ADJUURiVED REGULAR Y~IEETING OCTOBER 2,9, 1946
The City Council of the City of Lynwood met in an adjourned
regular session in the Council Chamber of the City Hall, 11331 Plaza
Street, Lynwood, on above date at 7:30 P. Pal.
Mayor Doty in the chair. •
Councilmen Doty, Shrock, `Wiggins, and 'Williams answered
the roll call.
Councilman Jensen was absent.
It was moved by Councilman Shrock, seconded by Councilman
Jlrilliams, that the minutes of the previous adjourned regular meeting
of October 22 be approved as written. All members of the City Council
present voting aye, the Pt~2~„yor declared the motion duly carried.
A request to operate a Christmas tree lot, made by C. T.
Stanley, was read, asking permission to operA.te at the northwest
corner of P~ulford and Long Beacri Boulevard. It was moved by Council-
man Williams, seconded by Councilman Shrock, that permission be
granted sub,je~ct to the policy previously outlined. All members of
the City Council present voting aye, the P,~ayor declared the motion
duly carried.
A communication from B. PR. P~~illion requesting permission
to operate a Christmas tree lot on the Prior beast corner of ~rJisconsin
and Long Beach Boulevard was read. It was moved by Councilman
V`diggins, seconded by Councilman Shrock, that permission be granted
subject to the policy previously established. All members of the
City Council present voting aye, the ~~~a~ror declared the motion duly
carried. •
A communication was read from Leonard S. Barnes, stating
his physical inability to continue as City Attorney, agreeinn• to
continue until services of another attorney can be secured, requesting
that he be able to complete bond proceedings already pending on wrich
most of the work has been completed-. It was moved by `Councilman
'Williams, seconded by Councilman '~~i~;gins, tYrat the resignation be
accented with regrets, subject to the completion of the bond proceed-
ings. All members of the City Council present voting aye, •the ?~.a,yor
declared the motion duly carried.
It was moved by Councilman Shrock, seconded by Councilman
~Yilliams, that the I~4anager investigate and present to the Council at
their next meeting suggested names for consideration as City Attorney.

The Clerk presented a Quitclaim Deed signed by H. A1. C.ytron
and Louise. F. Cytron whereby they convey their interest in and to
Parcel 1, Licensed Surveyor's Tract to the City of Lynwood. Tt was
moved by Councilman WJi~;~•ins, seconded by Councilman Shrock, that
said deed be accepted and that the City Clerk be instructed to cause
said. instrument to be recorded in the office of the Recorder of Las
Angeles County, California..

The Clerk presented a ,judgment nuieting title of Lots 2,
3, 4, and 5 of Block 18, Pt~od,jeska Park. It was moved by Councilman
Shrock, seconded by ~Cou.~cilm~~.n 'Williams, that said instrument be
accented and the Cit~j Clerk instructed to cause same to be recorded
in the office of t~~.e~ Recorder 'of ins Angeles County, California.

Transfer of general liquor licensQ notification was pre-
sented, transferring liquor license from Isabelle Talbert to Anna
and Frank Haller. It wa•s moved by Councilman 'Williams, seconded
by Councilman Shrock, that said notification be filed .• All members
of the City Council present voting aye, the iVIayor declared the
motion duly carried.
The b,2anager reported on specifications for hanc?i-crane
needed in the '+~ater Department for pipe laying. He pointed out the
need for such a crane s.nd. that the City has heretofore been bog^row-
in~ one from a local plumber.... It was moved by Councilman '~lilliams,

A communication ~~~as read from the T~ational Citizens
Political Action Committee ebjectin~ to the sales tax. It was moved
by Councilman Shrock, seconded by Councilman `~~'illi~ ms, that the
communication be filed. All mpmbors of the City Council present
voting• aye, the ,~~ayor declared the matron duly carried.
The ;~ayor inquired ~.f there yea s anyone there in regard
to the Letter read. There eras no response.
' 'tghereupon, '~Jillia.m Cormier of 315 S. Rampart Bauleva,rd,
owner of th.e Lynwood T~~u~~;ic Center, stated that he was Chairman
of the Cons~~mers and T.ercha.nts Committee and. as such was expressin~•
an opinion of UT1aniPilGUS adoption of tr~a.t organization. He stated y
that they did not' ael eve t'r_a t the time is ri~'r~t fora city sales
tax and t~~~~t action should be delayed until the State Legisl,~,ture
or su.rroundin~• communities hn.ve takeiz ~or~e action. If' not, tr:e
or~l~anization is prepare ~~. to take le~?:al action calling for referendum

