City Council of the City of Lynwood met in a regular session in the Council Chambers of the City Hall, 11331 Plaza Street, on above date at 7:30 P. M. Mayor Doty in the chair. Councilmen Doty, Jensen, Shrock, Wiggins and Williams answered the roll call. It was moved by Gouncilman Shrock, .seconded by Councilman Williams, that the minutes of the meeting of December 17, 1946, be approved as written. All members of the City Council noting aye, the ~a.yor declared the motion duly carried. . A communication from A. J. Bateman, City Engineer, in regard to sewer installation in portions of Century Square, the City acting as escrow agent for the Century Development Co. and Bob ''~" Bosnyak. The Engineer .stated that the work had been satisfactorily . completed and that the X5,000.00 deposited shculd be paid to said Bob Bosnyak. It was moved by Gouncilman Williams and seconded by Councilman Jensen that said Engineer's report be concurred in and that a check be drawn. Roll Call: Ayes: Councilmen Doty, Jensen, Shrock,. Resolution No. 2018, entitled, "RESOLUTION OF THE CITY OF LYN'NOOD, CALIFORNIA: AUTHORIZING EXECUTION OF CONTRACT WITH THE LOS ANGELES SOCIETY FOR THE PREVENTION OF CRUELTY TO ANIMALS", was read and it was moved by Gouncilman Wiggins and seconded by Gouncilman Jensen that said resolution be adopted. Roll Call: Ayes: Councilmen Doty, Jensen, Shrock, Wiggins, and Williams. Noes: None. It was moved by Councilman Williams and seconded by Coun- cilman Wiggins that the Mayor and the City Clerk be authorized to execute a grant deed to Frank and Mary Battyany, husband and. wife as 3oint tenants, deeding all of Lot 56, Block 19, Mod,~eska Park, except the South 40 feet thereof, said property being involved in the proposed new fire station site. Roll Call: Ayes: Councilmen Doty, Jensen, Shrock, Wiggins and Williams. Noes: None. It was moved by Councilman Jensen and seconded by Council- man Williams that the Mayor and the City Clerk be authorized to. execute a grant deed to Grace C. Miller, an unmarried woman, deeding all of Lot 55, Block 19, Mod~jeska Park, except the South 40 feet thereof, said property being involved in the proposed new fire station site. Roll Call: Ayes: Councilmen Doty, Jensen, Shrock, Wiggins, and Williams. Noes: None. !'' The Clerk presented a quitclaim deed, signed by J. E. Pickling and Nell Fick ling, husband and wife, wherein they conveyed their interests in and to Lot 434, Tract 2551, as per map recorded in Book 24, Pages 78, 79 and 80 of Maps in the Office of the County Recorder of said County to the City of Lynwood.' It was moved by Councilman Wiggins and seconded by Council- man Jensen that said deed~be accepted and that the City Clerk be directed to cause said instruments to be recorded in the Office of the Recorder of Los Angeles County. All members of the City Council voting aye, the Mayor declared the motion duly carried. ~'he City Clerk presented a public official bond for Westana Lot, Court Clerk, in the amount oP X1,000.00. It was moved by Councilman Shrock and seconded by Councilman Jensen that said bond be accepted and filed. Roll Call: Ayes: Councilmen Doty, Jensen, Shrock, Wiggins, and Williams. Noes: None. . __ _ __ .,; ti RESOLUTION N0. 2019, entitled, "RESOLUTION SELLING CERTAIN REAL ESTATE AND AUTHORI7ING THE EXECUTION OF A DEED UPON PAYMENT OF THE CONSIDERATION NAbIIED THEREIN", was read. It was moved by Councilman Wiggins and seconded by Councilman Shrock that said resolution be adopted. . Roll Call: Ayes: Councilmen Doty, Jensen, Shrock, Wiggins and Williams. Noes: None. A communication was read from the City Treasurer wherein he requested authority to cancel the following bonds; Bonds Nos. 1701 and 1702 in District 17, on Lots Nos. 119 and 120 in Licensed Surveyor's. Map which lots are now part of the public park. Bonds Nos. 139, 140, 143 in District 6, and Bonds Nos. 256, 257, and 259 in District 9 on Lots Nos. 327, 328, and 340 in Tract 2551 which lots are now used-for parking across the street from the City Hall. Bonds Nos. 162, 163, 164, 165 and 166 in District 19, covering Lots 2? to 31 in Block 19, Mod~eska Park, which will be the site of the new fire station. Bond No. 16? in District 6 and No. 313 in District 9 covering the North 50 feet of the East 80 Peet of Lot 483-in Tract 2551. It was moved by Councilman Shrock. and seconded by Coun- cilman Wiggins that said cancellation be authorized. Roll Call: Ayes: Councilmen Doty, Jensen, Shrock, `JPiggins and Williams. , Noes: None. ORDINANCE NO. 444, entitled,"AN ORDINANCE OF THE CITY OF LYNWOOD, CALIFORNIA, AMENDING ORDINANCE N0. 382, SECTION 14", was read by caption. It was moved by Councilman Wiggins and seconded by Councilman Williams that further reading be waived. Roll Call: Ayes: Councilmen Doty, Jensen, Shrock, Wiggins, and Williams. Noes: None. It was moved by Councilman Wiggins, seconded by Coun- cilman Williams, that said Ordinance No. 444 be adopted, finally pass and be published as required by law. Roll Call: Ayes: Councilmen Doty, Jensen, Shrock, Wiggins, and Williams. Noes: None. ORDINANCE N0. 445, entitled, "AN ORDIIJANC E OF THE CITY OF LYNWOOD CREATING A CiJRFEW OF 10:00 O'CLOCK P. M., AND PRE- SCRIBING PENALTIES FOR THE VIOLATION THEREOF AND REPEALING ORDINANCE N0. 380", was read by caption. It was moved by Coun- cilman Williams, seconded by Councilman Jensen, that further reading be waived. Roll Call: Ayes: Councilmen Doty, Jensen, Shrock, Wiggins,. and Williams. _ Noes: None. It was moved by Councilman Shrock, seconded by Coun- cilman Williams, that said Ordinance No. 445 be adopted, finally pass and be published as required by law. RESOLUTION N0. 