M. Mayor Doty in the chair. Councilmen Doty, Jensen, Shrock, Wiggins, and ~Nilliarns answered the roll call. It was moved by Councilman Shrock, seconded by Councilman Williams, that the minutes~of the previous regular meeting of December 3 and the special meeting of December 9 be approved as written. All members of the City Council Voting aye, the Mayor declared_the motion duly carried. A communication was received from the Recreation Commission requesting cooperation from the City as to the Christmas celebration and suggesting that the City provide a decorated Christmas tree in front of the City Hall for the celebration. It was moved by Councilman Williams, seconded by Councilman Wiggins, that the communication be filed. All members of the City Council voting aye, the Mayor declared the motion duly carried. A communication was received from Bruce Mason, attorney for the Consumers' and ~[erchants' Committee of the City of Lynwood wherein he presented a petition protesting the sales tax ordinance. The City Clerk presented his certification of sufficiency on the peti- tion wherein it was Pound there were 1340 good signatures of a total registration of 5536. It was moved by Councilman ~Ciggins, seconded by Councilman Jensen, that the petition be referred to the City Attorney for checking and written report thereon as to it,,s legality. All members of the City Council voting aye, the Mayor declared the motion duly carried. A communication from the Lynwood Chamber of Commerce ex- pressing their feelings on the sales tax matter was read. It was moved by Councilman Shrock, seconded by Councilman Jensen, that the communication be filed. All members of the City Counci_1 voting aye, the Mayor declared the motion duly carried. The hour of 8:00 P. M. having arrived, said hour being the time fixed for the continuation of the Louise Street Assessment hearing. The Mayor inquired if there were any present in regard to same. Mr. George Kennedy addressed the Council, stating that he represented the people in the district and that they request contin- uation of the hearing until the next meeting to give time to investi- gate some discrepancies in the work. Mr. Kennedy explained that the ,fob had not been done in accordance with specifications, in once instance the curb was 11~ inches instead of 15 inches in depth. Mr. Kovaeevich, the contractor, was in the audience and addressed the Council, explaining the construction, pointing out that a 15 inch curb is poured independent of the gutter and that monolithic curb and gutter, regardless of the difference in depth oP the actual curb, is better construction and recommended by the Engineer. Mr. Kennedy further pointed out that there were many sections of curb and sidewalk cracking. Mr. Kovacevich explained the reason why cracks appear when new concrete is hardening, Stating that a poor mixture will not crack but a good mixture will. He further backed up his work with a public guarantee of one year to repair any claimed defective infitallation. The Mayor inquired of the City Attorney if there was any solution to the problem. The-Cityy Attorney stated that there was c~~{;-e e ~ ~., nothing to do but confirm the.Assessment inasmuch as it had been equitably spread, the only correction that might be taken would be to reduce some and raise others but the grand total would. have to remain the same. After further discussion, RESOLUTION N0. 2016, entitled, "RESOLUTION SETTING FORTH FACTS 0~' HEARING, OVER-RULING PROTESTS AND C~:?NFIRMING ASSESSP,~ENT," was read. It was moved by Councilman Shrock,•seconded by Councilman Wiggins, that said Resolution be adopted. Roll Call: Ayes: Councilmen Doty, Jensen, Shrock, Wiggins, and Williams. Noes: None. • The Clerk presented requests for refund of weed assessment. One from E. L. Herb, 10235 Hildreth Street, South Gate, claiming for refund on Lot 41, Block 12, Tract 6436. The Weed Superintendent recommended no refund as the lot had been disked by his crews. It was moved by Councilman Shrock, seconded by Councilman Williams, that the refund be denied. Roll Call: Ayes: Councilmen Doty, Jensen, Shrock, Wiggins, and Williams. Noes: None. A similar request was presented by R. R.Romaniello for refund as to Lot 181, Tract 8716. lldr. Wallace reported there was an error in assessment and that the refund should be granted. It was so moved by Councilman