'rhe Iu7ayor inquired if the organization had any suggestion
to offer, an alternate measure of raising such funds. Tti~r. Cormier
replied they did not.
The nu7ayor inquired ? f t'rere were any further oral' com-
munications, stat'in~• that this was a continuation of the second
reading of the sales tax and that now was the time and p~ ce for
such discussion.
T~2r. Gliver Kieffer, 3631 Cedar Avenue addressed the
Council.. During his remarks, t`he i~~ayor reminded him that the
subject ti~~as sales tax and to please confine his remarks to that
subject.
`~ti'hereupon, PIIr. Kieffer said he would like to present' three
letters as evid_er.ce of the results of the sales tax in Huntington
Park. The letters were from Bell Tailors, Bell, Jennings Hardware
and Supply Company, Huntington Park, and Ed D. Garner Furniture,
of Bell.
At this point the ~7ayor explained that .Walter Thiel and
Fay Loomis of Los Angeles came at the request of the City Council
and through Lhe courtesy of ~Nalter Peterson, City Clerk of Los.
Angeles; that they were brought there expressly to answer technical
question's a.t the meeting of Thursday, October 24, this meeting
haveing been called especially for technical investigation of
the ordinance.
T~Irs. 'N. E. Sulin~•, 3601 Lynwood Road, addressed the
Council and expressed the thoup°ht th~.t the Council was elected by
the people to operate the City and that until proved otherwise we
sho`~ald respect their judgment as the voice of the people and th~r.t
she felt that the sales tax was a painless way to raise money and
further, she felt tTiat putting it on the ballot would not be a
solution as citizens never will vote a tax upon themselves, that
:~,II taxes are levied by some' legislative grour~.
Tvir.Bush of Seminole Street expressed his opinion that
it should go to a vote of the people.
tutr. Bert Corolet, 3076 Lym~~ood. Road, addressed the
Council, stating he didnot oppose tre tax but didn't like the
way it vas rushed. through.
l~Tr. Taylor of 402.5 Agnes Avenue inquired if provision
had_ been made for automatic repeal in the event of State collection
of the City~s share. He ~.aas told that it wculd_ be taken care of
in proposed amendments that will be passed.
~Zr. T,:Ieyer, 333x7 Cedar Avenue, wanted to be assured that
the money would go to drainage.
Pete Economou of the L,yn-T~4art expressed his disapproval
of the tax.
TI~Ir. Janssen, 3'726 Cedar Avenue, addressed the Council,
citing the proposed -crane as an example of over-expenditure,
sug~•esting that curtailment of Duch items might solve the problem
of additional revenue.
Whereupon, Mr.-Gray, 332'7 Imperis.l Highway, inquired
what ha.d become of his request that the City acquire a c~.nnon to
be installed preferably in the Park or possibly at the City Hall as
~, war memorial. After some discussion, it was moved by Councilman
~iJilliams, seconded by Couricil`man Wiggins, that the City manager
check into possible acquisition of a cannon. All members of the
City Council present voting aye, the Mayor declared the motion duly
carried. '
The validity of the emergency measure in the ordinance was
questioned from the floor.
Whereupon, City Attorney Barnes stated that it is the
Council's prerogative to establish a state of emergency and that
any court in the land would .uphold their right to so esta blish a
state of emergency.
The ~4ayor inquired if there was any further discussion.
There was-no response.
Whereupon, Ordinance No. 440, entitled, "UNIFORM SALES
TAX ORDINANCE, COLLECTION BY CITY, AN ORDIP~ANCE OF THE CITY OF
LYNWOUI7 Ii~,hJ'OSING A LICENSE TAX FOR THE PRIVILEGE OF SELLIi~IG TANGIBLE
PERSONAL PROPERTY AT RETAIL, PROVIDING FOR PERh1IITS TO RETAILERS,
PROVIDING FOR THE COLLECTION AND PAYING OF SUCH TAX, AND PRESCRIBING
PENALTIES FOR VIULATIOIvrS OF THE PROVISIONS HEREOF, "' was read.
After the reading, Councilman Wiggins stated that in his
opinion there was no "cramming down people's throats" in this
passage; that there had been ample opportunity for public discussion
and that he further felt that the majority of people, from his
investigation, were for this measure as a "painless" way to raise
revenue. '
Whereupon, it was moved by Councilman '~M1'iggins, seconded
by Councilman ti~'illiams, tr,at said Ordinance No. 440 be adopted as
read the second time, finally pass and be published as required by
law.

It was moved by Councilman 'Nilliams, seconded by Council-
man Shrock, that the meeting adjourn to November 6, 1946 at 7:30
P. M. All members of the City Council present 'voting aye, the Nlayor
declared the motion duly carried.
