVEMBER 15, 1999 Councilman Larry Vincent requested that if these amendments are made, that the motions be made on each issue individually. A second motion to amend was made by Councilman Rick Nilges to change 22 -74 to 50¢ the first 2 hours and $1.00 each hour thereafter, not to exceed $6.00 per day. Councilman Carol Blaney seconded the motion, and motion was approved unanimously. Councilman Rick Nilges moved to further amend bill 99 -87 by changing the 10¢ charge per validation to a $5.00 per month flat rate. Motion was seconded by Councilman Carol Blaney and approved with Councilman Bob Weber voting "Nay." Councilman Steve Nelson moved to accept Substitute Bill 99 -87, as just amended, in lieu of the previously distributed Bill 99 -87, motion was seconded by Councilman Rick Nilges approved by the following roll -call vote as Ordinance 12995: Aye: Blaney, Jaynes, Landwehr, Nelson, Nilges, Stella, Vincent, and Vogel Nay: Weber BILLS PENDING There were no bills pending before the Council at this time. NEW BUSINESS Councilman Larry Vincent moved that Staff review the impact of Bill 99 -87 on the downtown area and on the security of the City's bond covenant which was passed tonight, and report back to the Council with its findings in six months. Motion was seconded by Councilman Steve Nelson approved unanimously. UNFINISHED BUSINESS Councilman Carol Blaney announced that a public hearing will be held on November 17, 7:00 PM, in Room 490 of the Truman State Office Building, to get public input regarding the use of the old Jefferson City Correction Center facility (JCCC). COUNCIL LIAISON REPORTS Councilman Larry Vincent announced thatthe Environmental Services Committee meetings have been canceled until January. EXECUTIVE SESSION MINUTES November 1, 1999 Executive Session Minutes — A motion was made by Councilman Rick REGULAR COUNCIL MEETING NOVEMBER 15, 1999 Nilges for approval of the minutes, seconded Councilman Larry Vincent, and approved unanimously. ADJOURN MENT There being no further business to come before the Council at this time, Councilman Steve Nelson made a motion to adjourn, seconded by Councilman Carol Blaney, and approved unanimously at 8:35 P.M.
