HomeMy Public PortalAbout19991220REGULAR COUNCIL MEETING DECEMBER 20, 1999 CALL TO ORDER The Regular Council Meeting of December 20, 1999, was convened at 7:30 P.M. by Mayor Tom Rackers. Prayer was offered by Rev. Mauricio Vargas, Interim Pastor of Spanish Baptist Mission, followed by the Pledge of Allegiance. ROLL CAL The following Council Members were present for the roll call: Present: Blaney, Jackson, Jaynes, Landwehr, Nelson, Nilges, Stella, Vincent, Vogel and Weber Absent: None A quorum was declared present. ANNOUNCEMENTS BY MAYOR Mayor Tom Rackers announced that if no one had any objections, he wished to move Mayor's Announcements up on the agenda at this time to accommodate recipients of the honor being bestowed upon them. No objections were voiced. Ralph Etter Family — Mayor Tom Rackers read a proclamation which was presented to the Ralph Etter family for their contribution to the community and the Spirit of the Christmas season for the past several years. Mr. & Mrs. Etter were present to accept the proclamation and thanked Mayor Rackers and the City Council for the honor. The Etters have played "Mr. and Mrs. Santa Claus" from their home for the past several years, greeting people who come to see them and handing out over 10,000 candy canes over this period. PUBLIC HEARINGS Rezoning approximately 7.41 acres on east side of East McCarty (2931 E. McCarty) from RS -2 (Single Family Residential) to M -1 (Light Industrial). Janice McMillan, Senior Planner, made a presentation outlining the background of the request for rezoning. Following Ms. McMillan's presentation, no one present wished to speak in favor of, or opposition to, the proposed rezoning. Mayor Tom Rackers declared the public hearing concluded. Rezoning Lots 8 and 9 of Lower Jefferson Subdivision and 12 feet of vacated REGULAR COUNCIL MEETING DECEMBER 20, 1999 W. Miller St. right -of -way (420 Brooks St.) from RD (Two - Family Residential) to C -2 (General Commercial). Janice McMillan, Senior Planner, made a presentation outlining the background of the request for rezoning. Following Ms. McMillan's presentation, no one present wished to speak in favor of, or opposition to, the proposed rezoning. Mayor Tom Rackers declared the public hearing concluded. Rezoning portions of a 132.55 acre tract located along proposed W. Edgewood Dr. Extension, south of Sherwood Drive & Country Ridge Road, east of Graystone Drive and west of Picketts Run from RA -1 (Multiple Family Residential) to RS -1 (Single Family Residential), C -O (Office Commercial) and C -2 (General Commercial). PRESENTATIONS FROM STAFF AND CONSULTANTS Finance Director Steve Schlueter made a presentation regarding the status of Y2K compliance. His report indicated that all city departments are now fully Y2K compliant. Mr. Lonnie Brandt, representative of the Firefighter's Retirement Board, made a report regarding the fund's organization, functions, and explained how the fund works for its members. CONSENT AGENDA The following items were presented for approval on the Consent Agenda: a. Minutes of December 6, 1999 City Council Meeting b. (RENEWAL) Bid 1731 — Uniform Purchases, Fire Department c. Approval of Demolition of Property at 1121 Park Avenue A motion was made by Councilman Rick Nilges to approve the Consent Agenda as presented, seconded by Councilman Charles Jackson, and approved unanimously. BIDS OVER $25,000 Bid 1851 - Granulated Quicklime, Waste Water Division — A motion was made by Councilman Charles Jackson for approval, seconded by Councilman Carl Jaynes approved unanimously. REGULAR COUNCIL MEETING DECEMBER 20, 1999 MINUTES AND REPORTS RECEIVED & FILED Mayor Tom Rackers announced that the following reports have been received and are on file for public viewing in the City Clerk's Office: a. Planning & Zoning Commission, November 18, 1999 b. Report of Planning & Zoning Commission's approval of Conditional Use Permit for erection of cellular tower on northeast