2020, entitled, "RESOLUTION RELATIiVG TO THE ABATEMENT OF DRY AND DRYING WEEDS ON CERTAIN LOTS OF LAND IN THE CITY OF LYNWOOD UNDER 5TATUTES OF CALIFORNIA 1915 PG 841 AS AMENDED, DEERING'S GENERAL LAWS N0. 5197 ENTITLED 'AN ACT AUTH- ORIZING MUNICIPALITIES TO DECLARE NOXIOUS OR DANGEROUS WEEDS GROWING UPON THE STREETS OR SIDEWALKS, OH UPON PRIVATE PROPERTY WITHIN MUNICIPALITIES, TO BE A PUBLIC NUISANCE, CREATING A LIEN UPON THE PROPERTY FRONTING UPON SUCH STREETS OR SIDEWALKS OR UPON WHICH SUCH NUISANCE F•XISTS FOR THE; COST OF ABATING THE SAME.' An ordinance entitled, "AN ORDINANCE ANfENI~ING ORDINANCE N0. 422 FOR THE PURPOSE OF CHANGING THE CLASSIFICATIOid OF CERTAIN PROPERTY AND THE ADOPTION OF AN AMENDED SECTION OF THE ZONING It~.AP WHICH IS A PART OF SAID ORDINANCE N0. 422", was read. After some discussion it was moved by Councilman Jensen, seconded by Council- man Williams that said. ordinance be set over until the next regular meeting for further study. All members of the City Council present voting aye, the Mayor declared the motion duly carried. The hour of 8:00 P. M. having arrived, said hour being the time fixed for receiving any and all bids for furnishing fire equipment as per notice published as required by law. The Mayor announced that this was the tune and place for receiving bids and as there was no one present who wished to submit a~bid, the City Clerk stated he had received four bids. It was moved by Councilman Shrock, seconded by Councilman 1V'illiams, that the bids be publicly opened, examined and declared. All members of the City Council voting aye, the Mayor declared the motion duly carried. All members of .the Council voting aye, the Mayor declared the motion duly carried. The hour of 8:00 P. M. having arrived, said hour being the time fixed for receiving any and all bids for motor equipment as advertised for sale. The Mayor announced the first piece of equipment to be. sold was a Chevrolet 1940, four-door Sedsn. He asked for offers, the highest ,offer heard being in the amount of X400.00. It was moved by Councilman Jensen and seconded by Council- man Williams, that according to the Council's rights to re~eet any and all bids., said bid be rejected and sale closed. All members of the City Council voting aye, the Mayor declared the motion duly carried. The Mayor announced 'Chat the other piece of equipment to be sold ~as.a 1933 .Ford, Model B, Pick-up Truck. Harry Eriteh and Dean Brown oompetitiveiy bid from X300.00 up to Mr. Brown's bid of X360.00; said bidding; stopped and the Mayor declared the equipment sold to Mr. Brown. ~ - The Clerk read the opinion of the City Attorney as to the validity of .the Referendum Petition filed .against Ordinance No, 440, as requested at the previous meeting, said opinion being (1) that the urgency .clause of Ordinance No. 440 is valid and that said Ordinance thereby went into effect on Nover~ber 1, 1946. (2) Refer- endum cannot be invoked to suspend an emergency ordinance. (3) F'ur- thur proceedings on account of the referendum not be talon without definitive court adjudication. - It was moved by Councilman Shrock and seconded by Counell- man Jensen that the opinion of the City Attorney be accepted and that the Referendum Petition filed November 26, 1946, be rejected owing to its. invalidity, and that the Council desires additional time to study the advisability of calling an election on the Sales Tax question. ORAL COMMUNICATI0118: - Mr.. u~sh of Seminole avenue addressed the Council in regard to the new "super street light" installed at the corner of Century and Long Beach Boulevard, stating that it has been unlighted for several nights and that a~i exeavatian at its base due to its installation as yet is unfilled. After same discussion, the Mayor declared the Manager will check into the matter immediately. 4 I~Zr. E. C. Shimick, of 11610 Nichols Aven~.ze, addressed the Council in regard to the Louise Street assessment, inquiring as°to whether final approval had been given the pro,fect. He was informed that it had. He further stated that it was his under- standing that the specifications had not been met in 90 per cent of the project. There was an explanation by the Manager that it was the City Engineer's right to alter specifications to insure •a better ,job. It was further agreed that the r;4anager ~rould meet with ~+1r. Shimick on Sunday to go over the matter on the spot. The Manager presented his written request for budget revision for the second half of the 1946-1947 fiscal year. After same discussion, it was moved by Councilman Wiggins and. seconded by Councilman Shrock, that the revisions as presented, be approved and the necessary adjustments made. The matter of the suspension of Southeast Taxi Company's taxi license having been continued to this meeting was reopened. Mr. Ballard of the Southeast Company addressed the Council, etating that he will close his Lynwood office at 8:00 p. m. simultaneously with the closing of the Paeific•Electric depot, thereby bringing his company in compliance with the taxi ordinance. He also stated that he is negotiating for a new place of business in town. After some disetzssion, it was moved by Councilman Jensen, seconded by Councilman `1~illiams, that the matter be continued and suspension ~R~ithheld to the meeting of January 21, 1947.