Shrock and seconded by Councilman Wiggins. Roll Call: Ayes: Councilmen Doty, Jensen, Shrock, Wiggins, and Williams. Noes: none. A similar request was made by Mrs. Mildred Marsh, 2914 Poplar Drive, claiming refund on Lots 10 , 11, 12, Block 1, Mod~eska Park. Mr. Wallace stated that the first time around, as instrtzcted they refrained from disking the lots but the next time there had still been no correction of the weeds and the lot had been declared a fire hazard so the City proceeding to clean it. He recommended that no refund be granted. It was so moved by Councilman Shrock and seconded by Councilman Jensen. Roll Call: Ayes: Councilmen Doty, Jensen, Shrock, Wiggins, and William8. Noes: None. ORAL CO~dMtTNICATI0N5: Mr. Gerfen oof 10900 Standard Avenue addressed the Council, explaining that he had bought Cal Frey 's used Car lot, not knowing that 1~r. Frey's tenure of operation applied only to him and that upon application for business license it had been denied and that he was informed of this condition. He requested some relief, hoping that the Council would see fit to extend this temporary arrangement to him so his investment would not be lost. After considerable discussion it was moved by Councilman Jensen, seconded by Councilman Shrock, that a continuation of the temporary permit given Frey be allowed in favor of PJtr. Gerfen. Whereupon, Building Inspector Hall addressed•the Council stating that if they did this it would create a bad situation as a precedent had already been established for full compliance with all the regulations and that numerous other individuals have been turned down until compliance with the minimum requirements, and in several instances after being turned down, they have gone to the expense of complying. -Whereupon, Councilman Jensen withdrew his motion with the consent of his second. • After further discussion, it was moved by Councilman Williams, seconded by Councilman Shrock, that full conformance with existing regulations be required and that Mr. Gerfen's request be denied. Roll Call: Ayes: Councilmen Doty, Jensen, Shrock, Wiggins, and Williams. Noes: None. Whereupon, Mr. Holder, 11?11 Virginia, addressed the Council regarding the speed limit on Atlantic Boulevard, painting out that it was very hazardous to attempt any crossing of the boulevard either on foot or in a car, requesting that something be done to slow down traffic. The tdianager explained that inasmuch as Atlantic is a state highway the City cannot establish-any regula- tions without the State's consent and that there has been considerable pressure brought t,o bear on the State Highway Commission to correct this admitted hazard and that the State has agreed to establish traffic signals along Atlantic. Such installations are being studied by the State at this time but when it will be done is not known. It was suggested, however, that there be an effort made to secure additional Installation of speed limit signs. Whereupon, Mr. Taylor of 4025 Agnes Avenue addressed the Council in regard to speed on Agnes between Bulbs and Atlantic. Mrs Jannsen, 372fi Cedar Avenue, addressed the Council inquiring as to when the markings on a tree on Cedar Avenue, put there by the "butcher bay" gang are going to be obliterated. She was informed that it should have been taken care of already but it will be done right away. Mr. McMullen addressed the Council, asking for the opinion on the garbage question that he had requested lastmeeting. Whereupon, the City Attorney's opinion was-read wherein it was held tYzat the Veterans' Exemption does not apply to•service charges and excise taxes. After some discussion it was agreed that the Attorney should contact the.Attorney General for his opinion and report back. The Manager reported on the dog pound service bids received at the last regular meeting. Inasmuch as there was only one bid, that being from the Los Angeles Society for Prevention of Cruelty to Animals, and that upon investigation their reputation proved good., he recommended that their bid be accepted and a contract entered into. He further stated that Mr. Herman, wha operates pound service, submitted a bid this evening and asked for the Attorneys opinion as to the legality of such an act. Whereupon, Mr. LeSage stated that inasmuch as the bids had been called for no later than 8:00 P. Iu[. on Deoember 3, it could not be