HomeMy Public PortalAboutOrd. 883 - Subdivision and PUD Deadline ChangesOrdinance No. 883 Page 1 of 2 November 4, 2010 ORDINANCE NUMBER 883 AN ORDINANCE OF THE CITY OF McCALL, VALLEY COUNTY, IDAHO AMENDING McCALL CITY CODE TITLE 3, CHAPTER 10 TO PROVIDE FOR CONSISTENCY BETWEEN PLANNED UNIT DEVELOPMENT AND SUBDIVISION DEADLINES AND ALLOWING FOR DEADLINE EXTENSIONS BY THE COMMISSION AND AMENDING McCALL CITY CODE TITLE 9, CHAPTER 2 TO ALLOW FOR PHASING PLANS AND PROVIDE FOR EXTENDED SUBDIVISION COMPLETION DEADLINES. WHEREAS, an application for approval of a code amendment, pursuant to MCC 3.13.04, was submitted by the McCall City Council; and, WHEREAS, the amendment to MCC 3.10.11(B) would bring consistency to the McCall City Code sections relating to the submission of final plat and final plans application; and, WHEREAS, the amendment to MCC 3.10.11(I) would allow for Commission discretion in the extension of preliminary plan approval; and WHEREAS, the amendment to MCC 9.2.06(I) would allow for the submission of final plat applications according to a phasing plan; and, WHEREAS, the amendment to MCC 9.2.07(B)(2) would allow for the extension of the ultimate completion date for subdivision projects at the Council’s discretion; and, WHEREAS, the McCall Area Planning and Zoning Commission held a properly noticed and regularly scheduled public hearing on October 2 and November 2, 2010 to consider the proposed code amendments; and, WHEREAS, the McCall Area Planning and Zoning Commission recommended the proposed code amendments for approval by the McCall City Council at the November 2, 2010 Commission meeting; and, WHEREAS, the proposed code amendments were approved by the McCall City Council at a regularly scheduled and properly noticed public hearing on October 21, 2010 and November 4, 2010. NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF McCALL, IDAHO, AS FOLLOWS: Section 1: McCall City Code Section 3.10.09(G) is amended as follows: 3.10.09: Application Procedure: (B) Final Development Plan: Within one year eighteen months after approval of the preliminary development plan, the applicant shall submit to the city a final development plan for the entire PUD or a final development plan for the first phase of development if the PUD has been approved for phased development. The applicant shall submit final development plans for any subsequent phases within the time limit specified in the approval of the preliminary development plan. " " ATTEST: By ����. �%w1:�%n��. BessieJo War- , City Cl rk A SUMMARY OF ORDINANCE NO. 883 PASSED BY THE CITY OF McCALL, IDAHO ORDINANCE NO. 883 AN ORDINANCE OF THE CITY OF McCALL, VALLEY COUNTY, IDAHO AMENDING MCCALL CITY CODE TITLE 3, CHAPTER 10 TO PROVIDE FOR CONSISTENCY BETWEEN PLANNED UNIT DEVELOPMENT AND SUBDIVISION DEADLINES AND ALLOWING FOR DEADLINE EXTENSIONS BY THE COMMISSION AND AMENDING McCALL CITY CODE TITLE 9, CHAPTER 2 TO ALLOW FOR PHASING PLANS AND PROVIDE FOR EXTENDED SUBDIVISION COMPLETION DEADLINES. This ordinance amends Chapter 10 of Title 3, and Chapter 2 of Title 9, McCall City Code by changing the deadline for submitting a final plan from the current deadline of one year to a new deadline of eighteen (18) months and permitting further extensions by the Planning and Zoning Commission for good cause. The new sections permit an approved phasing plan to supersede the code requirement for not more than thirteen months between phases, and allows the City Council to approve extensions for filing final plats for up to three years at a time. The Ordinance shall be effective upon its passage, approval and publication as required by law.