corner of 3518 N. Ten Mile Drive. c. Firefighter's Retirement System, October 28, 1999 d. Electrical Board, May 21, 1999 e. Historic Preservation Commission, October 26, 1999 f. Public Works & Planning Committee, December 6, 1999 g. Parks & Recreation Commission, November 8, 1999 h. Appointment Review Committee, November 15, 1999 Cable Quality Commission, October 21, 1999 j. Finance Report for November, 1999 Councilman John Landwehr mentioned Item (b), the report on cellular towers. A lengthy discussion was held on issues such as aesthetic appearance, safety, maintenance. Ms. Janice McMillan, Senior Planner, gave an oral report and answered questions regarding the towers. She explained the process by which companies obtain permits to build these towers, and the regulations governing their safety and maintenance. BILLS INTRODUCED Bill 99 -92, sponsored by Councilman Nilges, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING VARIOUS SECTIONS OF THE PERSONNEL POLICY MANUAL FOR THE MUNICIPAL SERVICE OF JEFFERSON CITY, MISSOURI. Bill 99 -93, sponsored by Councilman Nilges, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH MARSH USA, INC., FOR EMPLOYEE BENEFIT BROKER SERVICES. REGULAR COUNCIL MEETING DECEMBER 20, 1999 Following a presentation by Human Resources Director Gail Strope, several Council Members asked questions regarding the process which will be used, and requested the Council receive periodic reports on the progress. Ms. Strope stated that the requested information would be provided. Councilman Jaynes requested that Bill 99 -85 be removed from the Informal Calendar and placed on final passage at this time. Councilman John Landwehr moved to amend Bill 99- 85 by inserting the definition "dwelling unit" in Paragraph H, subparagraph (1), motion was seconded by Councilman Rick Nilges, and approved unanimously. Bill 99 -85 was then read third time by title, placed on final passage and passed, as amended, by the following vote as Ordinance 13007: Aye: Blaney, Jackson, Jaynes, Landwehr, Nelson, Nilges, Stella, Vincent, Vogel and Weber Nay: None Bill 99 -86, sponsored by Councilman Jackson & Vincent, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, VACATING AND DISCONTINUING A PORTION OF AN UNNAMED RIGHT -OF -WAY OF HICKEY'S SUBDIVISION, COMMONLY KNOWN AS ROMAR PLACE AND GRANTING A LICENSE TO UTILIZE CITY OWNED PROPERTY FOR CERTAIN PURPOSES. Councilman Larry Vincent requested that Bill 99 -86 be removed from the Informal Calendar and placed on final passage at this time. Bill 99 -86 was then read third time by title, placed on final passage and passed by the following vote as Ordinance 13008: Aye: Blaney, Jackson, Jaynes, Landwehr, Nelson, Nilges, Stella, Vincent, Vogel and Weber Nay: None REGULAR COUNCIL MEETING DECEMBER 20, 1999 NEW BUSINESS The Council recognized News Tribune reporter Dave Fults, and mentioned that this will be his last Council meeting to cover. He has accepted a position with the City of St. Peters, Missouri. The Mayor and Council wished Dave well in his new position. UNFINISH ED BUSINESS Councilman Charles Jackson stated he has received several calls from citizens regarding the quality of reception on cable tv, specifically the weather channel. He asked staff to relay his comments to the local cable company. Councilman John Landwehr mentioned the hazardous highway conditions on East Highway 50 between Clark Avenue and Eastland Drive. He stated that some meetings have been held, but encouraged staff to continue pursuing this issue until some positive action is taken by the Highway Department to alleviate the dangerous conditions there due to the lack of a median between the highways. COUNCIL LIAISON REPORTS There were no Council liaison reports made at this time. ADJOURN MENT There being no further business to come before the Council, Councilman Charles Jackson made a motion to adjourn, seconded by Councilman Carol Blaney, and approved unanimously at 9:05 P.M.