accepted. Y~'hereupo n, it was moved by Councilman Wiggins, seconded by Councilman Shrock, that the Los Angeles Society for Prevention of Cruelty to Animals' bid be accepted and a contract entered into as per specifications. • Roll Call: Ayes: Councilmen Jensen, Doty, Shrock, Wiggins, and Williams. The Manager reported on the cost oP living index as it applied to City salaries for the next six months from January 1, pointing out that the index for September 30, the determining point, was 145.5 for the Los Angeles area, an increase of 13 points which, at X1.40 per point, amounts to X18.20 per employee. It was moved by Councilman Jensen, seconded by Councilman Williams, that the increase of SIB.?0 as per cost of living salary ~,d3ustment•plan be ratified effective January 1. • Roll Call: . The Manager reported on the unifoz~{n curfew ordinance as recommended by the Los Angeles County Juvenile Officers' Association. He pointed out that South Gate has already passed the ordinance and that Campton will do eo at their next meeting; also that the Coordin- ating Council recommended passage of this ordinance. Whereupon, an Ordinance entitled, "AN ORDINANCE OF THE CITY OF LYNWOOD CREATING A CURFEW OF 10:00 0'C LOCK P. M., AND PRESCRIBING PENALTIES FOR THE VIOLATION THEREOF AND REPEALING ORDINANCE N0..380", was read f'or the first time. It was moved by Councilman Shrock, seconded by Councilman Williams, that said ordinance be accepted a$ read the first time and pass to the second reading.. e~~' Roll Call: Ayes: Councilmen Doty, Jensen, Shrock, 'Wiggins, and Williams. Whereupon, ORDINANCE NO. 443, entitled, "AN ORDINANCE OF THE CTTY OF LYNWOOL~, CALIFORNIA AP~IENDING ORDINANCE NO. 4~2, SECTION 4, SUB-SECTION A3, AND ADDING A SECTION THERETO TO BE KNOWN AS SECTION 4, SUB-SECTION A6 TO ALLOW "HOF:~E OCCUPATIONS" IN R-1 ZONE, " was read by caption.' It was moved by Councilman Shrock, seconded by Councilman Wiggins, that further reading be waived and said Ordinance No. 443 be adopted, finally pass and be published as required by law. Roll Call: Ayes: Councilmen Doty, Jensen, Shrock, Wiggins, and Williams. ~ Noes: None. Whereupon, an ordinance entitled, "AiJ ORDINANCE OF THE CITY OF LYNWOOD, CALIFORNIA, A1'~ENDIi~TG ORDINANCE N0. 382, SECTION 14, was read for the first time. It was moved by Councilman Williams, seconded by Councilman Jensen, that said ordinance be approved as read the first time and pass to the second reading. .Roll Call: Ayes: Councilmen Doty, Jensen, Shrock, Wiggins, and Williams. Noes: None. RESOLUTION NG. 2017, entitled, "RESOLUTION REQUESTING THE COUNTY TO CANCEL TAXES UNDER SECTION 4986 ET SEQ. OF THE REVENUE AND TAXATION CODE ON PROPERTY ACQUIRED BY THE CITY OF LYNWOOD FOR PUBLIC PURPOSES," was read. It was moved by Councilman Wiggins, seconded by Councilman Shrock, that said Resolution be adopted. Roll Call: Ayes: Councilmen Doty, Jensen, Shrock, Wiggins, and Williams. Noes: None. Planning Commission Resolution No. 10 was read wherein they approved a variance for the Lynwood School District in order that they might extend their Roosevelt School facilities. It was moved by Councilman Shrock, seconded by Councilman Williams, that the Council concur in the P]a.ming Commission's action as presented in Resolution No. 10 and that said variance be allowed. Roll Call: Ayes: Councilmen Doty, Jensen, Shrock, Wiggins, and Williams. _ Noes: None. The Clerk presented quitclaim deed and release of mortgage signed by Samuel Paul whereby he conveys his interest in and to Lots 12?5 and 1276, Tract 3335 to the City of .Lynwood. It was moved by Councilman Shrock, seconded by Councilman Jensen, that said instruments be accepted and ths.t the City Clerk be directed to cause same to be recorded in the office of the Recorder of Los Angeles County. Mr. Voge, being in the audience, stated that he was agreeable to the proposed ordinance rectifying the water main extension charge even though it wasn't what was offered hire previously but that inasmuch as his homes were nearing the com- pletion stage he would like to have a temporary main laid on the street. The Manager stated that a permanent installation could be completed within ten or twelve days. Whereupon, Mr. Voge stated that if that were the case it would be sufficient and that no temporary main would be required. The Poll awing demands were presented: GENERAL FUND J. P..
